Minutes of December 10, 1986
The regular meeting of the Planning Commission was held on December
10, 1986 in the City Council Chambers located at 799 Moorpark
Avenue, Moorpark, California 93021.
CALL TO ORDER
The meeting was called to order at 7 :00 p.m. by Chairman
Douglas Holland.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Chairman Holland.
3. ROLL CALL
PRESENT: Commissioners Scott Montgomery, William Butcher,
Douglas Holland, John Wozniak, Bernardo Perez.
ABSENT: None.
OTHER CITY OFFICIALS AND EMPLOYEES PRESENT:
Steven Kueny, City Manager; Patrick J. Richards,
Director of Community Development; Michael A. Rubin,
Senior Planner; John Knipe, Assistant City
Engineer; Celia LaFleur, Administrative Secretary.
4. PUBLIC COMMENTS
A. Ray Mansur, Seiegl Associates, 5101 Douglas Fir Road,
Calabasas, CA 91302. Inquired of the Commission
processing procedures for Development Plan Permit No.
355 and 357 in regards to landscape plan check review
prior to the issuance of zone clearance.
The Commission directed the question to staff. City
Manager stated that the zone clearance is issued only
after the Landscaped Plan Check review has been
processed, Building and Safety will not accept anything
until zone clearance has been issued. The process is as
follows; Zone Clearance, Plan Check, Building Permit,
Construction, Occupancy.

City Manager directed staff to review the Community
Development Department Conditions and determine whether
any modifications need to be made.
5. PUBLIC HEARINGS (continued business)
A. Planned Development Permit No. PD -1056 Burger King -
Herman Li
Requesting approval to construct a Burger King Restaurant and
playground contained within the project. The restaurant will
contain approximately 3,074 sq.ft. Located at the southwest
corner of Los Angeles Avenue. The site fronts Los Angeles
Avenue.
It was the general consensus of the Commission to table Item
S.A. to later in the agenda.
B. Development Plan Permit No. DP -348 Epi Silos
Requesting approval of an 47,400 sq.ft. self storage facility
r on Los Angeles Avenue west of Shasta Avenue and east of
Goldman Avenue.
MOTION: Moved by Chairman Holland, seconded by Commissioner
Montgomery to continue Item 5.B for 90 days in
order that staff and the applicant discuss possible
revision to request for development.
Motion passed on a 5:0 vote.
6. PUBLIC HEARINGS (new business)
A. Residential Planned Development Permit No. PD -1058
G1enHaven
Request to construct twenty -two single family residences of
previously approved 22 lot subdivision (TR- 3306). Location
on Inglewood Avenue between Peach Hill Road and the Southern
California Edison Company easement.
Presented by the Senior Planner; Reference: Staff Report dated
December 10, 1986.

The Commission concerned that upon approval of the RPD
request, was it possible that the applicant could sell each
of the 22 lots and be individually developed.
Staff replied that all residential Planned Development Permits
require that they be reviewed by the City Council for final
determination in regards to design, aesthetics only.
PUBLIC HEARING OPEN
Testimony received by the following:
1. H.A. Russell, President, G1enHaven, 601 Daily Drive,
Suite 232, Camarillo, CA 93010. Supporting the project
Mr. Russell commented that the surrounding residence are
single story homes, providing a 20 foot rear yard and
within this approval a potion of land would be dedicated
to each of the property owners as additional rear yard
and wall provided.
The Commission inquired of the applicant as to whether or not
" the adjacent property owners had consented to the Lot Line
Adjustment for an additional 3 feet of rear yard provided by
the developer. The applicant replied that the property owners
were informed at the meeting held by the developer which 12
of 16 property owners attended.
2. Tom Wolfinaton, Widmer Engineering, 790 Hampshire Road,
Suite 8, Westlake Village, CA 91361. Stated to the
Commission his concerns with Condition No. 22 in regards
to a cul -de -sac to be provided at the existing westerly
terminus of Inglewood Avenue which would require the
developer to purpose an agreement with Southern
California Edison.
Adjacent property owners addressed the Commission and had the
following concerns:
Fencing material
Trash and debris
Loss of view

Excess dirt on the street and gutter
Truck traffic
Two story homes adjacent to single story homes.
MOTION: Moved by Chairman Holland, seconded by Commissioner
Montgomery to continue Item 6.A. to the Commission's
next regularly scheduled meeting.
Motion passed on a 5:0 vote.
B. Tentative Parcel May No. PM -4220 Clifford and Christine
Mav
Request to subdivide an existing 3.48 acre lot into three
parcels of nearly equal size. Located on the north side of
Los Angeles Avenue approximately 1,600 feet east of Moorpark
Road. Assessor Parcel No. 512- 0- 16 -17.
Presented by the Senior Planner: reference; Staff Report dated
December 10, 1986.
Staff recommendation was to disapprove the
Tentative parcel
Map
No. 4220 for the following reasons:
1.
The proposed subdivision would create
the potential to
perpetuate an existing accessibility and sigh distance
problem.
2.
The proposed subdivision is not in the
best interest of
the general health, safety and welfare
of the public.
3.
The proposed subdivision lacks street
frontage for all
three proposed parcels.
4.
The proposed subdivision is contrary
to the adopted
General Plan.
The problems illustrated by this request could very likely
also pertain to other properties within this one mile segment
of Highway 118. So disapproval of other projects within this
one mile segment that would create an additional sight
distance problem.

Staff's recommendation is that until the time that the sight
distance problem can be made satisfactory, this request should
not be granted. It would appear that at present it is
infeasible for the applicant to correct the sight distance
issue.
PUBLIC HEARING OPENED
Testimony received by the following:
1. Clifford May, 138 E. Los Angeles Avenue, Moorpark, CA
93021. Mr. May inquired of staff to whether the request
could be approved with a condition stating that "no
Building Permit be issued until the sight distance issue
could be mitigated.
The Commission inquired of staff to whether the request could
be approved subject to processing of an Planned Development
Permit for a private street.
The Director stated that processing the project to a PD zone
would require a zone change.
MOTION: Moved by Chairman Holland, seconded by Commissioner
Perez to continue Item 6.B to the Commission's next
regularly scheduled meeting and directed staff to
consider the possibility of approving the request
for 3 lots with modifications to provide a private
street, and that no development occur on the
remaining two lots.
Motion passed on a 5:0 vote.
7. INFORMATION ITEMS
A. Hillside Grading Ordinance & Industrial Buildout
It was the consensus of the Commission to continue Item 9.A.
to the Commission's next regularly scheduled meeting.

9. STAFF COMMENTS
The Director informed the Commission of Resolution No. PC -86-
121 - Planned Development Permit No. 1014, and 122 - LDM -9
and requested that the Commission review each of the
resolutions and provide comments on December 15, 1986 at 6 :30
p.m. along with the City Council and City Attorney review.
10. ADJOURNMENT
By the consensus of the Commission the Planning Commission
meeting was adjourned to December 15, 1986 at 6:30 p.m., the
time being 11:00 p.m.
