Located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER The meeting called to order at 7 :09 p.m.. Chairman Michael H. Wesner presiding. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance led by Commissioner Christina May. 3. ROLL � AID Present: Vice Chairman John Torres, Barton Miller, Steve Brodsky; Christina May; and Chairman Michael Wesner Jr. Absent: None. Other City Officials and Employees present: Patrick J. Richards, Director of Community Development; Paul Porter, Senior Planner; Charles Abbott, City Engineer; Dirk Lovett, Assistant City Engineer; and Celia LaFleur, Administrative Secretary. 4. APPROVAL OF MINUTES August 5, 1991 July 5, 1991 Motion: Commissioner Brodsky moved and Commissioner Torres second a motion to approve the minutes of August 5, 1991 and July 5, 1991 as submitted. Motion passed with a unanimous voice vote. 7. PUBLIC COMMENTS None. 8. CONSENT CALENDAR A. RESOLUTION NO. PC -91 -246 A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA RECOMMENDING ADOPTION OF AN ORDINANCE REVISING ARTICLE 8 OF CHAPTER 1 OF DIVISION 8 OF THE MOORPARK MUNICIPAL CODE PERTAINING TO PARKING STANDARDS FOR PRIVATE MULTI -LEVEL STRUCTURES. Prior to the motion for approval the Commission discussed compact car space size. It was the general consensus to provide a 7 -1/2 x 15 as the standard compact car parking stall size. Staff was directed to make the appropriate revision to the resolution. Motion: Moved by Commissioner Torres second by Commissioner Brodsky to approve Resolution No. PC -91 -246 recommending to the City Council the adoption of an ordinance revising Article 8 of Chapter 1 of Division 8 of the Moorpark Municipal Code pertaining to Parking Standards for Private Multi - Level Parking Structures. PC -91 -247 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORP.ARK, CALIFORNIA, RECOMMENDING DENIAL WITHOUT PREJUDICE TO THE CITY COUNCIL ON THE APPLICATION OF LDM -90 -2 AND RPD -91 -1 OF BIBO, INCORPORATED. ASSESSOR'S PARCEL NO. 506- 0- 02 -48. Motion: Moved by Commissioner May second by Commissioner Brodsky to approve Resolution No. 247 recommending to the City Council denial with prejudice to the approval of LDM -90 -2 and RPD -91 -1 as proposed by BIBO, INC. Motion passed with a unanimous voice vote. 9. PUBLIC HEARINGS A. ;Applicant: City of Moorpark Proposal: Amendment to the Zoning Code - Article 5 of Chapter 1, Section 8105 -5. Proposed change to allow auto body repair and painting in commercial zones. Location: Citywide Presented by the Director of Community Development. Reference: Staff Report dated August 14, 1991. Commissioner May inquired as how auto retail was original permitted for the commercial use area. The Director responded that auto retail was permitted under the restrictions of a Conditional Use Permit. Commissioner Brodsky inquired about parking requirements and noise pollution. The Director replied that environmental concerns are addressed during the processing of an application for a Conditional Use Permit. On a case by case basis the CUP may be restricted by certain conditions, and by mitigation measures through the design of a future development. -- a: \91 -8.19 ,, - Planning Commission, City of Mooraprk, California Minutes of August 19, 1991 Testimony received by the following: Colin Velasquez, 476 W. Los Angeles Avenue, B -11, Moorpark, CA. Mr. Velasquez addressed the Commission by saying that Simi Valley and Thousand Oaks currently provides the same uses in commercial areas by way of a Special Use Permit. Mr. Velasquez went on to say that the facility at issue along with the original permit was heavily conditioned. No service bays were permitted to do any type of outside work at the facility. That the paint booth is self contained and had met environmental regulations. Commissioner May questioned how many bays were at the facility. Mr. Velasques responded 6 on the east, 6 on the west and 5 at the rear. Commissioner Torres noted that the original permit was conditioned to provide sound proofing because of the adjacent church facility. Mr. Velasquez stated that a block wall was constructed and exceeded the required condition. PUBLIC HEARING CLOSED AT 7:47 P.M. Commissioner Torres stated that the Commercial Planned Development had previously been condition and that there was no need to require a CUP. Commissioner May concurred, and said that it should have been conditioned that no painting be provided in the bays. That there was no need for additional processing. Commissioner Brodsky recommended that staff's recommendation to require a bonding condition remain. Motion: Commissioner Torres moved and Commissioner Miller second a motion to recommend to the City Council that the existing use remain in the existing zone. That the zoning be amended to allow this use in the Commercial Planned Development (CPD) zone, General Commercial (C -2). That all new commercial development be reviewed on a case by case use to determine a CUP requirement. To provide a condition requiring $1,000 cash deposit and condition for maintaining the cash deposit of $1000. a: \91 -8.19 Motion passed with a unanimous voice vote. LDM 91 -3, which consists of two parcels of .4 and .8 acres, will resubdivide the two parcels into one parcel. Tentative Tract Map No. 4789 will resubdivide two existing parcels into five parcels which will separate IPD 91 -1 thru 3, IPD 90 -10 and IPD 90 -12 into individual parcels. Location: The Southern portion of the Development is located south of Discovery Court, east of Maureen Lane and north of Los Angeles Avenue. The Northern portion of the Development is located north of Hertz Street between Bonsai Avenue and Maureen Lane. Presented by Paul Porter. Reference: Staff Report dated August 19, 1991. PUBLIC HEARING OPENED AT 8:22 P.M. Testimony received by the following: Allen Camp, representing the applicant, 1050 S. Rinball Road, Ventura, CA 93004. Mr. Camp referenced the applicants request for several revisions to the proposed conditions. a. The applicant had previously paid for a study and signalization at Maureen Lane. b. No conditions recognizing traffic mitigation measures. C. LDM condition no. 12 change to 66 RV. d. LDM condition no. 16 change to read: 'Within two days after approval of the project by the City Council, the applicant shall deposit with the City one fee in the amount of $1,250 plus $25.00 filing fee for the following application which collectively comprise the project: LDM 91 -3, TT Map No. 4789, IPD -91 -7 through 13 and 91 -1 through 3. The fee shall be paid to the County of Ventura for the State required Notice of Determination filing fee in accordance with Assembly Bill 3158. e. LDM condition no. 17 Prior to recordation, all outstanding case processing fees for LDM -91 -3 shall be paid to the City. conditions 19 through 31, inclusive, should be deleted. Regarding Condition 25, the applicant has already executed the applicable covenant as part of LDM 10 and the same runs with the land and is bind upon LDM -91 -3. f. TT -4789 condition no. 9 to process building plans for each IPD simultaneous with plan check for the to -be recorded map. If so, the conditions is acceptable. If not, we suggest the language be changed from zoning clearance to building permit final. g. Condition no. 15 same as LDM condition no. 16 h. Condition no. 16 same as LDM condition no. 12 i. Condition no. 36 revise to read: The applicant shall pay .all energy costs associated with any new street lighting required of Tract 4789 for a period of one year from initial energizing of the street lights. k. Condition no. 37 delete. 1. Condition no. 46 Change street name from Atlantis to Columbia. M. IPD condition no. 8 same as LDM Condition no. 15 n. Condition no. 10 revise to: proceed with plan check of IPD's. o. Condition no. 16 same as LDM condition no. 16. P. Condition no. 17.a to read: Except as provided in condition no. 10 hereof, prior to the issuance of a zoning clearance for IPD nos. 90 -10 and 90 -12 and 91 -1 through 3, TT -4779 shall be recorded. q. Condition 17.b to read: Except as provided in condition no. 10 hereof, prior to the issuance of a zoning clearance for IPD nos. 90 -7 and LDM -90 -3 shall be recorded. (building permit should be substituted for zoning clearance). r. Condition no. 38 Prior to issuance of the zoning clearance, the permittee shall make a contribution to the :Moorpark Traffic Systems Management Fund of .15 cents per square foot of floor area to fund Traffic System :Management programs as a mitigation measure to fully :mitigate air quality impact so as to fund TSM programs or clean fuel programs as determined by the City. However, the permittee shall receive an in lieu credit with respect to said per square footage fee for the $20,000 that had previously been paid by the applicant to fund a City study for air quality mitigation programs. S. Condition no. 69 delete, covered by LDM condition no. 36. Commissioner Miller inquired about the previous deposit for signalization at Maureen Lane. The Director replied that $65,000 had been provided for the Maureen Lane signalization. And that the signal location changed in conjunction with future development, as will the disbursement of traffic. Further adjustments may be made in conjunction with the adjacent residential use and signalization may be required at the Maureen Lane location. Commissioner Brodsky identified that the traffic study prepared for LDM -10 was in 1988. Also that the signalization at Goldman Avenue and Maureen Lane may be too close in proximity. a: \91 -8.19 Planning Commission, City of Mooraprk, California Ninutes of August 19, 1991 Paae -8- Mr. Abbott stated that if both meet warrants and CalTrans approves, yes they would be close in proximity and, yes traffic would be slower. Commissioner Brodsky asked why there were no conditions related to noise pollution? The Director said that these proposals were spec buildings at this point and that condition no. 41 does reference 55 DBA's. Commissioner Brodsky asked why there were no conditions related to recycling. Mr. Porter referenced condition no. 23. Commissioner Brodsky inquired of overnight parking and parking standards. Mr. Porter referenced the zoning code related to permitted uses and parking associated with. The Director further added that code enforcement and sheriff would also monitor parking violations. Commissioner Brodsky also address concerns relating to drainage and catch basins. Mr. Porter stated that the specifics are provided �. within the conceptual grading plan, and not at this point. At this point in the meeting the following motion was made: Motion: Commissioner Wesner moved and Commissioner Torres second a motion to continue IPD 90 -7 thru 13, IPD 91 -1 thru 3, Tentative Tract Map no. 4789, LDM 91 -3 to the and direct staff to meet with the applicant to address the issues brought forward, and to return to the Planning Commission on September 3, 1991. Motion passed with a unanimous voice vote. 10. DIS SSION ITEMS None. 11. STAF F COMMENTS The Director reminded the Commission that their next meeting would be held on Tuesday September 3, 1991, due to the holiday. — a:\91 -8.19 12. Planning Commission, City of Moorpark, California Minutes of August 19, 1991 Pace -9- Commissioner Wesner inquired of the Planning Commission's recommendation to the City Council not to allow vehicle left turn movement off Wicks Road. The Director explained that the adjacent Wicks Road residents had requested that the City Council not prohibit left turn movement off Wicks Road. But that the conditioning to require a deposit for future improvements would still apply. Commissioner May asked that the sign at the southwest corner of High Street and the sign at the northwest corener of Spring Road be checked in relation to location of the sign and how they apply to vehicle right turn movement. Commissioner Brodsky asked if his previous comments regarding addresses and directory information had been researched. The Director answered that the information had been forwarded to the Building and Safety department for further investigation. �. Commissioner Brodsky requested that the City review the standards for sound separation in multi unit, industrial buildings and provide some type of policy or ordinance, or perhaps within the building code. The Director replied that the City has considered a noise ordinance as a future item. 13. ZJMW AGENDA ITEMS 13. None.
