The regular scheduled meeting of the Planning Commission held on September
24, 1986 in the City Council Chambers of the Community Center located at
799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:00 p.m., Chairman William
LaPearch presiding.
2. ROLL CALL
PRESENT: Chairman William LaPerch, Commissioners Dan Claffey,
Jim Keenan, and Jeffrey Rosen;
ABSENT: Douglas Holland (excused absence).
OTHER CITY OFFICIALS:
Michael A. Rubin, Senior Planner; John Knipe, Assistant City
Engineer; Thomas P. Genovese, Administrative Assistant;
Diane Eaton, Associate Planner; Carol Waldrop, Consultant,
Sage Institute; and Celia LaFleur, Administrative Secretary.

5. CONSENT CALENDAR
RESOLUTION NO. PC -86 -110
A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO, CUP 4504 ON
THE APPLICATION OF LARRY SCHUMAN. ASSESSOR PARCEL NO. 512- 150 -525.
Motion Moved by Commissioner Claffey seconded by Commissioner
Keenan to delete Condition No. 11 and approve Resolution No.
PC -86 -110.
6. PUBLIC HEARINGS
A. Development Plan Permit No. DP -355 Moorpark /Los Angeles
Requesting approval to construct an 19,992 square foot industrial
facility. 1,200 square feet of office and 18,792 square feet of
manufacturing. Located on Gabbert Road north of Commerce Avenue.
Development Plan Permit No. DP -357 Moorpark /Los Angeles
Requesting approval to construct a 19,074 square foot industrial

facility. 1,750 square feet of office and 17,504 square feet of
manufacturing. Located on the corner of Gabbert Road and Commerce
Avenue.
Presented by Diane Eaton who stated that the applicant had failed to
post a public hearing sign on the subject property of Notice of Public
Hearing on the proposed developments. Pursuant to CEQA's and the
Moorpark Municipal Code, this procedure is necessary to ensure
adequate time for review and public comment.
By the general consensus of the Commission Item 6.A. will be continued
to the Commission's meeting of October 8, 1986.
By the general consensus of the Commission Item 6.C., 6.D., and 6.E.
were taken out of order.
C. Planned Development Permit No. PD -1056 Burster King - Herman Li
and Daniel Cho
Request to construct a burger King Restaurant and playground
contained within the project. The restaurant will contain
approximately 3,074 square feet. Located at the southwest corner
of Los Angeles Avenue and Moorpark Avenue. The site fronts Los
Angeles Avenue.
By the general consensus of the Commission this item was continued for
further review.
D. Major Modification - Development Permit No. DP -335 Norman Baker
Major Modification to establish a permanent industrial
development from a temporary modular building. Located on the
north side of Los Angeles Avenue between Gabbert Road and Goldman
Avenue.
The applicant is requesting a two week continuance.
By the general consensus of the Commission this item was continued to
the Planning Commission's meeting of October 22, 1986.
E. Hillside Performance Standards Ordinance
Due to the Hillside Grading Ordinance being prematurely
advertised, this item will be continued to a date uncertain.
B. Vesting Tentative Tract No. TR-3049 Residential Planned
Development RPD -1057 U.S. Condominium
To subdivide a 58 acre parcel into 97 lots for 93 single family
units. Located west of the terminus of Loyola Street, south of
Happy Camp Regional Park, north of the Caltrans right -of -way.

Presented by Carol Waldrop, Consultant, Sage Institute.
Commissioner Rosen noted for the record a letter regarding neighborhood
concurrence and John Roberts representative of the Campus Park
neighborhood.
Testimony received by the following:
1. Tom Montgomery, Traffic Engineer, Thomas J. Montgomery &
Associates, Ventura, CA.
2. Rob Dick, Representative, U.S. Condo, 156 -1/2 W. Arwal Drive,
Beverly Hills, CA.
3. Rick Jones, ORO Engineering Corp., 2361 Craftsman Road., Suite B,
Calabasas, CA 91302.
4. John Roberts, 14419 E. Loyola, Moorpark, CA 93021. Neighborhood
representative.
It was the general consensus of the Commission that the following be
addressed as they are a concern of the existing residents.
Traffic circulation
Stop signs
Location and replacement of oak trees to be placed subsequently to the
review and alignment of trees.
That the following intersections be considered for stop signs:
3 Way Stop
Loyola /Colombia
Loyola /Westwood
Amherst /Westwood
Minor
Loyola /Amherst /Colombia /Berkley /Yale/ Auburn
Commissioner Rosen stated that the project did not support negative
declaration and should be mitigated negative declaration. That no
occupancy should be provided until a signal is provided, also referencing
the 560 vehicle trips per day at the Princeton Avenue and 118 Highway.
Motion: Moved by Commissioner Claffey, seconded by Commissioner Rosen

that condition no. 61 be deleted.
Motion passed on a 4:0 vote, Commissioner Holland absent.

Motion: Moved by Commissioner Claffey, seconded by Commissioner Rosen
that: a) a 24" oak tree at the southeast corner of property and a
5 foot high fence be provided outside the dripline and approved
by an Registered Tree Engineer; or b) that the developer shall
meet with staff to discuss the adequacy and alignment of the
road.
Motion passed on a 4:0 vote, Commissioner Holland absent.
Motion: Moved by Commissioner Keenan, seconded by Commissioner Claffey
to approve TR- 3049 /RPD -1057 subject to the amendments and deleted
conditions. That this item be returned under the Consent
Calendar at the Commission's meeting of 10/8/86.
Motion passed on a 4:0 vote, Commissioner Holland absent.
7. COMMISSION ACTION ITEMS
A. Minor Modification - Planned Development Permit No. PD -1047 -
Annotti
The applicant is requesting a minor modification to allow a 3rd eating
establishment. Located on Los Angeles Avenue and Park Lane.
Commissioner Claffey stated that any liquor, video, donut, pizza use would
generate constant traffic movements
Motion: Moved by Commissioner Rosen, seconded by Commissioner Keenan to
approve Minor Modification to PD -1047 provided that staff review
the number of parking spaces for the additional eating
establishment.
Motion passed on a 3:1 vote, Commissioner Claffey voting NO, and
Commissioner Holland absent.
B. Conditional Compliance for TR -3019 3525 Residential Planned
Development Permit No. RPD -1021
Review of fencing plan.
Motion: Moved by Commissioner Rosen, seconded by Commissioner Claffey to
approve TR- 3019/3525 Residential Planned Development Permit No.
RPD -1021 subject to the City Engineers review of site distance
issues related to fencing.
Motion passed on a 4:0 vote, Commissioner Holland absent.
C. Condition Compliance for TR -3963 and RPD -1041
Review of fencing plan.

Motion: Moved by Commissioner Keenan, seconded by Commissioner Rosen that
Condition Compliance for TR -3963 and RPD -1041 fencing plans be
approved.
Motion passed on a 4:0 vote, Commissioner Holland absent.
D. Minor Modification to TR -4037 and RPD -1044 - Calprop
Minor modification request to change lots 43 and 45 from two
story floor plans, to single story floor plans.
Motion: Moved by Commissioner Keenan, seconded by Commissioner Rosen that
this item be noticed for public hearing.
Motion passed on a 4:0 vote, Commissioner Holland absent.
8. INFORMATION ITEMS
A. Urban West Communities - Tierra Reiada Road Streetscaue
Received and filed.
B. Public Notification Periods and Requirements
The Commission in a motion of 4:0:1 (Commissioner Holland absent)
voted to direct staff to consider the following requirements for
public notification:
That code enforcement provide a polaroid snap shot of the
required public hearing sign posted on the subject property.
Provide applicants by certified mail staff reports considered
hearing.
To review the public hearing process for which applicants are
noticed.
9. COMMISSION COMMENTS
Commissioner Keenan asked that staff provide code enforcement services
for the "For Sale" cars located on the Scanlin property (Flinn and
Spring Road).
Commissioner LaPerch inquired of the City Engineer, informaiton on the
drainage channel at the DP -318 Kavlico site. The City Engineer
responded that improvements would be made during their Phase I
construction.
