CALL TO ORDER The meeting called to order at 7:05. Chairman Wesner presiding. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance led by Commissioner Brodsky. 3. ROLL CALL Present: Chairman Michael H. Wesner Jr., Vice Chairman John Torres, Commissioners Glen Schmidt, Barton Miller, and Steve Brodsky. Absent: None. Other City Officials and Employees present: Patrick J. Richards, Director of Community Development; Deborah S. Traffenstedt, Senior Planner; Craig Malin, Assistant Planner; Charles Abbott, City Engineer; and Celia LaFleur, Administrative Secretary. 4. APPROVAL OF MINUTES Motion: Commissioner Schmidt moved and Commissioner Torres second a motion to approve the minutes of April 15, 1991. Motion carried by a unanimous voice vote. 7. PUBLIC COMMENTS None. 8. CONSENT CALENDAR No items for consent. 9. PUBLIC HEARINGS A. LDM -90 -7 (Land Division Moorpark) - Gerald Bridgeman Subdivision of a 1.59 acre parcel into 4 lots of 10,190; 10,145; 14,350, and 34,690 sq.ft. The Director introduced Craig Malin, Assistant Planner to the Commission. Mr. Malin proceeded with his Staff Report on LDM -90 -7, dated May 6, 1991. The Assistant Planner provided the Commission Staff Analysis in stating that the proposed subdivision does not :Include any new streets but may impact the existing circulation system. The intersection of Wicks Road and Walnut Canyon Road is served by a Stop sign and the visibility from Wicks Road to the south is adequate. The visibility to the north is almost non - existent, because of a larger hill, making left turns are extremely dangerous. The City Engineer concurred with Staff Analysis and provided the following alternative conditions: 1. Full improvement of this intersection to provide proper sight distance. a:\91 -5/6 Planning Commission , City of Moorpark, California Minutes of May 6, 1991 -or- The applicant shall make a special contribution to the City representing the applicant's share of the cost of improvements to the intersection of Walnut Canyon Road - Wicks Road. To determine the cost of these improvements, the applicant's civil engineer shall first prepare a conceptual plan to the satisfaction of the City Engineer. The plan shall be designed to identify the necessary street improvements to provide standard intersection sight distance. The applicant's share shall then be approved by the City Council prior to final Map approval. The contribution shall then be paid to the City, prior to Final Map recordation. -or- Prohibit westbound left turns at the Wicks Road - Walnut Canyon Road intersection. At this point in the meeting the Chairman opened the public hearing. All Commissioners for the record stated that they had individually visited the site with the applicant present. The Commission proceeded to respond to concerns addressing liability, signal maintenance and responsibilities, private /city street. Commissioner Brodsky inquired of staff if Alternative No. 2 were considered, "Where would additional monies come from "? The Director replied that a new Area of Benefit would need to be developed. Testimony received by the following: Gerald Bridgeman, 78 Wicks Road, Moorpark, CA. Mr. Bridgeman provided the Commission with background information as to how he had acquired the property. He went on to explain that the four accidents mentioned by Staff were not related to sight distance problems, but were due to speeding. However, Mr. Bridgeman concurred with Staff on the sight distance problem. He stated that he intends to contribute to the funding needed to provide the improvements at this intersection. a: \91 -5/6 Planning Commission , City of Moorpark, California Minutes of May 6, 1991 Ty Valleunga, 179 Wicks Road, Moorpark, CA. In support of the requested subdivision. Mr. Valleunga commented that since the high school has been relocated that traffic issues are minimal. Les Kovacs, 798 Moorpark Avenue, Moorpark, CA. Mr. Kovacs, the applicant's engineer remarked that the grading would be minimal and that water services are now adequate for an additional three dwelling units. Commissioner Miller inquired of Staff if there were any other request for development north of Wicks Road. The Director responded that currently on the east and west side of Walnut Canyon, a few lots will develop. Commissioner Brodsky commented while on site he also concurred with the sight distance problem. The Commissioner's concerns were liability, maintenance responsibilities, whether emergency vehicles turning radius was adequate, and the enforcement of the vehicle code. PUBLIC HEARING CLOSED AT 8:00 P.M. Motion: Commissioner Schmidt moved and Commissioner Miller second a motion that: The applicant shall make a special contribution to the City representing the applicant's share of the cost of improvements to the intersection of Walnut Canyon Road - Wicks Road. To determine the cost of these improvements, the applicant's civil engineer shall first prepare a conceptual plan to the satisfaction of the City Engineer. The plan shall be designed to identify the necessary street improvements to provide standard intersection sight distance. The applicant's share shall then be approved by the City Council prior to final Map approval. The contribution shall then be paid to the City, prior to Final Map recordation. Amendment to Chapter 5.52 of Title 5 of the Municipal Code - City of Moorpark The City Council has initiated an amendment to the City Municipal Code to make minor corrections to mobile home park rent control regulations. The proposed changes are for editorial reasons and will not result in any change in procedure for processing applications for mobile home park rent increases, nor will they result in any increase in rents beyond that which is allowed by the current City Code. Deborah S. Traffenstedt, Senior Planner presented the Staff Report dated April 8, 1991. Motion: Commissioner Miller moved and Commissioner Torres second a motion to approve Staff recommendation to prepare a resolution recommending that the City Council adopt an ordinance which approves minor corrections to Chapter 5.52 of 'Title 5 of the Municipal Code, and adopt a resolution which revises the mobile home park rent control administrative rules and standardized forms to be consistent with Chapter 5.52. Motion passed by a unanimous voice vote. 10. DISCUSSION ITEMS A. Entitlement Processing The Director presented the Commission with background information on the Entitlement Permit Application and processing time frame. a:\91 -5/6 Planning Commission , City of Moorpark, California Minutes of May 6, 1991 Page -6- The Commission commended Staff for its accomplishments in the components related to Entitlement Permit Processing. B. Planning Commission Goals The Planing Commission concurred with their goals to include the following: To fulfill the intent of the General Plan; A commitment for long range land use. Area of Interest - to extended resources for all cities. That all potential development areas be considered in providing guidelines for land use. That all major infrastructure resources, such as capacity and utilization, limitations, be a part of the review for development request. 11. STAFF COMMENTS The Director informed the Commission on the next scheduled General Plan Update field trip to be held on May 20, 1991. 12. COMMISSION COMMENTS Commissioner Schmidt inquired of Staff, "What requires that a home owner acquire Flood Insurance "? The Director responded that this is a requirement of the Federal Government (FEMA - Federal Emergency Management Agency). That until specific requirements are revised, it will continue to be a requirement. Commissioner Schmidt informed the Commission and Staff of a potential conflict in his current work schedule and his commitments as a Planning Commissioner. He concluded to say it is still under consideration. 13. FUTURE AGENDA ITEMS None. a:\91 -5/6 r 13.
