HomeMy WebLinkAboutMIN 1989 1106 PC REGPlanning Commission, City of Moorpark, California Minutes of November 6, 1989 Page -I- The regular scheduled meeting of the Planning Commission held on November 6, 1989 in the City Council Chambers of the Community Center located at 799 Moorpark Avenue, Moorpark, California. 1.Call To Order The meeting was called to order at 7:00 p.m., Chairman Wozniak presiding. 2. Pledge of Allegiance The pledge of allegiance was led by Chairman Wozniak. 3. Roll Call Present: Chairman John Wozniak; Vice Chairman William Lanahan; Commissioners Glen Schmidt; Roy Talley. Absent: Michael Scullin (excused absence). Other City Officials and Representatives: Patrick J. Richards, Director of Community Development; Paul Porter, Senior Planner; John Knipe, Assistant City Engineer; and Celia LaFleur, Administrative Secretary. 4. Approval of Minutes January 4, 1988 February 29, 1988 October 2, 1989 Motion: Moved by Commissioner Schmidt, second by Commissioner Lanahan to approve the minutes of January 4, 1988, February 29, 1988, and October 2, 1989 as submitted with modification in reference to attendance of Planning Commissioner's (John Wozniak) within the minutes of February 29, 1989. Motion passed on a 4:0:1 vote, Commissioner Scullin absent. 5. Public Comments A. Cherie Call, 6052 Darlene Lane, Moorpark, CA. Property owner spoke of her intent to subdivide her three acre lot into three one acre parcels. The Commission directed her to staff to provide more information prior to a formal application being submitted. Also that staff provide a map of the subject area to the Commission. CPD -88 -3 Michitaka Sawada A request to build a commercial structure which would contain a total gross floor area of approximately 4,840 square feet (1,640 sq.ft. restaurant and 3,230 sq.ft. designated for retail type uses). Located at 415 High Street. Continued from September 18, 1989. Senior Planner Porter gave background information to the Commission's September 18, 1989 actions to request that staff work with the applicant and return this item to the Commission at a later date. Summary of Modifications 1. A condition was added to the project that no designated parking be provided within the parking area. This has been added to the existing conditions of approval. 2. There was concern regarding the perimeter wall and whether there would be an open space between the Barakat Market and the proposed building. A six foot high wall has been shown along the western boundary of the property line north of the proposed building and along the eastern boundary of the property line. Also, the plot plan has been revised to show no open space between he proposed building and the Barakat Market. 3. Any conditions referencing a "restaurant with a fixed bar" have been deleted from the conditions of approval. 4. Condition No. 11 has been modified to read maximum height of fourteen feet ". 5. Vine pockets have been added along the eastern wall of the proposed building adjacent to the access. 6. The trash enclosure has been moved from the southeastern portion of the parking area to the southwestern area so as to not cause a potential traffic congestion problem. 7. The elevations have been modified to provide larger base plates for the front posts, more decorative lighting fixtures, the center portion of the south elevation shows vertical boards which makes the architectural character of the building more interesting. Testimony received by the following: A. Franz Wolf, Jr., 250 Easy Street, #5, Simi Valley, CA. Representing the applicant concurred with the conditions of approval. Per Director Richards Condition No. 16 page 4 was modified to read a follows: Prior to issuance of a Zoning Clearance, a Surety Performance Bond in the amount of $10,000 shall be filed and accepted by the Director of Community Development. The Director of Community Development may, through a public hearing to be heard before the City Council recommend that any or all of the funds in the Performance Bond be forfeited for noncompliance of the Conditions of Approval or for some other just cause. This condition shall automatically be superseded by an related resolution or ordinance regarding condition compliance for entitlement approvals as adopted by the City Council. Motion: Moved by Commissioner Schmidt, seconded by Commissioner Lanahan to approved Condition No. 16 page 4 as modified. Motion passed on a 4:0:1 vote, Commissioner Scullin absent. Motion: Moved by Commissioner Schmidt, seconded by Commissioner Lanahan to approve Commercial Planned Development Permit No. CPD -88 -3 as revised with the modified condition to #16 page 4 and the approval and adoption of Resolution No. 204. Motion passed on a 4:0:1 vote, Commissioner Scullin absent. B. Land Division Moorpark No. LDM -89 -6 West America Construction Corporation Requesting approval to subdivide an existing 2.2 acre parcel into two parcels. The proposed subdivision is located on the west side of Maureen Lane north of Los Angeles Avenue in the City of Moorpark. The Assessor's Parcel No. 511 -0- 062 -03. Senior Planner Porter gave a presentation on LDM -89 -6; reference: Staff Report dated November 6, 1989. Testimony received from the following: 1. Kassie McMenamin, One Boardwalk, Suite 102, Thousand Oaks, CA. Representing Cohen Alexander & Clayton for West America Construction Corporation. Mll- 6- 89.DOC/DW4:crl Planning Commission, City of Moorpark, California Minutes of November 6, 1989 Motion: Moved by Commissioner Schmidt, seconded by Commissioner Lanahan to approve LDM -89 -6 on the application of West America Construction Corporation with modification to Condition No. 11 to read as follows: "This Land Division shall not be cleared for recordation until all mitigation fees required by IPD -88 -4 have been paid in full, a building permit has been issued, and a foundation slab exists for the two buildings." Motion passed on a 4:0:1 vote, Commissioner Scullin absent. Motion: Moved by Vice Chairman Lanahan, seconded by Commissioner Talley to adopt and approve Resolution No. 205 as presented with modification to Condition No. 11 as previously stated. Motion passed on a 4:0:1 vote, Commissioner Scullin absent. 8. Action Items A. Continued discussion regarding the consideration to rescind the current Zoning Ordinance in its entirety and adopt the current Ventura County Ordinance with minor modifications that addresses the City of Moorpark's current concerns and incorporates the City's revisions to the ordinance that has taken place since it's adoption. The Commission to discuss their proposed recommendations to the County Zoning Ordinances. In reviewing Articles I though IX the Commission referenced the following: Article 2 - Definitions Antenna, Ground - Mounted - A device for transmitting or receiving radio waves which rests on or is located in or anchored to the ground. "Ground- mounted antenna" includes antennas supported by guy wires and similar mechanisms. Commission comment: Change or add Antenna, Roof- Mounted. Automobile Service Station - A commercial activity, both retail and service in character, engaged in dispensing automotive fuels and motor oil; the sale and service of tires, batteries and other automobile accessories and replacement items; and washing and lubrication services. Activities associated with service stations do not include body and fender repair, painting or major motor repairs. Boarding House - A dwelling unit with one family in permanent residence, where all rooms have internal access to one another, and wherein two to five rooms are rented, with or without daily meals. Commission comment: This definition needs to be more specific and how does it relate to overcrowding. Decision, Discretionary - Discretionary decisions require the exercise of judgment, deliberation, or decision on the part of the decision - making authority in the process of approving or disapproving a particular activity, as distinguished from situations where the decision - making authority merely has to determine whether there has been conformity with applicable statutes, ordinances, or regulations. Decision, Ministerial - Ministerial decisions are approved by a decision making authority based upon a given set of facts in a prescribed manner in obedience to the mandate of legal authority. In these cases, the authority concerning the propriety or wisdom of the act although the statute, ordinance or regulation may require, in some degree, a construction of its language by the decision- making authority. Commission comment: Should include who or what group is the decision making authority. Expansion - Increasing the area or volume occupied by or devoted to a use, increasing the living space or occupant capacity of structure, or adding uses or structures accessory to a nonresidential use or structure. The following are not considered to be expansion: the addition of unenclosed porches, patio covers and the like; one enclosed addition of not more than 30 square feet to dwelling; and the addition of detached accessory structures not for hum habitation as accessory to a dwelling. Commission comment: Should this requirement be relaxed in order to provide more flexibility for small additions to expedite processing. Paae -6- Dwelling, Two - Family A building containing two dwelling units. Commission comment: be more specific, such as "A building containing two separate single family dwelling units. Fence - An unroofed vertical structure which is intended primarily to serve as a visual screen or as a physical enclosure around a building or yard are for security, containment or privacy, or to indicate a boundary. This definition includes hedges, thick growths of shrubs, and walls used as screens, but does not include windbreaks for the protection of orchards or crops, or County approved enclosures for the containment of wild animals. Commission comment: Does not reference masonry walls. Inoperative Vehicle - A vehicle which is not fully capable of movement under its own power or is not licensed or registered to operate legally on a public right -of -way. Tractors and similar farm vehicles that are used on a lot containing an established agricultural operation and are capable of movement under their own power are not considered to be inoperative vehicles. Commission comment: Need definition for Abandoned Vehicle. Public Road or Street - Any road or street or thoroughfare of whatever nature, publicly maintained and open to the use of the public for the purpose of vehicular travel. Commission comment: Need definition for Private Road or Street. Define construction trailers, use and hours of operation. 9. Information Items - Verbal presentation A. General Plan Update B. Appeals Processing Permit - Information sheet, Fee Structure, item by item, does it exist? Planning Commission member be a part of City Council's subcommittee for the Downtown Plan and implementation, to provide their recommendations. Provide the Commission with a draft copy of procedures for permit processing. Boutique Sales - current status. The City will issue a permit for hours of operation and notification to adjacent property owners of the upcoming event. Additional restrictions may be required of the applicant. Staff is currently working on this issue. Status of Los Angeles Avenue and Spring Road intersection regarding improvements to the turning radius. Also directed the City Engineer to examine the time for left turn eastbound traffic, currently while turning left east bound the green arrow does not provide sufficient time to clear the intersection. 11.
