CALL TO ORDER The meeting was called to order at 7:08 p.m., Chairman Douglas Holland presiding. 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Chairman Holland. 3. ROLL CALL PRESENT: Chairman Douglas Holland, Vice Chairman Scott Montgomery, Commissioner's William Butcher; Paul Lawrason. ABSENT: Commissioner John Wozniak with cause. OTHER CITY OFFICIALS AND EMPLOYEES PRESENT: Patrick J. Richards, Director of Community Development; Michael A. Rubin, Senior Planner; John Knipe, Assistant City Engineer; and Celia La Fleur, Administrative Secretary. 4. PUBLIC COMMENTS Connie Lawrason, 4291 Ambermeadow Street, Moorpark, CA Spoke on behalf of the Citizens Transportation Advisory Committee in reference to Item 10.A of this agenda regarding Sidewalks Along High Street. Stated that the City's share of the proposed funds would be 49,008.00. 5. APPROVAL OF MINUTES April 4, 1988 Motion: Moved by Commissioner Butcher, seconded by Commissioner Montgomery to approved the minutes of April 4, 1988 with a revision to motion #3 of Item 8.A to reflect motion approved by a "4:0 vote, Commissioner Butcher voting NO." Motion passed on a 4:0 vote, Commissioner Wozniak absent. -1- 6 8 I` MOORPARK PLANNING COMMISSION City of Moorpark, California Minutes of April 18, 1988 CONSENT CALENDAR A. APPROVAL OF RESOLUTION NO. PC -88 -171 RECOMMENDING TO THE CITY COUNCIL DENIAL OF PLANNED DEVELOPMENT PERMIT NO. 1062 MAJOR MODIFICATION NO. 1 (EMBASSY PLAZA NO. 16) Request of an additional 7,886 sq.ft. free - standing building in place of 2 smaller free - standing buildings. Located on the northwest corner of Spring Road and Tierra Rejada Road. This item held over until later in the agenda. PUBLIC HEARINGS (Old Business) None PUBLIC HEARINGS (New Business) A. PC -3 MAJOR MODIFICATION NO. 2 URBAN WEST COMMUNITIES Request to delete a condition of approval which requires completion of the Tierra Rejada bridge prior to occupancy of the 1,231st dwelling unit. Location, all of Mountain Meadows The City Council at their meeting of April 13, 1988 determined that the applicant need not process a major modification so as to amend the unit occupancy limit imposed under Resolution No. 85 -246 and took action to adopt a resolution to amend Resolution No. 85 -246 to that effect. The City Council directed the Planning Commission not to hear the Major Modification request at their April 18, 1988 public hearing. Although the Council directed the Commission not to hear the matter; staff suggested that the Commission formally request the applicant to withdraw his request. Testimony received by the following: Tom Zanic, representing Urban West Communities, 520 Broadway, Santa Monica, CA Officially withdrew the request for a major modification to Planned Community No. 3. Geret N. Kritzel, 12794 Summer Street, Moorpark, CA Referenced his letter to the Planning Commission dated April 11, 1988 related to on going moisture problems in the Urban West homes and yards and Urban West Communities unwillingness to respond to inquires in relation to the moisture problems. -2- MOORPARK PLANNING COMMISSION City of Moorpark, California Minutes of April 18, 1988 It was the general consensus of the Commission that the home owner address his concerns to the developer and referred Mr. Kritzel to the City Engineers office to review geological or soils reports related to the issue at concern. B. PARCEL MAP NO. 4449 - LAWANDA J. REED Request to subdivide an existing residential parcel so as to create individual parcels for each of 2 existing dwelling units. Located at 60 and 80 Fremont Street. Presented by Senior Planner; reference: staff report dated April 13, 1988. Testimony received by the following: Phyllis Anderson, representing the applicant, 2897 Circle View Drive, Simi Valley, CA 93065. Referenced Condition No. 9 which related to Los Angeles Avenue Improvement Area of Contribution applicable rate. Her request to the Commission was to waive this condition due to the fact that the only change that will occur would be to construct a garage, and in general everything would remain the same. Chairman Holland directed staff to inquire with the City Attorney as to the legality of Condition No. 9, 10, and 11 of Parcel Map No.4449. Condition No. 9 relates to the applicant shall deposit with the City of Moorpark a contribution for the Los Angeles Avenue Improvement Area of Contribution. Condition No. 10 relates to the applicant shall executing a covenant running with the land on behalf of itself and its successors, heirs, and assigns agreeing to participate in the formation of an assessment district or other financing technique including, but not limited to, the payment of traffic mitigation fees, which the City may implement or adopt, to fund public street and traffic improvements directly or indirectly affected by the development:. Condition No. 11 relates to the applicant shall executing a covenant running with the land on behalf of itself and its successors, heirs, and assigns agreeing to participate in the formation of an assessment district or other financing technique to fund public storm drain improvements along and south of Fremont Drive, as shown in the Moorpark Central City Master Drainage Study. -3- MOORPARK PLANNING COMMISSION City of Moorpark, California Minutes of April 18, 1988 PUBLIC HEARING CLOSED. Motion: Moved by Commissioner Butcher, seconded by Commissioner Lawrason to approve Parcel Map No. 4449 as recommended by staff subject to the City Attorney's reply regarding Condition Nos. 9, 10 and 11. This item will return to the Commission on May 5, 1988 to consider the adoption of a resolution approving Parcel Map No. 4449. Motion passed on a 4:0 vote, Commissioner Wozniak absent. C. IPD -88 -1, CUP -88 -1 AND V -88 -1 - MIKE & ROBIN HOROWITZ Industrial Planned Development Permit for an 8,486 sq.ft. A Conditional Use Permit for an Industrial Vehicle Service Center, and Variance for a smaller loading zone than required. Located on Fitch Avenue, north side, 85 feet west of Flinn Avenue. Presented by Senior Planner Rubin, reference: staff report dated April 13, 1988. The Senior Planner referenced the following conditions to be modified. Condition No. 20 - Page 12 Trash disposal areas shall be provided in locations which will not interfere with circulation parking or access to building, and shall be screened with a six (6) foot high solid wall enclosure with metal or wooden gates. Final design of said enclosure shall be subject to the approval of the Director of Community Development. Condition No. 23.b For all exterior lighting, a lighting plan shall be prepared by an electrical engineer registered in the State of California and submitted to the Department of Community Development for review and approval. The lighting plan shall achieve the following objectives: Avoid interference with reasonable use of adjoining properties; minimize on -site and off -site glare; provide adequate on -site lighting; limit electroliers' height to avoid excessive illumination; provide structures which are compatible with the total design of the proposed facility. These plans shall include the following: a. A photometric plan showing a point by point foot candle layout to extend a minimum of twenty (20) feet outside the property lines. Layout plan to be based on a ten (10) foot grid center. * b. Maximum overall height of fixtures shall be not more than fourteen- (14) twenty Feet in or adjacent to residential areas and not more than twenty (20) feet in non - residential areas. -4- MOORPARK PLANNING COMMISSION City of Moorpark, California Minutes of April 18, 1988 c. Fixtures must possess sharp cut -off qualities at property lines. d. There shall be no more than a seven to one (7:1) ratio of level of illumination shown. (Maximum to minimum ratio between Lighting Standards). e. Energy efficient lighting fixtures which are compatible with adjacent commercial lighting to the north and east. f. Minimttm Maximum of one-foot candle illumination. Added condition: * g. All exterior lamps shall be of low pressure sodium vapor lamps. Deleted Condition No. 19 - Page 11: (this condition appears under the City Engineer's conditions no. 49. The following condition to be numbered 43.13 The applicant shall demonstrate for each building pad to the satisfaction of the City of Moorpark as follows: a. Adequate protection from 100 year frequency storm; and b. Feasible access during a 10 year frequency storm. Hydrology calculations shall be per current Ventura County Standards. Hours of operation shall be limited to 6- 99- A. -M7 -to 7-:0(}f:M. 7:00 a.m. to 6:00 p.m. Monday through Saturday. Delete Condition No. 27 - which appears under Community Development Department Conditions No. (appears under City Engineer Conditions No. 45). Testimony received by the following: John Ennis, Ennis Realty & Investment Co., 31840 Village Center Road, Westlake, CA. Representing the applicant made reference to Condition Nos. 10, 13, and 19 which are as follows. -5- MOORPARK PLANNING COMMISSION City of Mborpark, California Minutes of April 18, 1988 Condition No. 10 The permittee agrees as a conditions of issuance (or removal) and use of this permit to defend, at his sole expense, any action brought against the City because of issuance (or renewal) of this permit or, in the alternative, in relinquish this permit. Permittee will reimburse the City for any court costs and /or attorney's fees which the City may be required by a court to pay as a result of any such action. The City may, at its sole discretion, participate in the defense of any such action, but such participation shall not relieve permittee of his obligations under this condition. Condition No. 13 The conditional use permit shall be reviewed by the City ten years from the date of City approval. At that time the permit shall be reevaluated for another ten year period. The purpose of this review shall be for determining the consistency in adherence to the conditions of approval. At the ten year review period the Director of Community Development shall determine if a ten year extension is warranted. The permit shall expire ten years from the date of City approval, unless a time extension is approved and granted by the Director of Community Development. Condition No. 19 The applicant shall prior to the issuance of a zone clearance execute a covenant running with the land on behalf of itself and its successors, heirs and assigns agreeing to participate in the formation of and be subject to any assessment district or other financing technique including but not limited to the payment of traffic mitigation fees, which the City may implement or adopt, to fund public street and traffic improvements directly or indirectly affected by the development. Traffic mitigation fees shall be used for projects in the Los Angeles Avenue Area of Contribution, such as, but not limited to, the extension of New Los Angeles Avenue. 2. Rick Harrell, Creative Structures, 717 Lakefield Road, Westlake Village, CA. Architect representing the applicant gave a brief overview of the development site, colors and materials. The applicant concurred with the Commission's concern to provide indoor vehicle repair only. PUBLIC HEARING CLOSED. Chairman Holland referenced the applicants concerns to Condition No. 10 by stating that this condition defends the sole interest of the applicant s and that the condition shall remain. Motion: Moved by Chairman Holland, seconded by Commissioner Montgomery to delete Condition No. 13. Motion passed on a 4:0 vote, Commissioner Wozniak absent. -6- MOORPARK PLANNING COMMISSION City of Moorpark, California Minutes of April 18, 1988 Motion: Moved by Commissioner Montgomery, seconded by Commissioner Butcher to delete Condition No. 19 from the Community Development Department Conditions and replace Condition No. 49 with the same language. All conditions to numbered consecutively. Motion passed on a 4:0 vote, Commissioner Wozniak absent. Motion: Moved by Commissioner Montgomery, seconded by Commissioner Lawrason to condition the applicant to "All delivery vehicles of 3 or more axles are not permitted ". Motion passed on a 4:0 vote, Commissioner Wozniak absent. Motion: Moved by Commissioner Montgomery, seconded by Commissioner Lawrason to approve staff's findings and showings and hereby approves IPD -88 -1, CUP -1 and V -88 -1 with the amended and deleted conditions and to direct staff to prepare one resolution of approval for the units of request. Motion passed on a 4:0 vote, Commissioner Wozniak absent. D. APPEAL NO. ZV -88 -1 - (HOME OCCUPATION PERMIT) NEBEKER Denial of a home occupation permit to conduct a dental lab at 13636 Shady Knoll Court, Moorpark in an RPD -4.5U zone. The Director of Community Development indicated that he had received a call from he applicant requesting continuance. Testimony received by the following: 1. Rick Nebeker, the applicant, 13636 Shady Knoll Court, Moorpark, CA. Requested that the Commission continue the hearing to May 16, 1988. The Commission concurred with the applicants request. Item 6.A Resolution No. PC -88 -171 presented out of order. Chairman Holland requested staff to correct Section 4 of the resolution relating to the Planning Commission's meeting of April 4, 1988. Motion: Moved by Commissioner Montgomery, seconded by Commissioner Lawrason to approved Resolution No. PC -88 -171 as corrected. Motion passed on a 4:0 vote, Commissioner Wozniak absent. -7- MOORPARK PLANNING COMMISSION City of I MIVahk, California Minutes of April 18, 1998 9. PLANNING COMMISSION ACTION ITEMS A. MULTIPLE PROCESSING OF PLANNED _DEVELOPMENTS ON A SINGLE LOT Presented by the Director, reference: staff report dated April 12, 1988. It was the general consensus of the Commission to direct staff to prepare a draft ordinance to amend the code to require entitlements requested to used a unified title and processed under one planned development. This item to be presented to the Planning Commission meeting of May 2, 1988. 10. INFORMATION ITEMS A. SIDEWALKS ALONG HIGH STREET - CONSTRUCTION STATUS Received and filed. 11. COMMISSION COMMENTS A. The Commission inquired as to the status of the Comprehensive Planning Ordinance and requested staff to provide a summary for the Commission's meeting of May 2, 1988. B. The Commission inquired as to the status of the Draft Downtown Plan. 12. STAFF COMMENTS None. 13.
