Located in the City of Moorpark, 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER The meeting called to order at 7:00 p.m. by Chairperson John Wozniak. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chairperson John Wozniak. 3. ROLL CALL PRESENT: Commissioners William Lanahan, Roy Talley, and John Wozniak. Planning Commission Meetings: October 8, 1990, September 17, 1990, August 22, 1987, August 15, 1985, June 27, 1985, July 24, 1984. The minutes of June 11, 1986 modified to reflect Commissioners present. Motion carried by unanimous voice vote. 5. PROC LAMATIONS. COMMENDATIONS AND SPECIAL PRESENTATIONS None. 6. PUBLIC COMMENTS None. 7. CONSENT CALENDAR None. 8. REORDERING OF, AND ADDITIONS T0, THE AGENDA None. 9. PUBLIC HEARINGS A. Communities The applicant is requesting the following: 1. A major modificaiton of the Specific Plan and Master Plan for Planned Community No. 3 to allow the designated Community Focus Area to include 11 acres of Neighborhood Commercial land uses instead of 7.5 acres of Neighborhood Commercial use and 4 acres of Community Use. The entire 90 -11.5M Planning Commission Minutes of November 5, 1990 Page 3 Community Focus Area is now being proposed as Neighborhood Commercial. 2. Zone change to rezone the existing area from PC (Planned Community) to CPD (Commercial Planned Development). 3. Commercial Planned Development No. 90 -2 is a proposal for a Neighborhood Commercial Shopping Center consisting of a 45,000 sq.ft. market; 60,400 sq.ft. retail; 5,000 sq.ft. medical office; and 12,000 sq.ft. of restaurant uses for a total of 122,400 sq.ft. 4. LDM -90 -2 (Vesting Tentative Parcel Map) is a subdivision for a 11.77 acre parcel and a 11.69 acre remainder parcel. Parcel A consisting of 11.77 acres will be the location of the proposed Neighborhood Shopping Center. The proposed project site is located southwest of the intersection of Tierra Rejada Road and Mountain Trail Street in the City of Moorpark. The Assessor Parcel No. 505- 0- 12 -41. Presented by Paul Porter, Senior Planner. Reference: Staff Report dated November 5, 1990. PUBLIC HEARING OPEN AT 8:00 P.M. Testimony received by the following: Tom Zanic, representative, 520 Broadway, Santa Monica, CA 90401. Mr. Zanic referred to a letter dated November 5, 1990 addressed to the Commission requesting that they consider modifications, revisions and deletions of conditions. Group Vice President, Engineering and Construction - Ralphs Grocery Company. 90 -11.5M Planning Commission Minutes of November 5, 1990 Staff Condition No. 48.c (page 9) Page 4 That landscaping along Tierra Rejada Road and Mountain Trail Street shall be increased to provide a minimum of 30 feet of landscaping buffer from the property line to the parking area. Applicant request: Delete the condition. Action: No action taken. Staff Condition No. 21 The mid -block driveway on Tierra Rejada Road between Mountain Trail Street and the entrance to the high school will be allowed, but a median break (for a west bound left turn pocket) shall not be allowed. If the median break is approved by the City Council the necessary striping transitions for the dual left turn at Tierra Rejada Road - Mountain Trail Street intersection shall occur to the west of the median break. The median curbs on Tierra Rejada Road will be relocated as required. Deceleration and acceleration lanes shall be provided for the main driveway on Tierra Rejada Road as shown on the tentative parcel map. A conceptual street improvement / striping transition plan for Tierra Rejada Road shall be submitted to the City Engineer for review prior to commencing final design. Applicant request: Modify the condition to permit the median break. Staff Condition No. 47 The applicant shall deposit with the City of Moorpark $640,749.24 to a TDM Fund as a mitigation measure to fully mitigate the significant impact to fund TDM programs or clean - fuel vehicles programs as required by the Mitigation Monitoring Program. 90 -11.5M Planning Commission Minutes of November 5, 1990 Page 5 Applicant request: Modify the condition to apply the 1989 Guidelines to the expanded commercial area of the project. Action: Motion: Commissioner Wozniak moved and Commissioner Lanahan seconded a motion to modify the condition to apply the 1989 Guidelines to the expanded commercial area of the project. Motion carried by unanimous voice vote. Staff Condition No. 3 That unless the project is inaugurated (building foundation slab In place and substantial work in progress) not later than one year after this permit is granted, this permit shall automatically expire on that date. The Director of Community Development may, at his discretion, grant up to one(1) additional year extension for project inauguration if there have been no changes in the adjacent areas and if applicant can document that he has diligently worked towards inauguration of the project during the initial one year period. Applicant request: Modify condition to provide for permit expiration in two years if substantial construction has not occurred. Action: Directed staff to provide for permit expiration in two years. Staff Condition No. 10 Prior to the submission of construction plan for plan check or initiation of any construction activity, a zoning clearance shall be obtained from the Community Development Department. Applicant request: Add the following wording; Construction check plan may be initiated with a "hold harmless" letter to the City and payment of all required plan check fees." 90 -11.5M Planning Commission Minutes Page 6 of November 5, 1990 Action: It was the general consensus of the Commission that this condition remain as is. Staff Condition No. 33 The applicant shall contribute to the City of Moorpark an amount of $.25 per square foot of gross floor area to support the City's current and future park system. Applicant request: Action: Delete condition. It was the general consensus of the Commission that a legal opinion be provided by the City Attorney to determine staff recommendation prior to the public hearing before the City Council. Staff Condition No. 34 The applicant shall contribute to the City of Moorpark's Art in Public Places Fund, an amount of $10 per each 100 square feet of building area. Applicant request: Action: Delete condition. The applicant concurs with the condition and will pay the fee ($12,000.00). Staff Condition No. 9 A sign permit is required for all on -site signs to be approved by the Director of Community Development. Only three monument signs, in addition to a monument sign with the shopping center name, will be permitted which will be externally lit. Applicant request: Modify condition to allow one sign on each entry feature. Signs will be limited to the shopping center name. 90 -11.5M Planning Commission Minutes of November 5, 1990 Action: Page 7 Motion: Commissioner Lanahan moved and Commissioner Tally seconded a motion that the applicant provide one sign at each entry. Motion carried by unanimous voice vote. Staff Condition No. 38 Prior to the issuance of a zoning clearance, a Surety Performance Bond in the amount of $10,000 shall be filed and accepted by the Director of Community Development. The Director of Community Development, may, through a public hearing to be heard before the City Council recommend that any or all of the funds in the Performance Bond be forfeited for noncompliance of the Conditions of Approval or for some other just cause. This condition shall automatically be superseded by a related resolution or ordinance regarding condition compliance for entitlement approvals adopted by the City Council. Applicant request: Delete condition. Action: It wets the general consensus that the condition remain as recommended by staff. Staff Condition No. 18 Complete landscape plans (2- sets), together with specifications and a maintenance program shall be prepared by a State Licensed Landscape Architect, generally in accordance with the Ventura Guide to Landscape Plans and in compliance with the City of Moorpark Ordinance No. 74, and shall be submitted to and approved by the Director of Community Development. The final landscape plans shall be in substantial conformance with the conceptual landscape plan submitted with the application. The applicant shall bear the total cost of the landscape plan review and final installation inspection. The landscaping and planting plan submitted for review and approval shall be accompanied by a deposit as specified by the City of Moorpark. Additional funds may 90 -11.5M Planning Commission Minutes of November 5, 1990 Page 8 subsequently need to be deposited to cover allied by the City of Moorpark. Additional funds may subsequently need to be deposited to cover all landscape plan check and inspection fees. All landscaping and planting shall be accomplished and approved by the Director of Community Development, or his designee, prior to the approval of occupancy. The project landscape plans shall include the following: a. A 50 percent shade coverage shall be provided within all parking spaces. Shade coverage is described as the :maximum mid -day shaded area defined by a selected specimen tree at 50 percent maturity. b. Any turf plantings associated with this project shall be drought tolerant, low water using variety. C. Landscaping at site entrances and exits and any intersection within the parking lot shall not block or screen the view of a seated driver from another moving vehicle or pedestrian. d. Plantings in and adjacent to parking areas shall be contained within raised planters surrounded by six -inch high concrete curbs. e. Landscaping shall be designed so as to not obstruct the view of any exterior door or window from the street. f. Landscaping (trees) shall not be placed directly under any overhead lighting which could cause a loss of light at ground level. g. Earthen berms shall be provided to screen views of parked vehicles from access roads. h. Landscaping shall be used to screen views of any backflow preventers. Applicant request: Modify conditions as follows: 1) 18.a. change shade coverage requirement to 30 %. 90 -11.5M Planning Commission Minutes of November 5, 1990 Action: Page 9 2) 18.g. "earthen berms shall be provided, as feasible within the overall design, to screen views of parked vehicles from access roads." Motion: Commissioner Talley moved and Commissioner Lanahan to modify Condition No. 18.g. as follows: "Earthen berms shall be provided, as feasible within the overall design, with the concurrence of the Director of Community Development." Motion carried by unanimous voice vote. Motion: Commissioner Wozniak moved and Commissioner Lanahan seconded a motion to modify Condition No. 18.a. as follows: A 30 percent shade coverage shall be provided r within all parking spaces. Shade coverage is described as the maximum mid -day shaded area defined by a selected specimen tree at 50 percent maturity. Motion carried by unanimous voice vote. Staff Condition No. 26 For all exterior lighting, a lighting plan shall be prepared by an electrical engineer registered in the State of California and submitted to the Department of Community Development for review and approvals The lighting plan shall achieve the following objectives: Avoid interferences with reasonable use of adjoining properties; minimize on -site and off -site glare; provide adequate on -site lighting; limit electroliers height to avoid excessive illumination; and provide structures which are compatible with the total design of the proposed facility. The following may be adjusted as a result of the lighting plan review by the Director of Community Development. 90 -11.5M Planning Commission minutes of November 5, 1990 The lighting plan shall include the following: Page 10 a. A photometric plan showing a point -by -point foot candle Layout to extend a minimum of twenty (20) feet outside the property lines. Layout plan to be based on a ten (10) foot grid center. b. :Maximum overall height of fixtures shall be fourteen (14) feet. C. Fixtures must possess sharp cut -off qualities with a :maximum of one -half foot candle illumination at property lines. d. There shall be no more than a seven -to -one (7:1) ratio of level of illumination shown (maximum -to- minimum ratio between lighting standards). e. Energy efficient lighting fixtures shall be provided which are compatible with adjacent properties. f. Average maximum of one -half foot candle illumination'. g. No light shall be emitted above the 90 degree or horizontal plane. Applicant request: Modify conditions as follows: 1) 26.b Limit maximum overall height of fixtures to twenty feet. (Also applies to condition 48.a.) 2) Add 26.g. "Lighting plan detail requirements may be adjusted with the approval of the Director of Community Development." Action: Notion: Commissioner Talley moved and Commissioner Lanahan seconded a motion to modify Condition No. 26.b Limit maximum overall height of fixtures to twenty 90 -11.5M Planning Commission Minutes of November 5, 1990 Page 11 three feet. (Also applies to condition 48.a.) as long as the lighting plan meets parameter of other or as approved by the Director of Community Development. Condition No. Add 26.g. "Lighting plan detail requirements may be adjusted with the approval of the Director of Community Development." Motion carried by unanimous voice vote. Staff Condition No. 48.a. and 48.b. The plans shall be modified to include the following: a. The tower sign shall be eliminated; b. The compact parking spaces shall be redesigned to be 9' wide by 2011ong; C. The landscaping along Tierra Rejada Road and Mountain Trail Street shall be increased to provide a minimum of 30 feet of landscaping buffer from the property line to the parking area; d. The elevations shall be modified to provide additional architectural treatments to the rear of the retail buildings adjacent to the existing and proposed residential uses. The additional architectural features shall be approved by the Director of Community Development and are to include treatments such as florets, false balconies, windows, etc.; e. The parking lot pole lights shall be reduced to a maximum height of 14 feet; Applicant request: 48.a. Delete condition. 48.b. Modify the condition as follows: "All parking spaces shall be 9' wide by 20' long, except in the designated employee parking area as shown on the 90 -11.5M Planning Commission Minutes of November 5, 1990 site Plan. Page 12 Action: It was the general consensus of the Commission that this condition remain as recommended by staff. Staff Condition No. 59 No outside storage of shopping carts shall be permitted. Applicant request: Action: Delete condition. The Commission directed staff to work with the applicant to provide photographs of the low -wall as suggested by the applicant. The Director of Community Development to determine whether Condition No. 59 remain as recommended by staff. Staff Condition No. 86 Directory boards indicating locations of the various buildings and individual units shall be displayed at each entrance to the complex and lighted during the hours of darkness. Applicant request: Modify condition to clarify that the boards are to attached to the buildings. Action: Motion: Commissioner Wozniak moved and Commissioner Talley seconded a motion to modify Condition No. 86 to clarify that the boards are to attached to the buildings. Motion carried by unanimous voice vote. 90 -11.5M (— Planning Commission Minutes of November 5, 1990 City Engineer Conditions - LDM -90 -2 City :Engineer Condition No. 16 Page 13 The applicant shall submit to the city of Moorpark for review and approval, a grading plan prepared by a Registered Civil Engineer; shall obtain a grading permit; and shall post sufficient surety guaranteeing completion. Cut and fill slopes shall be no steeper than 2:1 (horizontal: vertical). An erosion control plan shall be submitted for review and control measures, hydroseeding of all graded slopes shall be required within 60 days of completion of grading. All haul routs shall be approved by the City Engineer. City Engineer Condition Modification: Add the following: The existing 1 -1/2:1 slope along the west property line can remain at 1 -1/2:1 if the applicant's geotechnical engineer will submit a report regarding the slope's stability to the City Engineer for his review and approval. City Engineer Condition No. 21 The mid -block driveway on Tierra Trail Street and the entrance allowed, but a median break (for shall not be allowed. A conceptual street improvement / striping transition plan for Tierra Rejada Road shall be submitted to the City engineer for review prior to commencing final design. 90 -11.5M Planning Commission Minutes of November 5, 1990 City :Engineer Condition Modification: Page 14 Delete the last sentence of the second paragraph and replace with "a 120 foot eastbound right turn only land w--shall be provided at the project driveway on Tierra Rejada Road.: Add the following: The City Engineer review of the conceptual street improvement /striping transition plan shall be completed four weeks after applicant's submittal. City Encineer Condition No. 31 A meandering sidewalk along the property frontage shall be constructed, with the precise design and location approved by the City Engineer and Director of Community Development. The following criteria for the design of the meandering sidewalk shall be met: 1. Crossfall shall not exceed two percent. 2. Sidewalks shall be a minimum 5 feet wide at all points. 3. The meandering sidewalk shall be contained either within public right of way or within an easement offered to the City. 4. The applicant shall agree to maintain the sidewalk and any related landscaping. City Engineer Condition Modification: Replace item No. 4 with the following: The applicant shall agree to maintain the sidewalk and any related landscaping except within the public right of way along Tierra Rejada Road. City Engineer Conditions - CPD -90 -2 City Engineer Condition No. 69 The traffic signal at the intersection of Tierra Rejada Road and Mountain Trail Street shall be constructed by the 90 -11.5M r Planning Commission Minutes of November 5, 1990 Page 15 applicant and shall be operational prior to any occupancy of this .project. City Engineer Condition Modification Traffic signal design and construction costs shall be reimbursed up to the amount provided for by the Tierra Rejada Road Area of Contribution. Motion: Commissioner Lanahan moved and Commissioner Talley seconded a motion to recommend to the City Council that the City Attorney modify the existing Memo of Understanding which will indicate a specific date for the completion of the Community Center building, and the park site within PC -3 Major Modification No.3 Notion: Commissioner Lanahan moved and Commissioner Talley seconded a motion to recommend to the City Council approval of Commercial Planned Development Permit 3 - Urban West Communities with the revisions as recommended by the Planning Commission and staff to: 1. Request that the applicant concur and agree with the mitigation measure for Air Quality Impacts as identified in the Mitigated Negative Declaration. 2. If the applicant does not agree to the Mitigation, the Planning Commission recommend to the City Council that an Environmental Impact Report be prepared for the project. 3. The Mitigated Negative a Declaration prepared for the projects has been prepared in accordance with CEQA and' it is adequate and complete for the aforementioned projects. 90 -11.5M Planning Commission Minutes of November 5, 1990 10. COMMISSION COMMENTS Page 16 Commissioner Lanahan inquired of staff whether a signal would be provided within the Los Angeles Avenue Widening project. 11. STAFF COMMENTS 12. None.
