Minutes of October 5, 1987
The regular scheduled meeting of the Moorpark Planning Commission
held on October 5, 1987 in the City Council Chambers located at 799
Moorpark Avenue, Moorpark, California
1. CALL TO ORDER
The meeting was called to order at: 7:14 Vice Chairman Montgomery
presiding.
2. PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Vice Chairman Montgomery.
3. ROLL CALL
PRESENT: Vice Chairman Scott Montgomery, William Butcher,
John Wozniak, and Paul Lawrason;
ABSENT: Chairman Douglas Holland with cause.
OTHER CITY OFFICIALS AND EMPLOYEES PRESENT:
Patrick J. Richards, Director of Community
Development; Michael A. Rubin, Senior Planner;
John Knipe, Assistant City Engineer; and Celia
LaFleur, Administrative Secretary.
4. PUBLIC COMMENTS
None.
5. CONSENT CALENDAR
A. Vesting Tentative Tract Nos. 4340, 4341 and 4342
Planned Development Permit Nos. 1070, 1071 and 1072
Zone Change Nos. 2815, 2816 and 2817
Location: adjacent, north and south of Tierra Rejada Road
between Walnut Creek Road and the north terminus of Tierra
Rejada Road at the Arroyo Simi.
Recommending denial Resolution Nos. PC -87 -153
PC -87 -154
PC -87 -155
Motion: Moved by Commissioner Butcher seconded by
Commissioner Lawrason to approve Resolution Nos.
PC -87 -153, -154, -.155 recommending to the City
Council denial without prejudice of Tract Nos.
4340, 4341, 4342.
Motion passed on a 4:0:1 vote Chairman Holland
absent.

7. PUBLIC HEARINGS (Old Business)
A. General Plan Update
For the purpose of soliciting
the proposed update to the
(traffic) Elements of the City's
citizen comments regarding
Land Use and Circulation
General Plan.
Presented by Senior Planner Rubin who gave a brief overview of
recent letters of interest received regarding interest in
re- zoning and amendments to the General Plan Land Use Element
Testimony was received by the following:
A. Harry Lieb, 8933 Amador Circle #1316E, Huntington Beach,
CA. Mr. Lieb referenced his June 12, 1987 letter
describing his property approximately 39 acres located on
Casey Road directly across the street from the Moorpark
High School, less than 1000 feet from the Moorpark Fire
Station. This property is currently zoned RESAc. and
requested that the property be re -zoned to Medium Density
3.1 - 5 DU /Ac (4DU /Ac average) referencing the amenities
for re- zoning .
B. Bill LaPerch. 7200 Walnut Canyon, Moorpark. Committee
to Preserve Moorpark. Mr. LaPerch referenced The
Enterprise newspaper, May 19, 1987: Freeway delays
attributed to traffic congestion which now account for 10
percent of the average commuter's time on the road will
increase 1,600 percent by 2010 ";
"One out of 420 people in the world today live in Southern
California ";
"By 2110, 18.3 million people are expected to live in the
Southland, a 47 percent increase from 1984 ".
Mr. LaPerch referenced other documents, such as Luis
Manzano & Associates, Inc. memo to Robert Felburg dated
4/24/85 regarding Development Plan and Guidelines
addressing the proposed land use for a 3,495.76 acre site
(Moorpark Solaris), Development Status Reports and a list
of applicants requesting general plan amendments.
Mr. LaPerch requested the
consider any change in

C. Connie Lawrason, 4291 Ambermeadow Street, Moorpark, CA.
Requested that the Planning Commission consider the
following:
Residential - encourage residential planned communities.
Commercial - restricted from a residential neighborhood,
no gas sales within the surrounding area.
Industrial - considerations should be made in maintaining
standards in environmental health, clean air,
maintenance /use hazardous /toxic waste or materials.
Traffic /Circulation - after the 118/23 connector is
accomplished the 118 could still be a problem to the Los
Angeles Avenue traffic circulation.
Other comments referenced hillside preservation,
hospital facility, more senior citizen housing, encourage
mobile home parks, and church site.
D. Rusty Beeler, representing West Oaks Realty, 299
Hillcrest Drive, Thousand Oaks. Promoted a change from 5ac
lots on his 350 acre parcel to lac lots. Future plans for
a golf course.
It was the general consensus of the Planning Commission to
continue the meeting of the General Plan Update to November 16th
for review of work task of the update by planning and public
works and study program and make its recommendation to the City
Council.
It was also requested by Commissioner Lawrason to keep an
updated map of locations and general plan amendment request.
8. PUBLIC HEARINGS (New Business)
A. Planned Development Permit No. 1065 - Colin Velazquez
Requesting approval of a 27,466 sq.ft. automotive center
(18,102 sq.ft.,of service bays and 9,356 sq.ft. of retail
space). Located on the south side of Los Angeles Avneue
(approximately 250 feet west of Parklane Avenue).
B. Planned Development Permit No. 1066 - Leonard Liston
Requesting approval of a 9,000 sq.ft. of automotive service
bays and a 4 -stall coin operated car wash. Located on the

west side of Parklane Avenue approximately 180 feet south
of Los Angeles Avenue.
The consensus of the Commission regarding Items 8.A & B. was to
hear both items together. The Senior Planner began with PD -1065
and proceeded with PD -1066 giving a brief overview of the staff
reports dated 10/5/87. Testimony received by the following:
A. Colin Velazquez, 1078 Mellow Lane, Simi Valley, CA. 93065.
Applicant for PD -1065.
Mr. Velazquez concurred with the following City Engineer
requirement:
The present site plan shows two points of access from Los
Angeles Avenue only. Among the City Engineer's conditions
is a requirement that only one driveway be permitted on Los
Angeles Avenue and that it should be a minimum of 40 feet
wide. The two driveways shown are presently 25 feet and 30
feet. No access is presently proposed to the rear. Part of
the same City Engineer's condition is to require a 30 foot
driveway to provide access to the south. This will provide
ultimate circulation to Park Lane Avenue and out to Los
Angeles Avneue.
The applicant proposed to use 36" box trees instead of the
required 24" as a credit towards replacement value of the
existing trees. Questioned a tree report imposed by the
City and its accuracy to the value of the 76 sited trees.
B. Bruce Labins, the applicants architect, 23935 Ventura
Blvd., Calabasas, CA. 91311. Concurred with the Commission
concern regarding a barrier for the adjacent property and
additional parking spaces.
PD -1065 related concerns were:
Establishing parking ratio for automotive repair service.
Hours of operation.
Setback requirements (related to visual impact, noise, odor,
etc.) in relation to the 67 single family units which will
be adjacent to the proposed PD -1065.
Increase landscaping.
Senior Planner Rubin proceeded with further comments regarding
PD -1066 and staff report dated 10/5/87.

Testimony received from the following:
A. Leonard Liston, 31129 Via Colinas, Suite #705, Westlake
Village, CA. 91362. Gave a brief overview of this proposal
and related needs for the community.
B. J.D. Jones, architect, 1146 :Hudson Court, Simi Valley, CA.
93065. Concurred with the applicant.
C. Herbert Rosekrantz, 16133 Ventura Blvd., Encino, CA.
Opposed to the development of PD -1065 & 1066. Requested
that the Commission consider a commercial office use.
D. Errol Hale, representing Shiloh Community Church, 4330
Deepwell Lane, Moorpark, CA. 93021. Concerned with the
noise, visual impact, pollution . Requested the Commission
consider the hours of operation of the car wash facility
(i.e. Sunday a.m. hours - loitering, radios). Visual impact
on Los Angeles Avenue.
E. Bob Kreyccik, 1704 Alviso Street, Simi Valley, CA. 93065.
Concurred with previous speakers opposing PD -1066.
i E. Dave Wilkinson, 4791 Elderberry, Moorpark, CA. 93021.
Representing Moorpark Presbyterian Church. Oppose any
approval to PD -1065 and PD -1066.
G. Greg Burkhardt, 3932 Southampton Road, Moorpark, CA.
93021. Concurred with previous speakers opposing PD -1065
and PD -1066.
H. James Detwiler, 15102 Varsity Street "D ", Moorpark, CA.
93021. Also concurred with previous speakers.
PD -1066 related concerns were:
Car wash and hours of operation.
Visual impacts.
Testimony received by church residents opposing
development.
PLANNED DEVELOPMENT PERMIT NO. 1065 - ACTION
Motion: Moved by Vice Chairman Montgomery, seconded by
Commissioner Butcher that the applicant shall receive
credit for one parking space per each bay provided.
Motion passed on a 4:0:1 vote.

Motion: Moved by Vice Chairman Montgomery, seconded by
Commissioner Butcher that the hours of operation shall
be as follows:
Repair /Service Monday — Saturday 7 a.m. - 6 p.m.
Retail Service Monday - Saturday 7 a.m. - 10 p.m.
Sunday 8 a.m. - 5 p.m.
Motion passed on a 4:0:1 vote.
Motion: Moved by Vice Chairman Montgomery, seconded by
Commissioner Lawrason that tree replacement shall not
be limited to the proposed site, recognizing needed
improvements for parkas and streets within the
community and that a portion, not to exceed 50% of
this $54,000, could be offset by the dedication of
trees and subsequent landscaping off site.
Motion passed of a 4:0:1 vote.
Motion: Moved by Vice Chairman Montgomery, seconded by
Commissioner Butcher that a minimum wall of 8 feet be
provided to mitigate noise, odor, and visual impact to
the adjacent 62 single family homes and adjacent
church. Roofing shall be designed to accommodate
baffling or deflector to control noise.
Motion passed on a 4:0:1 vote.
Motion: Moved by Vice Chairman Montgomery, seconded by
Commissioner Butcher to require the developer to
continue noise deflector features to the service bays
at the east side of the property.
Motion passed on a 4:0:1 vote.
Motion: Moved by Commissioner Butcher, seconded by Vice
Chairman Montgomery that a 10% error factor at $49,000
be allowed on the submitted tree report.
Motion failed on a 1:3:1 vote.
Motion: Moved by Vice Chairman Montgomery, seconded by
Commissioner Wozniak to recommend conditional approval
to the City Council of Planned Development Permit No.
1065 as recommended by staff with modified and
additional conditions.
Motion passed on a 4:0:1 vote.

PLANNED DEVELOPMENT PERMIT 1066 - ACTION
Motion: Moved by Commissioner Wozniak, seconded by
Commissioner Montgomery that the hours of operation
shall be limited to the following:
Repair /Service Monday - Saturday 7 a.m. - 6 p.m.
Car Wash Monday - Saturday 7 a.m. - 10 p.m.
No Sunday operation
Motion passed on a 4:0:1 vote.
Motion: Moved by Vice Chairman Montgomery, seconded by
Commissioner Lawrason that this project has been found
to be incompatible with surrounding land uses in the
area and that this project can not be mitigated to
interface with the adjacent church and directs staff
to prepare a resolution denying the proposed project.
Motion passed on a 4:0:1 vote.
Motion: There being no further business it was moved by Vice
Chairman Montgomery, seconded by Commissioener Butcher
to adjourn, the time being 12:10 a.m.
