CALL TO ORDER The meeting was called to order at 7:00 p.m., Chairman William IaPeanch presiding. 0AREEM :1•r •i c1 r° The pledge of allegiance was led by Michael Rubin, Senior Planner. 3. ROM CALL PRESENT: Chairman William LaPerch, Commissioners Dan Claffey, Jim Keenan, and Jeffrey Rosen; ABSENT: Douglas Holland (emmmed absence). OTHER CITY OPFICIAIS: Michael A. Rubin, Senior Planner; John Knipe, Assistant City Engineer; Diane Eaton, Associate Planner; Carol WaldLop, Consultant, Sage Institute; and Celia LaFleur, Administrative Secretary. 4. PC -86 -109 Y I' •i •!' •�•c sr g _ n •• • •r i' •r • W to 1• Notion: Moved by Commissioner Rosen, seconded by Commissioner Claffey to conditionally approve Resolution No. PC -86 -109 which authorized a lot split at 142 Everett Street with the modification that when constructed, the now residence shall have a roof composed of mecomhustible material, treated wood shake shall not be acceptable. PUBLIC HEARUN3S The applicant is requesting approval of a Conditional Use Pexmit for a baseball batting cage and aerobic - workout facility in a Light Industrial zone. mated on the northwest corner of Flinn Avenue at 387 N. ZaCkery Avenue. Presented by Diane Eaton, Associate Planner. The public hearing was conducted to discuss a baseball batting cage and aerobics studio in an existing 13,783 sq.ft. industrial building. Pursuant to Council Reeoluticm No. 86 -276 the Planning Commission has final authority in this matter, unless appealed to the Council. Testimony received by the following: Larry , 4838 Heather Court, Noorpark, CA 93021. Informed the Cmmission of the different activities the facility could bring to the comunity and haw it could benefit the young people. Nation• Moved by Commissioner Rsenan, seconded by Coniussioner Rosen that the following conditions be added for approval of CUP -4504: a. Conditional Use Permit No. CUP -4504 shall prohibit installation arid/or operation of video games on said premises at any time. b. Hours of operation shall be as follows: Aerobic: Monday - Sunday 6:30 a.m. to 9:00 p.m. Batting Cage: Sunday - 7hursday 10:00 a.m. to 9:00 p.m. Friday & Saturday 10 :00 a.m. to 10:00 p.m. C. The developer shall comply with revised City Sign Code. Motion passed on a 4:0:1 vote, Commissioner Holland absent. Motion• Commissioner Rosen, seconded by Commissioner Keenan to approve Negative Declaration CLIP-4504, awarded conditions as stated, and to direct staff to prepare a resolution of approval and present it to the remission for Conser►t Calendar at their next regular scheduled meeting. DP-332 and EP-333 - Cabot. Cabot The applicant is requesting approval to construct a.) DP -332 - a 39,424 sq.ft. and b.) a 55,008 sq.ft. industrial facilities located at Candor Drive and Los Angeles Avenue, at the northeast intersection. At the applicants request and by the general consensus of the Commission this item was continued for 60 days. 7. CCRUSSICN ACTICN ITEMS Denial by the Director of Cco nuuity Developamt of a request for a 2nd time extension of DP-311 and DP -314. The Commission was asked to reconsider its decision from the previous meeting regarding the appeal of the Director's disapproval of a request for a second six month time extension for DP -311 and DP -314. The reconsideration was requested due to the applicant's absence at the previous meeting. Testimony received by the following: Don Stahl =n, 540 del Oro Road, Ojai, CA 93033. The applicant's stated that he felt he would not be able to acquire a building permit and thus inaugurate gyrate the use, as required by the DP Permit approval within the remaining six months that the time extension would have allowed. Upon hearing the applicant's testimony the Ccamission was still of the opinion that the Director's recommendation of denial should be upheld. The Commission requested that staff provide information on the following: A. Traffic signal phasing at High Street and Moorpark Road. Status of the enlargement of the turning radius at the southeast corner of High Street and Moorpark Road. D. Iength of time a planned development permit is valid. E. Ability to restrict truck traffic hours on a grading project due to potential school pedestrian conflicts. F. An explanation of state and local public notification requirements.
