MINUTES OF FEBRUARY 16, 1988
The regular scheduled meeting of the Planning Commission held on
February 16, 1988 in the City Council Chambers located in the Community
Center at 799 Moorpark Avenue, Moorpark, CA 93021.
1. CALL TO ORDER
The meeting was call to order at 7:25 p.m., Vice Chairman Scott
Montgomery presiding.
2. PLEDGE OF ALLEGIANCE
The pledge of allegiance led by Vice Chairman Montgomery.
3. ROLL CALL
PRESENT: Vice Chairman Scott Montgomery, Commissioner's
William Butcher; John Wozniak; Paul Lawrason.
ABSENT: Chairman Douglas Holland, with cause.
OTHER CITY OFFICIALS AND EMPLOYEES PRESENT:
Patrick J. Richards, Director of Community
Development; John Knipe, Assistant City Engineer;
Mark Wessel, Traffic Engineer; Michael A. Rubin,
Senior Planner; and Celia La Fleur, Administrative

4. PUBLIC COMMENTS
None.
5. APPROVAL OF MINUTES
Motion: Moved by Commissioner Butcher, seconded by
Commissioner Lawrason to approve the minutes of
February 1, 1988 as submitted.
Motion passed on a 4:0:1 vote.
6. CONSENT CALENDAR
A. Development Plan Permit No. 320, 321 and _322SF.E. Financial)
Condition Compliance No. 13 of Resolution Nos. 86 -298, approved
April 21, 1986; PC- 86 -89, approved February 26, 1986; and
86 -299, approved April 21, 1988.

Motion: Moved by Commissioner Wozniak, seconded by
Commissioner Lawrason to approve staff
recommendation to approve the building exterior colors
and materials.
Motion passes on a 4:0:1 vote.
PUBLIC HEARINGS (Old Business)
A. Planned Development Permit No. 1068 - Richard Hart
Requesting approval to construct an 4,800 square foot automotive
repair facility on a 15,186 sq.ft. site. South side of Los
Angeles Avenue approximately 170 feet east of Spring Road.
Continued from November 2, 1987
Presented by Senior Planner Rubin, reference: Staff Report dated
2/16/88.
This item was continued from the Commission's November 2, 1987
meeting. The applicant consented to a time extension to this date.
The purpose of this continuance was to allow sufficient time for the
draft Downtown Plan to be prepared and for City review of the
plan. The applicant has also reviewed pertinent sections of the plan
and has prepared a set of revised elevations that conform to the
western style of architecture advocated by the draft plan. Although
the plan is still in the draft stage, and not yet an adopted, legal
document, there seems to be a fair amount of concurrence with the
content of the plan at this point.
Testimony received from the following:
Lillian Hart, 17827 Ridgeway Road, Granada Hills, CA.
Spoke in support of the development. Gave the Commission
the background of the purchase of this particular parcel
which is zoned for the applicants intent and use for
development.
2. Joy Vincioni, 11913 Maplecrest Street. In support of the
development and prospective occupant. Stated Mr. Hart's
attempts with adjacent property owners for joint driveway
to be provided.
3. Andy Vincioni, 11913 Maplecrest Street. Prospective tenant
and current owner of a transmission service facility and is
relocating his business to Moorpark providing this
development receives the Commission's approval. Informed
the Commission of being in business for the past five years
and had never received a complaint of excessive noise from
the surrounding (adjacent) property owners.

4. Richard Hart, 17827 Ridgeway Road, Granada Hills, CA
The applicant was brief in describing the revision made to
the current site plans and in his attempt for joint access
with adjacent property owners and their replay was
negative. Concurred with the additional Community
Development Conditions.
PUBLIC HEARING CLOSED AT 8:05 P.M
The Commission expressed the following concerns:
a. Utility pole and the relocation should the property
owner concur with the joint driveway.
b. Traffic circulation.
C. Parking requirement satisfied.
d. Signage proposed.
e. Meandering sidewalks
The Director stated that the parking requirements had been met;
presently no requirements for meandering sidewalks; signage will be
reduced to accommodate the Downtown Plan style, lighting, lettering,
size reduction and placement only above the service bay areas; 30
foot setback would allow for future development.
Motion: Moved by Commissioner Butcher, seconded by
Commissioner Lawrason to delete Item K. of Page 8 as
follows:
The applicant shall obtain access to his property from
the property to the west. The intent of this
condition is to limit the number of access points to
Los Angeles Avenue. A new site plan showing the
revised access shall be submitted to the Director of
Community Development and City Engineer for
approval."
".......and that Planned Development Permit No. 1068
be approved as recommended by staff with the deletion
of Item K. Page 8 of the City Engineer Conditions
dated for the Commission meeting of October 19, 1987.
Motion passed on a 4:0:1 vote.
Mr. Hart agreed to a time extension until the Commission's meeting of
March 7, 1988 in order that the resolution of approval may be acted
upon.

8. PUBLIC HEARINGS (New Business)
A. Vesting Tentative Parcel Map No. 4318 - Robert L. Falke
Requesting approval to subdivide an existing 39.9 acre parcel
into four proposed parcels of 16.9; 6.8; 10.0 and 6.2 acres
respectively in a hillside area.
Located at Gabbert Road approximately 2/3 mile north of
Poindexter Avenue.
Presented by Senior Planner Rubin, reference: Staff Report dated
February 16, 1988.
Assistant City Engineer Knipe then proceeded to inform the
Commission of the additional paragraph to be added to City Engineer
Condition No. 28 which reads as follows:
"Additional land shall be offered for dedication as necessary such
that the minimum width of the dedication is 60 feet throughout the
entire length of this easement."
Testimony received by the following:
1. Les Kovacs, Kovacs Engineering 165 E. High Street,
Moorpark, CA. Representing the applicant and had the
following concerns:

Requested that "....and sewer.." be deleted.
Page 3 - Ventura County Fire Department Condition No. 42
Second paragraph "Prior to combustible construction on any
parcel, the water mains shall be extended to within 250
feet of the building site."
Requested that 250 be modified to 500.
Page 7 - City Engineer Condition No. 32
Modified to read at the time of grading permit.

Motion: Moved by Commissioner Montgomery, seconded by
Commissioner Lawrason to amend the following
conditions to read as follows:
Page 1 - Community Development Department
Condition No. 9
"No zoning clearance shall be issued for
residential construction for more than one (1)
dwelling unit until the Final Map has been recorded.
Prior to construction ........
Page 2 - Community Development Department
Condition No. 11
"An "Unconditional Will Serve" letter for water
and sewer service shall be obtained from Ventura
County Water Works District No. 1 or that the
applicant shall have satisfied all requirements of the
Ventura County Water Works District No. 1.
Delete "....and sewer.."
Page 4 - City Engineer's Condition No. 18
The applicant shall deposit with the City of
Moorpark a contribution for the Los Angeles Avenue
Improvement Area of Contribution.
The actual deposit shall be the then current Los
Angeles Avenue Improvement Area of Contribution
applicable rate prior to approval of thejinal map.

Motion: Moved by Commissioner Lawrason, seconded by
Commissioner Montgomery to condition VTPM -4318 that
grading for future pad locations shall be arranged so
tha, generally, areas of 20% slope or greater are not
proposed to be graded. The grading plan shall be
approved by the City Engineer and the Director of
Community Development.
Motion passed on a 4:0:1 vote
With the concurrance of the applicant and the Commission a time
extension will be provided for this item to return with a resolution
of approval at the Commission's meeting of March 7, 1988.
Motion: Moved by Commissioner Wozniak, seconded by
Commissioner Lawrason to approve staff
recommendation to:
1. Approve the attached Negative Declaration as
having been completed in compliance with State
CEQA Guidelines. As part of its approval, the
Planning Commission has reviewed and considered
the information contained in the Negative
Declaration.
2. Make the following findings:
a. The proposed subdivision is consistent with
the City's zoning ordinance.
b. The proposed subdivision together with the
provisions for its design and improvements
is consistent with the City's adopted
General Plan.
C. The subdivision is compatible with the
objectives, policies and uses specified in
the General Plan.
d. The Planning
Commission has
considered the
effect of its
action upon he
housing
needs
of the region
and has balanced
these
needs
against the
public service
needs
of its
residents and
available
fiscal
and
environmental
resources.
3. Direct staff to prepare a Resolution No.
PC -88 -163 conditionally approving Vesting
Tentative Parcel Map No. 4318, for consideration
at its next regular meeting of March 7, 1988.

Final Disposition:
Pursuant to Resolution No. 86 -276, this entitlement is for a
tentative parcel map. Therefore, the Planning Commission has
final approving authority, unless appealed to the City Council.
B. Tentative Parcel Map No. 4278 - Abe Gum
Requesting approval to subdivide an existing 64.75 acre parcel
into three proposed parcels of 21.5; 22.9 and 21.1 acres
respectively in a hillside area.
Located on Walnut Canyon Road, east side, south of north City
limits.
Presented by Senior Planner Rubin, reference: Staff Report dated
February 16, 1988.
Testimony received by the following:
1. Abe Guny, 18311 Sherman Way, Reseda, CA. 91335.
2. William La Perch, 7200 Walnut Canyon Road, Moorpark,
CA Concerned with access easement description for the
access road from Walnut Canyon Road to Parcels 1, 2 and 3.

Moorpark, CA. Applicant's representative.
Motion: Moved by Commissioner Montgomery, seconded by
Commissioner Butcher to amend the following condition
to read:

Revised City Engineer Condition No. 18
Prior to recordation, if access is obtained via
adjoining property the applicant shall submit to the
City of Moorpark for review and approval by the City
Engineer and Director of Community Development, a
full and complete access easement description for the
access road from Walnut Canyon Road to Parcels 1, 2,
and 3. This access easement must be completely
within the parent parcel, or an easement obtained from
the adjacent landowners whose land is traversed. The
improvement plans for the access road shall
demonstrate that adequate sight distance from the
access road onto Walnut Canyon Road is available.
