Located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER The meeting called to order at 7:07 p.m.. Chairman Michael H. Wesne:r presiding. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance led by Commissioner Barton Miller. 3. RLLi� Present: Vice Chairman John Torres, Barton Miller, Steve Brodsky; Christina May; and Chairman Michael Wesner Jr. Absent: None. Other City Officials and Employees present: Patrick J. Richards, Director of Community Development; Deborah S. Traffenstedt, Senior Planner; Paul Porter, Senior Planner; Craig Malin, Assistant Planner; Charles Abbott, City Engineer; and Celia LaFleur, Administrative Secretary. 4. PROCLAMATIONS COMMENDATIONS AND SPECIAL PRESENTATIONS A. Secretary administers the Oath of Office to the newly appointed Planning Commissioner Christina May. Commissioner May thank Mayor Lawrason and Councilmembers for her newly appointed position. She stated that she looks forward to the challenges of this new position as a Planning Commissioner. REORDERING OF, AND ADDITIONS TO THE AGENDA It is the Planning Commission's intent to adjourn to the Residential Development Evaluation Board at the close of item 8 of this agenda. For the purpose of conducting a public hearing and action of item 9.A and then reconvene to the regularly scheduled meeting of the Planning Commission. 6. APPR VAL OF MINUTES July 15, 1991 Motion: Commissioner Torres moved and Commissioner Brodsky second a motion to defer the minutes of July 15, 1991 to the Planning Commission meeting of August 19, 1991. Motion passed by a unanimous voice vote. 7. PUBLIC COMMENTS None. 8. CONSENT CALENDAR No items for consent calendar. 9. PUBLIC HEARINGS A. Entitlement: DA -91 -1 Applicant: Abe Guny Proposal: The Applicant has requested 18 residential development allocations for approved Tentative Tract Map No. 4652 to allow construction of single - family residential homes. A total of 270 development allocations are available for Cr \NP51 \r1n \91 -8.5 Planning Commission, City of Moorpark, California Meeting of August 5, 1991 1991. A public hearing is required consistent with the City's Growth Management Ordinance and adopted Residential Development Management System. .Location: Tentative Tract Map No. 4652 has been approved for a property located west of Walnut Canyon Road (State Highway 23) and just north of Casey Road. .Assessor Parcel No(s) : 511 - 110 -035, 511 - 020 -025, and 511 -020- 035. Presented by Debbie Traffenstedt, Senior Planner. Reference: Staff Report dated July 29, 1991. Commissioner Brodsky commented that the only difference he recognized was that the applicant has been conditioned to provide front yard landscaping. Commissioner Torres inquired of the applicant whether he was satisfied with the results of DA -91 -1. The applicant replied, yes. Testimony received by the following: Abe Guny, 616 Fitch Avenue, Moorpark, CA. 93021. Mr. Guny concurred with staff's recommendation, and had no further comments. Joe Latunski, 289 Casey Road, Moorpark, CA 93021. Mr. Latunski reiterated his concerns regarding easement onto his property. He also informed the Commission of the current court case related to the easement concerns he spoke of. if the permits are approved on this development any new buyer would be liable for any cost or judgement, he stated. Commissioner Brodsky addressed staff how is the city affected regarding private suits. The Director responded that the items that Mr. Latunski referenced were a civil matter and that the city has no part in the matter. Motion: Commissioner Torres moved and Commission Brodsky second a motion to approve Resolution No. RDEB -91 -1 recommending to the City Council the Board's recommended point rating for DA -91 -1. Motion passed by a unanimous voice vote. At this point in the meeting the Residential Development Evaluation Board reconvened to the regularly scheduled meeting of the Planning Commission. B. ;ADDlicant: City of Moorpark Proposal: Amendment to the Zoning Code - Article 15 Section 8115 -1. Proposed change to parking standards regarding multilevel parking structures. Presented by Craig Malin, Assistant Planner. Reference: Staff Report dated July 22, 1991. Testimony received by the following: Eloise Brown, 13193 E. Annette Street, Moorpark, CA 93021. Ms. Brown recommended that the Commission consider private parking structures over public parking structures. Commissioner Miller recommended no change to handicap parking; and to provide compact stall spaces on multi -level parking. Commissioner May recommended allocations be provided to compact parking, an allocation of perhaps 408- 508 on compact parking. Motion: Moved by Commissioner Miller second by Commissioner Brodsky to direct staff to draft a resolution recommending 408 compact stall spaces with the remaining 608 standard 91x20' parking spaces. Motion passed by a unanimous voice vote. C2\NP31 \s1n \91 -8.3 Planning Commission, City of Moorpark, California Meeting of August 5, 1991 Pace -5- Motion: Moved by Commissioner Torres second by Commissioner Miller that the motion be amended to include "that the recommended standard be established for private multi -level parking structures only." Motion passed by a unanimous voice vote. C. Entitlement: No. 91 -1 BIBO, INC. Proposal: Land Division Map No. 91 - 2 is for the subdivision of an existing 8.79 acre parcel into four lots consisting of the following: Parcel A - 1.38 acres, Parcel B - 2.53 acres, Parcel C - 3.71 acres and Parcel D - 1.17 acres. Residential Planned Development No. 91 -1 is for construction of a multi - family apartment project which will consist of 12 structures consisting of a total of 100 residential units. There will be 40 - two bedroom units, 40 -three bedroom units, and 20 - four bedroom units. The project is proposed to provide 100 units of low income housing that will be affordable on a long term basis to help meet the affordable housing needs of the City. :Location: The proposed project is located in the City of Moorpark, Ventura County, California. The site is generally bounded by a single - family residence facing Los Angeles Avenue on the north, the Arroyo Simi to the south, single family residences on Freemont Street to the east, and two story condominiums and apartments to the west. The project site will be divided by the future extension of Majestic Court, and existing public street which currently provides access to the condominiums to the west. Reference: Staff Report dated July 30, 1991. The Commission reopened the public hearing at 7:48 p.m. Commissioner Christina May for the record stated that she had previously listened to the recorded cassette tapes of the July 15, 1991 public hearing of Land Division Map No. 91 -2 and Residential Planned Development Permit No. 91 -1 BIBO, INC. Testimony received from the following: Justin F. Farmer, 207 S. Brea Blvd., Brea, CA 92621. Mr. Farmer engineer for the project provided his interpretation relating to tables and charts within the traffic study which was prepared for the applicant. During Mr. Farmer's presentation, Commissioner Brodsky said that there were several areas of discrepancy. Commissioner Brodsky gave a synopsis of his two day traffic study at Los Angeles /Moorpark Avenues which indicated that the number of vehicle trips stated were higher than the original traffic study information prepared. At this point in the meeting Charles Abbott, City Engineer stated that the left turn movements onto Millard would justify signalization and alignment of Millard Street as recommended in staff's report dated July 30, 1991. Eugene J. O'Brien, 150 E. Los Angeles Avenue, Moorpark, CA. Opposed to the project said that the timing for the Millard Street signalization would be difficult to accomplish along with :Left turn movements onto Millard Street. Rita ]M. Ruddy, 151 Majestic Court, #707, Moorpark, CA 93021. Opposed to the proposed development. Ms. Moody stated that the Regal Park residents had retained an attorney to address the concerns of the proposed project. Daniel Schmidt, 90 Fremont Street, Moorpark, CA 93021. Opposed. Stated that the information provided by the traffic study was incorrect. Public hearing closed at 8:47 p.m. Ci \NP51 \ain \91 -8.5 Planning Commission, City of Moorpark, California Meeting of August 5, 1991 Paae -7- Commissioner Brodsky commented that he had visited other sites which were developed by the Bibo, Inc. developer and was pleased to identify that the Bibo, Inc. developers projects were adequate in design. Motion: Commissioner Miller moved to recommend that a wall be provided from the north to the south course of the development. Motion declined for the lack of a second. Motion: Commissioner Brodsky moved and Commissioner Wesner second a motion to recommend to the City Council denial without prejudice of Land Division Map No. 91 -2 and Residential Planned Development Permit No. 91 -1 BIBO, INC. based on the following: Cr \WP51 \Ala \91 -8.5 Because the proposed apartment units will have a significant adverse impact on the public health and safety which cannot be satisfactorily mitigated; and the applicant has demonstrated an unwillingness to comply with conditions of approval pursuant to the Mitigation Measures in the Mitigated Negative Declaration which are necessary in order to comply with CEQA without rendering the project unaffordable. The significant adverse impacts will be created for the following reasons: That interior open space area of the proposed apartments has been reduced by the applicant in order to accommodate required parking. The applicant has not provided adequate recreational facilities (such as a swimming pool) other than providing tot lots for young children, thus creating potential liability problems for the adjacent residents who have recreational facilities. There are no one bedroom units within the proposed complex which would help reduce the potential demand for parking. The project does not provide sufficient on -site parking required by the City's Zoning Ordinance. The lack of adequate parking will exacerbate an existing adverse traffic safety problem because of existing on- street parking in the area of the proposed project. Planning Commission, City of Moorpark, California Meeting of August 5, 1991 Page -8- That instead of providing access through an extension of Millard Street to Los Angeles Avenue, which would create a safer situation for motorists, the applicant has indicated that the project will provide access at the westerly boundary of the project adjacent to the access used by the residential development to the west. The failure of the applicant to agree to provide adequate, safe, access to the site via the extension of Millard Street to Los Angeles Avenue will create a detrimental safety problem because: a) The applicant's requested access is adjacent to the access presently used by the existing residential development to the west, 2) The proposed project is 700 feet from the signalized intersection at Los Angeles Avenue and Moorpark Avenue making it dangerous for motorists to turn left onto Los Angeles Avenue from the proposed access, and 3) This access will create an additional off -set vehicle entry /exit point along Los Angeles Avenue. That the Planning Commission hereby recommends to the City Council denial without prejudice, of the Land Division Map on the application of BIBO, Inc., because the site is unsuitable for the type of development proposed on the property. The reasons the proposed development is unsuitable for the property is as follows: The proposed apartment development on the subject site does not provide sufficient parking on -site to meet the City's parking requirements as defined in the City's Zoning Ordinance. The proposed apartment complex will generate sufficient traffic volumes to warrant the extension of Millard Street to Los Angeles Avenue as the primary access to the proposed development. The Land Division Map as proposed does not provide for this extension. With the additional traffic generated as a result of the proposed apartment complex, the existing access shown on the Parcel Map located along the west side of the property will conflict with the Cr \NP31 \i1a \91 -8.5 Planning Commission, City of Moorpark, California Meeting of August 5, 1991 Page -9- General Plan goal to provide for the safe and efficient movement of people within the City. This is because: 1) The proposed project is 700 feet from the signalized intersection at Los Angeles Avenue and Moorpark Avenue making it dangerous for motorists to turn left onto Los Angeles Avenue from the proposed access to the site, and 2) This access will create an additional off -set vehicle access point along Los Angeles Avenue. The applicant has failed to consent to mitigation to complete the Millard Extension improvements as well as the Traffic Signalization at the intersection of Los Angeles Avenue /Millard Street. This is conflict with the stated goal in the Circulation Element of the General Plan to promote the completion of the ultimate circulation system through the improvement of substandard roadway segments and intersections, and the construction of missing roadway links and related facilities. In the event the City Council approves the project, the Planning Commission recommends the conditions of approval found in Planning Commission Staff Report dated March 4, 1991 along with the following additional conditions: * That a landscaping barrier to be approved by the Director of Community Development be constructed in the following areas: a. Along the westerly most portion of the access easement located to the west of the project site b. Along the easterly boundary of the proposed project adjacent to the properties fronting on Freemont Street * That a swimming pool and spa be provided on- site. The location and design of the facility is subject to approval of the Director of Community Development. C, \WP51 \a1n \91 -6.5 Planning Commission, City of Moorpark, California Meeting of August 5, 1991 Paae -10- * That the apartment units shall contain at a minimum the following additional sound attenuation over and above the minimum required by the Uniform Building Code. The construction drawings showing the attenuation measures shall be submitted to the Department of Community Development for review and approval. STC 50 between adjoining dwelling units STC 45 within individual living areas Note: The appropriate IIC ratings shall apply for each of the above * Primary access to the site will be from the extension of Millard Street via Los Angeles Avenue. The proposed westerly access on the site plan and the Tentative Map shall be r eliminated prior to issuance of a Zoning Clearance and prior to recordation of the Tentative Map. Geometric improvements and traffic control measures approved by the City Engineer, or associated Traffic Studies must be included on the site plan. The site plan will be signed by a registered Civil Engineer. The applicant shall provide a bond in an amount equal to 1/2 the cost of signalizing the intersection of Los Angeles Avenue and Millard Street. Said bond shall be in the amount determined by the Department of Public Works, and in a form acceptable by the City. Said bonding shall be in effect for three years or until the development is completed and occupied, or whichever comes last, at which time, the bond will be refunded if it is determined by the Public Works Director that a signal will not be required for this intersection, applied to construction of the signal or extended for another three years. The proposed westerly access on the tentative map shall be eliminated prior to recordation. * The applicant shall provide a bond in an amount equal to 1/2 the cost of signalizing the intersection of Los Angeles Avenue and Millard Street. Said bond shall be in the amount determined by the Department of Public Works, and in a form acceptable by the City. Said bonding shall be in effect for three years or until the development is completed and occupied, or whichever comes last, at which time, the bond will be refunded if it is determined by the Public Works Director that a signal will not be required for this intersection, applied to construction of the signal or extended for another three years. The action of the foregoing direction was approved by the following roll call vote: AYES: Commissioners Wesner, Miller and Brodsky; NOES: Commissioners Torres and May; ABSENT: None. DISCUSSION ITEMS A. .Auto Body Repair & Paintinc within Commercial Zones That the Planning Commission review the appropriateness of allowing auto body repair and auto painting in commercial zones. The Commission by general consensus set the matter for public hearing on August 19, 1991. 11. STAFF COMMENTS None. COMMISSION COMMENTS Commissioner Brodsky asked if Building and Safety should talk to the Sheriff's department regarding how house numbers are listed in multi - family projects. Chairman Wesner requested that staff provide a summary for the Planning Commission on the rules for items of public hearing matters. 13. FUTURE AGENDA ITEMS 14. None.
