CALL TO ORDER The meeting was called to order at 7:10 p.m., Vice Chairman Wozniak presiding. 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Vice Chairman Wozniak. 3. ROLL CALL PRESENT: Vice Chairman John Wozniak; Commissioner's Michael Scullin; Bill Lanahan; Glen Schmidt. ABSENT: Chairman Douglas Holland excused with cause. OTHER CITY OFFICIALS AND REPRESENTATIVES: Patrick J. Richards, Director of Community Development; John Knipe, Assistant City Engineer; Mark Wessel, Traffic Engineer; Deborah S. Traffenstedt, Senior Planner; Celia LaFleur, Administrative Secretary. 4. PUBLIC COMMENTS None. 5. APPROVAL OF MINUTES The minutes of May 1, 1989 and August 3, 1987 were continued to the Commission's meeting of June 5, 1989. 6. CONSENT CALENDAR Resolution No. PC- 89-192 Recommending that the City Council amend the City's Zoning Code to allow day care centers in commercial and industrial zones. Motion(a): Moved by Commissioner Lanahan, seconded by Commissioner Scullin to approve Resolution No. PC -89 -192. Motion passed on a 4:0:1 vote, Chairman Holland absent. Industrial Planned Development_ Permit No. IPD -88 -2 and Variance No. V -88 -2 Robert & Sharon Riddle Construction of a 24,000 sq.ft. automotive center on a 1.35 acre site. a variance has been requested to allow a 10 foot front landscaped setback and zero -foot side setbacks in lieu of the required 30 foot front landscaped setback and 30 foot landscaped setback required along one side. The project is located at 1380 East Los Angeles Avenue, approximately one - fourth mile east: of the intersection of Spring Road, High Street and East Los Angeles Avenue. Assessor Parcel Nos. 512- 160 -07, -65, and -73. Motion(b): Moved by Commissioner Lanahan, seconded by Commissioner Scullin to continue IPD -88 -2 and V -88 -2 to the Commission's meeting of June 19, 1989. Motion passed on a 4:0:1 vote, Chairman Holland absent. 8. PUBLIC HEARINGS (NEW BUSINESS) B. Revised Draft Housing Element (March 1989) of the General Plan The Planning Commission will consider a draft of the revised Housing Element of the General Plan as required by Article 10.6 of the Government Code. A periodic updating of the City's housing element is mandated by law every five years. Continued from the Commission's meting of May 1, 1989. Motion(c): Moved by Commissioner Scullin, seconded by Commissioner Lanahan to continue. the Draft Housing Element to the Commission's meeting of June 5th to review and redline notes to identify general items of agreement and incorporate the City Attorneys comments. Motion passed on a 4:0:1 vote, Chairman Holland absent. 9. PLANNING COMMISSION ACTION ITEMS A. Tentative Parcel Map No.4278 Abe Guny - Clarification of Ambiguity The subdivider is requesting clarification of access road(s) within PM -4278. Presented by the Director: reference; staff report dated May 10, 1989. Planninrz Commission, City of Moorpark, California Minutes of May 15, 1989 Pve3 The applicant, Mr. Guny, is currently attempting to record the Parcel Map by meeting the conditions of approval associated with the map. Several weeks ago Mr. Guny's engineer submitted the final map for approval which identified two access roads from Walnut Canyon Road, serving the three parcels. (one to serve two lots). At issue is the two access roads vs. one. The original Tentative Map had shown only one access road planned. It was pointed out at the public meeting that the old road extended across other private property and would need to be modified. It is now entirely on Mr. Guny's property. Within Resolution PC 88 -164 Condition 27 refers to "two approved access roads." However, conditions 16, 36, 37, 38, 39 and most specifically 44 refer to only one (1) access road. A letter dated May 3, 1989 from Mr. Guny requests the Commission to clarify their intent to allow more than one access road to the three parcels. Along with Mr. Guny's letter are exhibits showing the parcel map as currently prepared, a memorandum from the Fire Department. to the City Engineer, and a letter from Mr. Coleila of Caltrans. Note that the Caltrans letter refers to "a" driveway. Staff's main concerns regarding this matter are two fold. First, another access road will require more grading which will be highly visible from Walnut Canyon Road. Second, another access road will cause an additional potential traffic conflict point along Walnut Canyon Road. Recognizing the fact that these are twenty (20) acre parcels, staff's concerns are some what lessened because of a very low volume of expected traffic generation. Also, there would be some merit for two access drives if they were linked together forming a loop emergency access. Should the Commission desire to allow the two access driveways, staff would suggest additional landscape treatment to mitigate the grading aspect and that at least recorded easements for emergency access between the two driveways. Also, some consideration might be given towards expanded access points so as to increase a high speed exit: and provide expanded visibility. Staff Recommendation 1. That the Planning Commission review this matter and clarify their intent towards either one or two access driveways for Parcel Map 4278. 2. That should the Planning Commission allow the second access driveway Resolution No. PC -88 -164 be amended to add the following conditions and that the Parcel Map not be recorded until the Resolution has been approved with it's modified conditions: r Planning Commission, Citv of Moorpark, California Minutes of May 15, 1989 Page 4 A. That an emergency roadway easement be shown on the face of the Parcel Map. B. That an all weather emergency roadway be constructed per Ventura County Fire Department standards between the two access driveways. C. That all graded areas shall be hydro seeded with native material and the hydro seed mix shall contain native tree seeds or such native trees shall be hand planted as seedlings at one per every 100 sq. ft. of that area which has been graded for road purposes (other than paved areas) or five - gallon native trees shall be planted along the roadway staggered from side to side so that there is a tree every 100 feet and such trees are to be continually watered by a drip irrigation system for a period of one year. All five gallon trees which die shall be replanted with water provided for an additional year. Testimony received by the following: 1. Les Kovacs, 798 Moorpark Avenue, Moorpark, CA. Motion(d): Moved by Commissioner Schmidt t, seconded by Commissioner Scullin to approve staff recommendation as follows: To allow the second access driveway and that Resolution No. PC -88 -164 be amended to add the following conditions and that the Parcel Map not be recorded until the Resolution has been approved with it's modified conditions: A. Proposed Middle School and Community Hitch School - Public Resources Code Section 21151.2 The Moorpark Unified School District in accordance with Public Resources Code Section 21151.2 is requesting the Planning Commission to review the proposed school sites and determine their appropriateness in relation ship with the City of Moorpark General Plan. Presented by the Director, reference; staff report dated May 10, 1989. On May 2, 1989 the City received a letter from Moorpark Unified School District Superintendent Thomas Duffy which was a notice to the Planning Commission of the School District's intentions to purchase two additional school sites within the City. The School District has been searching for school sites that would meet their needs for an additional middle (Jr. High) school and community high (continuation) school. The proposed middle school site has been identified as being on the Carlsberg property south of Peach Hill Road extension and east of Spring Road. The Community High School is to be located on the south side of Condor Drive, east of Los Angeles Avenue within the CC &F Moorpark Business Center (Industrial Zone). The School District in accordance with Public Resources Code Section 21151.2 is requesting that Moorpark Planning Commission review the proposed school sites and determine their appropriateness in relation to the City's General Plan. Mr. Duffy, District Superintendent provided an additional letter to the City which further illustrates the District's intentions as follows: Proposed Middle School - 14 acres, 57,306 sq.ft. facility Proposed Community High School - 13.12 acres, 7,937 sq.ft. facility It was staff's opinion that should. the Commission not render any recommendations within the 30 days from receipt of notice the District may still proceed with their plans to acquire the properties. Staff Recommendation 1. That the Planning Commission review the Moorpark School District's request to make recommendations on the District's intent to purchase two school sites and that the Commission make such recommendation. `--, Planning Commission, City of Moorpark, California Minutes of May 15, 1989 Page 2. That the Planning Commission direct staff to forward the Commission's recommendations and comments in written form to the Moorpark Unified School District Board of Education before April 2, 1989. Commission's concerns are as follows: - Continued use of the existing Continuation High School facility. - Cost of rehabilitation of the existing Continuation School Site. - Waste of taxpayers money. Testimony received by the following: 1. Tom Duffy, Moorpark Unified School District Superintendent, 30 Flory Avenue, Moorpark, CA. Gave a brief background of the MUSD proposal for the new middle and continuation schools sites. The new continuation high school site would be located within the existing Moorpark Business Center which was considered to generate student workers and provide personnel into the school facility for special training and job activities /skills. The cost to rehabilitate the existing Continuation School facility could be up to $4 million and would require the school to apply for funding to consider reconstruction or modernization. Also stated that new construction has a higher priority than rehabilitation. It was the general consensus of the Commission that the Planning Commission directed staff to forward the Commission's recommendations and comments in written form to the Moorpark Unified School District Board of Education before April 2, 1989. 10. INFORMATION /FUTURE ITEMS None. 11. COMMISSION COMMENTS A letter was received from the Countryside Homeowners Association regarding the need to restrict parking on the streets adjacent to Peach Hill Park. The Commission directed staff to forward the letter to the City Council. Commissioner Scullin requested that his Commission packet be available to him on or before the Wednesday prior to the Commission's next regularly scheduled meeting. Commissioner Lanahan recommended that the staff forward to the City Council the Commission's concerns with not having a full time City Attorney and an Attorney available to the Commission's meeting.
