CALL TO ORDER The meeting was called to order at 7:08 p.m., Chairman Holland presiding. 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Chairman Rolland. 3. ROLL CALL PRESENT: Chairman Douglas Holland, Vice Chairman Scott Montgomery, Commissioner's William Butcher, John Wozniak, and Paul Lawrson; OTHER CITY OFFICIAL AND EMPLOYEES PRESENT: Patrick J. Richards, Director of Community Development; R. Dennis Delzeit, City Engineer; Mark Wessel, Traffic Engineer; Michael A. Rubin, Senior Planner; Celia LaFleur, Administrative Secretary. 4. PUBLIC COMMENTS a. Connie Lawrson, 4291 Ambermeadow Street, Moorpark, CA. Expressed the urgency and need for public input at the Planning Commission's special meeting of August 22nd, Saturday at 9:00 a.m. to discuss the General Plan Update and encouraged the news media attending, to provide coverage to inform local residents to provide their input. 5. APPROVAL OF MINUTES Minutes of July 6, 1987 Minutes of August 3, 1987 Deferred to the next regular scheduled meeting of the Planning Commission. 6. CONSENT CALENDAR None. 7. PUBLIC HEARINGS OLD BUSINESS None. 8. PUBLIC HEARINGS NEW BUSINESS a. Planned Development Permit No. 1064&_ Zone. _Chansge No 2813 TOPA MANAGEMENT PARTNERSHIP Planning Commission, City of Moorpark, California Minutes of August 17, 1987 - - -- ...... Page 2 Requesting approval to construct a 20,029 square foot neighborhood shopping center. Located on the southwest corner of Moorpark Road and New Los Angeles Avenue. Presented by Senior Planner Rubin; reference: Staff report dated August 14, 1987. The following conditions were hand delivered by City Engineer Delzeit: Missing City Engineer Conditions No storm water flows from a 50 year storm shall exit the parking lot and enter onto either Los Angeles Avneue or Moorpark Road. The proposed parkway drain shown on the conceptual grading plan shall be deleted, with all water from the site directed to the new RC bos along Moorpark Road. To provide for project related improvements, developer shall, prior to zone clearance, offer for dedication to the City of Moorpark right -of -way of sufficient width along Los Angeles Avenue to provide a total right -of -way of 59 feet south of the Los Angeles Avenue centerline along the entire frontage of the parent parcel. To provide for ultimate improvements, developer shall, prior to zone clearance, make an irrevocable offer to the City of Moorpark right -of -way of sufficient width along Los Angeles Avneue to provide a total right of way of 70 feet south of the Los Angeles Avenue centerline along the entire frontage of the parent parcel Prior to zone clearance, developer shall obtain reciprocating access easements from the properties to the south and west. Deleted City Engineer Conditions l.h. The developer shall submit to the City of Moorpark for review and approval, evidence that this buildable site will be protected from flooding. l.i. The developer shall have prepared a geotechnical investigation with regard to liquefaction, expansive soils, and seismic safety. Per the City's Safety Element:, this report shall be prepared by a Registered Professional Civil Engineer or Geologist. Public hearing opened. Testimony received by the following: 1. Susan Weintraub, representing Topa Management Company, 1800 Avenue of the Stars, Suite 1400, Los Angeles, CA. Gave a brief introduction and background related to the current request for development. Requested staff to identify, clarify and interpret the following conditions: Planning Comission, Ci_of Moorpark, California Minutes of August 17, 1987 Community Development Department Conditions 2.j. page 4 related to formation of and subject to any assessment district or other financing as related to traffic mitigation (or public improvements) fees. 2.k. page 4 related to pullover parking shall be limited to 24 inches maximum. 3.b. page 5 related to the developer shall pay all school assessment fees levied by the Moorpark Unified School District. 4.c. page 5 related to a separate zoning clearance shall be obtained prior to occupancy of individual lease units within the shopping center. 4.d. page 5 related to no use for which this permit is granted shall be commenced until a Certificate of Occupancy has been issued by the Building & Safety Division. City Engineer's Conditions 1.c. - page 7 - Moorpark Road is to be constructed per Plater B -2B for all improvements west of centerline. A meandering sidewalk will be constricted along Moorpark Road, with the design approved by the Director of Community Development. - A minimum 45 foot curb return radius will be provided at the southwest corner of the Los Angeles Avenue /Moorpark Road intersection. l.d. page 8 - The developer shall deposit with the City of Moorpark a contribution for the Los Angeles Avneue Improvement Area of Contribution. The actual deposit shall be the then current Los Angeles Avenue Improvement Area of Contribution applicable rate at the time the Building Permit is issued. l.j. page 8 - The developer shall offer for dedication to the City of Moorpark a street right -of -way of sufficient width along Moorpark Road to provide an ultimate right -of -way of 47 ft., west of the centerline of Moorpark Road along the entire frontage of the parent parcel. l.m. page 9 - related to formation of and subject to any assessment district or other financing as related to traffic mitigation (or public improvements) fees. 3.c. page 10 - Prior to occupancy, an approximately 4 foot high by 8 foot wide reinforced concrete box will be constructed along the east property line. The location and design of the RCB will be Planning Commission, Cites of Moorpark, California Minutes of August 17, 1987 Paste 4 reviewed and approved by the Ventura County Flood Control District and the City Engineer. This reinforced concrete box will connect to the existing 3 feet high by 5 feet 8 inch wide RCB crossing under Los Angeles Avenue. The new RCB will provide a stub -out where it meets the existing RCB for a future 54 inch reinforced concrete pipe entering from the east. The developer will enter into an agreement with the City of Moorpark to be reimbursed for the construction of this reinforced concrete box from the Los Angeles Area of Contribution Fund subject to review and approval by the City. The total reimbursement shall not exceed $225,000. 3.d. page 10 - Prior to occupancy, developer shall improve the intersection of Moorpark Road - New Los Angeles Avenue . The improvements shall include al.l work necessary to achieve the following: Southbound right turn overlap signal phasing 4.a. page 11 - Any direct expenses incurred by the developer relating to curb, gutter, and sidewalk construction on the north leg of the Los Angeles Avenue - Moorpark Road intersection shall be reimbursed by the Los Angles Avenue Area of Contribution Fund, subject to review and approval by the City. It is intended tha the eventual developer of the northeast corner of this intersection will reimburse the Los Angeles Avenue Area of Contribution Fund for these expenses. City Engineer Delzeit commented in response to the applicants request for clarification of fees and deposits and stated the following. Generally, it is not anticipated that are any credits, all that can be anticipated is that the developer is to provide the initial monies, construct the improvements subject to the agreement entered into by the developer and the City, the time factors would be established and put into the agreement. 2. Brian Tiedge, representing MCS Architects, 199 So. Los Robles Avenue, Suite 400, Pasadena, CA. 91101. Supporting the applicants request and gave a brief overview of thep amenities that this project would provide. 3. W. Mayfield, 6085 Darlene, Moorpark, CA. 93021. Opposing the applicant's request. Also expressed concerns regarding traffic circulation. 4. Moody Knotts, 446 E. Los Angeles Avenue, Space 18, Moorpark, CA. 93021. Uncommitted. Expressed opssition and concerns with being displaced from the Angeles Trailer Lodge. Motion: Moved by Chairman Holland, seconded by Commissioner Montgomery that the zoning be changed from Trailer Park Development to Commercial Planned Development and all future retail to support office commercial uses on the subject site. Motion passed on a 5:0 vote. Motion: Moved by Chairman Holland, seconded by Commissioner Woznaik that the issues of relocation for the existing tenants be resolved prior to any decision being made on the design. Motion passed on a 5:0 vote. Motion: Moved by Vice Chairman Montgomery, seconded by Commissioner Lawrason that the project should be denied because of it's inconsistency with the General Plan and Zoning. Motion passed on a 5:0 vote. RECESS 8:32 P.M. - RECONVINE 8:41 P.M. b. Development Plan Permit No. 390 & Condition Use Permit No. 4507 - Site Friedman Requesting approval to construct a 9,847 sq.ft. industrial building including an automotive repair and incidental retail sales of automotive parts. Located on the northwest corner of Los Angeles Avneue and Goldman Avenue. Presented by Michael A. Rubin, Senior Planner: reference; staff report dated August 17, 1987. Testimony received by the following: Amy Dengler, 141 Duesenberg Drive, Westlake Village, CA. Architect for the applicant. Colin Velazquez, 8366 Topanga Canyon Blvd., Canoga Park, CA 91304. In opposition to the request for development to land use requirement and retail portion for the M zone (industrial.). The Copmmission expressed concerns with light automotive repair, retail sales, noise. Motion: Moved by Vice Chairman Montgomery, seconded by Commissioner Planning Co®mission, City of Moorpark, California Minutes of August 17, 1987 Butcher to approved the request to construct an industrial building and to use the building for auto repair and incidential sales of auto parts. (The Commission did not place a time limit on the CUP when they took their action. Staff will consider ten years with an extension of an additional ten years after review by the City. Motion passed on a 5:0 vote. C. Conditional Use Permit No. 4508 - Grace Chapel Moorpark Foursquare Church Requesting a 1,440 sq.ft. church sanctuary, and 720 sq.ft. classroom facility. Located on the southeast corner of Los Angeles Avenue and Beltramo Road (private street). Presented by Michael A. Rubin, Senior Planner: reference; staff report dated August 17, 1987. 8 Testimony received by the following: David Benefiel, 11930 Los Angeles Avenue, Moorpark, CA. Applicant. Nancy Kuhn, 373 Sarah Avenue, Moorpark, CA. In support of the applicants request. Joe Fedele, P.O. Box 11, Tarzanz, CA 91356. In opposition to the request of the applicant. Expressed concerns of access road ( Beltramo Road). It does not meet infrastructure requirements and needs to be researched. After considerable discussion by the Commission relating to public works conditions. Also, the fact that the owner of Beltramo Road stated that he would not give future access to the church from his property ( Beltramo Road). Motion: Moved by Vice Chairman Montgomery, second by Chairman Holland to approve staff's recommendation. Motion passed on a 5:0 vote. 9. PLANNING COMMISSION DISCUSSION /ACTION ITEMS None. 10. INFORMATION ITEMS a. TR -4174 Minor Modification-- Villa Campensina The Planning Commission was advised of the Director's intentions to approve a minor modification to allow a street side yard setback on a corner lot to be reduced from 20 feet to 10 feet. r Planning Commission, City of Moorpark, California Minutes of August 17, 1987 b. Quarterly Status Report - Residentials_Commercial, & Industrial Recieved and filed. 11. COMMISSION COMMENTS The Commission requested a status on the wooden light pole at th3 southeast corner of Spring Road and Los Angeles Avenue. The Commission requested information regarding the type of left turn signal being used on Los Angeles Avenue at Moorpark Avenue regaring periphery view of the signal. 12. STAFF COMMENTS Staff requested informaiton regarding the format of Saturday's General Plan meeting. Staff advised the Commission that their regular scheduled meeting of September 7th would be scheduled for September 8th, (Tuesday) due to the holiday. 13.
