CALL TO ORDER Meeting called to order at 7:05 p.m. Vice Chairman Glen Schmidt presiding. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance led by Commissioner John Torres. 3. ROLL CALL Present: Vice Chairman Glen Schmidt, John Torres, Michael Wesner Jr. Absent: None. Other City Officials and Employees present: Patrick J. Richards, Director of Community Development; Deborah S. Traffenstedt, Senior Planner; Paul Porter, Senior Planner; Tim DeNiro, Impact Sciences; Steve Craig, The Planning Corporation; Charles Abbott, City Engineer; Jon Taylor, Assistant City Engineer; and Celia LaFleur, Administrative Secretary. 4. APPROVAL OF MINUTES MOTION: Commissioner Schmidt moved and Commissioner Torres second a motion to approve the minutes of: February 19, 1991 (PC), March 4, 1991 (PC), January 14, 1991 (J), April 30, 1986 (J), December 9, 1985 (J), January 3, 1985 (J). Motion carried by a unanimous voice vote. 7. PUBLIC COMMENTS Connie Lawrason, 4291 Ambermeadow, Moorpark, CA. Mrs. Lawrason spoke in support of the Martin V. Smith hotel project. B. CONSENT CALENDAR RESOLUTION NO. PC -91 -231 A RESOLUTION OF THE PLANNING COMMISSION, CITY OF MOORPARK, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL DENY WITHOUT PREJUDICE TENTATIVE TRACT MAP NO. 4652 (APPLICANT: ABE GUNY) MOTION: Commissioner Torres moved and Commissioner Wesner second a motion to approve Resolution No. PC -91 -231 as presented. Motion carried by a unanimous voice vote. 9. PUBLIC HEARINGS A. Consideration of a Draft Environmental Impact Report regarding: The applicant is proposing to construct the following housing: r a: \91 -4.1 Planning Commission, City of Moorpark, California Minutes of: April 1, 1991 Page -3- 110 single - family detached units, 175 multi - family units, Location: 850 West Los Angeles Avenue, (south of Los Angeles Avenue, east of Maureen Lane, and west of Liberty Bell Road). The Director of Community Development gave background information as it related to the Commission's February 19, 1991 meeting on the project. Mr. Craig cited the Planning Commission Staff Report dated April 1, 1991. In the presentation Mr. Craig stated that public written comments were received and provided within the Draft Environmental Impact Report. Along with Ventura County Agency responses within the DEIR. The public comments received are as follows, Mr. Craig addressed a response for each concern. a. Whether existing residences rear wall height would be adequate screening. A recommendation for adjustments. b. Quality of life, the proximity of rural with the proposed adjacent high density use. .A horizonal /vertical buffer separation to be considered. Commissioner Wesner inquired of staff how setbacks are determined? Mr. Craig said that the City's Zoning Ordinance would be applicable and if needed, modifications could be made. Commissioner Schmidt suggested that the traffic pattern for the existing Maureen Lane residents could be reduced by 1) not providing any connector streets to Maureen Lane, and that it remain a cul -de -sac; 2) that a sign be posted "Not A Through Street ". Testimony received by the following: 1. Becky Gunn, 4730 Maureen Lane, Moorpark, CA. Ms. Gunn's concerns related to housing mix. The current 1 1i: - 2 acre lots now maintain livestock, horse, roosters, which contribute to dust, flies and odors. Ms. Gunn recommendation was that a: \91 -4.1 Planning Commission, City of Moorpark, California Minutes of: April 1, 1991 Page -4- one story homes be built at rear yards of Maureen Lane residences. A signal provided at Maureen Lane. 2. Lucy Burrard, 4887 Maureen Lane, Moorpark, CA. Ms. Burrard concern was that her animals are not appreciated by "city folk ". 3. Jeff Markel, 4967 Maureen Lane, Moorpark, CA. Opposed to condemnation of property for street access. Prefers single story homes. 4. Elaine Markel, 4967 Maureen Lane, Moorpark, CA. Oppose. Requested that the Planning Commission consider 1) single story homes; 2) posted sign "Not A Through Street "; 3) children safety on the street. 5. Vera Sorrels, 4789 Maureen Lane, Moorpark, CA. Uncommitted. Ms. Sorrels concerned that the Waterworks District has requested residents to voluntarily cut back water usage by 108, faith the current proposed development cut backs could be higher. 6. Leonard Patterson, 4788 Maureen Lane, Moorpark, CA. Oppose. Mr. Patterson had the following concerns: a. Proposed landscape buffer would screen the sunlight. b. Developing on a flood plain. C. No two story dwellings. d. That the new park site located across the arroyo would bring additional traffic, and trespassing of private property. e. .Additional traffic on Maureen Lane. f. Signalization at Maureen Lane. g. Water consumption. 7. Dominic A. Thoman, 4762 Maureen Lane, Moorpark, CA. Mr. Thoman concerned with the additional traffic, buffer zone, provide single story homes, and the wall provided at the rear of the existing Maureen Lane homes, children would he attracted to the animals and climbing over the wall. 8. Daniel Stack, 4833 Maureen Lane, Moorpark, CA. Mr. Stack was concerned with the following: a. Dust created by the horses would not be tolerated by the a: \91 -4.1 Planning Commission, City of Moorpark, California Minutes of: April 1, 1991 Page -5- new homeowners. b. The current drought situation. C. That the buffer zone should be increased, example Beltramo Road. 9. Gerry Goldstein, 11932 Los Angeles Avenue, Moorpark, CA. Mr. Goldstein discouraged development on the flood plain area. Referenced a past occurance on Beltramo Road which cause 3/4 acre eroision after a heavy rain fall. The Commission inquired of staff of concerns relating to traffic issues, buffer zone, signalization, drought situation. Mr. Craig replied that these concerns expressed by all who spoke could be address in ways of conditioning the project, such items for recommendation could include: a. Recommendation for a live park (buffer zone). b. wall screening C. Recommendations could include signalization at Maureen Lane, Gabbert Road, and dual access to the east to Unidos Avenue. d. Expand setbacks e. Expand zoning setback requirements and dedicate as a trail. PUBLIC HEARING CLOSED AT 8:10 P.M. Motion: Commissioner Torres moved and Commissioner Wesner second a motion to close the public hearing, and recommending that the City Council certify the Final Environmental Impact Report as adequate, pursuant to the California Environmental Quality Act, for Westland Company Residential project (GPA -90 -2, RPD -90 -3; and RPD- 90 -4). Planning Commission, City of Moorpark, California Minutes of: April 1, 1991 Page -6- V -90 -2 (Variance) - Martin V. Smith and Associates Subdivision of an existing 7.52 acre parcel into two parcels of 2.138 and 4.64 acres. Industrial Planned Development Permit and Conditional Use Permit to construct 135 room hotel and free standing 5,100 square foot restaurant. Variance to permit tower element, to extend a maximum of 4 feet in the rear yard setback, permit decorative hardscape paved delivery access to be placed in the rear yard setback area and permit parking requirements for hotel /restaurant to be reduced. Location is proposed at the northeast corner of Flinn Avenue. East of Spring Road and south of Southern Pacific Railroad. Presented by Senior Planner Paul Porter. Mr. Porter referenced Staff Report dated February 26, 1991. PUBLIC HEARING OPENED AT 8:55 P.M. Testimony received by the following: 1. Mitch Kahn, representing the applicant, 300 Esplanade Drive, Oxnard, CA. Mr. Kahn spoke on several matters related to conditions of approval and referred to his March 27, 1991 letter to staff. Mr. Kahn addressed the proposed Flynn Road realignment (condition no. 25), the cost of the box drainage culvert, the sign limits proposed an d variance issues. 2. Ebb Vederilssen, architect for the applicant. Mr. Vederilssen provided the Commission with various items related to the design and structure of the proposed hotel, restaurant proposal. 3. Terry Hockett, Traffic Engineer, Thomas Montgomery & Associates, 2151 Alessandro Drive, Ventura, CA 93001. Discussed issues about traffic signalization. Mr. Hockett's recommendation was that a signal be provided at Flynn Avenue. Along with the previous recommendation to have the dual signals approved is still being considered. a: \91 -4.1 ,.- Planning Commission, City of Moorpark, California utes of: April 1, 1991 Paae -7- 4. Abe Guny, 7250 Walnut Canyon Road, Moorpark, CA. Mr. Guny concerns is that his office which is directly behind the new proposal would take away his view; that the city is over developing and the current commercial areas are still lacking tenants. 5. Joy Cummings, 640 Bard Street, Moorpark, CA. In support of the project, encouraged staff to work with the applicant. Ms. Cummings was positive in saying that the current proposal for Moorpark would bring life into to the downtown area along with other upcoming features proposed for the City of Moorpark. 6. Robert Coughlon, representing the Chamber of Commerce, 11955 Silvercrest, Moorpark, CA. Provided letters of support. Reminded the Commission that soon the freeway connector will be completed and the issues of traffic circulation will not be the issue. 7. Bill'.Poleri, Arts Committee member, 300 Moorpark Avenue, #203, Moorpark, CA. Mr. Poleri supported the hotel project, saying that future events will bring housing here in Moorpark and r people will not have to go to surrounding cities. 8. Eloise Brown, 13193 Annette, Moorpark, CA. Ms. Brown stated that tax collector would be good for the city that the applicants proposed sign can be changed to attract other businesses, and would be an enhancement to the downtown area. 9. Ken Scribner, 554 Flinn Avenue, Moorpark, CA. Supports the proposal. 10. Gerry Goldstein, 11932 Los opposed to the project. project appears close to train derailment. 11. Ethel Sulkis, 270 Sierra A proposal. Angeles Avenue, CA. Mr. Goldstein He stated his concerns that the the railroad, noise impacts, and venue, Moorpark, CA. Supports the 12. Francis Okyfre, 480 E. Los Angeles Avenue, CA. Supports the proposal and looks forward to new hotel business clients. Request that the Planning Commission move forward by solving the issues of concern. a:\91 -4.1 Planning Commission, City of Moorpark, California Minutes of: April 1, 1991 PUBLIC HEARING CLOSED AT 10:15 P.M. The Commission members were in favor of the project and commented on the following issues: a. They did not support the need to realign Flynn Avenue. b. There was support for a signal only at Flynn Avenue. However, there was also some support from the minority to have the dual signals approved as described by the applicants traffic consultants in the March 27, 1991 letter. C. They agreed to support Mr. Kahn's proposal to form an assessment district to solve the drainage issue. d. The loading zone matter was a non issue and they supported the Community Development's proposal to use part of the rear setback. e. The use of shared parking for this project was acceptable. Motion: Commissioner Wesner moved and Commissioner Torres F seconded a motion to approve the proposed project with the deletion of conditions no. 25 and other issues discussed. Motion passed on a unanimous voice vote. Motion: Commissioner Wesner moved and Commissioner Torres seconded a motion to direct staff to prepare a resolution of approval based on staff and the applicant resolving the issues discussed. Motion passed by a unanimous voice vote. C. IPD -90 -15 (Industrial Planned Development. LDM -91 -1 (Land Division Map) - Litton Industries Proposal to develop a four story, 176,000 sq.ft office building to be used for administration, and research and development. Located at the northeast corner of South Condor Drive and Los Angeles Avenue in the Moorpark Business Center. a: \91 -4.1 Planning Commission, City of Moorpark, California Minutes of: April 1, 1991 Presented by Tim DeNiro, Impact Sciences. Referenced staff report dated April 1, 1991. There were., no public speakers on this project. The applicant presented the Commission and staff an eleven (11) page letter addressing thirty (30) different conditions of approval. Mr. Greg Backus, speaking for the applicant discussed only five (5) topics from his April 1, 1991 letter: 1. Litton wanted only one more sign for a total of five. 2. Requested that bonds not be required. 3. Requested that the requirement for bus turn out be deleted. 4. Requested more information regarding the formation of an underground assessment district. 5. Questioned all the traffic mitigation fees. The Commission did not have any specific concerns. Motion: Commissioner Wesner moved and Commissioner Torres seconded a motion to approve IPD -90 -15 (Industrial Planned Development), LDM -91 -1 (Land Division Map) - Litton Industries based on staff and the applicant resolving differences regarding condition language and to return to the Commission with a resolution recommending approval of this project to the City Council at their April 15, 1991 meeting. Motion passed by a unanimous voice vote. 10. STAFF COMMENTS The Director informed the Commission that Reddy Pakala of the Waterworks District would provide a presentation at the City Council meeting of April 3, 1991. 11. 12.
