California Minutes of April 2, 1990 The regular meeting of the Planning Commission was held on April 2, 1990 in the City Council Chambers located at 799 Moorpark Avenue, Moorpark, California 93021. 1. CALL TO ORDER The meeting was called to order at 7:00 p.m. by Chairman John Wozniak. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chairman Wozniak. 3. ROLL CALL PRESENT: Commissioners William Lanahan, Glen Schmidt Michael Scullin, Roy Talley, and Chairman John Wozniak. ABSENT: None. OTHER CITY OFFICIALS AND EMPLOYEES PRESENT: Patrick J. Richards, Director of Community Development; Paul Porter, Senior Planner; Deborah S. Traffenstedt; John Knipe, Assistant City Engineer; Celia LaFleur, Administrative Secretary. 4. APPR yAL OF MINUTES March. 19, 1990 MOTION: Moved by Commissioner Schmidt, seconded by Commissioner Lanahan to approve the minutes with the modification to Item 7.A. Motion passed on a 5:0 vote. Planning Commission Meeting Of: April 2, 1990 Page2 S. PUBLIC COMMENTS A. Mark Lombardi, 13251 Peach Hill Road, Moorpark, CA 93021. Inquired of the Commission as to when his entitlement permit would be rescheduled. The Commission responded that RPD -89 -2 and LDM -89 -5 would be placed on the :Planning Commission agenda of April 16, 1990. B. :Mark A. Trexler, 4455 Skyglen Court, Moorpark, CA. Representing Wambold Furniture, V.P. /G.M. Responded to the Commission addressing the concerns of complaints received regarding Wambold Furniture, 5100 Commerce .Avenue. Informed the Commission of Larry D. Smith's letter addressing the concerns of landscaping and sidewalk at this location in which he stated that Ken Smith, Landscape Architect has started working on such a plan for submittal. 6. CONSENT CALENDAR RESOLUTION NO. PC -90 -209 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORP.ARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF INDUSTRIAL PLANNED DEVELOPMENT PERMIT NO. IPD -89- 2 ON THE APPLICATION OF ANNOTTI /PETRILLI. M TION: Moved by Commissioner Schmidt, seconded by Commissioner Lanahan to approve Resolution No. PC- 90 -209 with minor modification. Motion passed on a 5:0 vote. PUBLIC HEARINGS A. Zone Code Chance No Z -90 -1 - City of Moorpark The City Council has initiated a proposed amendment to the City Municipal Code to require that a Residential Planned Development (RPD) Permit be obtained for all residential development creating five (5) or more separate lots or dwelling units as part of any entitlement request. This requirement would pertain to all residentially zoned property in the City. This Code amendment revision is being proposed in lieu of changing any zoning for a specific property to RPD. Location: affects residentially zoned properties citywide. Presented by Deborah S. Traffenstedt, Senior Planner Staff Report dated March 29, 1990. A draft ordinance, which would need to be adopted by the City Council to implement the proposed Zoning Code changes, was also presented and provided to the Commission (Exhibit A). m2Apr90 Planning Commission Meeting Of: April 2, 1990 Page3 Commissioner Schmidt inquired of staff as to whether within the ordinance the City could establish a Water Conservation Policy and whether or not a project could be denied if the project would impact water services. Patrick Richards, Director responded that prior to public hearing and as part of the Initial Study the Environmental Impact Report would provide for information of water impacted services. Also, within the City's Landscape Guidelines greater detail would be provided to address concerns of water conservation measures. MOTION: Moved by Lanahan, seconded by Chairman Wozniak to direct staff to prepare a resolution recommending to the City Council the approval of the draft ordinance (Exhibit A) which would revise various sections of the City Zoning Code related to RPD Permit requirements as identified. B. Motion passed on a 5:0 vote. Zone Change No. 89 -2 - A zone change from PC (Planned Community) to the appropriate RPD designation (RPD 13.28u). Residential Planned Development No. 89 -4 - Planned Development for the construction of 257 townhouse units ranging in size from 1,863 to 2,5551 square feet. Vesting Tentative Tract map No. 4637 to accompany the Residential Planned Development Townhouse project. The projects is located south of Mountain Trail Street between Mountain Meadow Drive and Cedar Spring Street. Presented by Paul Porter, Senior Planner: Staff Report dated April 2, 1990. Senior Planner gave a detailed overview of the proposed project. Provide the Commission with a letter dated April 2, 1990 of recommended modifications to the conditions of approval. See applicants submittal of Exhibit 15. Commissions concerns were as follows: Tree and landscape planting, method of irrigation. Irrigation responsibility. Rear parking and circulation, noise. Guest parking. - Appropriateness of T- intersections and internal traffic circulation. Rear parking and elevation facing collector streets. - Shared recreational areas. :Drainage. Testimony received by the following: 1. Tom Zanic. Urban west Communities representative, 520 Broadway, Suite 100, Santa Monica, CA 90401. Addressed the Commissions concerns as follows: - Applicant to provide landscape planting and irrigation methods to meet the requirements of the Landscape Guidelines. - Irrigation responsibility would be the Homeowners Association in contracting for landscaping maintenance. - Master bedrooms designed to be at the front of the units and sound wall along with double -pane glass for noise reduction provided. - Rubbish pick -up would be provided by each and every unit resident, by placing their own trash barrel at the rear of their private parking area. - The appropriateness of T- Intersection allows for privacy within the traffic circulation and residential units. - Guest parking has been provided beyond the standard requirement. - Parking facing collector streets would be mitigated by elevations and landscaping provided. - An additional recreation area has been provided for multifamily use and also the project is within near by parks. - Drainage issues will be addressed with the City Engineers requirement for a drainage plan. 2. Gary S. Anderson, 11990 Havencrest, Moorpark, CA. Board member of Homeowners Association /Neighborhood Council supported the request for development. m2Apr90 Planning Commission Meeting Of: April 2, 1990 Pages 3. Shirley Baher. P.O. Box 147, Buttercreek Estates, Moorpark, CA. Homeowner Board member opposes guardhouse entry which would be directly across cul -de -sac (Blossomwood Court). Requested that the developer redesign to provide guardhouse entry at another location. 4. Haldun Accn, 11678 Chestnut Ridge, Moorpark, CA. Opposes the development of multifamily use. Requesting the developer to provide lower density units and more open space. Single family preferable. 5. Jim Keenan, 12651 E. Hillside Drive, Moorpark, CA. President Mountain Meadows Neighborhood Council. Supports the consistent and varied housing which is needed within the Moorpark community. Break: 9:45 p.m. Reconvene: 10:00 p.m. MOTION: Moved by Commissioner Scullin, seconded by Commissioner Schmidt that Tract Condition No. 31 and RPD Condition No. 25 be deleted in reference to the "shall not protest the formation of an assessment district..." Chairman Wozniak call for a roll call vote: Commissioner Talley: Yes Commissioner Lanahan: Yes Commissioner Scullin: Yes Commissioner Schmidt: Yes Chairman Wozniak: Yes MOTI N: Moved by Chairman Wozniak to direct staff to provide the recommendation of the City Attorney as to whether the project could be conditioned to provide a Water Conservation Program; to establish a water plan /usage, and the possibility of denying the project could be based on the ability to prove with consensus of the Waterworks District that the project would /would not detour from established water plan /usage. The potential of denying a project based on the ability of the city to prove with the consensus of the Waterworks District that the project would /would not detour from the water availability to the community. That the multifamily units provide additional tot lot recreational areas within the project. That the request for development be continued to the Commissions regular scheduled meeting of April 16, 1990 so that the City Attorney may provide comments regarding the Commission's concerns related to Water Conservation. m2Apr90 Plannina Commission Meetina Of: April 2, 1990 Page6 8. PLANNING COMMISSION ACTION ITEMS None. 9. INFORMATION ITEMS Report Back - Code Enforcement Actions regarding the building at the northeast corner, 5100 Commerce. Report received and filed. 10. COMMISSION COMMENTS Status of the Texaco Station Prepare status report of Los Angeles Avenue Widening for the Commission review at the 4/16/90 meeting. Status of the Downtown Plan for the Commission's review at the 4/16/90 meeting. Complimented Code Enforcement in relation to the overcrowding issues. Plan of implementation for upcoming summer months. Symphony Homes - Real Estate sales signs which were displayed during the weekend of March 30, 1990. 11. STAFF COMMENTS None. 12.
