The regular scheduled meeting of the Planning Commission held on September
18, 1989 in the City Council Chambers of the Community Center located at 799
Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:00 p.m., Vice Chairman John
Wozniak presiding.
2. PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Vice Chairman Wozniak.
3. SEATING OF THE NEWLY APPOINTED PLANNING COMMISSIONER ROY TALLEY, JR, &
HIS OATH TO OFFICE
The Vice Chairman opened the meeting with the introduction of the newly
appointed Planning Commissioner Roy Talley and asked that he take the
podium. The Recording Secretary then executed the Oath as required by
Article XX, Section 3, of the Constitution of the State of California,
and Chapter 8, Division 4, of the Government Code.
Commissioner Roy Talley then took his seat on the Commission.
4. ROLL CALL
PRESENT: Vice Chairman John Wozniak; Commissioner's Roy Talley; Bill
Lanahan; Glen Schmidt; Michael Scullin.
ABSENT: None.
OTHER CITY OFFICIALS AND REPRESENTATIVES:
Patrick J. Richards, Director of Community Development;
John Knipe, Assistant City Engineer; Deborah S. Traffenstedt,
Senior Planner; Paul Porter, Senior Planner; and Celia
LaFleur, Administrative Secretary.
5. PLANNING COMMISSION REORGANIZATION
By the appointment of the Planning Commission the selection of Vice
Chairman was selected.
Motion: Moved by Commissioner Schmidt, seconded by Commissioner
Lanahan to reaffirm Commissioner Wozniak as Chairman.
Motion passed on a 5:0 vote.

Motion: Moved by Commissioner Schmidt, seconded by Chairman Wozniak
to nominate Commissioner Lanahan as Vice Chairman.
Motion passed on a 5:0 vote.
6. APPROVAL OF MINUTES
March 4, 1985 PC
February 26, 1986 PC
August 17, 1987 PC
July 17, 1989 PC
By general consensus the Commission deferred the approval of minutes to
their meeting of October 2, 1989, so that they receive the City
Attorney's memo regarding approval of dated minutes.
7. PUBLIC COMMENTS
a. Mike Ellis, 6678 N. Berkeley Circle, Moorpark, CA. Addressed the
Commission with a concern related to his request for a permit
approval which would provide for a variance to a setback
requirement which was denied over the counter. Mr. Ellis inquired
further into the appeal process which he claims was not given to
him as an option.
Staff proceeded to explain the appeal process and stated that in most
cases when there is a denial of an zoning clearance permit, the appeal
process is explained to the applicant.
Staff was directed by the Commission to research how the Department
could provided a better means of communication in order that the
applicant have a clear understanding to permit processing.

None.
9. PUBLIC HEARINGS
A. CPD -88 -3 Michitaka Sawada
A request to build a commercial structure which would contain a total
gross floor area of approximately 4,800 sq.ft. (1,610 sq.ft. restaurant
and 3,230 sq.ft. designated for retail type uses). Located at 415 High
Street.
Presented by Paul Porter, Senior Planner; reference: staff report dated
September 18, 1989.

The Senior Planner in his presentation made reference to his most
recent meeting with the applicant and the concerns and possible
revisions of the following, masonry wall along the west side to the
north property line; corrbal roof detail to be approved by the
Director; cost factor for undergrounding utilities; and adjacent
property leased for the additional parking required.
Commissioner Scullin made reference to the back drains which would
provide rear north wall drainage and asked if this was a standard
requirement.
City Engineer Knipe responded that this is a requirement and is
addressed at the time of grading plan approval.
Testimony received by the following:
A. Franz Wolf, Jr., 250 Easy Street, #5, Simi Valley, CA. General
Contractor for the applicant. Mr. Wolf ask if the Commission
would consider a request to amend the following concerns:
- Reduction in landscape requirement of 10%
- Unclear as to the implementation of Condition No. 11 relating
to light standards.
- Condition No. 13 relating to Utilities, cost for
undergounding.
- Condition No. 16 relating to Performance Bond. Request that
the Commission amend this condition to include "that within
36 months if the applicant has complied with requirements,
then this condition would terminate".
The Commission inquired of the following concerns:
Whether the undergrounding of utilities was a shared expense
amongst adjacent owners /developers.
Whether redevelopment would provide for undergrounding.
- Condition No. 22, 23 and 24 reference to, a "restaurant with
fixed bar"
Landscaped finger within the rear parking area.
Garbage bin, and truck turning radius.
- That no designated parking be provided.
- Perimeter wall, masonry or chainlink fence.
Motion: Moved by Commissioner Talley, seconded by Commissioner
Schmidt that no designated parking be provided within the
parking area.
Motion passed on 5:0 vote.

Motion: Moved by Commissioner Schmidt, seconded by Commissioner
Talley that the applicant and staff resolve outstanding
issues of the perimeter wall.
Motion passed on 5:0 vote.
Motion: Moved by Chairman Wozniak, seconded by Commissioner Schmidt
to delete from Condition Nos. 22, 23 & 24 any reference to
"restaurant with fixed bar ".
Motion passed on 5 :0 vote.
Motion: Moved by Chairman Wozniak, seconded by Commissioner Schmidt
that Condition No. 11 be modified to read "maximum height of
fourteen feet."
Motion passed on 5:0 vote.
Motion: Moved by Chairman Wozniak, seconded by Commissioner Schmidt
to continue CPD -88 -3 to the Commission's meeting of October
16, 1989.
Motion passed on 5:0 vote.
10. PLANNING COMMISSION ACTION ITEMS
None.
11. INFORMATION /FUTURE ITEMS
A. Hillside Ordinance
Presented by Deborah Traffenstedt; reference staff report dated
September 7, 1989.
Commissioner Scullin discussed his views and concerns with ridgeline
development and contour grading. He stated that contour grading
provides for a continual maintenance program and erosion problems. In
Commissioner's Scullins' opinion he was opposed to this type of
grading.
Commissioner Scullin also stated and supported the concept of ridgeline
development, with the requirement of the developer to provide planting,
which could preserve the beauty of the canyons untouched and in its
natural state.
Chairman Wozniak directed staff to provide a memo to the City Council .
inquiring of the direction the Planning Commission should proceed with.

B. General Plan Update and Carlsberg Specific Plan
Received and filed.
12. COMMISSION COMMENTS
Commissioner Talley expressed his appreciation and interest to work
with the Commission.
Commissioner Lanahan informed staff of calls he had received regarding
the appeal process and how applicants were unclear as how or whether
they had the opportunity to file.
Also, inquired of portable trailers that he has taken notice of. Staff
informed Commissioner Lanahan that school site portable trailers are
strictly matters of the Moorpark Unified School District.
Informed staff of Conejo's Valley's new directory regarding Child Care
Centers an that he would make this copy available to staff.
Commissioner Schmidt made mention of Country Days signs that had not
been taken down.
Overcrowding issues in the downtown area and the status of enforcement.
Also that staff provide the Commission with a status report related to
the concerns of the downtown area.
Commissioner Scullin congradulating newly appointed Commissioner Talley
and Chairman Wozniak. Also made mention of a two day class to be held
at Moorpark College on October 27th and 28th relating to grading codes
and administration.
Chairman Wozniak thanked the Commission for their consideration in
nominating him as Chairman of the Planning Commission.
In appreciation of the City Engineer for placing a sign at the corner
of Charles Street and Spring Road indicating "not a through street ",
which has kept re- routed traffic off Charles Street.
Directed staff to prepare a time study for the intersection of High
Street and Spring Road concerning timing for north bound traffic
preparing to make a left hand turn.

13. ADJOURNMENT
There being no further business the meeting of the Planning Commission
adjourned at 10:00 p.m.
