Minutes of December 3, 1990
The regular meeting of the Planning Commission held December 3,
1990. In the Council Chambers of City Hall, 799 Moorpark Avenue,
Moorpark, California.
1. CALL 'TO ORDER
Called to order at 7:00 p.m. by Commissioner Glen Schmidt.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance led by Commissioner Glen Schmidt.
3. ROLL CALL
PRESENT: Commissioners Glen Schmidt, Roy Talley, Jr.,
Michael H. Wesner, Jr.
ABSENT: None. (2- vacancies)
OTHER CITY OFFICIALS AND EMPLOYEES PRESENT:
Patrick J. Richards, Director of Community
Development; Pat Dobbins, Assistant City Engineer;
Debbie Traffenstedt, Senior Planner; Celia
LaFleur, Administrative Secretary.
At this point in the agenda the Commission by general consensus
reorganized the agenda to proceed with the Secretary administering
the Oath of Office to the appointed Commissioners.
8. REORDERING OF AND ADDITIONS TO THE AGENDA
Secretary administered the Oath of Office. The Commissioners
took their seat at the dias. Nominations opened for Interim
Chairman and Interim Vice Chairman.
Motion: Commissioner Glen Schmidt moved and Commissioner
Wesner second motion to appoint Commissioner Roy
Talley as Interim Chairman. Motion passed by
unanimous voice vote.
Motion: Chairman Talley moved and Commissioner Wesner
second a motion to appoint Commissioner Glen
Schmidt as Interim Vice Chairman.

Each of the Commissioners acknowledged their commitment and
thanks to serve as Planning Commissioner.
4. APPROVAL OF MINUTES
November 19, 1990
Motion: Commissioner Schmidt moved and Commissioner Wexner
second a motion to approve the minutes of November
19, 1990 as presented.
Motion passed by unanimous voice vote.
5. PROCLAMATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS

9. PUBLIC HEARINGS
A. Vesting Tentative Tract May No. 4620 - JBH Development
ComnariV
Subdivision of a 348 acre site into 66 residential lots with
a minimum lot size of 5 acres consistent with existing zoning.
Located west of Walnut Canyon Road and approximately one half
mile north of Casey Road.
Continued from November 19, 1990. Public hearing remained
open.
At this time Commissioner's Glen Schmidt and Michael H.
Wexner, Jr. stated for the record. "Preceding the meeting of
December 3, 1990, staff had provided staff reports, and
cassette tapes recording the November 19, 1990 public hearing
on this matter.
Staff gave an overview of the Commissions November 19, 1990
discussion and concerns of Vesting Tentative Tract Map No.
4620.

Testimony received by the following:
Stan Cohen, representing the applicant, 300 Esplanade Drive,
Oxnard, CA. Mr. Cohen stated that he accepted the
Commi3sioner'8 statement, although not physically present at
the November 19, 1990 meeting.
Mr. Cohen agreed with staff recommended condition no. 118. On
equestrian trails, Mr. Cohen perceive staff recommended
condition as premature for dedication of easements because of
the unknown number of residents involved. Mr. Cohen requested
that the Fire Department determine the street width required
within condition no. 33.
The Commission requested information concerning the existing
Aspen Hills Drive width. Staff replied that now the road
width is 16 feet, and is conditioned within another
entitlement to be increased by an additional 4 feet in width.
David Potter, Potter Engineering, 12 N. Ash Street, Ventura,
CA.
Pete Peters, 7155 Walnut Canyon Road, Moorpark, CA. Mr.
Peters supports the developer in their proposal. Commended
the developer for working towards the development of
equestrian trails.
Bill Howseman, 150 E. Los Angeles Avenue, #205, Moorpark, CA.
Mr. Howseman informed staff that he did not receive a notice
of public hearing. He also expressed his concern for the road
widening of Aspen Hills Drive In his opinion, it would
increase the traffic volume. Mr. Howseman's request was that
staff consider a gate at Gabbert Road to avoid additional
traffic.
Dan Swinburne, 6685 Aspen Hills Drive, Moorpark, CA. Mr.
Swinburne agreed with Mr. Howseman that the developer provide
a gate at Gabbert Road leading to Aspen Hills Drive.
The Commission questioned Mr. Swinburne as to how much traffic
now exists? Mr. Swinburne replied "mostly on weekends he has
observed drivers in the area."
Mark Taillon, 6617 Aspen Hills Drive, Moorpark, CA. Mr.
Taillon informed the Commission that now he along with three
other property owners have an agreement for shared maintenance
of Aspen Hills Drive.

Mr. Taillon's request was that staff consider the fire access
road gated by card key or a locking mechanism to avoid
additional traffic impact on Aspen Hills Drive.
At this point in the discussion the Commission requested staff
to consider that the Home Owners Association request to
require a fee for the use of the equestrian trail facilities.
Mr. Cohn stated that the HOA maybe acquiring more than it's
usual power in that request. Mr. Peters also replied that
the State should regulate the equestrian trails and not the
HOA.

second a motion to approve Vesting Tentative Tract
No. 4620 along with staff's recommended conditions.
Direct staff to work with the Fire Department in
determining the required road width of Aspen Hills
Drive. Motion passed by a unanimous voice vote.
B.
Ordinance No. 112 currently requires a conditional use permit
to allow operation of a child day care facility in industrial
and commercial zones. The proposal is to amend the zoning
code to allow child day care centers and schools (elementary
and secondary) to be operated with an industrial use in a:
M -1 (Industrial Park) Zone;
or in an existing commercial building in a C -1
(Neighborhood Commercial);
C -2 (General Commercial);
CPD (Commercial Planned Development);
C -O (Commercial Office) zone,
subject to approval of a minor modificaiton to an existing
industrial or commercial planned development permit. In
conjunction with amendment of the zoning code, Ordinance No.

112 would be repealed, because it would be superseded by this
zoning code amendment.
Location affects all Industrial Park (M -1) and Commercial (C-
1, C -2, CPD, and C -O) zones citywide.

Testimony received by the following:
Mike :Horowitz, 619 Pitch Avenue, Moorpark, CA. Mr. Horowitz
stated overnight parking was restricted within the industrial
area. Also, that a day care facility should not be allowed in
the industrial zoned areas.
Commissioner Schmidt commented that Moorpark should be
commended for it's efforts to provide child care facilities in
industrial zones. A positive move in parent /child relations.
Commissioner Wesner supported the amendment which develops
positive moral.
Motion_ Commissioner Schmidt moved and Commissioner Wesner
second a motion to approve the amendment to the
zoning code to allow child day care centers and
schools (elementary and secondary) to be operated
in conjunction with an industrial use in a:

10. DISCUSSION /ACTION ITEMS
None.
11. COMMISSION COMMENTS
Commissioner Schmidt requested that staff provide a preview of
items to come before the Commission. Also, that light
meetings provide for time and discussions of process of
planning and procedures.
Also commended the city for it consistent work in the
improvements of the Union 76 station curb alignment.
Commissioner Talley commented on the Texaco Station. Provided
a status on the Texaco site.
