Located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Chairman Michael H. Wesner called the meeting to order at 7:07 p.m. 2. PLEDGE 08 ALLEGIANCE: Kathleen Mallory Phipps led the Pledge of Allegiance.. 3. ROLL CALL: Present: Steve Brodsky, Christina May, Barton Miller, John Torres; and Chairman Michael Wesner Jr. Jim Aguilera, Director of Community Development; Deborah S. Traffenstedt, Senior Planner; Paul Porter, Senior Planner; Kathleen M. Phipps, Associate Planner; Craig Malin, Assistant Planner; Charles Abbott, City Engineer; Dirk Lovett, Assistant City Engineer; and Celia LaFleur, Administrative Secretary. Absent: Commissioner John Torres (excused). 4. PROCLANATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS: There were no proclamations, commendations or special presentations. S. REORDERING OB, AND ADDITIONS TO THE AGENDA: It was the consensus of the Planning Commission to reorder the agenda to have Item 9.B. be presented first. 6. APPROVAL OF MINUTES: No minutes were presented for approval. 7. PUBLIC COMMENTS: No public comments received. S. CONSENT CALENDAR: No consent items presented. r' 9. Presented by Senior Planner Debbie Traffenstedt. Reference: Staff Report dated February 23, 1993. The Planning Commission opened the public hearing at 7:12 p.m. and closed at 7:16 pm. No public speakers were present. MOTION: Chairman Wesner moved and Commissioner Brodsky seconded a motion to approve Resolution No. PC -93 -272 recommending that the City Council adopt an ordinance amending the Moorpark Zoning Ordinance by adding Article 16, Density Bonus Provision, and revising Sections 8103 - 1.3 and 8109 -2.3 pertaining to Residential Planned Development (R -P -D) Zone Density and Development Standards. Motion passed by a 4:0:1 voice vote. Commissioner Torres was absent. Reference: Staff Report dated March 15, 1993. Chairman Wesner opened the public hearing at 7:50 P.M. Testimony received from the following: Hayssam A1- "assi. 2337 Roscomare Road Suite 7, Los Angeles, CA 90077. Mr. A1- Atassi provided the Commission with background information of events which led the March 151 1993 public hearing. He said that Arco had worked diligently to address and revise his original proposal to accommodate staff's recommendations and the City's intent for the proposed site. Mr. A1- Atassi disputed the following conditions: Condition W 65 page 35 - Prior to issuance of a Zone Clearance, the applicant shall make a special contribution to the City representing the applicants pro -rata share of the cost of the improvements at the following intersections: Los Angeles Ave. /Spring Rd. Los Angeles Ave. /Gabbert Rd. Moorpark'Ave. /Poindexter Ave. The actual contributions shall be based upon the additional traffic added to each intersection per the traffic study prepared by Wadi Transportation Consultants May 22, 1992 (revised Sept. 21, 1992) and as approved by the City Engineer. City Engineer Charles Abbott responded to the applicant with the following cost estimates: Los Angeles Avenue / Spring Road - $6,784; Los Angeles Avenue / Gabbert Road - $11,954; Moorpark Avenue / Poindexter Avenue - $20,571. Condition M 103 page 42 - Prior to issuance of a Building Permit, the construction plans shall show additional windows should be considered to be located on the north and east of the building to allow view of the parking area and discourage loitering. Planning Commission, City of Moorpark, California Minutes of March 15, 1993 Condition M 104 page 43 - Prior to Final Inspection, the Community Development Department shall assure that the standard wall shelving labeled 'X' in the Store Fixture Plan should be lowered to no more than the other 416" Gondolas. Windows should be positioned above the shelves to provide surveillance outside. The drink and ice dispensers located along the north wall should be positioned to again provide surveillance. s Mr. A1- Atassi proposed a modification to use surveillance cameras instead of the widows required by Condition 10 103 and the lowering of the Gondolas per Condition M 104 K.T. Wickerham, Arco Petroleum Production Company & AM -PM Development, 1596 Ryder Cup Drive, North Ranch, CA. Mr. Wickerham spoke on the type of procedures that took place with gasoline deliveries. He confirmed the Commission's questions of whether or not the hours of gasoline deliveries could be altered. Mr. Wickerham explained ARCO's training process. Ed Jones, Ed Jones & Associates, 5135 Island Forest Drive, Westlake Village, CA 91362. Mr. Jones gave some background information of the meetings that took place with the surrounding property owners. James Hartley, 5950 Gabbert Road, Moorpark, CA. Mr. Hartley commended staff's work and the applicant's proposal to locate in Moorpark. His concerns were that public restrooms be available; egress /ingress be considered; Los Angeles Avenue trucks parking near the proposed development and potential visual hazard when leaving the facility; easy access to alternate fuel tanks; that enough space be provided for vehicles maneuvering in and out between each of the gasoline pump islands. Elias Jabbour, 13973 Christian Barrette, Moorpark, CA. Spoke in support of the proposed development. Roger Smith, 150 Majestic Court 11009, Moorpark, CA. Spoke in support of the proposed development. Mr. Smith questioned if a curfew was imposed on liquor sales. Mr. Wicherham said that at 2:00 a.m. an automatic locking devise is triggered and locks all compartments where liquor is stored. Planning Commission, City of Moorpark, California Minutes of March 15, 1993 Mr. A1- Atassi addressed some of the concerns stated. He said the vehicles maneuvering between gasoline pump islands will be provided with pass through areas. In response to the number of employees ARCO would hire, he replied that their would be 8 -12. Also he confirmed that there would not be any arcade game machines at this location. Debra D. Blade, 51 -1101 Majestic Court, Moorpark, CA. Ms. Blade questioned staff whether Moorpark Avenue south of Los Angeles Avenue would be widened to accommodate the additional traffic expected by the new development. The Director said that street widening would be provided to the end of the ARCO property line, somewhat like the existing street widening north of the Los Angeles /Moorpark Avenues intersection. Commissioner Miller inquired of staff whether there were any proposals for development at the southwest property of the proposed site. The Director informed Commissioner Miller that at this time there were no proposals, but that staff had diligently been working towards an agreement to accomplish a "No Parking" zone with the property owner west of the proposed development. The Commission discussed the matter of sign colors and the type of lettering ARCO was considering. The commission and staff determined the use of ARCO Federal and State trademark colors which are blue and white The commission recessed at 8:40 p.m. and reconvened at 8:55 p.m. Commissioner Brodsky question Mr. Wickerham about the type of safety alarms ARCO provided to detect gasoline leaks. Mr. Wickerham said that there a safety valve is provided on each gasoline dispenser along with a leak detector /monitor. commissioner Brodsky commented that the public telephone should also be relocated to the front of the building. Commissioner Miller question considered a high - volume responded that ARCO's plan expansion. if the ARCO station would be facility. Mr. Wickerham as to over -build for future Public Hearing Closed at 9:30 p.m. Planning Commission, City of Moorpark, California Minutes of March 15, 1993 Page -6- Motion: Commissioner Brodsky moved and Commissioner May seconded a motion to approve Commercial Planned Development If 92 -1, the Mitigated Declaration, and amended conditions as follows: * That with the surveillance camera a video recorder be provided; * That a shared driveway be provided to the west of the development; * That the delivery hours be allowed to be any time during the day or night with the provision that if complaints were received by the Community Development Department that the Director would have the authority to specify the hours of delivery. Motion passed by a 4:0:1 voice vote. Commissioner Torres absent. k 10. DISCUSSION ITEMS: A. A resolution which the Planning Commission recommends the Historic Preservation Ordinance to be Codified as Title 14 Entitled Historic Preservation, Chapter 14.04 of the Moorpark Municipal Code and further recommending that the Planning Commission act as the Historic Preservation Advisory Board. Presented by Associate Planner Kathleen Mallory. Reference: Staff Report dated March 9, 1993. The Commission discussed the possibility of appointing an advisory board to assist in the Cultural Heritage Ordinance. Commissioner Miller suggested that staff contact the Historieal Society. Motion: Chairman Wesner moved and Commissioner Miller seconded a motion to continue this item to the next regular meeting of the Planning Commission to provide comments from those parties interested in the Cultural Heritage Ordinance for Moorpark. STAFF COMMENTS: The Director gave a verbal overview of the conference that the Planning Commission had recently attended. The Director also noted to the Commission the City Council / Planning Commission's joint meeting would be held on April 19, 1993. 12. COMMISSION COMMENTS; The Commission directed staff to provide conference material from the Planning Commission recent conference. 13. FUTURE AGENDA ITEMS: Planning Commission Conference material from the League of California Cities Planning Commission Conference. 13.
