CALL TO ORDER The meeting was called to order at 7:14 p.m., Chairman Holland presiding. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chairman Holland. 3. ROLL CALL PRESENT: Commissioners Douglas Holland, Scott Montgomery, William Butcher, Bernardo Perez; ABSENT: Commissioner John Wozniak, excused absence. OTHER CITY OFFICIALS AND EMPLOYEES PRESENT: Patrick J. Richards, Director of Community Development; R. Dennis Delzeit, City Engineer; Michael A. Rubin, Senior Planner; Diane Eaton, Associate Planner; and Celia LaFleur, Administrative Secretary. 4. PUBLIC COMMENTS Mr. Allen Wutkee, lease holder of the present Cheveron U.S.A., Inc. service station. 502 E. Los Angeles Avenue, Moorpark, CA. Spoke on Chevron's intentions to revise the new self service station, Commission noted that they Would discuss his intent under Consent Item 6.d. 5. APPROVAL OF MINUTES - Meeting of January 19, 1987. Had not been provided for Commission's review, by general consesus of the Commission the minutes for the Planning Commission meeting of January 19, 1987 shall be provided at the Planning Commission's meeting of February 16, 1987. Resolution No. PC -87 -126, PM -4220, Clifford & Christina Map RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP NO. PM -4220 ON THE APPLICATION OF CLIFFORD C. MAY & CHRISTINA D. MAY. The Community Development Director requested clarification of the Cortai::oior regarding the issue of not requiring street improvewmw,.... for,ethis Parcel Map and only requiring AOC payment of the applicant. Moved by Commissioner Montgomery seconded by Commissioner Holland for the approval of Resolution No. PC -87 -126. Motion carried unanimously. 6.b. Resolution No. PC -87 -127 DP -348, Epi Silos /Sterling Storage A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA APPROVING DEVELOPMENT PERMIT NO. DP- 348 ON THE APPLICATION OF EPI L. SILOS /STERLING STORAGE NO.1. Moved by Commissioner Butcher, seconded by Commissioner Montgomery for the approval of Resolution No. PC -87 -127. Motion carried unanimously. 6.c. Resolution No. PC -87 -128, DP -332, Cabot, Cabot & Forbes A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA APPROVING DEVELOPMENT PLAN PERMIT NO. DP -332 ON THE APPLICATION OF CABOT, CABOT & FORBES. Moved by Commissioner Montgomery, seconded by Commissioner Perez to approve Development Plan Permit No. DP -332 with an additional condition to read; "Prior to occupancy, signal located at Condor Drive /118 Hwy. shall be operational, approximate date being August 1987. Motion carried unanimously. 6.d. Resolution No. PC -87 -129 PD -1059, Chevron U.S.A., Inc. A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA APPROVING PLANNED DEVELOPMENT PERMIT NO. PD -1059 ON THE APPLICATION OF CHEVRON U.S.A., INC. Moved by Commissioner Montgomery, seconded by Commissioner Butcher to approve Planned Development Permit No. 1059 with added Condition No. 39 to read as follows: "Two public restrooms, one male, and one Temale, shall be provided. Revision to Grading Plan - TR -4170 & TR- 3070 -4, U.S. Condominium A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL DENIAL OF A REQUEST TO MODIFY AN APPROVED GRADING PLAN ON THE APPLICATION OF U.S. CONDOMINIUM. Moved by Commissioner Holland, seconded by Commissioner Montgomery to approve Resolution No. PC -87 -130. Motion passed unanimously. 7. PUBLIC HEARINGS 7.a. ^mit No. PD -10. - Herman Requesting approval to construct a Burger King Restaurant. The restaurant will contain approximately 3.074 square feet. Located at the southwest corner of Los Angeles /Moorpark Avenues. The site fronts Los Angeles Avenue. Continued from 1/5/87 At the Planning Commission meeting of January 5, 1987, the Commission directed the applicant to address concerns of staff and the Commission on the proposed project. The major modification was to locate the Los Angeles Avenue driveway approximately 150 feet west of the site. Presented by the Director of Community Development; reference; Staff Report dated January 23, 1987. After a brief discussion by the Commission this item was open for public comment. 1. Harr A. Mead, 12283 Jackson Road, Sloughhouse, CA., property owner o su ject site in support of this development ask the Commission to consider the factors involved with the- associated project in regards to location, providing the City with a profitable development, employment for Moorpark. 2. Herman Li, 21601 Vanowen Street, Suite 201, Canoga Park, CA., developer spoke it support of the request for development and informed the Commission of their recent discussions with CalTrans to alleviate the concerns of egress /ingress on Los Angeles Avenue. -3- MOORPARK PLANNING COMMISSION City of Moorpark, California February 2, 1987 7. PUBLIC HEARINGS (continued) 7.a. Planned Development Permit No. PD -1056, Burger King - Continued. Moved by Commissioner Butcher, seconded by Commissioner Holland to modify City Engineer Condition No. 10 to read as follows: "Right turns only shall be allowed out of northerly driveway on Moorpark Avenue. The developer is required to install a raised median island (with Caltrans approval from Moorpark Avenue to Parklane). This would be accomplished by the applicant entering into a reimbursement agreement with the developer required to construct the median island per Caltrans standards. This shall be accomplished prior to occupancy., The 'reimbursement agreement shall have a provision to reimburse the developer from Los Angeles Avenue Area of Contribution Funds ". Motion passed unamiously. Moved by Commissioner Perez, seconded by Commissioner Montgomery for the approval of staffs recommendation and adapt the findings within the staff report, with the modification to 1.d. of the proposed findings to read as follows: "The proposed use would be obnoxious to adjacent residential uses because of potential traffic conflicts." Motion passed 3:1, Commissioner Butcher, no. 8. PLANNING COMMISSION ACTION ITEMS 8.a. Reauest of the Citv Council for a Joint Meet It was the general consensus of the Commission to schedule a joint meeting with City Council on February 25, 1987 (items for discussion available February 19, 1987). Non -A enda Item - Under the provisions of Ordinance No.33 adopted Oct , er 4, relating to Commissions, Section 2.06.070(d), "If any regular meeting falls on a holiday (February 16, 1987 - Washingtons Birthday), it shall be held on the next scheduled business day and all meetings otherwise scheduled or noticed to be held on a regular meeting day falling on a holiday shall be held at the meeting of the next business day without the necessity of any other or further notice ". -4- MOORPARK PLANNING COMMISSSON City of Moorpark, California February 2, 1987 8. PLANNING COMMISSION ACTION ITEMS (continued) It was the general consensus of the Commission to reschedule the meeting of February 16, 1987 to Thursday, February 19, 1987. MV Pursuant to Condition No. 13 of Resolution No. 85 -166, approved February 4, 1985. Moved by Commissioner Holland, seconded by Commissioner Butcher for approval as submitted. Motion carried unanimously. 9. INFORMATION ITEMS 9.a. Industial Buildout Received and file, and suggested to be considered at the joint meeting of City Council and Planning Commission, February 25, 1987. 9.b. Recreation Fee re Development Projects Held over to the Commissions meeting of February 19, 1987. 9.c. Goldman Avenue On- Street Parking Problem Received and file, City Engineer Delzeit directed to report back re parking time limitation. 9.d. Traffic Operations on Street -East Street This item deferred to the Commissions meeting of February 19, 1987. 10. COMMISSION COMMENTS None. 11. STAFF COMMENTS None. 12.
