HomeMy WebLinkAboutMIN 1988 0516 PC REGMOORPARK PLANNING COMMISSION MINUTES OF: May 16, 1988 The regular scheduled meeting of the Planning Commission held on May 16, 1988 in the City Council Chambers of the Community Center located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER The meeting was called to order at 7:12, Chairman Holland presiding. 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by former Commissioner William La Perch. 3. ROLL CALL PRESENT: Chairman Douglas Holland, Vice Chairman Scott Montgomery, Commissioner's William Butcher, John Wozinak and Paul Lawrason; ABSENT: None. r" OTHER CITY OFFICIALS AND EMPLOYEES PRESENT: Patrick J. Richards, Director of Community Development; Michael A. Rubin, Senior Planner; John Knipe, Assistant City Engineer; Mak Wesell, Traffic Engineer and Celia LaFleur, Administrative Secretary. 4. PUBLIC COMMENTS None. 5. APPROVAL OF MINUTES Minutes of May 2, 1988 Motion: Moved by Commissioner Butcher, seconded by Commissioner Lawrason to approve the minutes of May 2, 1988 as submitted. Motion passed on a 5:0 vote. 6. CONSENT CALENDAR None. PCM5 /16 /PCAGENDA MOORPARK PLANNING COMMISSION MINUTES OF: May 16, 1988 7. PUBLIC HEARINGS (Old Business A. Appeal No. ZV -2 Rick Nebeker Director of Community Development decision to deny a Home Occupation Permit to conduct a dental lab (13636 Shady Knoll Court) within an RPD -4.5U zone. Staff informed the Commission of Mr. Nebeker's request to withdraw his appeal and that he had relocated his business to a commercial Westlake Village area. 8. PUBLIC HEARINGS (New Business) A. Comprehensive Planning Ordinance (Draft) Part 1 addresses the General Plan. It would require voter approval on any general plan amendment that involved the following: 1. Land of 100 acres or more. 2. Increase population by more than 350 people. 3. Add more than 1000 average daily vehicle trips. Part II requires the adoption of various ordinances. 1. Hillside, Ridgeline and Open Space Preservation Ordinance. 2. Development Standards Ordinance. This ordinance would address specific development and design standards for all projects. 3. The development of a comprehensive Traffic Management and Circulation Development Plan. This includes a mandate to maintain an LOS of "C ". 4. The establishment of additional greenbelts both east and west of the City. 5. Historical and significant tree preservation measures. Staff gave a brief summary of the draft CPO and explained various attachments provided by City staff. The Commission was presented with a copy of the Chamber of Commerce letter stating their opposition to the draft CPO. PCM5/16 /PCAGENDA MOORPARK PLANNING COMMISSION MINUTES OF: May 16, 1988 The Commission opend the public hearing and took testimony from the following: 1. Paul Tryon, representing the Building Industry Association, 751 Daily Drive, Camarillo, CA. Mr. Tryon was in opposition to the Comprehensive Planning Ordinance and felt that the CPO was a complex approach to planning and that the city should rely on researching, staff, consultants and the elected officials to provide comprehensive planning for the city. 2. Bob Crockford, 7189 Walnut Canyon Road, Moorpark, CA. Representing the Committee for Managed Growth spoke in favor to the CPO and felt that the residents be provided with this issue on the November ballot. 3. John Roberts, 14419 E. Loyola, M000rpark, CA. Expressed concern with the majority (residents south of Los Angeles Avenue) opinion in regards to the Campus Park residents and felt the ordinance would be unfair. 4. Bill La Perch, 7200 Walnut Canyon, Moorpark, CA. Representing the Committee to Preserve Rural Moorpark. In support of Part I of the CPO and GPA processing. 5. Jeff Obreumt, 13177 Sleepy Wind Street, Moorpark, CA. Stated that the priority should be of hillside ordinance, development standards, etc. 6. Paul Coyle, 15750 Los Angeles Avenue, #151, Moorpark, CA. Representing .the Villa del Arroyo Homeowners Association. Expresed concerns dealing with the expenses of implementing Part I of the CPO processing. Stated that the current process of public hearings is the best method. 7. Glen Schmidt, 4287 Tecolote Court, Moorpark, CA. Community involvement, committees should be appointed to provide input and concentrate on the General Plan as is or start additional work proceedings. 8. William E. Mason, 437 Shasta Avenue, Moorpark, CA. The City should not consider any other projects at this time and let the approved permits be built. The Commission continued their discussion in two parts. First was their discussion of Part I and Part II was deferred to their meeting of June 6th. Chairman Holland introduced the idea of an automatic update of the general plan every four years with voter approval of the plan. Commissioner Butcher voiced concerns related to the following: 1. What would the cost of multiple elections be? 2. Who deterines the population? 3. There is a need for more public input into the general plan process. PCM5/16 /PCAGENDA MOORPARK PLANNING COMMISSION MINUTES OF: May 16, 1988 Commissioner Montgomery promoted the idea that there should be a provision for "smaller" general plan amendments (GPA). He suggested a two (2) year review with the four (4) year general plan update occuring at the time of general election. Commission members were concerned about multiple elections for GPA's and what effect it would have on voter turn out. The Commission discussed he matter at length and ended their review with the following motions: Motion: Moved by Commissioner Butcher, seconded by Commissioner Lawrason that the General Plan update should occur every four years. Motion passed on a 5:0 vote. Motion: Moved by Chairman Holland, seconded by Commissioner Montgomery that General Plan Updates process be subject to voter confirmation during regular election time. Motion passed on a 4:0:1, Commissioner Butcher voting NO. Motion: Moved by Commissioner Lawrason, seconded by Commissioner Wozniak that amendments to the General Plan Amendment could occur between the four year renewal periods on a 5:0 vote of the City Council if such an amendment is less than a specified criteria (which is yet to be identified) . Motion passed on a 5:0 vote. Motion: Moved by Commissioner Lawrason, seconded by Commissioner Wozniak to direct staff to request legal opinion of the City Attorney regarding the specified criteria in context and whether it is defendable criteria. Motion passed on a 5:0 vote. Motion: Moved by Commissioner Montgomery, seonded by Commissioner Lawrason to continue Item 8.A. Part II of the CPO and the following items to the Commission's meeting of June 6, 1988. Motion passes on a 5:0 vote. 9. PLANNING COMMISSION ACTION ITEMS A. m n Conditional approval of colors for buildings DP -345, 346, 2, 3, 8, 9, 13, and 14. PCM5/16 /PCAGENDA MOORPARK PLANNING COMMISSION MINUTES OF: May 16, 1988 This item presented and heard out of order with the general consensus of the Commission. Testimony received by the following: Mark Annotti, the applicant, 5000 N. Parkway Calabasas, Suite 103, Calabasas, CA. Presented the Commission with the revised color board for the Commission's review. 2. Felicia Faracik, 30758 Lakefront Drive, Agoura Hills, CA. Spoke in support of the revised colors for the buildings and requested that there be no more delays to the project. 3. Aki Eaerer, 1611 Calle Artigas, Thousand Oaks, CA. Concurred with the revised colors submitted by the applicant. 4. Homer Scott, 5090 Coldman Avenue, Moorpark, CA. Also concurred with the revised color selection. Motion: Moved by Commissioner Montgomery, seconded by Commissioner Lawrason to approve the colors board as submitted. Motion passed on a 5:0 vote. 10. INFORMATION ITEMS By general consensis of the Commission Items 10.A and C to be continued to the Commission's meeting of June 6, 1988 A. Ordinance No. 84 - Home Occupation Permit AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA ADDING CHAPTER 12 TO TITLE 9 OF THE MOORPARK MUNICIPAL CODE; AND MAKING CERTAIN AMENDMENTS AND DELETIONS TO THE VENTURA COUNTY ZONING ORDINANCE, AS ADOPTED BY THE MOORPARK CITY COUNCIL ON SEPTEMBER 21, 1983, PERTAINING TO HOME OCCUPATIONS. B. Status Report - Moorpark /Poindexter Avenue Signal C. Peach Hill Road Speed Limits None. 11. COMMISSION COMMENTS Commissioner Butcher directed staff to provide a more detailed information regarding slope area and percentages at the next Planning Commission meeting.
