Located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Chairman Michael H. Wesner called the meeting to order at 7:10 p.m. 2. PLEDGE OF Vice Chairman John Torres led the Pledge of Allegiance.. 3. ROLL CALL: Present: Steve Brodsky, Christina May, Barton Miller, John Torres; and Chairman Michael Wesner Jr. Jim Aguilera, Director of Community Development; Deborah S. Traffenstedt, Senior Planner; Paul Porter, Senior Planner; Assistant City Engineer; Dirk Lovett, and Celia LaFleur, Administrative Secretary. Absent: None. 4. PROCLAMATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS: There were no Proclamations, Commendations or Special Presentations introduced to the Commission. S. REORDERING OP, AND ADDITIONS TO TEE AGENDA: The Commission concurred to reorder the agenda to bring public hearing Item 9.B. before to 9.A. Motion: Commissioner Torres moved and Commissioner May seconded a motion to receive an additional staff report dated September 13, 1993 regarding Industrial Planned Development Permit No. 93 -1. CONSENT CALENDAR: None. 9. PUBLIC NEhRINGS: b. applicant: G & S Partnership Proposal: IPD 93 -1: The applicant is proposing to construct two industrial concrete tilt -up warehouse buildings as follows: Site area: BUILDING AREA: Building 1 262,000 s.f. Building 2 152,500 s.f. Total 414,500 s.f. Building Footprint: 414,500 s.f. Coverage: 49.3 % Parking provided: 343 spaces 19.3 acres The proposed building will be used mainly for a regionally oriented direct mail processing and distribution center with no sales area. There will be 33 truck wells and a total employment of approximately 300 people with approximately 150 people per shift. Lot Line Idjustment No. 93 -8 - The lot line adjustment is to consolidate three existing parcels into two parcels by eliminating one of the lot lines. Location: The proposed project is located at the northerly terminus of Science Drive southwest of the Moorpark Freeway, and northwest of New Los Angeles Avenue, Moorpark, California. Reference: Staff Report dated September 7, 1993 and September 13, 1993. Public Hearing opened at 8:05 p.m. Testimony received from the following: Stan Brown, Vice President of Mail Marketing. In support of the proposal. Brian Holquin, Architect for GAS Partnership in support of the proposal. Robert G. Lumley, agent for GAS Partnership, Vice President, The Voit Companies, 1701 Pacific Avenue,Suite 170, Oxnard, California 93033. Mr. Lumley spoke to the Commission about the concern he had with staff's conditions of approval. He referenced his letter to Chairman Wesner dated September 9, 1993. He address the following conditions: Condition No. 9 - GAS Partnership disagreed with this condition. The proposed use of the property by Mail Marketing Corporation would be within the regulations of the M -1 zone. Mr. Lumley requested that Condition No. 9 be deleted. Condition No. 16 - Mr. Lumley requested clarification of this condition. Staff clarified this condition to indicate "along New Los Angeles Avenue, the location of which shall be determined by the Director of Community Development. Condition No. 18 - Mr. Lumley said that this condition restricted the issuance of the Grading Permit until such time that the final landscape and irrigation plans, together with specifications and a maintenance program, have been submitted to the Director for approval. His request was that staff revise this condition to show that the term "Grading Permit" be substituted with "Building Permit ". Condition No. 18.k. - Mr. Lumley requested that the Commission revise this condition to state various tree sizes of "15 gallon to 36 inch box containers ". le- Planning Commission, City of Moorpark, California Minutes of September 14, 1993 Pecs -4- Condition 18.m. - Mr. Lumley said because of the fact that the New Los Angeles Avenue was the Caltrans right - of -way and not the G &S Partnership's property he requested that this condition be deleted. Condition 26. - Mr. Lumley said that this condition required roof mounted equipment screening tall enough to block the view or the equipment from New Los Angeles Avenue. A condition difficult to obey and suggested that the Commission consider a revision that G &S Partnership agrees to paint to match the color of the roof mounted equipment to blend into the roof. Condition No. 27. - Mr. Lumley requested that the phrase "masonry wall" be removed. G &S Partnership may want to provide an alternative means of screening. Condition No. 28. - Mr. Lumley requested that this condition be deleted. Condition No. 30. - Mr. Lumley requested that this condition be modified from 120 to "180" days to complete the on -site improvements. Condition No. 32.d. - Mr. Lumley requested that this condition be modified to read "disposal areas shall be protected from weather conditions...". Condition No. 32.i. - Mr. Lumley said that the concept of gates to enclose the disposal area was not practice. He suggested that this condition be revised to read "subject to the Director's approval ". Condition No. 34.d. - There colored /designed concrete area, the northeast corner objected to this condition tractor /trailers. He said soon be visible and creatiz requested that the Commiss this requirement. was much discussion regarding to be installed in the open of the property. Mr. Lumley due to the use of the area by tire arks, oil stains would q an unsightly condition. He ion consider the deletion of Condition No. 34.e. - Mr. Lumley asked that this condition be revised from a 7 foot to 5 foot wide strip around the perimeter of Building 1 be landscaped. Planning Commission, City of Noorpark, California Yinntes of September 14, 1999 Inge -s- Condition No. 35.i. - Mr. Lumley asked that the Commission to consider the deletion of a requirement that GAS Partnership landscape and irrigate the large slope area between the property and the 23 Freeway. He went further to say that approximately two years ago, Caltrans purchased the slope area from Cabot Cabot A Forbes. At that time, the slope was fully landscaped and irrigated. Condition No. 42. - Mr. Lumley requested that this condition be modified to read, "GAS Partnership would underground all on -site existing utilities. Condition No. 45. - Mr. Lumley modification to this condition was that GAS Partnership expand on this condition to include the option of allowing the installation of public art on -site of equal value. Condition No. 46. - Mr. Lumley asked that the Commission consider a modification to Condition No. 46 as follows: ZOE "T Condition No. 50. - Mr. Lumley asked that this condition be clarified in the following way "pay a fee established pursuant to Ordinance 102 in the amount of $ .05 per sq. ft. Ito be used to install..." Condition No. 55. - same as Condition No. 30. Condition No. 64. - That this condition be revised to include an option to designate a screened area for the maintenance of Mail Marketing forklifts. Condition No. 75. - The applicant shall provide for all necessary on -site and off -site storm drain facilities required b the Cit to accommodate upstream and on -site flows Planning Commission, City of Moorpark, California Minutes of September 14, 1993 Condition Nos. 79, 80 and 86. The applicant shall submit to the City of Moorpark for review and approval, street improvement plans prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improvements; and shall post sufficient surety guaranteeing the construction of the improvements. Any right -of -way acquisition necessary to complete the required improvements will be acquired by the applicant at his expense. The Agreement shall be prepared by the City and shall be signed by all parties of interest. The improvements shall include concrete curb and gutter, sound /screen wall, sidewalk, street lights, striping and signing, paving, medians, traffic signal modification, controller re- phasing, traffic control, and any necessary transitions to the satisfaction of the City Engineer. All driveway locations shall be approved by the City Engineer and the Director of Community Development. The applicant shall dedicate the necessary right -of -way to make all of the required improvements. Iffffeaffauffffm Condition No. 8o - The applicant shall prepare for the City a conceptual alignment and right -of -way plan, (to be reviewed and approved by the city Engineer), verifying that New Los Angeles Avenue can be constructed to its ultimate width without conflicts with the proposed project. The study shall investigate and confirm that ultimate construction of New Los Angeles Avenue, including all necessary slope maintenance, drainage and construction easements, can be accomplished and be compatible with the proposed Mail Marketing site plan. Condition No. 86 - Los Angeles Ave. adjacent to IPD 93 -1 shall be widened north of the centerline in accordance with Ventura Co. Standard Plate B2 -A. The improvements shall include concrete curb and gutter, sidewalk, street lights, striping and signing, paving, medians, traffic signals or traffic signal relocation, controller rephrasing, traffic control, and any necessary transitions to Planning Commission, City of Moorpark, California Minutes of september 14, 1993 Paae -7- the satisfaction of the City Engineer. The subdivider shall dedicate any necessary right -of- way to make all of the required improvements. If it can be shown that previous guarantee for the improvement of Los Angeles Ave. to its ultimate right of way, is in place, upon concurrence of the City Manager, the applicant will not be required to construct the improvements. Improvement of Los Angeles Ave. shall be defined as all costs to design, administer, construct and inspect the improvements. If required by the City, the applicant shall provide a conceptual design and cost reviews for the proposed improvements. Condition No. - 81. The applicant shall make a special contribution to the City representing the applicant's pro -rata share of the cost of the improvements at the following intersections: New Los Angeles Avenue /Spring Road Condition No. - 85. The applicant shall execute a covenant running with the land on behalf of itself and its successors, heirs, and assigns agreeing to participate in the formation of an assessment district or other financing technique including, but not limited to the payment of traffic mitigation fees, which the City may implement or adopt, and to fund public street and traffic improvements directly or indirectly affected by the development. The covenant is to be approved the Director of Community Development and City Attorney. Condition No. - 105 A licensed security guard is recommended during the construction phase, or a 6 -foot high chain link fence shall be erected around the construction site. Condition No. 106 - Construction equipment, tools, etc., shall be properly secured during non - working hours. Condition No. - 107 All appliances (microwave ovens, dishwashers, trash compactors, etc. will be properly secured prior to installation during nonworking hours. All serial numbers will be recorded for identification purposes. Public Hearing Closed at 8:22 p.m. Break at 8:23 P.M. Reconvene at 8:50 p.m. The Commission discussed in great length the requirement of Condition No. 35.i. that G &S Partnership landscape and provide irrigation to the larger slope area between the property and the 23 Freeway. The other issue of concern was found in Condition No. 34.d. which related to a requirement of colored designed concrete which would be installed in the open area northeast corner of the property. The Commission concurred that concrete be alternating color variation on that portion of the property. The Commission question the applicant about the number of employees this facility would employ. Mr. Brown said the currently Mail Marketing is employing 300 + - and it was unknown whether these employees would relocate or commute to the newly proposed facility. Cost factors were identified as $20,000 - $30,000 for landscaped and irrigation; Caltrans slope area $2,600 toward intersection improvements proposed. Motion: Chairman Wesner moved and Commissioner Torres seconded a motion to recommend to the City Council approval of IPD 93 -1 and LLA 93 -8 with the revised conditions. Motion passed by a 5:0 voice vote. a. satitlement: Amendment to Ordinance No. 137, the Moorpark Zoning Ordinance, Sections 8102 -0 and 8107 -1.7 Applicant: City of Moorpark Proposal: Amend Sections 8102 -0 and 8107 -1.7 of Zoning Ordinance pertaining to Second Dwelling provisions. Zoning Ordinance revisions include a requirement that a Planning Commission Conditional Use Permit be obtained for a second dwelling and that such dwellings shall only be permitted on a residential lot that is one -half acre or larger in size located in a Rural Exclusive (R -E) , Piamminq Cosstission, City of !Moorpark, California Minutes of September 14, 1993 Pane .9- Rural Agricultural (R -A), Single Family Estate (R -O), Residential Planned Development (R -P -D) , or Specific Plan (SP) zone district. Locations Applicable Citywide. Senior Planner Debbie Traffenstedt gave a presentation. Reference: Staff Report dated September 14, 1993. Public Hearing Opened at 10:35 p.m. No public testimony received. Motion: Commissioner Brodsky moved and Commissioner Torres seconded a motion to approved Resolution No. PC -93 -283 as recommended by staff. Notion passed by a 5:0 voice vote. r� 10. DISCOSBION ITIMSt a. Hillside Ordinance Motion: Chairman Wesner moved and Commissioner Torres seconded a motion to directed staff to prepare a memo to the City Council identifying the urgency in preparing a hillside ordinance. Motion passed by a 5:0 voice vote. b. Historical Preservation ordinance - Review of historic preservation ordinances by other cities within Ventura County. Motion: Commissioner May moved and Commissioner Torres seconded a motion to recommend to the City Council that the Ventura County Historical Society be the governing body for Moorpark historical preservation. Motion passed by a 3:2 voice vote, Commissioner's Wesner and Brodsky voting no. 11. STAFF COMMENTS: None.
