Located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Chairman Michael Wesner called the meeting to order at 7:10 p.m. Z. PLEDGE OF ALLEGIANCE: Commissioner May led the Pledge of Allegiance. 3. ROLL CALL: Present: Steve Brodsky, Christina May, Barton Miller, John Torres; and Chairman Michael Wesner Jr. Jim Aguilera, Director of Community Development; Senior Planner; Paul Porter, Associate Planner Kathleen M. Phipps, Associate Planner; Assistant City Engineer; Dirk Lovett; and Celia LaFleur, Administrative Secretary. Absent: None. Traffic Engineer Kendal Elmer; Impact Sciences Project Manager Eric Sacowics. 4. PROCLAMATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS: There were no Proclamations, Commendations or Special Presentations introduced. S. REORDERING OB, AND ADDITIONS TO THE AGENDA: There were no items reordered or added to the agenda. 6. APPROVAL OF MINUTES: Motion: Chairman Wesner moved and Vice Chairman Torres seconded a motion to approve with revision the minutes of August 16, 1993. Motion passed by a 5:0 voice vote. Planning Commission, City of Moorpark, California Minutes of September 7, 1993 7. PUBLIC COMMENTS: Connie Lawrason, 4291 Ambermeadow Street, Moorpark. Mrs. Lawrason who was representing the Moorpark Historical Society read from a written statement recommending that the Ventura County Cultural Heritage Board be appointed as the City's Historical Preservation Board. B. CONBENT CALENDAR: A. Resolution No. PC -93 -281 Entitlement: Conditional Use Permit Number 92 -4 Applicant: Moorpark United Methodist Church To approve a Resolution to allow Moorpark United Methodist Church to construct an 11,570 square foot addition to the existing church for the addition to the worship area, construction of additional classrooms and administration buildings, and an addition to the existing fellowship hall. The proposed classroom addition will result in the addition of a second story. Location 261 Flory Avenue. Motion: Vice Chairman Torres moved and Commissioner May seconded a motion to approve with revisions to the hours of operation, and the placement of self - closing gates within the facility. Resolution No. PC -93 -281 was approved as follows: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE NEGATIVE DECLARATION AND MITIGATION MONITORING PROGRAM; AND APPROVING CONDITIONAL USE PERMIT NO. 92 -4 RELATED TO ASSESSOR'S PARCEL NO. 512 -0- 111 -270, 512 -0- 111 -160 AND 512- 0 -111- 170, FOR MOORPARK UNITED METHODIST CHURCH. Motion passed by a 5:0 voice vote. B. Resolution No. PC -93 -280 Entitlement: Conditional Use Permit Number 93 -2 Applicant: DeMontfort Academy To approve a Resolution to allow the DeMontfort Academy to operate a private school within an existing public school (the old Moorpark High School) which is still owned by the school district but is not being operated r Planning Commission, City of Moorpark, California Minutes of September 7, 1993 for public school activities. Location: 280 Casey Road, west of Walnut Canyon Assessor's Parcel Numbers 511 -0- 020 -055 and a portion of 511 -0- 020 -075 Motion: Vice Chairman Torres moved and Commissioner Miller seconded a motion to approve Resolution No. PC -93 -280: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 93 -2 FOR DEMONTFORT ACADEMY IN ORDER TO UTILIZE CERTAIN BUILDINGS AT 281 CASEY ROAD. 9. PUBLIC HEARINGS: 1. Carlsberg Specific Plan and Draft EIR - Carlsberg Financial Corporation (Continued from August 16, 1993) Entitlement: Amendments to Carlsberg Specific Plan and Draft EIR, Amendment to Land Use Element of the General Plan to reflect amended land uses, and amendment to the City's Zoning Ordinance to adopt amended land use regulations of the Specific Plan as Zoning for property. Proposal: Several text changes to the approved Carlsberg Specific Plan as well as the following amendments to the land uses within the Specific Planning area: Land Use 1. S.F. (Planning Area A) 2. Primary Roads isF�Ra Gross Acres Dwelling Units 40 46 37 32 7 27 43.5 2.5 9.0 221.4 17.5 145 138 109 160 482.9 552 Planning Commission, City of Moorpark, California Minutes of September 7, 1993 Carlsberg Specific Plan and Draft EIR - Carlsberg Financial Corporation Amendment to Land Use Element of the General Plan to reflect amended land uses, and amend City's Zoning Ordinance to adopt amended land use regulations of Specific Plan as Zoning for property. Location: The Carlsberg Specific Plan is located on 500 acres of land in the southeastern portion of the City of Moorpark. The site is bounded by the Arroyo Simi and New Los Angeles Avenue to the north, Spring Road to the west, Tierra Rejada Road to the south, and the Moorpark Freeway (State Highway 23) to the east. Commissioner Brodsky withdrew from the public hearing on this item due to a conflict of interest. Presented by Senior Planner Paul Porter. Reference: Staff Report dated August 26, 1993. Testimony received from the following: Ron Tankersley, 2800 28th Street, Santa Monica, California 91405. Mr. Tankersley provided the Commission with a summary of the overall Specific Plan 92 -1. He commented on the fact that individual opinions had been considered in this proposal. He described the type of improvements and contribution of fees to the City. He requested that the Commission recommend to the City Council the following: 1. That the Environmental Impact Report be certified as being complete and adequate. 2. That a 100 -foot buffer be established from the seasonal pool high water mark, that the seasonal pool be fenced with wrought iron with an appropriate access gate, that other appropriate provisions of the Rare Plant Management Plan (i.e. including but not limited to implementation of the dual drainage system) be incorporated to ensure the continued protection of the sensitive plants that occur in or near the pond, and that the pond and site drainage be maintained and managed by the homeowner's association or other entity as approved by the City Council. That within 30 days after excavation, all borrow sites shall be hydroseeded, contour graded and irrigated with a temporary above ground system until such time that the vegetation is well established, and that the borrow site be graded in such a manner as to minimize use of rectilinear forms. 4. That bike and hiking trails shall be shown on the Specific Plan. 5. That the City Council consider utilizing a portion of the BP (Business Park) designation be utilized for moderate income housing. 6. That the City Council consider utilizing the I (Institutional) land use designation for senior housing. �.- 7. That homes along the perimeter of housing area D which parallel Spring Road be limited to one -story structures to reduce visual impacts. Two story homes may be allowed if the rear setback is increased to a point where the two story house will exhibit the same profile as the one story house as seen from Spring Rd. The caveat to this condition is that the amount of grading of the Spring Rd. slope may not be increased in order to accomplish the larger rear setback. 8. The 552 dwelling units requested by the applicant be approved, and that an additional 15 units be approved as moderate income homes in order to encourage a diversity of housing unit types to provide for the diverse needs of the community. The developer agreement shall be used as the tool to implement the details of the housing assistance program and attachment "A" may be utilized as a guide for the assistance program. Margaret Kurnig, 10725 Citrus Drive, Moorpark. Ms. Kurnig representing the Environmental Coalition addressed her concerns to the Commission in a letter dated September 7, 1993. Mrs. Kurnig's only additional comment was that she supported the comments made in a letter addressed to the City of Moorpark dated June 30, 1993. Planning Commission, City of Moorpark, California Minutes of September 7, 1993 Beverly Harris, 13893 Christian Barrette Road, Moorpark. Ms. Harris commented on the fact that the Carlsberg Specific Plan was a well know issue. That in the year 1990 she and the homeowners association voiced their opinion to the City Council requesting consideration of the preservation of Moorpark's open space areas. Marjorie Blye, 4122 Oakcliff Drive, Moorpark. Ms. Blye said that the public hearing sign indicated a July 19th hearing date and may have been a reason that the public participation was low. She suggested that public hearing signs be placed at Spring Road and Christian Barrette. Janet Murphy, 15308 Seitz Court, Moorpark. Ms. Murphy representing the Environmental Coalition read from a written statement dated September 7th. Pat Basso, 3940 Southhampton Road, Moorpark. Ms. Basso said that the people affected by this development were unaware of the public hearing due to poor noticing procedures. Her second concern was that the Commission required that dwelling units to be built on the Spring Road ridgeline be built on the easterly portion of that ridgeline. Eloise Brown, 13193 Annette Street, Moorpark. Ms. Brown commented on the City's Government Channel 10 and provided information as to when City Council and Planning Commission meetings were broadcasted. At this point in the meeting Chairman Wesner called for a ten minute break. BREAK 8:10 P.M. - RECONVENE 8:26 P.M. At 8:30 p.m. the public hearing was closed. Eric Sacowics reiterated to the Planning Commission the staff report dated August 26, 1993. Motion passed by a 4:0:1 voice vote (Commissioner Brodsky abstained). 10. DISCUSSION IT$MSs Zoning Ordinance - Review the updated version of the Zoning Ordinance as amended by the City Council. The Commission concurred to continue this item to their next regular meeting. Historical Preservation Ordinance The Commission approved the ordinance as written with a 3:2 voice vote (Commissioner's Brodsky, May and Wesner voting yes; Commissioner's Miller and Torres voting no). The Commission then directed staff to report back with a summary of Cultural Heritage Ordinance in various cities in Ventura County. August 18, 1993 City Council Annotated Agenda Received and filed. COMMISSION COMMENTS; Planning Commission, City of Moorpark, California Minutes of September 7, 1993 Page -9- Commissioner May questioned staff about the possibility of a sound -wall between the residential area and the Metrolink Rail Station. Staff said they would forward her inquiry to the appropriate department head. 13. FUTURE AGENDA ITEMS: The Commission directed staff to agendize the formation of an Hillside Ordinance. 13.
