CALL TO ORDER The meeting was called to order by Vice Chairman Scott Montgomery; the time being 7:20 p.m. Chairman Holland arrived at 7:30 p.m. 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Vice Chairman Montgomery. 3. ROLL CALL PRESENT: Commissioners Scott Montgomery; William Butcher; John Wozniak; Paul Lawrason; Chairman Douglas arriving at 7:30 p.m. I-- ABSENT: None. OTHER CITY OFFICIALS AND EMPLOYEES PRESENT: Patrick J. Richards, Director of Community Development; Michael A. Rubin, Senior Planner; John F. Knipe, Assistant City Engineer; Fred Talarico, Sanchez Talarico Associates, Inc. (representatives .1017 DP -302); Jaime Maldonado, Assistant Planner, Sanchez Talarico Associates, Inc. (representatives for DP -302); and Celia LaFleur, Administrative Secretary. 4. PUBLIC COMMENTS None. 5. APPROVAL OF MINUTES None. 6. CONSENT CALENDAR None. Planning Commission, City of Moorpark, California Minutes of January 4, 1988 Page 7. PUBLIC HEARINGS (Old Business) A. Development Plan Permit No. 302 - Major Modification , Peter Sturdivant, Structural Conceits LInc.(continued from 12/7/87) The proposed facility is an additional 121,520 sq.ft. building used for office, manufacturing, and warehouse uses. The company manufactures swimming pool equipment and accessories. Located along Highway 118 (Los Angeles Avenue), nearest cross street Gabbert Road; Moorpark, CA. Jaime Maldanado representing the applicant gave a brief overview of the project status and of the remaining issues of concern related to lighting plan; flood control channel; that a decelleration lane be provided. Testimony received by the following: 1. Thomas Nelson, 688 N. Auburn Circle, Moorpark, Ca. Representing Structural Corcepts of California, Inc. referred to his letter dated December 24, 1987 of proposed changes to the project conditions and referred to his letter dated December 24, 1987 and also addressed the following concerns: A. Flood control channel to remain as is with no additional improvements. (Estimated cost for additional improvements - 2.5 million dollars and a cost of 40,000 dollars has already been provided for the rework of the flood control channel.) B. Reduction in sidewalk from 8 to 4 feet to provide mounding. C. City Engineer Condition No. 105, page 14 necessary improvement to L.A. Avenue, and the Walnut Canyon to provide a 12 foot wide, 300 foot long westbound right turn lane east of Montair Drive. 2. Dan Kennedy, Toler & Associates, Inc. 1115 Avenida Acaso, Suite G, Camarrillo, CA. A detailed presentation was presented to the Commission concerning lighting ratios, candle illumination, light spillage on to the adjacent 118 Highway, light fixtures, pole fixtures and heights. 3. David Sargent, Rasmusen & Associates 248 S. Mill Road, Ventura, CA Referenced Condition Nos. 106, 107 & 108 and informed the Commission that access to the parcel had been provided with front and rear dedication for access to the east adjacent parcel Planning Co®ission, City oi` Moorpark, California Minutes of January 4, 1988 Page 4. Jim McGrath, J.D. McGrath Farms, 11015 L.A. Avenue, Moorpark, CA Rear property owner to the north stated that the rear access had been completed to his satisfaction but that their would always be a problem with left turn movements on to the 118 Highway. 5. Brook Luke, 4755 No. Buttercre.ek Road, Moorpark, CA Address the following concerns: A. Should there be any concerns of the occupant using hazardous waste materials, solvents and dumping, spillage? B. The possibility of American Products meeting with the adjacent homeowners to address concerns in detail. Mr. Blum cordially accepted. 6. Paul Blum, KDI American Products, 51-804 Majestic Court, Moorpark, CA Informed Ms. Luke of American Products years of compliance with Environmental Health requirements and how American Products would counteract to any hazardous materials spillage. 7. Michelle Redling, Moorpark resident also addressed the concerns of a 24 hour mill operation, noise impact. Tom Nelson then referred Ms. Redling to American Products condition compliance with Condition No. 44, page 6. PUBLIC HEARING CLOSED AT 8:47 P.M. Motion: Moved by Chairman Holland., second by Commissioner Butcher that Condition No. 34, page 5 be modified to read: That the preliminary site plan and landscape plan be redesigned to the satisfaction of the Director of Community Development, City Engineer and Ventura Flood Control District. Such changes may include reducing sidewalk from eight (8) feet to five (5) feet, mounding from curb line to channel wall, altered landscape design, and reduced height of the wrought iron fence. Also, that the cost for undergrounding be included within the contribution to the Area of Contribution Fund. Motion passes on a 5:0 vote. Motion: Moved by Chairman Holland, seconded by Commissioner Wozniak that Condition No. 36 be modified to include Traffic mitigation fees shall execute covenant and landscape fee or cost for improvements along Los Angeles Avenue. Motion passes on a 5:6 vote. Planning Commission, Citv of Moorpark, California Minutes of January 4, 1988 Page 4 Motion: Moved by Chairman Holland, seconded by Commissioner Wozniak that Condition No. 93 be redrafted to be consistent with Condition No. 34 which reads: That the preliminary site plan and landscape plan be redesigned to the satisfaction of the Director of Community Development, City Engineer and Ventura County Flood Control District to underground and cover over the flood control channel. Also, that the cost for undergrounding be included within the contribution to the Area of Contribution Fund. Motion passes on a 5:0 vote. Motion: Moved by Chairman Holland, seconded by Commissioner Wozniak to modify Condition No. 24.f. to read as follows: Condition No. 24.f Average maximum of one-half candle illumination. and to include an additional. condition to read as: Condition No. 24.g. Light fixtures adjacent; to residential areas shall be provided with a house size shield. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Montgomery second by Commissioner Lawrason that Condition No. 43 be deleted. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Montgomery second by Commissioner Butcher that Condition Nos. 95 and 101 be deleted. Motion passed on a 5:0 vote. Motion: Moved by Chairman Holland seconded by Commissioner Montgomery that the area south of Los Angeles Avenue, west of the Buttercreek tract be designated by the City as single family residential reserve area on the City's Land Use Map. Also, that the residential reserve be place on this area if and when it comes out of agricultural reserve. Motion passed on a 5:0 vote. B. Appeal No. 18 Planned Development Permit No. 1066 - Leonard Liston (continued from 12/7/87) Requesting approval of revised planned development to construct a full service car wash facility and 7,000 sq.ft. automotive service center. Located on the west side of Park Lane Avenue approximately 130 feet south of Los Angeles Avenue. Motion: Moved by Chairman Holland seconded by Commissioner Montgomery that Condition No. 2.a. remain and the replacement value of dollars worth of trees being removed be reevaluated by and determined by the Director of Community Development. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Montgomery seconded by Commissioner Butcher that parking spaces shall be determined as one per 300 square feet of gross floor area and one per each service bay be allowed as parking spaces. Motion passed on a 4:1 vote. Chairman Holland voting N0. Motion: Moved by Commissioner Montgomery seconded by Commissioner Butcher to approve as recommended and modified. Motion passed on a 5:0 vote. A. Appeal 19 Planned Development. No. 1048 Colin Valazguez Directors decision regarding Planned Development Permit No. 1048 - Condition No. 3 of Resolution No. PC- 85 -73. The applicant had appealed the Directors decision to deny a time extension regaring PD -1048 because of a lack of diligent effort on the part of the applicant. Motion passed on a 5:0 vote. B. Appeal No. 1 (Administrative Determination) - Roy Hamamura An appeal of an Administrative Determination regarding a City Zoning Violation at 4661 Adonis Place. The violation involves the storage of a boat and boat trailer in the required yard area. At the request of Mr. Brent Vallens, Attorney for Mr. Hamamura the Commission continued this matter to their first meeting in February (2/25/88). Mr Hamamura intends to build a garage to house the boat in question if access can be gained on Vista Del Valle. 9. PLANNING COMMISSION ACTION ITSN,S A. Tentative Point Ranking Residential Development Management Svstem - Vesting Tentative Tract Map Nos. 4340, 4341, 4342 and 4338 Under Section 7 of Resolution No. 87 -421 a Tentative Point Rating is to be given to a residential project in conjunction with the entitlement review. The Commission on a 4:0:1 vote assigned the following tentative point rating to the above tracts. Commissioner Butcher excused due to possible conflict of interest. Tract Points Available Points Percentage 4338 133 160 83.1 4340 142 160 88.8 4341 142 160 88.8 4342 142 160 88.8 The only change the Commission made to staff's recommended points was to increase b -6 Water Conservation (Chart B) from 5 to 7 points. The reason was the generally high points given by the Council on past projects recently granted allotments in this area. West Village RPD's - Final Design Approval Tracts 4340, 4341 and 4342 This item is being returned to the Planning Commission for final resolution of detailed design considerations (buildings, common open space, recreational facilities, walls and fences including materials and colors, etc.). The Commission approved the elevations submitted without much comment. The recreation areas were also approved with a condition added to screen pool equipment when visible from second story windows. The bus stop structures were also revised as follows: Motion: Moved by Commissioner Montgomery seconded by Commissioner Wozniak that the roof material for each bus stop should match the material of adjacent units. Motion passed on 4:0:1 vote, Commissioner Butcher excused due to possible conflict of interest. Motion: Moved by Commissioner Montgomery seconded by Commissioner Wozniak that there be more variety in the design of the buildings. Motion passed on 4:0:1 vote, Commissioner Butcher excused due to possible conflict of interest. Motion: Moved by Commissioner Montgomery seconded by Commissioner Lawrason that regarding fences and walls staff was directed to review the final plan for their comment. Motion passed on 4:0:1 vote, Commissioner Butcher excused due to possible conflict of interest. 10. INFORMATION ITEMS None 11. COMMISSION COMMENTS Chairman Holland requested that the City Engineer check the left turn signal at Los Angeles Avenue due to the fact that it was not visable from both lanes. Commissioner Wozniak requested that Code Enforcement or the Sheriff's Department field check the "For Sale" cars at Spring Road and Peach Hill Road.
