CALL TO ORDER The meeting was called to order at 7:40 p.m., Chairman Holland presiding presiding. 2. ROLL CALL PRESENT: Chairman Douglas Holland; Commissioner's John Wozniak; William Butcher; Paul Lawrason; ABSENT: Vice Chairman Montgomery. OTHER CITY OFFICIALS AND REPRESENTATIVES: Patrick J. Richards, Director of Community Development; Michael A. Rubin, Senior Planner;Paul Berland, Division Manager of Planning; John Knipe, Assistant City Engineer; Celia LaFleur, Administrative Secretary. 4. PUBLIC COMMENTS None. S. APPROVAL OF MINUTES The minutes of October 19, 1987 and November 2, 1987 were deferred to the Commission's meeting in December 1987. 6. CONSENT CALENDAR None. 7. PUBLIC HEARINGS (OLD BUSINESS) A. Planned Development Permit No. 1068 - Richard Hart Requesting approval to construct a 4,474 sq.ft. automotive repair facility on a 15,186 sq.ft. site. South side of Los Angeles Avenue approximately 170 feet east of Spring Road. Note: This item was scheduled for public hearing on October 19, 1987 and at the request of the applicant was continued to the Commission's meeting of November 16, 1987. Staff report presented by Michael A. Rubin, Senior Planner; reference: Staff Report dated November 9, 1987. Testimony received by the following: 1. Lillian Hart, 17827 Ridgeway Road, Granada Hills, CA. In support of Planned Development Permit No. 1068. 2. Andy Vincioni, 4485 Forestglen Court, Moorpark, CA. In support of Planned Development Permit No. 1068. Mr. Vincioni stated to the Commission that he is the current lessor for an automotive center and is relocating to the proposed PD -1068 location and would provided the following: Lease 3 bays Hours of operation would be 7:00 a.m - 6:00 p.m. (no Sat. or Sun.) No outside vehicle storage. 3. Richard Hart, 17827 Ridgeway Road, Granada Hills, CA. Applicant of Planned Development Permit No. 1068. State to the Commission that there would be storage for 12 vehicles within the bay areas. 4. Joy Vicioni, 4485 Forestglen Court, Moorpark, CA. In support of Planned Development Permit No. 1068. Stated that she with her husband currently operate a automotive center located at the rear of a residential area and have never had any complaints from the residents regarding noise. Public Hearing closed. The Commission stated the following concerns: a. Joint access with the established Uncal gasoline station. b. Would the automotive use be compatible to what the Downtown Plan provides, theme, architectural design, etc. C. Light reflecting onto undeveloped but approved 27 condominium units north of PD -1068. d. That cinderblock be provided for fencing as a noise buffer. e. Provide traffic mitigation measures. MOTION(c): Moved by Commissioner Wozniak, second by Commissioner Lawrason to require noise barrier be provided for PD -1068. Motion passed on a 4:0 vote. MOTION(d): Moved by Chairman Holland, seconded by Commissioner Butcher that no outside overnight vehicle storage be provided. Motion passed on a 4:0 vote. MOTION(e): Moved by Chairman Holland, seconded by Commissioner Butcher that no overnight vehicle storage be provided on Los Angeles Avenue. MOTION(a): Moved by Commissioner Lawrason, seconded by Commissioner Wozniak that the architectural design provide a Western /Victorian theme. Motion passed on a 4:0 vote. MOTION h : Moved by Commissioner Lawrason, seconded by Commissioner Wozniak that a Right- Turn -Only sign be provided on Los Angeles Avenue egress from PD -1068 driveway exit. On a roll call vote: Chairman Holland: No Commissioner Lawrason: No Commissioner Butcher: No Commissioner Wozniak: No; and directed staff to prepare a resolution of denial and return it to the Commission nest regular scheduled meeting. B. Vestinq Tentative Tract No. 4338, Planned Development Permit No. 1069, Zone Change No. 2814 - Urban West Communities Request to subdivide the subject property into 55 single family lots. Southerwesterly corner of Walnut Creek and Sunny Glen Drive. North of Hillside Drive. Continued from November 2, 1987 as requested by the applicant. Presented by Paul Berlant, Division Manager of Planning. Reference staff report dated November 2, 1987 and November 12, 1987. Testimony received by the following: 1. Tom Zanic, 520 Broadway, Santa Monica, CA., representing Urban West Communities. Referenced his letter dated November 9, 1987 which state comments and recommendations regarding the staff report and recommended conditions for the above entitlement requests dated November 2, 1987. 2. James Brady, 12419 Sunnyglen Drive, Moorpark, CA. Creekside II Homeowners Association President. Expressed to the Commission preference of a) single family residence for TR -4338; b) walkway be provided to the park facility. 3. Dave Schroder, 12579 Sonnyglen Drive, Moorpark, CA. Stated his preference for single family units within the TR -4338. 4. Robert A. Felburg, 136 93 Christian Barrett Drive, Moorpark, CA. New homeowner and concurred that he was not aware of an moisture problem. Planning CosaissioJ_City of Moorpark, California Minutes of November 16, 1987 MOTION(i): Moved by Chairman Holland, seconded by Commissioner Lawrason that tract redesign for storm drain and that the storm drain access area be an easement maintained by the Homeowners' Association. (The parcel adjacent to Lots 2 through 8 shall be finished with a surface approved by the City Engineer (i.e., gravel or asphalt) from the gate to the existing block wall southwesterly of Lot 8... The gate shall be maintained by the Homeowners' Association. The parcel shall be dedicated to the city. ") Motion passed on a 4:0 vote. MOTION(k): Moved by Commissioner Butcher, seconded by Chairman Holland that unless substantial dwelling unit construction has occurred on all phases within the tract not later than 36 months after the date the permit is granted, or 36 months from the original and additional 36 months after the date on which a Measure F allocation is made for all of the dwelling units in the specific phase; this permit shall automatically expire on that date„ whichever date is late. Motion passed on a 4:0 vote. MOTION(1): Moved by Chairman Holland, seconded by Commissioner Butcher to modify Condition No. 14 to read as follows: RPD Condition No. 14 requires gutters and downspouts over all garage doors and entryways for all units. Water shall be conveyed to the street in non - erosive devices." Motion passed on a 4:0 vote. MOTION(m): Moved by Chairman Holland, seconded by Commissioner Lawrason that Condition No. 15 read as follows: That a minimum setback shall be an average of 20 feet. Motion passed on a 4:0 vote. It was the general consensus of the Commission to concur with the following conditions as recommended within the Urban West Communities letter dated November 9, 1987. Condition Nos. as follows: 1^ Planning Corission, City of Moorpark, California Minutes of NoveMber 16, 1987 RPD Condition Nos. 31, 33, 34, 35, 42, and Tract Condition No. 24 be modified to read as follows: That prior to recordation, the developer shall submit to the City of Moorpark for review and approval, a grading plan prepared by a Registered Civil Engineer..." MOTION(n): Moved by Chairman Holland, seconded by Commissioner Butcher that Condition No. 44 which requires deletion of Parcel "A" which is a pedestrian link between the existing Creekside II neighborhood to the north and TR -4338. It is the intent of the Creekside II Homeowners' Association to annex TR -4338 and that the walkway be relocated between Lot 33 & 34. Motion passed on a 4:0 vote. MOTION(o): Moved by Commissioner Lawrason, seconded by Commissioner Wozniak to recommend that address numbers be 4- inches in height. Motion passed on a 4:0 vote. (Inclusive within any modifications made by the City Engineer's conditions submitted and dated 11/16/87.) MOTION(p): Moved by Commissioner Butcher, seconded by Commissioner Lawrason that Condition No. 46 be deleted which reads as follows: "Lots 27 and 28 shall share a common driveway approach and once, on site, driveways shall divide to the respective lots, leading to each garage." Motion passed on a 4:0 vote. MOTION(q): Moved by Commissioner Lawrason, seconded by Commissioner Butcher that Condition No. 17 be deleted which reads as follows: "At lease one -third (18) of the units shall be limited to one story in height and distributed throughout the development." Motion passed on a 4:0 vote. r-- Planning Co®ission, City of Moorpark, California Minutes of Noveliber 16, 1987 Page 7 MOTION(r): Moved by Commissioner Lawrason, seconded by Commissioner Wozniak that Condition No. 37 be deleted which reads as follows: "The developer shall submit to the Director of Community Development for review and approval, a plan showing the mix of roof color and materials on a lot by lot basis. The mix shall consist of at least three color groups." Motion passed on a 4:0 vote. MOTION(s): Moved by Chairman Holland, seconded by Commissioner Lawrason that Condition No. 42 of RPD -1072 be deleted which reads as follows: "Prior to occupancy of any residential units under this RPD Permit, the applicant or successor in interest of the multi - family parcels in either the South Village or West Village shall commence and substantially complete at least g0 units of multi - family development." Motion passed on 3:1 vote, Commissioner Wozniak voting NO. Motion passed on a 4:0 vote. MOTION(t): Moved by Commissioner Wozniak, seconded by Commissioner Butcher that at the end of cul -d -sac at "A" Street open space be provided and maintained by the developer for one year for evaluation of access parcel. Motion passed on a 4 :0 vote. MOTION(u): Moved by Commissioner Lawrason, seconded by Commissioner Butcher to recommend to the City Council that they consider walkways and access from park sites with the review of the Community Development Department, Sheriff, and City Engineer. Motion passed on a 4:0 vote. MOTION(v): Moved by Commissioner Lawrason, seconded by Commissioner Butcher to recommend approval of TR -4338 as modified to the City Council. General Plan Update City of Moorpark General Plan Update to the Land Use and Circulation (traffic) Elements of the General Plan. Presented by Director Pat Richards. Reference; staff report dated November 12, 1987. The Commission last considered the update to the Land Use and Circulation Elements of the General Plan at their meeting of October 5, 1987. Within the staff report are listings regarding those areas which the Department of Community Development and Public Works feel merit consideration towards placement on an Request for Proposals. These listings are intended to be a starting point for discussion and are not all inclusive. Options to the Commission at this time are to continue the scoping process and request additional information from the public and staff. Second, close the scoping process and consider the Land Use and %— Circulation requests for their merit. Adoption of project goals in this way the scope of work could be narrowed. Once the project goals have been formulized, the commission should consider the work task listing prepared by staff. Lastly, specific consideration should be given to those requested land use and circulation changes made by property owners. Testimony received by the following: 1. Mr. A. A. Milligan, 143 N. MOTION(w): Moved by Commissioner Lawrason, seconded by Commissioner Butcher to approve as submitted the Scope of Work for Land Use Element Update. Motion passed on a 4:0 vote. Scope of Work for Land Use Element Update 1. Lot by lot land use inventory in a form for easy conversion to a geotechnical base system. Identify Residential, Commercial, and Industrial reserve areas in outlying areas. 4. Create goals and policies regarding future hillside development. 5. Create standards for recreation services. 6. Identify potential rental and senior housing sites. 7. Create goals and policies related to the need to protect the visual freeway corridor (118/23 Freeway Connector). 8. Create goals and policies which will ensure that site planning and design of development respects the predominantly low profile suburban environment of Moorpark and enhances and respects the surrounding natural features. 9. Identify the natural features within and adjacent to the community that need to be protected. 10. Create an urban limit line considering both the non - growth areas of the Countywide Planning Program (CPP) and the city's need to provide buffers or transitional zones. 11. Establish city gateways and identify land uses to promote that identity. 12. Create a document(s) that can be used and an effective tool to update the city's zoning ordinance. 13. Prepare studies of the existing or future population density patterns within the city. Empresses must be places on those areas either designated for redevelopment or high - growth potential. 14. Prepare a report which will provide projections of those elements, such as population, income and employment which will forecast the land required, public facilities needed and future distribution of land uses through the year 2000. 15. Create goals and policies regarding the extension of public services in areas which provide significant natural constraints to development. 17. The design of commercial areas should complement the area in which it is located. Create design overlay areas with specific goals and policies related to development. 18. Create goals and policies related to obtaining an overall 85% / 15% single family /multi - family mix based on housing units. 19. Create goals and policies related to minimum parcel sizes in open space and areas over 20% slope (such as 40 acres). 20. Create goals and policies which promotes agricultural uses in those areas over 20% slope. 21. Identify major ridge lines within the community. 22. Create goals and policies to preserve and protect features of cultural and historical significance to the community. 23. Create goals and policies to save and protect mature trees within the community. 24. Create goals and policies related to the need to adopt guidelines to mitigate the impact of exterior lighting on adjoining parcels and adjacent public right -of -way. 25. Review land use designations in light of service capacity of various infrastructure systems (sewer, waste, streets, storm drains, flood control, etc.). 26. Review and incorporate applicable and appropriate sections of the county of Ventura's General Plan. 27. Need to consider maintenance of the document after adoption - consider computer applications. 28. That the Land Use and Circulation amendments shall be internally consistent with all other elements of the General Plan. 29. Land Use Element - Incorporate any Measure F requirements criteria, standards. 30. Infrastructure - Identify current infrastructure limitations as to how development would be limited by infrastructure expansion capability. Downtown Plan - Incorporate, land use issues, goals, design standards, parking in downtown areas - in lieu fee concept - identification of potential parking areas. 32. County Plans - (see p. 8 No. 4 in existing Moorpark Land Use Element) - make certain that Moorpark Land Use Element is consistent with and takes into account any other applicable. 33. Individual Areas of Concern a. South of Los Angeles Avenue from Moorpark Road to Liberty Bell Road. b. Multiple family residential south of Majestic Court. c. Commercial office designation for southwest corner of Los Angeles Avenue and Moorpark Road. Is it still valid? d. Alan Robins property? e. Freeway Business Center (Science Drive). Some of the text and maps in the current Land Use Element show this area as either open space, or "non- growth ". Make sure this area is appropriately indicated in the new Land Use Element. f. Happy Camp Canyon Park - show precise boundaries. 34. Incorporate all present GPA's into new Land Use Element Map and Text Amendments. 35. Land Use Element, page 41 Commercial - do we want to change "Neighborhood Commercial Center - pertinent - Convenient Market ?" 36. Land Use Element, page 42 - Existing section on Commercial Industrial mix. Is it still. valid. Perhaps the downtown plan will propose something else. 37. Land Use Element, page 42 - Growth Tables population projections need to be revised. 38. Land Use Element, page 57 - Table 9 Zoning Compatibility Matrix - Any revision necessary? MOTION W: : Moved by Commissioner Butcher, seconded by Commissioner Lawrason to approve the Scope of Work for r Circulation Element Update with modification to No. 16 of the City Engineer's staff report dated October 26, 1987, Planning Co®ission, City of Moorpark, California Minutes of November 16, 1967 Kama 12 DRAFT SCOPE OF WORK 1. The potential impact of the 118/23 Freeway connection, as quantified by street and intersection levels of service. It is anticipated that the primary circulation element scenario will be general plan buildout, with a second scenario based on all development preceding the Freeway connection. 2. Estimated volumes of "pass through" traffic, i.e. that traffic with both trip ends outside of the City. Ideally, these estimates should include the pass through traffic on Route 118 as well as the pass through traffic on Route 23. 3. Analysis of the effects of the extension of New Los Angeles Avenue to Collins Drive. In conjunction with this analysis, comments should be offered regarding the justification of downgrading the Los Angeles Avenue width requirements through the Virginia Colony area. 4. Analysis of the effect of the extension of High Street westerly from its existing terminus to Gabbert Road north of the railroad. 5. Recommended alignment of a new Route 23 to extend from the Freeway connection northerly to Broadway. The effects of this bypass construction should also be analyzed. 6. Recommended alignment and analysis of the effect of extending Moorpark Road northerly from High Street to Broadway. 7. Recommended location of the future 118 Freeway ramps in the vicinity of Gisler Avenue. 8. Number of lanes required and street section recommendations for arterials, secondaries, and collector streets. 9. Specific plan recommendation for area bounded by Los Angeles Avenue, Arroyo Simi, Maureen Lane, and Liberty Bell Road. 10. Recommended locations of traffic signals. 11. Major intersection estimated level of service for each of the following scenarios: :^ Plannina Commission, City of Moorpark, California Minutes of November 16, 1987 aae 13 12. Recommended changes to bicycle /pedestrian /equestrian plans. 13. Recommended policies regarding driveway placement, stop sign installation, parking restrictions, inter- section sight distance, meandering sidewalk, unobstructed sidewalk, etc. 14. Revisions to County road plates to provide for bike lanes. 15. Standard intersection plates that show required con- figuration for different types of intersections such as primary - primary, primary - secondary, secondary-collect - or, etc. 16. Analysis of the effects of the extension of the Route 118 Freeway west of the Route 23 Freeway. 17. Analysis of the effect of constructing an east -west street south of Broadway and north of the Route 118 extension west of Princeton Avenue. 18. Motion passed on a 4:0 Vote MOTION(z): Moved by Commissioner Wozniak, seconded by Commissioner Lawrason that the following list of goals be adopted: 1. To assure complete compliance with State law, case law, and General Plan Guidelines. 2. To update, complete and synthesize planning documents into a consistent, comprehensive usable document. 3. To propose growth and development policies for the hillside areas within the General Plan. 4. To provide a comprehensive General Plan Update that is usable in daily planning activities. 5. To recommend and develop specific and realistic objectives, policies, programs and standards for planning and physical development of the city, and for creating a viable economic base and new revenue sources. 6. To graphically display each of the General Plan Land Use and Circulation Elements. 7. To create a computerized base data system. Motion passed on a 4:0 vote. S.
