Minutes of February 19, 1991
The regular meeting of the Planning Commission held on February 19,
1991 in the City Council Chambers located at 799 Moorpark Avenue,
Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:10 p.m.. Chairman Roy
Talley presiding.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Commissioner Michael
Wesner.

Present: Commissioners John Torres, Michael H. Wesner Jr.,
and Chairman Roy Talley Jr.
Absent: Glen Schmidt (excused absences)
Other City Officials and Employees present:
Patrick J. Richards, Director of Community Development;
Deborah S. Traffenstedt, Senior Planner; John Knipe, City
Engineer; Pat Dobbins, Assistant City Engineer; and Celia
LaFleur, Administrative Secretary.
4. APPROVAL OF MINUTES
Motion_: Commissioner Torres moved and Commissioner Werner
seconded a motion to approve the minutes of January
22, 1991 as submitted.
Motion passed by a unanimous voice vote.

A
Consideration of a Draft Environmental Impact Report
reoardino:
The applicant is proposing to construct the following
housing:
110 single - family detached units,
175 multi - family units,
Location: 850 West Los Angeles Avenue, (south of Los Angeles
Avenue, east of Maureen Lane, and west of Liberty Bell Road).
The Director introduced Steve Craig as the case contract
planner on the Westland project. Mr. Craig is with the firm
of Planning Center.
Mr. Craig identified the Staff Report of February 19, 1991
regarding a Draft Environmental Impact Report. In his
presentation he went on to state that staff's recommendation
for the Commission was to open the public hearing, take
testimony form any member of the public interested in making
comments, and close the public hearing on the adequacy of the
environmental document. He also identified for the public

that 'the 45 day review period for the project extends to March
11, 1991 and that written comments would not be accepted after
that date.
Mr. Craig proceeded with his presentation and at the
conclusion Chairman Talley opened the public hearing on the
Draft Environmental Impact Report.
Testimony received by the following:
Allen Camp, attorney representing the applicant, 5450
Telegraph Road, Ventura. Mr. Camp determined the Draft
Environmental Impact Report to be comprehensive.
Mitri A. Muna, 2654 Whitechapel Place, Thousand Oaks, CA
91362. Representing the property owners east of the proposed
development and concern of the proposed extension of Unidos
which is not currently on the General Plan or within the Draft
Environmental Impact Report extending east to Liberty Bell
Road. Mr. Muna request was that the applicant meet and work
towards this concern.
Maybel Ortiz, 12552 James Weak Avenue, Moorpark, CA 93021.
Ms. Ortiz expressed her concerns by stating that she lives
adjacent to the proposed development and is concerned with
additional traffic impacts. Currently traffic circulation is
at its worst, the noise level is high and the children safety
is an. issue in regards to their current bus stop location.
Her question was how would these impacts be mitigated?
Nancy M. Thomas, 4762 Maureen Lane, Moorpark, CA 93021. Ms.
Thomas an adjacent property owner was concerned with the
impact of the development. Grading issues, grade level
between properties, rodents during grading, fencing, when and
how long grading would take place. Water rationing, how will
this proposed development affect the water problems? Ms.
Thomas questioned how underground utilities will be placed,
will her existing rear structures need to be relocated?
Steve Craig indicated to Ms. Thomas by stating that a written
response would be provided at the next meeting.
Motion: Commissioner Torres moved and Commissioner Wesner
second a motion to continue the public hearing
regarding the EIR to the Planning Commission
meeting of March 18, 1991.

Motion passed by a unanimous voice vote.
B. Tentative Tract Mao No. 4652 - Abe Gun
The applicant is proposing a subdivision of a 35.8 acre
property into 18 single family lots zoned Rural Exclusive (RE)
and one remainder parcel zoned RE -5 Acre. The total gross
area of the project site to be subdivided is 7.1 acres. The
minimum lot size of the 18 proposed lots is 10,000 square
feet. The remainder parcel would be 29.71 acres in size, is
proposed to be used as a borrow site during grading
operations, and may be further subdivided in the future.
Located west of Walnut Canyon Road (State Highway 23) and just
north of Casey Road in the City of Moorpark.
Presented by Debbie Traffenstedt, Senior Planner. Staff
Report referenced and dated February 12, 1991 and addendum
dated February 15, 1991 concerning issues not covered in the
February 12, 1991 staff report; 1) compliance with Measure F;
2) applicants proposal to provide a affordable, first time
home buyer unit; and the whether road should be public or
private.
Ms. Traffenstedt concluded with her presentation. Chairman
Talley opened the public hearing.
Testimony received by the following:
Abe Guny, the applicant, 7250 Walnut Canyon Road, Moorpark, CA
93021. Mr. Guny noted the following concerns:
1. Length of time in processing TR -4652, since 1988 although
approved in 1984.
2. Three changes to the map.
3. Project time account has not been provided.
4. Housing unit sold as low income.
5. water run -off from adjacent property.
Linda Mackinson, 17934 Hatton Street, Reseda, CA.
Representing the applicant. Ms. Mackinson noted her concerns
as follows:
1. Hillside and ridgeline requirements, lots within 20%
slope areas.
2. Further delays would be costly.

3. Condition No. 83, regarding applicant's prorated share of
the costs of improvements to the intersection of Broadway
Avenue /Walnut Canyon Road, how will these costs be
shared? Consider a solutio to the Traffic Mitigation
fee.
4. That the school bus turnout proposed is dangerous,
recommend that the school bus turnout be located on Casey
Street or on the high school property.
5. Home owner Association in the proposed development
unjustified if there are no common areas and if the
slopes are part of the parcel.
6. Public streets would provide means for maintaining the
streets by collecting by property tax.
7. Condition No. 93 be modified to read "all weather road
surface be provided "............
Terry Hockett, the applicants Traffic Engineer, 2151
Alessandro Drive, Suite 210, Ventura, CA 93001. Mr. Hockett
informed the Commission that he was available for questions if
needed.
Bill Jensen, the applicants Civil Engineer, Lockman &
Associates, 1534 Eastman Avenue, Suite A, Ventura, CA 93003.
Mr. Eastman noted to the Commission that the applicant has
worked toward accomplishing minimize grading for this
development.
Lowell N. Richards, 287 Casey Road, Moorpark, CA. Mr.
Richards expressed his concerns over the drainage
specifications in reducing the outlet from 81x6' to 61x6'.
Regarding the Home Owners Association, who will this
association include, the new 18 lot property owners,
surrounding property owners? Also concerns with cars
stacking on Casey Road since the Boys and Girls Club
relocation at the school site. That the applicant consider
naming "A" Street "Richards Street ".
Staff at this point clarified to the applicant that street
naming would be an item that would require the City Council's
approval.
Lowell Withington, 295 and 261 Casey Road, Moorpark, CA. Mr.
Withington requested the Commission and staff to eliminate
sidewalk requirement on the west side of "A" street which
would require property owners to dedicate a portion of their
property for sidewalks.

Joe Latunski, 289 Casey Road, Moorpark, CA. Mr. Latunski gave
the Commission background information relating to how he had
acquired access and previous court proceedings regarding
access roads. His concerns were that his would be land - locked
if the applicant was not required to provided access roads.
Valerie Jacoby and Thomas Jacoby, 1017 Walnut Canyon Road,
Moorpark, CA. The Jacoby's were also concerned with their
property being land - locked if access roads were not provided.
Thomas Jacoby informed the Commission that he has provided
maintenance for the past ten years on the existing road which
also leads to lots 3 and 4 on the current proposal.
Lynnette Scaroni, 5740 W. Greentree, Somis, CA. Ms. Scaroni
identified herself as the property owner of four parcels on
Everette Street and informed the Commission of her support in
the proposed development.
Mr. Guny at this point in the meeting addressed the Commission
and stated that he would be willing to work with the Jacoby's
in trying to resolve the matters of an access road.
Mr. Guny also mention to the Commission and staff that some
time ago Mr. Latunski was approached with a proposed access
road presented by JBH Development and that Mr. Latunski
refused the proposal. Mr. Latunski then stepped forward and
sited JBH's proposal.
Carl C. Schiff, the applicants attorney, 7041 Owensmouth
Avenue, #101, Canoga Park, CA. Mr. Schiff informed the
Commission that a current suit is before the courts related to
access rights and this matter should not have any impact on
the Commission's decision.
Commissioner Torres commented to the applicant that he should
consider meeting with the school district to consider the
relocation of the proposed bus stop location.
The Director addressed the Commissions inquiry regarding
Covenant and Agreement for Traffic Mitigation. By requiring
the applicant to commit to the agreement "the applicant state
that he will not protest future funding for traffic
improvements."

Commissioner Torres inquired, "what determines private road
opposed to public roads ?" The Director replied that there is
no specific criteria. Generally, where a subdivision roadway
system will not be a direct public benefit, the City may only
ask for future dedication rights. Also, the size of a
subdivision can play a part in the decision.
Motion: Commissioner Wesner moved and Commissioner Torres
second a motion to continue TR -4652 to the Planning
Commission meeting of March 4, 1991. And directed
staff to work with the applicant on the following
issues brought forward on 1) Traffic Mitigation
Fee; 2) relocation of the bus stop; 3) an access
road for surrounding property owners at 1017 Walnut
Canyon Road, and 289 Casey Road; 4) 20% slope
areas; 5) zone boundary issue.
Motion passed on a 3:0 vote.
10. DISCUSSION/ACTION ITEMS
None.
11. COMMISSION COMMENTS
The Commission requested staff to prepare a list of possible
agency speakers to provide background information on matters
pertaining to topics such as Air quality, LAFCO, Water &
Sewer, Fire Service and Development Standards
12. STAFF' COMMENTS
Staff gave the Commission a status regarding their request for
Code Enforcement to review Coast Auto Salvage for possible
persons residing in cars. Staff reported that no persons were
living in any vehicles.
