Traffenstedt, Senior Senior Planner; Charles and Celia LaFleur, PROCLAMATIONS. COMMENDATIONS ;AM SPECIAL PRESENTATIONS None. It is the Planning Commission's intent to adjourn to the Residential Development Evaluation Board at the close of item 8 of this agenda. APPR9f1AL OF MINUTES June 17, 1991 Chairman Wesner inquired of staff of the Planning Commission's recommendations on the Westland Affordable Housing project. His concern was that the minutes did not summarize the Commission recommendations to the Council. The Director replied that the recommendations of the Commission were within the staff report to the City Council for public hearing on July 17, 1991. :Motion: Moved by Commissioner Wesner second by Commissioner Torres to approve the minutes of June 17, 1991. Motion passed by a unanimous voice vote. 7. PUBLIC COIMNTS None. 8. CONSENT CALENDAR None. PUBLIC HEARINGS A. Entitlement: Land Division Map No. 91 -2 and Residential ;Planned Development Permit No. 91 -1 BIBO, INC. Proposal: 1. Land Division Map No. 91 - 2 is for the subdivision of an existing 8.79 acre parcel into four lots consisting of the following: Parcel A - 1.38 acres, Parcel B - 2.53 acres, Parcel C - 3.71 acres and Parcel D - 1.17 acres. 2. Residential Planned Development No. 91 -1 is for construction of a multi - family apartment project which will consist of 12 structures consisting of a total of 100 residential units. There will be 40 - two bedroom units, 40 - three bedroom units, and 20 - four bedroom units. The project is proposed to provide 100 units of low income housing that will be affordable on a long term basis to help meet the affordable housing needs of the City. Location: The proposed project is located in the City of Moorpark, Ventura County, California. The site is generally bounded by a single - family residence facing Los Angeles Avenue on the north, the Arroyo Simi to the south, single family residences on Preemont Street to the east, and two story condominiums and apartments to the west. The project site will be divided by the future extension of Majestic Court, and existing public street which currently provides access to the condominiums to the west. The Assessor's Parcel Number is 506- 02 -48. Presented by Paul Porter, Senior Planner. Staff Report dated July 15, 1991. At the close of the presentation Chairman Wesner disclosed the general acquaintance with the applicant referencing Mrs. Wesner's professional dress design business. At 8:00 p.m. Chairman Wesner called for a 5 minute recess due to a citizen out - break. The meeting reconvened at 8:17 p.m. a: \91 -7.15 Planning Commission, City of Moorpark, California Minutes of July 15, 1991 Pave -4- Testimony received by the following: Dave Fukutomi, 360 Mobil Avenue, Camarillo, CA 93010. Mr. Fukutomi concurred with staff's presentation and indicated to the Commission that Bibo, Inc. and Flood Control District were working toward an agreement for the use of the Flood Control easement property. In reply to Commissioner Brodsky's inquiry of the process for condemnation for the Millard Road exit, Mr. Fukutomi responded that negotiations were taking place and that the purchase would take place at close of escrow. Chairman Wesner questioned staff as to the adequacy of the Traffic Study referencing trip generations and whether the numbers reported were concise. Charles Abbott said that all the standards used for study have been provided. Max Yates, 81 Fremont Street, Moorpark, CA 93021. Mr. Yates statements as follows: Adjacent affordable housing would destroy the value of his home; currently there is enough rental property in Moorpark; concerned with crime and being robbed. Teresa Schmidt, Fremont, Moorpark, CA 93021. Ms. Schmidt's statements as follows: This affordable housing project would lower the quality of living (as referenced from a newspaper article); high density would bring problems to residents; too many affordable project located within the same vicinity; if the Flood Control District easement property is reclaimed there would be a parking problem; how will the number of people per dwelling unit be monitored? Commissioner Brodsky informed the residents that the decision of the type of development is not the City's decision, the property owner makes the decision as to which type of development he is considering for the specific type of zoning provided. Arthur Terry, 150 - 303 E. Los Angles Avenue, Moorpark, CA 93021. Mr. Terry's comments as follows: a 6 year resident and Regal Park condominium owner; LeClub offers low income housing. Marie J. Sorne, 150 E. Los Angeles Avenue, Moorpark, CA 93021. Ms Sorne statement as follows: Opposed. a: \91 -7.15 Planning Cc®ission, City of Moorpark, California Minutes of July 15, 1991 Page -S- Rodger Smith, 150 Majestic Court #1009, Moorpark, CA 93021. Mr. Smith's comments as follows: his home was purchased in 1986 and at the time of purchase he was told that the adjacent property would provide single family dwelling units or condominiums; his preference is to provide the proposed use adjacent to other apartments or in commercial areas; no abatement for noise has been provided. Eugene J. O'Brien, 150 E. Los Angeles Avenue, #101, Moorpark, CA 93021. Mr. O'Brien's comments as follows: inadequate parking provided; signalization at Millard would halt egress at the entry of Regal Park; the Majestic Court extension not adequate for proposed traffic flow; concerned with overcrowding and the public health and safety. Rene Menard, 150 - 802 Majestic Court, Moorpark, CA 93021. Ms. Rene's comments as follows: a devaluation of property would occur; traffic concerns have prompt in hiring a private patrol service for the Regal Park area; swimming pool liability when children try to use the Regal Park facility; the LeClub apartments often bring the police to investigate; also what about the current drought concerns. Sandra Paul, 4611 Belay Vista, Moorpark, CA 93021. Ms. Paul comments as follows: The affordable housing units have been built and /or proposed in a concentrated area; the Arroyo Simi is currently being worked on and there is a concern for the children safety in that area; consider using Irvine as a model for housing in the Moorpark area; parking problems will increase with the current proposal. Wes Aardahl, 150 Majestic Court, #1107, Moorpark, CA 93021. Mr. Aardabl comments as follows: the speakers in opposition have addressed many issues and concerns they have; increase in traffic problems; parking problems currently exist that provide excess parking on the adjacent vacant lot across from the LeClub apartments; density, noise and the high concentration of low income housing on Los Angeles Avenue are problems for the existing residents on Los Angeles Avenue. David Williamward, 150 Majestic Court, #1016, Moorpark, CA 93021. Mr. Willamward comments as follows: concerned with property values; additional noise, crime and overcrowding of school facilities; opposed to Majestic Court extension. l a: \91 -7.15 Planning Commission, City of Moorpark, California Minutes of July 15, 1991 Paae -6- Rita ]teddy, 151 Majestic Court, #707, Moorpark, CA 93021. Ms. Reddy's comments as follows: opposes Majestic Court extension; referenced a Newbury Park complex for low income and said low income housing usually brings one family per bedroom. Mary DAttle, 151 Majestic Court, Moorpark, CA 93021. Opposed to the development. Ms. DAttle concern related to traffic circulation and children safety. Ron Vanderhoeven, 150 E. Los Angeles Avenue #507, Moorpark, CA 93021. Opposes the proposal to provide low income housing. Dave Fukutomi, 360 Mobil Avenue, Camarillo, CA 93010. Mr. Fukutomi stated that the project as proposed has met the Moorpark design criteria, that the 100 foot separation will eliminate any concerns of noise between the existing and proposed residences. Commissioner Miller inquired whether the Bibo, Inc. development could provide a wall separating the existing and proposed developments. Mr. Fukutomi replied that there was no allowance for such a structure. Mr. Fukutomi addressed the concern of the residents regarding the agreement and specification for qualifying persons within the affordable housing project. And that this agreement would be in place for 30 years and operates with the land. Commissioner Brodsky asked the applicant if they were will to implement methods to address overcrowding, drug problems, etc. within their rules and regulations? Mr. Fukutomi replied that as an owner it is the right and obligation to prohibit any illegal use and such a resident would be required to vacate. Commissioner Miller inquired of the applicant why there were no 1 bedroom apartments for senior citizens. The applicant responded that it was due to financing availabilities. Mr. OBrian stated that a pool facility should be provided to avoid the Regal Park pool from being vandalized or used. Mr. OBrian questioned Bibo, Inc. in December 1990 to provide funding for a pool. Mr. Fukutomi replied that financiers do not provide fund for this type use. a: \91 -7.15 Planning Commission, City of Moorpark, California Minutes of July 15, 1991 Page -7- AT THIS POINT IN THE MEETING 9:50 P.M. A 15 MINUTE RECESS WAS CALLED. MEETING RECONVENED AT 10:05 P.M. PUBLIC HEARING CLOSED AT 10:12 P.M. Commissioner Brodsky commented that affordable housing restrictions had been met by the applicant and the Commission is unable to find a reason for denial. That staff should meet with the applicant and address the concerns stated by the adjacent residents. Commissioner Torres quoted from the April 1991 HUD Ventura County Income Limits as being $48,400 for a family of four. He also stated that most of us (residents) were not too far from the income quoted. Commissioner Miller requested that the applicant consider providing two tot lots and a pool facility. That a concrete wall be provided on the easterly border of the proposed project. Motion: Moved by Commissioner working with of the adja continued to Commissioner Brodsky second by Torres to direct staff to continue the applicant to address the concerns cent residents. That the item be August 5, 1991. Motion passed on a 3:1 vote, Chairman Wesner voting NO. 10. DISCUSSION ITEMS A. Residential Development Management System 1991 (DA -91 -1 Evaluate the attached application for DA -91 -1 and staff's tentative point rating recommendations, and make a determination on point assignment consistent with Resolutions 87 -421 and 88 -522. Presented by Debbie Traffenstedt, Senior Planner. Staff Report dated July 9, 1991. Motion: Moved by Commissioner Miller seconded by Commissioner Brodsky to approve staff's tentative a: \91 -7.15 Planning Commission, City of Moorpark, California Minutes of July 15, 1991 Pace -8- point rating recommendations as being consistent with Resolutions 87 -421 and 88 -522 and direct staff to post the Board's recommended point assignment for DA -91 -1 and schedule a public hearing for August 5, 1991. Motion passed by a unanimous voice vote. At this point in the meeting the Residential Development Management Board reconvened to Planning Commission meeting. 11. STAFF COMMENTS 12. Report Back - Verbal status report regarding Texaco Gasoline Station on Moorpark Avenue. The Director gave a verbal presentation on the status of the Texaco Station which is proposed for a coin operated car wash. He informed the Commission that the property owner is not will to clean the site because it is currently in escrow and waiting to close. Chairman Wesner commented that implementation procedures should be met once a violation letter date exceeds and be forward to the City Council for review and determination whether the item should be reviewed by the City Attorney for processing. Commissioner Miller requested the status of the 27 condominiums located on Charles Street. The Director informed Commissioner Miller that the property had been sold and weed abatement will soon proceed. Commissioner Torres requested the status of the proposed Ralphs Market within the Urban West Communities development. The Director stated that building permits had been issued and that it was a matter or time before Ralphs Market would break ground. a: \91 -7.15 Planning Commission, City of Moorpark, California Minutes of July 15, 1991 Page -9- Chairman Wesner requested that staff investigate the parking concerns addressed by the local residents of LeClub and Regal Park condominiums on the adjacent property to Le Club apartments. The Director stated that the property owner is unwilling to work with the city. The Director also said that monies have been appropriated through the budget for tow -away purposes. Chairman Wesner requested that perhaps a no parking sign be provided. 13. FUTURE AGENDA ITEMS 14. None.
