Minutes of August 15, 1988
The regular scheduled meeting of the Planning Commission held on August 15, 1988
in the City Council Chambers of the Community Center located at 799 Moorpark Avenue,
Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:10 p.m., Vice Chairman Montgomery
presiding.
2. PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Vice Chairman Montgomery.
3. ROLL CALL
PRESENT: Vice Chairman Scott Montgomery, Commissioner's William
Butcher, John Wozinak and Paul Lawrason;
ABSENT: Douglas Holland, with cause.
OTHER CITY OFFICIALS AND EMPLOYEES PRESENT:
Patrick J. Richards, Director of Community Development;
Michael A. Rubin, Senior Planner; John Knipe, Assistant City
Engineer; and Celia LaFleur, Administrative Secretary.

Pursuant to Condition No, la of Resolution No. 88 -443 the Planning
Commission is to approve the conceptual landscape plan.
Location: the southwest corner of Los Angeles Avenue and Spring Road.
Pursuant to Condition No. 15 of the Resolution No. 86 -297 of approval
which requires the Planning Commission is to approve the fencing plan.

Location: south side of Los Angeles Avenue west of Parklane at Liberty
Bell Road.
Motion(a): Mocved by Commissioner Butcher, seconded by Commissioner
Lawrason to approved Items A & B as submitted (PD -1064
and RPD- 1049).
Motion passed on a 4:0:1 vote, Chairman Holland absent.

INFORMATION ITEMS
A. Proposal by Tom Schleve
The proposed development of a 71 acre site located east of Walnut Canyon
Road north of Wicks Road.
At the Commission's August 1, 1988 meeting Mr. Schleve spoke under public
comments and requested the Commission to place his proposal on their next
agenda for discussion. The Commission directed staff to schedule this
matter for the August 15th Commission agenda and to place it under Item 10
"Information Items ".
Mr. Schleve is requesting consideration to expedite the processing time on a
proposal to develop a 71 acre site located east of Walnut Canyon Road and
north of Wicks Road. The proposal would require a general plan land use
amendment, zone change, approval of a planned development and a tract map.
Proposed is a 13 acre area to be set aside for 240 units of which 50 units
will be available for low cost housing and 190 fair market rented units.
Although the attached letter identifies 29 acres to be dedicated for passive
and active park purposes the size still appears a subject of further
discussion and consideration on the part of the proponent.
Staff identified the following concerns associated with this proposal:
1. It would require a general plan amendment to occur prior to the overall
update to the City's land use and circulation elements. This would
potentially cause an incremental approach to the update process. Also,

it may reduce the number of land uses and circulation options in the
northwest area of the City.
2. The area proposed for park is mainly of a passive nature. The City's
primary goal appears to be for a large active park site.
3. The area to be set aside for high density is a difficult area to build
in, Walnut Canyon Road is not currently in a condition where a high
density project should be placed. Also, this high density project may
be growth inducing to the surrounding area.
4. This proposal may not meet those hillside performance standards
currently being considered by the City.
Until an application is submitted or the staff is directed to review the
project in detail no further analysis will be accomplished.
Staff noted that inasmuch as the City has no formal process for this type of
review the applicant can not rely upon any statements or recommendations by
the Commission in the future.
Testimony received by the following:
A. Tom Schleve, 8160 Happy Camp Road, Moorpark, CA.
The proposed development of a 71 acre site located east of Walnut Canyon
Road north of Wicks Road.
Prior to Mr. Schleve making his presentation Chairman Montgomery advised Mr.
Schleve that he could not rely on any comments made by the Commission or
staff at this meeting.
Mr. Schleve noted the merits of his proposal by stating how the project
would give the downtown area a park site, would provide affordable housing
and set aside an area to provide the circulation linkage between the JBR
property and Walnut Canyon Road which would promote the east -west freeway
connector.
Mr. Schleve noted that the high density area would be developed by others.
He also stated that the one acre lots would not allow horse keeping. Mr.
Schleve noted several areas within the existing general plan where his
proposed project was consistent.
Commission comments were as follows:
Commissioner Butcher supported the concept as proposed by Mr. Schleve, but had
concerns of grading and asked Mr. Schleve he had a definition of an active park.
Commissioner Lawrason asked if the grading along Walnut Canyon would result in
the type of slope as found along Tierra Rejada. Mr. Schleve responded that it
would. He asked if this was a balance fill, Mr. Schleve concurred that it was.

A concern regarding the visibility of the development from adjacent areas
(ridgeline) was questioned. This matter was not clearly responded to.
Commissioner Lawrason also asked if the east /west connector had been discussed
with other surrounding property owners, Mr. Schleve replied, no.
Commissioner Montgomery asked when the City could expect an application.
Mr. Schleve noted his interest to appear on the Council's agenda and request
the following:
1. To be able to process a separate general plan amendment over and above
the General Plan update.
2. To receive a "fast track" processing timetable.
3. Reserve allotments for this project.
Commissioner Montgomery concluded this discussion and stated that he would
encourage other developers to do the same thing that Mr. Schleve did.
Commissioner Wozniak asked John Knipe about the power pole at the southeast
intersection of Spring Road and High Street. City Engineer Knipe replied
that Caltrans is currently working with the property owner regarding the
setback of the curb site and that no definite timetable was set to start.
Commissioner Lawrason questioned John Knipe as to the status of the Delfen
Street signal. John advised the Commission that the City Council has
awarded the contract and the contractor is in the process of ordering the
equipment.
Commissioner Lawrason inquired of staff of an amendment to the Commission's
minutes of June 20, 1988 and requested that they be returned for review at
the Commission's meeting of September 6, 1988.
Motion(b): Moved by Commissioner Lawrason, seconded by Commissioner
Montgomery to direct staff to return' the mintues of June 20,
1988 for an amendment of Appeal 88 -6 Stepitus.
Motion passed on a 4:0:1 vote Commissioner Holland absent.
Commissioner Montgomery inquired of the status of Moorpark Avenue railroad
crossing being rubberized. City Engineer replied October 1988 start date.
12. STAFF COIUMS
Staff asked the Commission whether a special meeting should be held to
discuss the 1988 allotment schedule. The Commission elected to hear the
matter and adopt a resolution at the September 19th meeting.

Staff informed the Commission of the following items scheduled for the City
Council meeting of August 17th:
1. General Plan Amendment - RFP
2. Joint meeting with Parks & Recreation Commission
3. A & R Construction Company's appeal of the Planning Commission
decision regarding fencing /wall plan.
Staff advised the Commission of the recent Blue Star Ready Mix, Inc. request
for a conditional use permit.
Staff also advised the Commission of Councilmember Galloway's intent to
attend the Commission's meeting of September 6th to discuss the matter of
Art in Public Places.
Staff requested that the Commission provide information of reservation dates
and times for the 1988 Annual League of California Cities Conference being
held October 16th - 19th in San Diego.
