Minutes of August 16, 1993
The regular meeting of the Planning Commission held on August 16,
1993 in the City Council Chambers. Located at 799 Moorpark Avenue,
Moorpark, California.
1. CALL TO ORDER:
Chairman Michael Wesner called the meeting to order at
7:11 p.m.
2. PLEDGE OF ALLEGIANCE:
Commissioner John Torres led the Pledge of Allegiance..
3. ROLL CALL:
Present: Steve Brodsky, Christina May, Barton Miller,
John Torres; and Chairman Michael Wesner Jr.
Jim Aguilera, Director of Community

4. PROCLAMATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS:
There were no Proclamations, Commendations or Special
Presentations.
5. REORDERING OP, AND ADDITIONS TO TEE AGENDA:
Motion: Chairman Wesner moved and Vice Chairman Torres
seconded a motion to reorder the agenda. The
Public Hearing portion of the agenda was
reordered as follows: Item 9.B., Item 9.0 and
Item 9.A.

6. APPROVAL OF MINUTES:
Motion: Vice Chairman Torres moved and Commissioner
Miller seconded a motion to approve the
minutes of August 2, 1993 as submitted.
Motion passed by a 5:0 voice vote.
7. PUBLIC COMMENTS:
Eloise Brown, 13193 Annette Street, Moorpark. Ms. Brown
commented on the amended Specific Plan conflict of
interest
S. CONSENT CALENDAR:
There were no items for Consent Calendar.
9. PUBLIC BEARINGS:
B. Entitlement: Conditional Use Permit Number 92 -4
,— Applicant: Moorpark United Methodist Church
Proposal: To construct a 11,570 square foot addition to
an existing church for additional worship area,
construction of additional classrooms and administration
buildings, and an addition to the existing fellowship
hall. The proposed classroom addition will result in the
addition of a second story.
Location: 261 Flory Avenue, on the southwest corner of
Third Street and Flory Avenue. Assessor's Parcel No.s
512 -0- 111 -270, 512 -0- 111 -160 and 512 -0- 111 -170
Associate Planner Kathleen Mallory gave the presentation.
Reference: Staff Report dated August 16, 1993.
Commissioner's May, Miller and Torres announced to the
applicant that they were indirectly associated with
Moorpark United Methodist Church and if the applicant
wished they would abstain from voting. The applicant
responded that it was unnecessary and that the Commission
members remain for the public hearing process.
Testimony received from the following:
Walter Dilg, Pastor, 261 Flory Avenue, Moorpark. Pastor
Dilg commended staff for their efforts and processing of
T the church's request to expanding it's current facility.
He went on to explain how the proposed expansion would

facilitate the church's needs.
Carl Irwin, Irwin Architectural, 7400 Center Drive 1215,
Huntington Beach. Mr. Irwin responded to:
Condition No. 26 - "Roofing material shall be concrete or
clay..." The Commission concurred that the roofing
material shall be approved by the Director of Community
Development.
Condition No. 30 - "...noise generation sources on -site
shall be attenuated to 55 DBA at the property line..."
The Commission concurred that no DBA requirement should
be imposed for the existing chimes.
Condition No. 47 - "All uses and activities shall be
conducted inside the buildings unless otherwise
authorized..." The Commission concurred that this
condition be revised to read "All uses and activities
shall be conducted inside the buildings or within the
property limits. unless otherwise..."
The Commission questioned staff about the conditional use
permit, the duration, and procedure to reapply. Staff
responded that the permit in this case would be valid for
ten years and the applicant would reapply six months
prior to the termination of the ten -year period for CUP
92 -4.
The Commission discussed the issue of gates, where they
were to be placed, whether they should be locking gates
or self- closing gates. The biggest concern regarding the
gate issue was that the gate nearest the entry to the
parking lot be locked during hours the Church was not in
operation. The applicant's architect responded and said
that a locking gate could be unsafe in emergency
situations. He recommended a self closing gate.
Jim Hartley, 5950 Gabbert Road, Moorpark. In support of
the requested proposal.
John Newton, 165 High Street, Moorpark. In support of
the requested proposal provided a written comment.
"Chairman Wesner and Members of the Commission: My
comments concern parking and in particular, Condition No.
19. It is my understanding that the project can be
approved at it's requested 350 seat capacity, and that
/ Condition No. 19 provides the Planning Director the
opportunity to review and acknowledge the additional

twelve (12) parking spaces to be provided, if not
provided tonight, in the future via reciprocal parking
agreement with a neighbor, thereby allowing the 350 seat
facility ".
Commissioner May commended staff on their working
practices to help the preservation of the downtown area.
Motion: Vice Chairman Torres moved and Chairman Wesner
seconded a motion to direct staff to prepare a
resolution of approval for Conditional Use
Permit No. 92 -4 for a ten (10) year period in
order to permit the 11,570 square foot
expansion at 216 Flory Avenue with the
following revisions:
(1) Add a requirement within the conditions of
approval to provide wrought iron gates and
fencing to enclose and extend the entire
length of the west side of the site, enclose
the parking lot on Flory Avenue, and gate the
�,- walkway leading to the patio area on Third
Street;
(2) Clarify permitted outdoor and annual
activities to be a condition of approval;
(3) Modify the allowable hours of operation to:
7:00 a.m. to 11:00 p.m. Monday through
Saturday; 7:00 a.m. to 10:00 p.m. on Sundays;
(4) Confirm that shielding of lights is a
condition of approval;
(5) Delete the reference to "concrete or clay
tile" in Condition No. 26;
(6) Exclude the existing chimes from the noise
attenuation requirement in Condition No. 30.
Motion passed by a 5:0 voice vote.
C. Entitlement: Conditional Use Permit Number 93 -2
Applicant: DeMontfort Academy Proposal: The proposed
project is to operate a private school within an existing
public school (the old Moorpark High School) which is
still owned by the school district but is not being
operated for public school activities.

511 -0- 020 -075.
Presented by Associate Planner Kathleen Mallory.

PUBLIC HEARING OPENED AT 8;40 P.M.
Testimony received from the following:
Greg Dilsaver, 280 Casey Road, Moorpark. Mr. Dilsaver
provide the Commission with a brief overview of the
proposed use. Mr. Dilsaver had no special comments
regarding the project.
Robert Janik, 58 Del Ray Circle, Thousand Oaks. In
support of the proposed use.
Marilyn L. Janik, 58 Del Ray Circle, Thousand Oaks. In
support of the proposed use.
Suzannah Loiselle, 2218 Fig Street, Simi Valley. Ms.
Loiselle presented the Commission with additional
material related to a leases for a proposed day care
facility on the Moorpark Unified School District (MUSD)
property. The Commission concurred to accept a copy of
the lease for Commission review.
Ms. Loiselle outlined the day care facility and
identified 72 children who are currently attending. She
explained to the Commission that she was preparing to
submit an application for a Conditional Use Permit. The
Director responded to the Commission that Ms. Losielle
proposed request was a matter of first come first served,
and that Demontfort Academy had submitted their CUP
application where Ms. Losielle had not.

support of the proposal.
Stephen Schuberg, 4621 Peppermill, Moorpark. In support
of the project.
PUBLIC HEARING CLOSED AT 9:20 P.M.
The Commission was concerned about outdoor
sports /activities /physical education, would a Temporary
Use Permit be required for these activities as stated in

Condition No. 29 ( "All activities shall be conducted
inside the buildings unless otherwise authorized by the
Director... "). The Director responded by saying that
"activities" would be identified in the conditions of
approval.
The Commission questioned staff about who would maintain
the facility. The Director said that the issue of
maintenance would be between the lessor and lessee and if
needed the City would have the authority to condition the
Conditional Use Permit user.
Commissioner Torres questioned staff whether the facility
was conditioned to update earthquake standards. The
Director responded that the Building Codes had been
considered and they are a part of the Conditional Use
Permit conditions of approval.
Motion: Chairman Wesner moved and vice Chairman Torres
seconded a motion to direct staff to prepare a
resolution of .approval for entitlement
Conditional Use Permit No. 93 -2; DeMontfort
Academy to operate a private school within the
existing public school (the old Moorpark High
School) which is still owned by the school
district but is not being operated for public
school activities.
Motion passed by a 5:0 voice vote.

A. Carlsberg Specific Plan and Draft EIR - Carlsberg
Financial Corporation (Continued from July 19, 1993)
Entitlement: Amendments to Carlsberg Specific Plan and
Draft EIR, Amendment to Land Use Element of the General
Plan to reflect amended land uses, and amendment to the
City's Zoning Ordinance to adopt amended land use
regulations of the Specific Plan as Zoning for property.
Proposal: Several text changes to the approved Carlsberg
Specific Plan as well as the following amendments to the
land uses within the Specific Planning area:

Location: The Carlsberg Specific Plan is located on 500
acres of land in the southeastern portion of the City of
Moorpark. The site is bounded by the Arroyo Simi and New
Los Angeles Avenue to the north, Spring Road to the west,
Tierra Rejada Road to the south, and the Moorpark Freeway
(State Highway 23) to the east.
Commissioner's May, Miller, provided a verbal statement
that indicated that they believed there were no
financial, or conflicts associated on their behalf.
Commissioner Brodsky provided a verbal statement for the
record that he would abstain.
The public hearing proceeded with the following
testimony:
Mary Myers, Department of Fish and Game, 330 Golden
Shore, Suite 50, Long Beach. Ms. Myers clarified the
Department of Fish and Game concerns as outlined in their
letter of June 30, 1993 and March 12, 1993. The
Commission concurred to accept additional information
provided by Ms. Myers.
Ms. Myers stated her recommendations to the Commission in
an effort to protect the undeveloped land in the
southeastern portion of the city limits. Her
recommendations included, that Alternative 3 be adopted
which would provide an acceptable level of protection for
the two endangered species and vernal pool habitat. A
modification to Alternative 3: 1) by establishing an
additional buffer of 250 -300 feet between the Lyon's

pentachaeta habitat and any construction or fuel
modification areas; 2) to require permanent protection
through a conservation eas®ment to the Department or
designated agent, for those portions of the open space
containing endangered species habitat, the vernal pool
watershed, and habitat for wildlife species of special
Concern. Ms. Myers concluded with a statement to the
applicant that the Department of Fish and Game has the
authority to require a permit for this purpose from the
applicant.
There was extensive discussion by the Commission about
the Fish and Game concerns.
Eric Sacowics addressed the Commission's August 2, 1993
request for further project information.
• Additional information about site grading.
• Additional information regarding project phasing,
street improvements and manufactured slope
(� revegetation.
e Caltrans identification of the impact of this SP
project on roadways under the jurisdiction of that
agency.
• Identify how the middle school will impact traffic.
• Provide discussion regarding the affordable housing
and how the project could be amended to incorporate
more affordable housing opportunities.
Kendal Elmer addressed the traffic response as outlined
in Attachment B.
PUBLIC HEARING REOPENED AT 10:40 P.M.
The applicant Mr. Tankersley provided the Commission with
his presentation on project phasing (Exhibit 15). He
also identified placement of housing units for TR -4785
and TR -4786. He gave an overall description of the
square footage, lot area, cut /fill areas, with a brief
description of the landscape plan for SP 92 -1.

Testimony received from the following:
Jackie Clifford, 4130 oakcliff Drive, Moorpark. Opposed
to the specific plan development.
Dan Wallman, 4210 Laurelhurst Road, Moorpark. Opposed to
the specific plan development.
Janet Murphy, 15308 Seitz Court, Moorpark. Opposed to
the specific plan development as proposed. Supports Fish
& Game recommendations.
Glen Ingel, 4121 Oakcliff Drive, Moorpark. Opposed to
the specific plan development. Mr. Ingel commented that
City staff reconsider the placement of public hearing
signs. In this particular case the public hearing sign
was not accessible to Mr. Ingel.
Marjorie Blye, 4122 oakcliff Drive, Moorpark. Supports
Fish & Game recommendations. Opposed to the specific
plan development as currently proposed.
Senior Planner Debbie Traffenstedt commented on
affordable housing concepts for SP 92 -1. They included
recommendations on changing the product type; reducing
lot size; setbacks and spread throughout the project
site. Ms. Traffenstedt informed the Commission of an
available Fannie Mae loan program for buyers with incomes
less that 120% of median income. Commissioner May
commented that site C could offer flexibility in
considering an affordable housing program for SP 92 -1.
Motion: Chairman Wegner moved and Vice Chairman Torres
seconded a motion to adjourn the public
hearing and all items remaining on the
Planning Commission Agenda to the Commission's
next regular meeting of September 7, 1993
Motion passed by a 4:0:1 (Brodsky abstain)
voice vote.
