CALL TO ORDER The meeting was called to order at 7:12 p.m., Vice Chairman Montgomery presiding. 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Vice Chairman Montgomery. 3. ROLL CALL PRESENT: Vice Chairman Scott Montgomery; Commissioner's; John Wozniak; Paul Lawrason and William Butcher. ABSENT: Chairman Douglas Holland (excused with cause). OTHER CITY OFFICIALS AND REPRESENTATIVES: Patrick J. Richards, Director of Community Development; John Knipe, Assistant City Engineer; Michael A. Rubin, Senior Planner; Celia LaFleur, Administrative Secretary. 4. PUBLIC COMMENTS a. Tom Nelson, 6862 Auburn Circle, Moorpark, CA. Representing Gershenberg, Development Plan Permit No. 302, Item 9.a. Requested the Commission to continue this matter to the Commission's meeting of August 17th. MOTION(A): Moved by Vice Chairman Montgomery, seconded by Commissioner Wozniak to continue Item 9.a to the Commission's meeting of August 17, 1987 as requested by the applicant. Motion passed on a 4:0 vote (Chairman Holland absent). b. Slide presentation provided by the Bill Mount, Air Pollution Control District 5. APPROVAL OF MINUTES MOTION(B): Moved by Commissioner Lawrason, seconded by Commissioner Wozniak to approve the minutes of July 20, 1987 as submitted. The Commission elected to consider Items 9.a. DP -302; Action Items 7.a. PD -1061; Information Items a. thru d.; and Item 7.b. Draft Residential Building Permit Allocation System. 7. PUBLIC HEARINGS (OLD BUSINESS) a. Planned Development Permit No. PD -1061 Raymond Caren Commercial Planned Development Permit for an existing 11,760 square foot building previously an industrial building now zoned for commercial use. Located at 111 - 165 Poindexter Avenue. Continued from July 6, 1987. APPROVAL OF RESOLUTION NO. PC -87 -148. The final wording of conditions has been made and the City Council has begun to discuss the subject of the applicability of the AOC fee or i— other applicable traffic fees. Since the Council has not yet made a determination, the condition of approval on this subject has been revised to defer payment of the fee until after the Council has determined that a fee is appropriate. Presented by Senior Planner Rubin: reference; staff report dated April 6, 1987. Testimony received by the followinF;_ 1. John W. Newton, John W. Newton and Associates, 165 High Street, Moorpark, CA. Representing the applicant who concurred with staff's memo dated July 29, 1987 and attached conditions. MOTION(C): Moved by Vice Chairman Montgomery, seconded by Commissioner Wozniak to delete the Condition No. 2 referenced under City Engineer Conditions. Motion passed on a 4.:0 vote (Chairman Holland absent). MOTION(D): Moved by Commissioner Butcher, seconded by Commissioner Wozniak to approve: staff's recommendation with the modification of the City Engineer's condition to read as follows: "Within 30 days after adoption of a resolution conditionally approving PD-1061 the developer shall deposit $5,000.00 to the City for installation of a ill- Planning Commission, City of Moorpark, California Minutes of August 3, 1987 Paws signal at the corner of Moorpark Avenue and Poindexter Avenue. If this is not paid by this time, no further occupancies shall be approved. This amount represents a 8.4% of the City's share (50 %) of the estimated signal project cost of $120,000.00 As an alternative to the deposit, a letter of credit in the amount of $5,500.00 may be posted for the installation of the signal. This letter of credit shall be exonerated after the signal has been installed and the developer has paid 8.4% of the cost. In no event shall more than fifty percent (50 %) occupancy for the building be approved without the traffic signal deposit being paid." Motion passed on a 4:0 vote (Chairman Holland absent). 8. PUBLIC HEARINGS (NEW BUSINESS) a. Planned Development Permit _N. 1064, Zone Change No. 2813 Topa Management Requesting approval to construct a 20,029 sq.ft. neighborhood shopping center. Located on the southwest corner of Moorpark Road and New Los Angeles Avenue. This item has been reschedule for the Commission's meeting of August 17, 1987. MOTION(E): Moved by Commissioner Butcher, seconded by Commissioner Wozniak to continue this item to their meeting of August 17, 1987. Motion passed on a 4:0 vote (Chairman Holland absent). 9. PLANNING COMMISSION ACTION ITEMS a. DP -302 Jerry Gershenberg Clarification of intent regarding building color /material of revels. On May 22, 1985 the City Council approved the construction of a 104,840 sq.ft. industrial building on Los Angeles Avenue, approximately 2,000 feet west of Buttercreek Road. At the time of approval, a color board was submitted. Although there is no record of actual approval, it is staff opinion that there was no objection, which can interpreted as an approval. The color board identified the walls to be "painted concrete" and indicated a tan color. The revels were shown as a "brick trim." Staff has taken the position that since the original color board states "brick" - that a brick veneer is required. MOTION(F): Moved by Vice Chairman Montgomery, seconded by Commissioner Wozniak to continue this matter as requested by the applicant to August 17, 1987. Motion passed on a 4:0 vote (Chairman Holland absent). 10. DISCUSSION /ACTION ITEMS a. TR -4174 Villa Campensina Minor Modification Due to the absence of a staff member; the minor modification for Villa Campesina will appear on the Commission's August 17, 1987 agenda. b. quarterly Status Report- Resj'.dential, Commercial and Industrial Due to the absence of a staff member; this items will appear on the Commission's August 17, 1987 agenda. C. DP -358, 361, 362 and 389 CC &F Minor Modification Many projects in the past have been conditioned to require that an "unconditional will -serve letter" be obtained prior to issuance of a zoning clearance. The condition has always been listed among the Community Development conditions, but is actually administered and the letter written by the Ventura County Waterworks District No. 1. A difficult situation has been created because the Waterworks District is in fact not issuing these letters until just prior to the building permit being issued. This procedure gives the Waterworks District as much assurance as possible that allocated water will actually be utilized. Currently many projects have this requirement and delays are being created while this matter is resolved. Typically an "availability" letter is required at the time of project submittal. This represents the extent of the water commitment that waterworks is willing to make. This level of commitment is what holds until the will -serve letter is sent. It would not create any problems for the Community Development Department to defer the requirement prior to issuance of a building permit. A sample availability letter is attached. Presently, at least for projects, DP -358, 361, 362 and 389 have this requirement imposed. Several others have been approved by the City, but not yet received zoning clearance may very well be in the same circumstance. It was the general consensus of the Commission to approve staff's recommendation that: Planning Commission, City of Moorpark, California Minutes of August 3, 1987 Pake 5 "Approve a blanket minor modification for all outstanding development entitlements where the above condition appears. General rewording of the condition would be as follows: "Prior to issuance of a building permit, an unconditional will -serve letter for water and sewer service will be obtained from Ventura County Waterworks District No. 1." Information item only, no action taken. d. DP -304 Wasserman Minor Modification The 22,239 sq.ft. industrial building located on Commerce Avenue between Poindexter Avenue and Los Angeles Avenues. It was approved by the Council on September 19, 1984. The original approval authorized 2,100 sq.ft of office space and 20,139 square feet of manufacturing space. A total of 50 parking spaces (provided 2 additional spaces, 48 required). The present owner wishes to expand the office space to 3,900 square feet (consequently reducing the manufacturing area to 18,339 sq.ft.). Sufficient parking exists on the site to accommodate this request. It was staff recommendation to approve the applicants request. An information item only no action taken by the Planning Commission. 7. PUBLIC HEARINGS (OLD BUSINESS) a. Draft Residential Development Management System Consideration of a draft staff proposed Residential Development Management System so as to implement Measure F (a ballot measure limiting the number of residential dwelling units to be constructed within a calendar year. Presented by Director Richards; reference: Staff report dated July 28, 1987 Motion(G): Moved by Vice Chairman Montgomery, seconded by Commissioner Lawrason to reopen the hearing for the Draft Residential Management Allocation System. Motion passed on a 3:0 vote (Commissioner Butcher abstain due to a potential conflict of interest and Chairman Holland absent). Testimony received by the following: 1. Russ Russell, 3240 San Ysidro Street, Camarillo, CA. Representing Glenhaven Development (TR-3306). Urged the Commission to expedite the RDMS implementation of Measure F. Also inquired to whether Planninft Co®ission, City of Moorpark, California Minutes of August 3, 1987 Pge6 there was an appeal process. Staff responded that the is. 2. Glen Schmidt, 4287 Tecolote Court, Moorpark, CA. Requested that the Commission consider the following issues: - overall impact of developments - identify phasing of development in relation to infrastructure - provide flexibility - consider the three planned Community Zones: Urban West Communities; Union Oil; and above Moorpark College - the allocation process does not encourage long -range planning 3. Tom Zanic, 520 Broadway, Suite 100, Santa Monica, CA 90401. Referenced his letter dated August 3, 1987 with recommendations within Group I were related to grading for planned communities; encourage infrastructure improvements; water service; water drainage; and storm water drainage facilities. Group II related to fire protection; project seniority; amendments to projects after allotment. Motion(H): Moved by Commissioner Lawrason, seconded by Vice Chairman Montgomery to amend Section 7 No. 4. Allotments to read as follows: 4. Allotments - If in a given year the highest ranking application does not at least meet both of the minimum point requirements of Section 7(B)(4), the City Council shall make no permit allotment for that year. The number of units will then be added to the next annual allocation, as the only allowed exception to the ten percent (10 %) rule of Section 12. School Impact (iii) Need for Busing remain within the text and read as follows: One point for each level (elementary and intermediate only) for which at least fifty percent of the pupils estimated to inhabit in the project would not require busing to the school of attendance, as determined by the applicable policy of the Moorpark Unified School District. Motion(J): Moved by Commissioner Lawrason, seconded by Commissioner Wozniak a four -range category under Section 9 B Qualit of Design and Contribution of Public Welfare and Amenity 1. Design Quality - Buildings amend point range and standards to read as follows: Point Standard 8 -10 The project architecture represents excellent design in terms of all the above standards. 4 -7 The project meets a majority of the above standards. 1 -3 The project meets some of the above standards. 0 All other projects Motion passed on a 2:1:2 vote, Vice Chairman Montgomery voting No (Commissioner Butcher abstain due to a potential conflict of interest and Chairman Holland absent). Motion(K): Moved by Commissioner Lawrason, seconded by Vice Chairman Montgomery that Section 9 Wozniak a four -range category under Section 9 Evaluation System b. 12. Aesthetical Environment be amended to read as follows: Under 7 points: The project creates minimal environmental impacts which are mitigated at no expense to any public agency and is compatible with the adjacent land uses but does not incorporated any exterior quality design enhancements beyond those required. Motion passed on a 3:0:2 vote, Vice Chairman Montgomery voting No (Commissioner Butcher abstain due to a potential conflict of interest and Chairman Holland absent). Motion(L): Moved by Commissioner Lawrason, seconded by Vice Planning Commission, City of Moorpark, California Minutes of August 3, 1987 P Qe 8 Chairman Montgomery that Section 9 Evaluation System C. Incentives Contributing to the Public Welfare be amended to read as follows: Bonus points Standard 5 The project completes a neighborhood, planned development or tract within a planned development by infilling. Motion passed on a_3:0:2 vote, Vice Chairman Montgomery voting No (Commissioner Butcher abstain due to a potential conflict of interest and Chairman Holland absent). It was the general consensus of the Commission to forward its recommendations to the Councils meeting of August 19, 1987. 11. COMMISSION COMMENTS Commissioner Lawrason commented on the need for equity in the allocaiton process. That the allocaiton system should be viewed as guidelines. Commissioner Wozniak requested that the City Engineer's office once again look at removal of the light pole at the Moorpark Road /Los Angeles Avneue intersection. 12. STAFF COMMENTS None. 13.
