Located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER The meeting called to order at 7 :06 p.m. Chairman Michael H. Wesner Jr presiding. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance led by Commissioner John Torres. 3. ROLL CALL Present: Vice Chairman John Torres, Barton Miller, Steve Brodsky; Christina D. May, and Chairman Michael Wesner Jr. Absent: None. Other City Officials and Employees present: Patrick J. Richards, Director of Community Development; Paul Porter, Senior Planner; Charles Abbott, City Engineer; Dirk Lovett, Assistant City Engineer; and Celia LaFleur, Administrative Secretary. 4. APPROVAL OF MINUTES August 19, 1991 Motion: Commissioner Brodsky moved and Commissioner Torres second a motion to approve the minutes of August 19, 1991 as submitted. Motion passed with a unanimous voice vote. 7. PUBLIC COMMENTS None. CONSENT CALENDAR A. :RESOLUTION NO. PC -91 -248 A RESOLUTION OF THE MOORPARK PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA RECOMMENDING AMENDMENT OF THE MOORPARK ZONING CODE TO ALLOW AUTO BODY REPAIR AND AUTO PAINTING IN CERTAIN COMMERCIAL AND INDUSTRIAL ZONES SUBJECT TO A CONDITIONAL USE PERMIT. Motion: Commissioner Brodsky moved and Commissioner Miller second a motion to approve Resolution No. PC -91 -248 with the following revision: "Section 4. The Planning Commission here y recommends that 1) The City Council adopt an ordinance to revise .Article 5 and Article 7 of Chapter 1 of Division 8 of the .Moorpark Municipal code to allow auto body repair and ,painting in existing facilities designed for such purposed without any additional entitlement permit; 2) That future auto body repair and painting uses proposed for facilities not designed for that specific use in General Commercial (C -2), Commercial Planned Development CPD), Industrial Park (M -1) and Limited Industrial (M -2) zones shall be evaluated on a case by case basis to determine a Conditional Use Permit requirement; 3)All new auto body repair and painting uses must post and maintain a $1,000 deposit with the City to guarantee condition compliance. Entitlement: IPD 90 -7 thru 13 IPD 91 -1 thru 3 Tentative Tract Map no. 4789 LDM 91 -3 Applicant: Moorpark West Proposal: This North and South development phase is an industrial planned infill development of 10 buildings totaling 238,388 square feet. LDM 91 -3, which consists of two parcels of .4 and .8 acres, will resubdivide the two parcels into one parcel. Tentative Tract Map No. 4789 will resubdivide two existing parcels into five parcels which will separate IPD 91 -1 thru 3, IPD 90 -10 and IPD 90 -12 into individual parcels. Location: The Southern portion of the Development is located south of Discovery Court, east of Maureen Lane and north of Los Angeles Avenue. The Northern portion of the Development is located north of Hertz Street between Bonsai Avenue and Maureen Lane. Reference: Staff Report dated August 22, 1991. Testimony :received by the following: Allen Camp, 1050 S. Kimball Road, Ventura CA 93004. Mr. Camp representing the applicant spoke on several conditions and the prior related $20,000 requirement to provide a traffic study for LDM -10 signalization at Maureen Lane. Addressed Assembly Bill 1600 which requires specific use of deposits collected from the applicant :for studies related to entitlement requests. Mr. Camp also expressed the applicants opposition to Condition No. 38 requiring $.15 per square foot of floor area to fund Traffic System Management programs as a mitigation measure to fully mitigate air quality impacts. Mr. Camp stated that this requirement had previously been met by LDM -10 Condition No. 91 and Condition No. 38 of the IPD should be changed to "subject to applicant's in -lieu credit estimated by Condition No. 91 of LDM -10 (DP- 397 -404). Commissioner Brodsky inquired why conditions on the LDM -3 had been deleted. Mr. Camp responded that the LDM and the IPD conditions would be :repetitious and are not part of the LDM request for approval. That all improvements, provisions, studies and conditions would be required under the IPD permit approval. Commissioner May inquired if the applicant was disputing the deposit or location? Mr. Camp said that the original intent of the deposit was to provide a traffic study to provide a signal at the Maureen Lane intersection and not the present staff recommendation of Goldman Avenue. At this point Mr. Richards clarified that $5,000 was deposited for the traffic study and $65,000 was applicable for the signal. Mr. Camp stated that under the direction of the Planning Commission meeting of August 19, 1991 staff was directed to meet with the applicant, city engineer to resolve issues of concern and the consensus concluded to delete the LDM conditions as described in the staff report dated August 22, 1991. a: \91 -9.3 Planning Commission, City of Moorpark, California Minutes of September 3, 1991 Commissioner Brodsky reiterated that the recommendations are of city staff and that as a decision maker there was nothing trivial about discussing the issues of conditions deleted from the LDM application. PUBLIC HEARING CLOSED AT 9:00 P.M. Commissioner May inquired "What was the previous $20,000 fee for ?" The Director said that the Planning Commission had previously approved and required that signalization be in place prior to the approval of industrial planned development approvals. Motion: Commissioner Brodsky moved to approve the Mitigated ]Negative Declaration and related Mitigation Monitoring :Program prepared for IPD 90 -7 thru 13, IPD 91 -1 thru 3 Tentative Tract Map No. 4789 and LDM 91 -3 and recommend to the City Council approval of the projects with the following revisions: a: \91 -9.3 'to adopt sections B, G, I M O Q, S, T, A, H, N, R as modified within the related Mitigation Monitoring :Program, with the concurrence of staff; adopt LDM -91 -3 conditions 1 -7, 9, 10, 21, 24 -27, 30, 32 as previously recommended by staff; :revise LDM condition no. 15 to read like IPD condition no. 8. revised LDM condition no. 17, delete last sentence. :revise LDM condition no. 19 c. to include "......limited to graded areas of the property boundary." revise LDM condition :Prior to recordation, but subject to applicant's receipt Of a bill from the City, all outstanding case processing fees for TR -4789, IPD -90 -7 thru 13, LDM -91 -3 condition no. 22 leave in as standard condition for LDM; condition no. 23 leave in unless covered by an IPD condition; Planning Commission, City of Moorpark, California Minutes of September 3, 1991 Page -6- condition no. 28 leave in as standard condition for LDM; condition no. 29 delete "e." condition no. 31 leave in as standard condition for LDM. Approve TR -4789 and adopt condition nos. 1 -15, 17 -19, 21, 22, 25, 28, 31 -47 as recommended by staff; and 26 -29, 32, 33 as revised. condition 26 -29 revised to include: same language as 23.f. of LDM condition when reference to drain of adjacent parcels and 23.g. of LDM when regarding .Location of existing utility lines. condition no. 32 DELETE IPD Nos. 1 -3 and 7 -13 approve: adopt conditions nos. 1 -7, 9- 27, 29-40, 42 -68, 70 -107, 111 -119 as recommended by staff. Conditions Nos. 8, 28, 41, 69, 108, 109, 110, adopt as modified with the concurrence of staff. condition 8 read as in condition no. 15 of LDM; condition no. 28 d ..minimum of } foot candle power and maximum one foot candle power from outside property line. condition 28 g DELETE. condition 41 amend to include "adjacent residential ;property owners shall be protected from noise generated by sources on -site of the industrial use facilities." condition no. 69 revised to read: The applicant shall pay all energy costs associated with a new street lighting for a period of one year from the initial energizing of the street lights. condition no. 108 revise to include ".......that all industrial buildings be provided with automatic sprinkler system." a:\91 -9.3 Planning Commission, City of Moorpark, California Minutes of September 3, 1991 Paae -7- condition no. 109 revised to include "........by an approved fire sprinkler provided at IPD- 91 -1 -3 and IPD - 90-7-13." condition no. 110 DELETE Motion fails for a lack of a secondary on the motion. Motion: Commissioner Torres moved and Commissioner Miller second a motion to recommend to the City Council approval of the Mitigated Negative Declaration and related Mitigation Monitoring Program prepared for IPD 90 -7 thru 13, IPD 91- 1 thru 3 Tentative Tract Map No. 4789 and LDM 91 -3.
