CALL TO ORDER The meeting was called to order at 7:12 p.m., Chairman Holland presiding. 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Chairman Holland. 3. ROLL CALL Chairman Holland introduced and welcomed Paul W. Lawrson, the newly appointed Commissioner who's appointment was made by Councilmember John Patrick Lane. PRESENT: Chairman Douglas Holland, Commissioners Scott Mongomery, William Butcher, John Wozniak and new Commissioner Paul W. Lawrason. OTHER CITY OFFICIALS AND EMPLOYEES PRESENT; Patrick J. Richards, Director of Community Development; John Knipe, Assistant City Engineer; Mark Wessel, Assistant Traffic Engineer; Michael A. Rubiin, Senior Planner; Diane Eaton, Associate Planner; Fred Talerico, Representing Talerico Sanchez Associates (case planner for OP -392) and Celia La Fleur, Administrative Secretary. 4. PUBLIC COMMENTS Valerie Busby representing Cabot, Cabot & Forbes requested that Item 8.a. Development Plan Permit No. OP -392 be heard prior to Item 7.f. General Plan Update. It was the general consensus of the Commission to approve this request. 5. APPROVAL OF MINUTES Minutes of June 1, 1987 Minutes of June 15, 1987 Deferred to the Planning Commission's meeting of July 20, 1987 6. CONSENT CALENDAR None. Planned Development Permit No. 1061 - Raymond Caren Commercial Planned Development Permit for an existing 11,760 square foot building previously an industrial building now zoned for commercial use. Located at 111 -165 Poindexter Avenue. By general consensus of the Commission this item was continued to the August 3, 1987 Planning Commission meeting at the applicant's request. b. Amendment to the Siqn Ordinance Revise the Sign Ordinance regarding Real Estate Subdivisional Directional (off -site) Signs. Staff recommendation to continue to July 20, 1987 was approved. C. Planned Development Permit No. 1062 - Embassy Group, Inc. Requesting approval to construct a 31,560 sq.ft. commercial center on the northwest corner of Moorpark Road and Tierra Rejada Road. i- d. Planned Development Permit No. 1063 - Embassy Group, Inc. Requesting approval to construct a 3,090 sq.ft. convenience store located on the northwest corner of Moorpark Road and Tierra Rejada Road. e. Land Division Moorpark No. 11 - Embassy Group, Inc. Requesting approval to subdivide a 4.47 acre site into 2 lots, located on the northwest corner of Moorpark Road and Tierra Rejada Road. By general consensus of the Commission Items 7.c., d., and e. were heard together. Presented by the Associate Planner Eaton; reference Staff Reports for Items 7.c.,d., and e. dated July 6, 1987. Associate Planner Eaton gave an overview of the request of the applicant. Chairman Holland opened the matter for public hearing. Testimony was received by the following: 1. Ken Shishido, representing the Embassy Group, Inc. 800 S. Figueroa Street, Suite 960, Los Angeles, California 90017. Spoke in favor of this development and stated his concerns as follows: MOORPARK PLANNING COMMISSION CITY OF MOORPARK MINUTES OF JULY 6, 1987 PAGE 3 Roof equipment would be provided by the applicant at the rear of the development which he believed it would not be an unsightly view from ground level. Applicant will agree to provided a raised barrier to separate vehicle traffic from pedestrian traffic. The applicant felt no need to provide curb, gutter and sidewalk at this time due to future additional lanes to be provided (2 lanes to 4 lanes on Tierra Rejada Road). 2. Walter Gaoik, representing National Convenience Stores, Inc. (Stop & Go Market) 1385 Knollwood Circle, Anaheim, California 92801. Spoke in favor of the project and addressed the following concerns: - Hours of operation, Stop & Go Markets provide a 24 hour operation and was unable to concur with Community Development Condition No. 40 which limited his operation of the hours of 7:00 a.m. to 11:00 p.m. - Trash will be located at the rear and would not be unsightly as there will not be a need for dumpsters; referencing the need of Community Development Condition No. 13. - Indicated that gas sales are a priority and a known profit of at least 30% in sales.- Beer/Wine sale shall be permitted 3. Roger Ogilvie, 14093 Hargrove Ct., Moorpark, CA. An adjacent property owner opposes the development and requested the Commission to provide as a condition on approval, a block wall at the rear of the site separating the site from the residential homes that would /could overlook this use. A1!so expressed the following concerns regarding: - Odors, trash, noise, beer /wine sales , security, loitering and hours of operation for the convenience store. 4. Jerome M. Scherbenski, 13881 Meeham Way, Moorpark, CA. Opposed to the development and addressed the following concerns: - Trash, loitering, gas sales, odors, noise, beer cans /bottles, semi- truck traffic. - Bus drop at Christian Barrett:, children loitering at the site. S. Edward E. Wheelis, 14092 Hargrove Ct., Moorpark, CA. Opposed to development. Requested the Commission to consider the following: - Developer to provide a rear retaining wall of at least 15 feet in height at centerline. William Fraser, 3929 Willow Creek, Moorpark, CA. Opposed to the development and questioned traffic counts /circulation. 7. Richard Templeton, 3917 Willow Creek Lane, Moorpark, CA. Opposed to the development. Concerned with the following: - Traffic circulation, signage (height requirement), lighting (or intrusion), an eight foot wall along the ridge of the property of the site to prevent pedestrian traffic to the rear of the site. 8. Robert N. Mettam, 13848 Meeham Way, Moorpark, CA. Opposed to the development and addressed the following concerns: - Noise, odor, youth loitering, traffic, and liquor sales. 9. Ben Sierra, 13892 Christian Barrett Drive, Moorpark, CA. Recommended that final approval of this development only be considered after reviewing input from the Homeowners Association which will meet on July 15, 1987 10. Robin Haridul, 14077 Hargrove Ct., Moorpark, CA. Opposed to development, liquor sales, the convenience related to the bus drop and the children's availability to the site 11. Glen Schmidt, 4287 Tecolote, Moorpark, CA. Uncommitted. Gave an overview of the zoning designation of the General Plan. Requested the Commission to consider gas sales, ingress /egress, location of this particular site is at the rear entrance of the city and special attention should be given the the architecture in keeping with current surrounding areas, first impression of the City. 12. Pam Sierra, 13892 Christian Barrett Drive, Moorpark, CA. Recommended that the City acquire the site and providing a park /recreational area for Moorpark residents. Edward Wheelis also requested that the Commission consider conditioning each PD separately regarding the hours of operation. Public hearing closed. Ken Shishido representing Embassy address a few of the concerns given by local residents: - Signage - developer is considering monument signs. - Wall - site provides natural buffers with the slope and existing tree line. MOORPARK PLANNING COMMISSION CITY OF MOORPARK MINUTES OF JULY 6, 1987 PAGE 5 Convenience Store - site has provided on up- scaled design. Motion: Moved by Commissioner Lawrason moved, seconded by Commissioner Wozniak, that a solid masonry wall 8 feet in height be provided along the west property line to meet the existing wall along Tierra Rejada Road. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Wozniak, seconded by Commissioner Montgomery, that developer shall install a raised median not less than six inches high along the center of Moorpark Road in the area where it would block access to the southerly driveway for northbound traffic. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Wozniak, seconded by Commissioner Montgomery to prohibit all liquor sales for off site consumption on the entire site of the property, but to allow on -site consumption with food sales. /^ Motion passed on a 5:0 vote. Motion: Moved by Commissioner Wozniak, seconded by Commissioner Lawrason to condition for hours of operation be 7:00 a.m. - 11:00 p.m., delivery hours 8:00 a.m. - 6:00 p.m. seven days per week and to include gasoline delivery. Motion fails on a 3:2 vote; Commissioner's Montgomery, Butcher and Holland NO. Motion: Moved by Commissioner Montgomery, second by Commissioner Butcher to amend the Commission's previous motion to provide hours of operation 6:00 a.m. - 12:00 a.m. for both the convenience store and the center. Motion passed on a 4:1, Commissioner Wozniak NO. Motion: Moved by Commissioner Butcher, seconded by Commissioner Montgomery that public pay phones be limited to two. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Montgomery, seconded by Commissioner Butcher to amend Ventura County Sheriff's Condition No. 1 to read as follows: r A 6 -foot high chain link fence shall be erected around the construction site. Motion: Moved by Commissioner Montgomery, seconded by Commissioner Butcher that Planned Development Permit No. 1062, Item 7.c. no amusement or arcade uses will be permitted. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Mongomery, seconded by Commissioner Butcher that a limit of two amusement facility uses to be located in the convenience store (Planned Development Permit No. 1063). Motion passed on a 5:0 vote. Motion: Moved by Commissioner Montgomery, seconded by Commissioner Butcher the LDM -11, Item 7.e. of the agenda, under City Engineer Condition No. 25 be deleted. The developer shall provide $130,000 for the installation of the signal at the intersection of Tierra Rejada Road and Moorpark Road. The developer will be fully reimbursed from available Tierra Rejada Road /Moorpark Road area of contribution funds when deemed appropriate by the City Council. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Lawrason, second by Commissioner Butcher that the issue of loitering be referred to and addressed by the City Council. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Mongomery, seconded by Commissioner Butcher to approve Planned Development Permit Nos. 1062/1063 and LDM -11 as recommended by staff and to include amended conditions. Motion withdrawn. Chairman Holland calls for a roll call vote to approval of Planned Development Permit Nos. 1062/1063 and LDM -11: Commissioner Montgomery: NO Commissioner Butcher: YES Commissioner Holland: NO Commissioner Wozniak: NO Commissioner Lawrason: NO Motion: Moved by Commissioner Holland, seconded by Commissioner Montgomery to recommend denial of Planned Development Permit Nos. 1062/1063 and LDM -11 to the City Council. General Plan Update - City of Moorpark - SCHEDULING The Planning Commission will conduct a public meeting for the purpose of soliciting citizen comments regarding the proposed update to the Land Use and Circulation (traffic) Elements of the City's General Plan. By general consensus Item 8.a. DP -392, Cabot, Cabot & Forbes heard prior to Item 7.f. General Plan Update - Scheduling 8. PUBLIC HEARINGS (New Business) a. Development Plan Permit No. 392 Cabot Cabot, & Forbes Requesting development of a light industrial facility in the Moorpark Business Center of a 202,656 square foot building to be used for office, manufacturing and warehouse. Located at 6080 Condor Drive, east of Los Angeles Avenue (Lot 7). Commissioner Lawrason removed from the dais due to a conflict of interest. Presented by Consultant Fred Talarico, reference Staff Report dated July 6, 1987. Case Planner noted four errors 1) page 10 Table 3 Intersection Level of Service After Signal Construction re: Princeton Avenue PM changed to C; 2) re:Condor Drive (North) change to B. Also, page 11 Table 4 Intersection Level of Service After Signals and Proposed Project 3) re: Princeton Avenue PM change to C; 4) re: Condor Drive (North) change to B. Testimony received by the following: 1. Valerie Busby, representing Cabot, Cabot & Forbes 2801 Townsgate Road, Suite 101, Westlake, CA. In support of the development and had the following concerns regarding Community Development Department Conditions: 25.e. page 22 - Low pressure energy efficient light fixtures shall be used. 11. page 27 - Prior to zone clearance or occupancy, as deemed appropriate by the City, the developer shall deposit with the City the traffic mitigation fee. The amount of this fee has not been established at this time. The actual deposit shall be the then current traffic mitigation fee in effect at the time the deposit is required by the City. MOORPARK PLANNING COMMISSION CITY OF MOORPARK MINUTES OF JULY 6, 1987 PAGE 8 15. page 20 - That all roof mounted equipment (vents, stacks, blowers, air conditioning equip.) that may extend above the parapet wall shall be enclosed on all four sides by view obscuring material used in the construction of other buildings in the same park. Prior to the issuance of a zone clearance, the final design and location of any roof mounted equipment of the project must be approved by the Director of Community Development. 19. page 21 - That signs are subject to the Moorpark Code, Chapter 50, Title 9, Sign Ordinance. A sign permit is required. Only a monument sign shall be permitted for this development plan and shall not exceed 30 feet, no higher than 5 feet above average ground level. A sign program shall be submitted and approved by the Director of Community Development for all other on -site directional and building signage. 36. page 23 - The applicant shall, prior to the issuance of a zone clearance, execute a covenant running with the land on behalf of itself and its successors, heirs and assigns agreeing to participate in the formation of an be subject to any assessment district or other financing technique including but not limited to the payment of traffic mitigation fees, which the City may implement or adopt, to fund public street and traffic improvements directly or indirectly affected by the development. Traffic mitigation fees shall be used for projects in this Los Angeles Avenue Area of Contribution, such as, but not limited to, the extension of New Los Angeles Avenue. David G. Muran, 509 Marin Street, #131, Thousand Oaks, CA., representing Hill Pinckert Architects. Informed the staff and Commission of a change in color to a Burgundy red. 3. George Moore, landscape architect, P.O. Box 1752, Thousand Oaks, CA. Gave a brief overview of landscape placement and planting to be used for the DP -392 site. Public hearing closed. Motion passed on a 4:0 vote (Commissioner Lawrason absent) Motion: Moved by Commissioner Montgomery, seconded by Butcher to amend Condition No. 19 page 21 to allow monument sign or building such sign permit shall require submittal of a sign program and approved by the Director of Community Development. Motion passed on a 4:0 vote (Commissioner Lawrason absent) Motion: Moved by Commissioner Montgomery, seconded by Commissioner Holland that there will be no occupancy prior to signalization. Motion passed on a 4:0 vote (Commissioner Lawrason absent) Motion: Moved by Commissioner Holland, seconded by Commissioner Wozniak to approve Development Plan Permit No. 392 as recommended by staff and its resolution with amended and modified conditions. PLANNING COMMISSION DISCUSSION/ACTION ITEMS a. 2nd Draft Residential Building Permit Allocation System Consideration of a draft staff proposed Residential Development Management System so as to implement Measure F (a ballot measure limiting the number of residential dwelling units to be constructed within a calendar year.
