Minutes of March 4, 1991
The regular meeting of the Planning Commission held on March 4,
1991 in the City Council Chambers located at 799 Moorpark Avenue,
Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:15 p.m.. Chairman Roy
Talley, Jr. presiding.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance led by Commissioner Glen Schmidt.
3. ROLL CALL
Present: Vice Chairman Glen Schmidt, John Torres, Michael
Wesner, Jr., Chairman Roy Talley, Jr.
Absent: Michael H. Wexner, Jr. (excused absence)
Other City Officials and Employees present:
Patrick J. Richards, Director of Community Development;
Deborah S. Traffenstedt, Senior Planner; Charles Abbott, City
Engineer; John Taylor, Assistant City Engineer; Claude
Steward; and Celia LaFleur, Administrative Secretary.
4. PROCLAMATIONS. COMMENDATIONS AND SPECIAL PRESENTATIONS
The Director of Community Development introduced Charles
Abbott, City Engineer, John Taylor, Assistant City Engineer
and Claude Stewart, Public Works Inspector, and then gave a
background information on the engineering firm of Charles
Abbott Associates.
5. REORDERING OF AND ADDITIONS TO THE AGENDA

6. APPROVAL OF MINUTES
By general consensus the Commission deferred the Planning
Commission minutes of February 19, 1991 to their next regular
meeting of March 18, 1991.
7. PUBLIC COMMENTS
None.
B. CONSENT CALENDAR
None.
9. PUBLIC HEARINGS
A. Tentative Tract Mao No. 4652 - Abe Guny
The applicant is proposing a subdivision of a 35.8 acre
property into 18 single family lots zoned Rural Exclusive (RE)
and cne remainder parcel zoned RE -5 Acre. The total gross
area of the project site to be subdivided is 7.1 acres. The
minimum lot size of the 18 proposed lots is 10,000 square
feet. The remainder parcel would be 29.71 acres in size, is
proposed to be used as a borrow site during grading
operations, and may be further subdivided in the future.
Located west of Walnut Canyon Road (State Highway 23) and just
north of Casey Road in the City of Moorpark. Continued from
the Planning Commission Meeting of February 19, 1991.
Debbie Traffenstedt, Senior Planner provide background
information on Tentative Tract Map No. 4652. Outstanding
issues brought forward at the February 19 meeting included:
1. School bus turnout location
2. Private easement conflict
3. Reduce impacts to 20% and greater slopes
4. Zone boundary location
5. Cumulative traffic mitigation fee
6. Private versus public roads
At this point in the meeting Commissioner Schmidt addressed
the Chairman and the applicant. Stating that although he had
been absent from the February 19 meeting he had requested from
staff the tape recordings of such meeting.

Commissioner Schmidt inquired of the applicant if there were
any concerns regarding his participation on this matter. The
applicant replied, no.
Testimony received by the following:
Abe Guny, 7250 Walnut Canyon Road, Moorpark, CA 93021. Mr.
Guny spoke about his efforts to resolve the issues of concern.
Addressing item no. 1 School bus turnout. Mr. Guny agreed
with staff, to revise condition no. 57 to construct a bus stop
on the north side of Casey Road. Item no. 2 Private Easement
Conflict. Mr. Guny stated to the Commission that a proposal
was made to the affect property owner and this would be a
matter for both parties to consider and resolve. The issue
addressing the 208 slope would be presented by Linda
Mackinson, project coordinator. Regarding the zone boundary.
Mr. Guny requested the Commission staff to determine that the
boundary be consistent with the northerly boundary of Lot 18.
Addressing item no. 5 Cumulative Traffic Mitigation Fee. Mr.
Guny again agreed with the required payment of $3,000 per lot
for cumulative traffic mitigation. Item no. 6 Private versus
Public Roads. Mr. Guny no longer objected to the requirement
for private roads and the formation of a homeowners
association.
Linda Mackinson, project coordinator, 17934 Hatton Street,
Reseda, CA. Ms. Mackinson proceeded to give an overview of
the applicant's plan for grading and addressing the issues of
208 slope concerns. Ms. Mackinson provided the Commission
with information on eleveaions, and cut and fill produced by
the lots in question.
Commissioner Schmidt inquired of the applicant's
representative whether the issues of drainage improvements had
been considered. Ms. Mackinson responded, saying that
provisions were made by conditioning the applicant. Also,
she :suggested that the city should originate an area of
benefit, for improvements within a specific area. The
developer shoul only provide a contribution of funds to help
support future specific improvements overall.
Valerie Jacoby, 1017 Walnut Canyon Road, Moorpark, CA. Ms.
Jacoby at the meeting submitted pictures and an illustration
of the applicants proposal. Ms. Jacoby stated the proposal
provided by Mr. Guny was financially infeasible. Purchasing
on additional easement and providing retaining walls, at 21

feet in height would be a hardship to accomplish. Ms. Jocoby
was concerned about work to be accomplished on her connected
city sewer when it would be 14 feet under fill dirt.
Lowell Richards, 287 Casey Road, Moorpark, CA. Mr. Richards
reiterated his comments previously address at the February 19
meeting. They were concerns associated with drainage. He
inquired of staff what property owners are part of homeowners
association. Staff responded that only the new 18 lots.
Commissioner Schmidt stated that drainage concerns should be
imprcved and expanded to meet the needs of current
development.
Joe Latunski, 289 Casey Road, Moorpark, CA. Mr. Latunski
reiterated his comments from the previous public hearing on
the matter.
Commissioner Schmidt inquired what option were before the
Commission at this point? The Director proceeded to inform
the Commission that an entitlement for a subdivision requires
the Commission's review and recommendation only. That the
City Council under the recommendation of the Commission to
give more consideration with specific areas of concern.
PIIBLIC HEARING CLOSED
Motion: Commissioner Schmidt moved and Commissioner
Talley second a motion to approve Resolution
No. 231 to deny TR -4652 without prejudice,
based on the following concerns:
1. The problems that would occur in the fill
areas, not the cut areas.
2. The need to re- evaluate downstream (drainage)
issues.
3. The access easements between adjacent property
owners needs to be resolved before a final
decision is made.
4. Concerns with the safety of turning movements
at the Casey Road and Walnut Canyon
intersection.

Motion passed on a roll call vote:
Ayes: Commissioners Schmidt, Talley;
Noes: Commissioner Torres;
Absent: Commissioner Wexner.
Subdivision of an existing 7.52 acre parcel into two
parcls of 2.88 and 4.64 acres. Industrial Planned
Development Permit and Conditional Use Permit to
construct 135 room hotel and free standing 5,100 square
foot restaurant.
Variance to permit tower element, to extend a maximum of
4 feet in the rear yard setback, permit decorative
hardscape paved delivery access to be placed in the rear
yard setback area and permit parking requirements for
hotel /restaurant to be reduced.
Location is proposed at the northeast corner of Flinn
Avenue. East of Spring Road and south of Southern
Pacific Railroad.
This item was continued to the next regular Planning
Commission meeting of March 18, 1991, at the request of the
applicant.
10. STAFF COMMENTS

Staff gave a brief update on the status of the Texaco Gasoline
Station, on Moorpark Avenue
Commissioner Schmidt advised staff that he would not be
present at the March 18, 1991 Planning Commission meeting.
