Minutes of December 3, 1986
The regular meeting of the Planning Commission held December 3,
1986 in the City Council Chambers. Located at 799 Moorpark Avenue,
Moorpark, California 93021.
1. CALL TO ORDER
Called to order at 7:00 p.m. by Chairman Douglas Holland.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Chairman Holland.
3. ROLL CALL
PRESENT: Commissioners Scott Montgomery, William Butcher,
Bernardo Perez, John Wozniak, and Douglas Holland.
ABSENT: None.
OTHER CITY OFFICIALS AND EMPLOYEES PRESENT:
Patrick J. Richards, Director of Community
Development; Michael A. Rubin, Senior Planner; John
Knipe, Assistant City Engineer and Celia LaFleur,
Administrative Secretary.

None.
6. PUBLIC HEARINGS
A. Planned Development Permit No. PD -1014 and LDM -9
The applicant is requesting to subdivide an existing 30.51
acre site into 4 parcels, and construct 287 rental apartment
units.
Located between Poindexter Avenue and Los Angeles Avenue and
east of Sierra Avenue.

The applicants is requesting the approval of the following:
A tentative parcel map to subdivide a 30.51 acre site into
four lots, abandon the existing gisler Avenue and La Palma
Court dedicated rights of way, relocate Gisler Avenue westerly
of its present location, and realign the dedicated but
unimproved Lassen Avenue;
A density bonus, in accordance with Government Code Section
65915 et al., of 25% over the 15 dwelling units per acre
presently allowed under the City land use and zoning
designations on the portion of the property north of Lassen
Avenue;
A residential planned development permit for the construction
of 286 apartment and duplex units, plus one single family unit
north of Lassen Avenue (for a total of 287 units) , 58 of which
are proposed to be rented to persons of low or moderate
income.
Testimony received by the following:
Dan Palmer, the applicant, 11740 San Vicente, #208, Los
Angeles, CA. Mr. Palmer discussion centered towards the
inconsistencies of setbacks, parking, driveway cuts, park
site, and request for density bonus. Mr. Palmer means of
mitigation of setback were to adjust the land area west of
Gisler.
Mitchell B. Rahn, attorney for the applicant, 500 Esplanade
Avenue, Oxanard, CA. Mr. Rahn cited Government Code Section
65589.5 - stating that after a project has be deemed complete,
substantial evidence for denial would,be required.
Frank Wein, Michael Brandman Associates, 606 S. Olive Street,
#600, Los Angeles, CA 90014. In support of the project.
Beulah Hayden, 538 Sierra Avenue, Moorpark, CA. Opposed the
nine foot wall along the railroad tracts. Concerned that the
wall proposed would create an area for young children to
gather.

Ethel Sulkis, 270 Sierra Avenue, Moorpark, CA. Requested that
the Commission certify the EIR as adequately addressing the
concerns of PD -1014 and deny the proposed project.
Nancy Runkie, 393 McFadden Avenue, Moorpark, CA. Ms. Runkie
was concerned with the proposed project and finds in
inconsistent with the surrounding residential use.
Danny Rasey, 4833 Mira Sol, Moorpark, CA. Requested that the
Commission take into consider Parks and Recreation
recommendation that "no further residential use be approved
until a park in the downtown area is provided."
Lewis M. Head, 336 Whitney Avenue, Moorpark, CA. Mr. Head's
concerns related to traffic impact, and how he currently has
problems exiting from his subdivision onto Los Angeles Avenue.
John Cones, 730 Shasta Avenue, Moorpark, CA. Mr. Cones did
not support low- income housing and additional traffic
circulation problems which would be placed on
Moorpark /Poindexter Avenues.
Barbara Schultz, 116 Sierra Avenue, Moorpark, CA. Ms. Schultz
stated her concerns with the additional traffic impact that
this project would propose.
Cynthia Hubbard -Dow, 187 Shasta Avenue, Moorpark, CA.
Concerns addressed traffic, parking, wall at the railroad
property. Does not support the proposed project.
Doug Fraiser, 237 Sierra Avenue, Moorpark, CA. Stated his
concerns with the additional traffic impact that this project
would propose.
Betty Colon, 230 Whitney Avenue, Moorpark, CA. Oppose the
proposed project.
Motion Commissioner Holland moved and Commissioner Perez
second a motion to recommend to the City Council
that the Planning Commission has determine the
Environmental Impact Report incomplete and does not
recommend it's certification. Motion passed on a
4:1 vote. Commissioner Butcher abstain.

Motion Commissioner Montgomery moved and Commissioner
Wozniak second a motion to deny the proposed PD-
1014 based on the following:
The project, unless disapproved or approved at a
lower density, would have the following specific,
adverse impacts upon the public health, safety and
general welfare:
1. The proposed apartment development would
negatively impact adjacent existing single
family residential uses because it would cause
a significant increase of 1750 vehicle trips
per day. This increase in vehicle trips would
negatively and permanently impact five out of
eight adjacent intersections.
2. The project would aggravate an on- street
parking problem presently existing within the
adjacent westerly residential neighborhood.
The project has the potential to cause
economic degradation of surrounding existing
residential uses inasmuch as the project would
provoke the economic decline of a residential
neighborhood bordered between Very High
Residential Density and Industrial land use
activities.
4. The project does not provide the required
design or number of vehicle parking spaces as
required by City Code standards.
5. The project does not provide the required park
land dedication as identified in the EIR as a
mitigation measure for the project.
6. Government Code Section 65915 et sea requires
a density bonus or equivalent financial
incentives where the project provides a
minimum number of low to moderate income
units. The City has already provided
equivalent financial incentives thought the
bond financing provided to this project.

Motion Commissioner Montgomery moved and Commissioner
Holland second a motion to direct staff to prepare
a resolution recommending denial of PD -1014 and
LDM -9 and present it for Consent Calendar on
December 10, 1986. Motion passed by unanimous
voice vote.
Motion Commissioner Holland moved and Commissioner Wozniak
second a motion to recommend to the City Council
that it initiate an amendment to the General Plan
and Zoning Code on the northerly 15.26 acres of the
30.51 acre subject site from High Density
Residential to Medium Density Residential and to
change the zone form RPD -15 to R -1 Single Family
Residential. Motion passed by unanimous voice
vote.
Motion Commissioner Holland moved and Commissioner Wozniak
second a motion recommending to the City Council
that the a service level no less that "C" be
provided. Motion passed by a unanimous voice vote.
