CALL TO ORDER The meeting was called to order at 7:12 p.m., Chairman Holland presiding. 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Nick Brown, Vice President, West America Construction Corporation. 3. ROLL CALL PRESENT: Chairman Douglas Holland; Vice Chairman John Wozniak; Commissioner's Michael Scullin; Bill Lanahan; Glen Schmidt, ABSENT: None. OTHER CITY OFFICIALS AND REPRESENTATIVES: Patrick J. Richards, Director of Community Development; John Knipe, Assistant City Engineer; Deborah S. Traffenstedt, Senior Planner; Paul Porter, Senior Planner; Celia LaFleur, Administrative Secretary. 4, PUBLIC COMMENTS None. 5. APPROVAL OF MINUTES The minutes of May 1, 1989; May 15, 1989 and August 3, 1987 were continued to the Commission's meeting of June 19, 1989. 6. CONSENT CALENDAR RESOLUTION NO. PC -89 -193 A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING CONDITION NO. 27 OF RESOLUTION NO PC -88 -164 OF TENTATIVE. PARCEL MAP NO. 4278 ON THE APPLICATION OF ABE GUNY. Motion(a): Moved by Commissioner Lanahan, second by Commissioner Scullin to approve Resolution No. PC -89 -193 as submitted. T Planning Commission, City of Moorpark, California Minutes of June 5, 1989 Page 2 Motion passed on a 5:0 vote. 7. PUBLIC HEARINGS A. Land Division Moorpark Permit No. LDM -89 -1 - West America Construction Company /Siegel & Associates The applicant proposes to subdivide an existing 5.2 acre parcel into four parcels as follows: Parcel No. 1, 1.7 acres; Parcel No. 2, 1.1 acres; Parcel No. 3, 1.7 acres; and Parcel No. 4, 1.3 acres. Located at the northeast intersection of Los Angeles Avenue and Maureen Lane. Presented by Senior Planner Porter, reference: staff report dated June 5, 1989. Staff recommendation to draft a resolution recommending approval of the Negative Declaration and approval of LDM -89 -1 as conditioned. Testimony received by the following: Michael Martello, One Boardwalk, Thousand Oaks, CA. Representing West America Construction Company. Opposed to Condition No. 14.a stating the following Prior to approval of Final Map, the following conditions shall be satisfied: a. The applicant shall deposit with the City of Moorpark a contribution for the Los Angeles Avenue Improvement Area of Contribution. The actual deposit will be the then current Los Angeles Area of Contribution applicable rate at the time of Final Map approval. It was the opinion of Attorney Martello that previous fees had been paid and perhaps it would be considered or credited towards Condition No. 14.a requirement. The Commission discussed in great length the previous fees paid and whether or not it would be considered within the approval of LDM -89 -1. Motion(b): Moved by Commissioner Lanahan, seconded by Commissioner Schmidt that Condition No. 14.a be amended not to require the Area of Contribution fee for the Los Angeles Avenue Improvement Area of Contribution. The actual deposit will be the then current Los Angeles Area of Contribution applicable rate at the time of Final Map approval. Motion passed on a 5:0 vote. It also was the general consensus of the Commission to modify the existing Condition No. 14,a to read as follows: Prior to approval of Final Map, the following conditions shall be satisfied: a. The applicant shall deposit with the City of Moorpark a contribution for the Los Angeles Avenue Improvement Area of Contribution. The actual deposit will be the then current Los Angeles Area of Contribution applicable rate at the time of Final Map approval. If the City Attorney determines that the AOC obligations already been discharged by this project, no further fee shall be required. B. Revised Draft Housing Element March__1989) of the City of Moorpark General Plan To consider a draft of the revised Housing Element to the General Plan as required by Article 10.6 of the Government Code. A periodic updating of the City's Housing Element is mandated by law every five years. Continued from May 15, 1989. Presented by the Director: reference; staff report dated The Commission expressed the following concerns: Plannine Comission, City of Moorpark, California Minutes of June 5, 1989 -- Pon4 Special needs for overcrowding. Contact service organizations that deal with overcrowding issues. Public comments and participation regarding the housing element. Statement regarding the consistency of Policies and Goals. How is Measure F applied within the housing element. Feasibility and management of the housing element. Redevelopment, how will it provide housing? Provide goals with High Street housing proposed, and address substandard housing within the existing conditions (relating to safety codes). By general consensus of the Commission staff was directed to consider the following in relation to the revised housing element: A. Rigorous enforcement of zoning, building and property maintenance ordinances; B. Develop & implement a pro - active property maintenance program that will identify areas within the City for code compliance. C. Develop and implement programs and ordinance that will require owners of substandard housing to provide rental assistance and relocation assistance to tenants displaced as a result of City code enforcement programs. It was the general consensus of the Commission to recommend to the City Council approval of the revised Housing Element with modifications as previously stated. 8. PLANNING COMMISSION ACTION ITEMS A. Zoning Ordinance Update Proposal to rescind the current Zoning Ordinance in its entirety and to adopt the current County Ordinance with minor modifications that addresses the City of Moorpark's current concerns and incorporates the City of Moorpark's revisions to the ordinance that have taken place since it's adoption. Presented by the Director, reference; staff report dated May 4, 1989. The present Zoning Ordinance adopted by the City of Moorpark was written by the County of Ventura in the early 1960's. It was revised by the County at various times in a piecemeal fashion during the 1970's until totally rewritten by the County in 1983. The County's Ordinance was revised in part because several of it's sections lacked clarity, the length of the Ordinance was cumbersom and some of the County's philosophy had changed since the Ordinance's adoption in the 1960's . The revised County Ordinance has been greatly simplified. r Planning Comission, City of Moorpark, California Minutes of June 5, 1989 Paste 5 Since the City has adopted the old County Ordinance, several amendments have been made due to public necessity, convenience, general welfare and good zoning practice by the City. These approved ordinance amendment's have never formally been placed into the Ordinance Code book. As a result it has been necessary for the staff to establish a separate binder with all of the appropriate changes just to keep track of matters, in turn making it difficult for the public and staff to operate in a business manner. It is staff's opinion that considering the above it is recommended to rescind the current ordinance in its entirety and to adopt the current County Ordinance with minor modifications that addresses the City's current concerns and incorporates the City's revisions to the ordinance that has taken place since it's adoption. It was requested that the Planning Commission make their recommendation to the City Council that staff be directed to rework the current Bounty Zoning Ordinance into the Moorpark Zoning Code and use that document until which time that the General Plan is updated and the City rewrites a new Zoning Code. It was the general consensus of the Commission to approve staff's recommendation to rescind the current ordinance in its entirety and to adopt the current County Ordinance with minor modifications that addresses the City's current concerns and incorporates the City's revisions to the ordinance. B. Public Hearing Notice - 300 foot radius requirement A report regarding the City's requirements for public hearing notice. Motion(e): Moved by Chairman Holland, second by Vice Chairman Wozniak to recommend to the City Council that the public hearing notice mailing requirement be changed to provide a 1,000 foot radius for surrounding property owners /residents 9. INFORMATION /FUTURE ITEMS None. 10. COMMISSION COMMENTS The status of parking along Maureen Lane and Gabbert Road. City Engineer to respond to the Commission on June 19, 1989 11. STAFF COMMENTS A. Clarification of the Planning Commission's intent to hold a regular scheduled meeting on July_ 3, 1989 and Vacation Schedules By general consensus the Commission will not meet on July 3, 1989 a Planning Commission, City of Moorpark, California Minutes of June 5, 1989 Pare 6 regular scheduled meeting date. 12.
