HomeMy WebLinkAboutMIN 1991 0107 PC REGPlanning Commission, City of Moorpark, California Minutes of January 7, 1991 The regular meeting of the Planning Commission held on January 7, 1991 in the City Council Chambers located at 799 Moorpark Avenue, Moorpark, California. 1. Call to Order The meeting was called to order at 7:00 p.m. Chairman Roy Talley, Jr. presiding. 2. Pledge of Allegiance The Pledge of Allegiance was led by Commissioner Michael H. Wesner, Jr. 3. Roll Call Present: Commissioners Michael H. Wesner, Jr, Roy Talley, Jr., Absent: Commissioner Glen Schmidt (excused). Other City Officials and Employees present: Patrick J. Richards, Director of Community Development; Pat Dobbins, Assistant City Engineer; Craig Malin, Assistant Planner; and Celia LaFleur, Administrative Secretary. 4. Proclamations Commendations and Special Presentations A. Secretary administers the Oath of Office At this point in the agenda Chairman Talley requested that John Torres step beside the podium to receive the Oath of Office. B. Comments from the newly appointed Commissioner Commissioner Torres thanked Councilmember John Wozniak for his nomination to the Planning Commission and Mayor Paul Lawrason for his appointment to the Planning Commission. Commissioner Torres said he looked forward to working with the Planning Commission in their endeavors to serving the city in good planning practices, and addressing in community concerns. 5. Reordering of, and additions to the agenda. None. 6. Approval of Minutes December December December April 25 December June 12, 3, 1990 3, 1986 11, 1985 1985 11, 1984 1984 Motion: Commissioner Talley moved and Commissioner Torres second a motion to approved the minutes of December 3, 1990, December 3, 1986, December 11, 1985, April 25, 1985, December 11, 1984, June 12, 1984 with a modification to the minutes of December 3, 1986 to include Commissioner John Wozniak present; and a correction to the minutes of December 11, 1985 on page 4, "..Parking....... ". Motion passed by a unanimous voice vote. 7. Public Comments None. 8. Consent Calendar None. a: \91 -1.7 Planning Commission, City of Moorpark, California ( Minutes of January 7, 1991 Paae -3- 9. Public Hearings A. Land Division Moorpark Permit No LDM -90 -3 Anka Nassi The applicant is proposing to subdivide a 17.26 acre parcel (gross) into three parcels of 6.82, 5.0 and 5.0 (net). The proposed subdivision is located at 7505 Walnut Canyon Road, Moorpark, CA 93021. On December 17, 1990 by letter, the applicant requested that this item be continued from December 17, 1990 to the next regular meeting of the Commission. Presented by Craig Malin, Assistant Planner; Staff Report dated December 17, 1990. Commissioner Wesner questioned staff about access roadway /driveway and whether an approved turn around areas could provide for fire apparatus. Staff's reply was that Condition No. 51 addressed Commissioner Wesner's concerns. Testimony received by the following: Steve Liska, 300 Montgomery Avenue, Oxnard, CA 93030. Mr. Liska stated to staff that he had reached a general concurrence with staff's recommended conditions. Commissioner Torres inquired of Mr. Liska as to the size of the structure on Parcel A. Mr. Liska responded 1,800 sq.ft. and has been removed. Also, the structure on Parcel B will remain. It was the Commission's concern that the structure on Parcel B be identified as to the current legal status and that Condition No. 18 be amended to reflect the concern. Motion: Commissioner Wesner moved and Commissioner Torres seconded a motion to approve Land Division Moorpark Permit No. LDM -90 -3 as recommended by staff with a revision to Condition No. 18 to read as follows: a: \91 -1.7 0 Prior to recordation of the Parcel Map, the existing structure on Parcel B shall be either: 1) shown to be a legal dwelling unit as evidenced by the applicant producing a zoning clearance, building permit, occupancy permit or similar document Planning Commission, City of Moorpark, California Minutes of January 7, 1991 Page -4- acceptable to the Director of Community Development; or 2) convert to an accessory structure with the approval of a zoning clearance from the City; or 3) removed from the subject site. Motion passed by an unanimous voice vote. 10. Discussion /Action Items None. 11. Commission Comments Commissioner Talley directed staff to investigate the noise level coming from the Texaco Gasoline Station and provide a report back to the Commission at their next regular meeting. 12. Staff Comments The Director gave the Commission a brief outline of coming events.
