HomeMy WebLinkAboutMIN 1994 0525 PC SPCMINUTES OF THE SPECIAL JOINT MEETING OF THE CITY COUNCIL AND PLANNING COMMISSION Moorpark, California May 25, 1994 A Special Joint Meeting of the City Council and Planning Commission of the City of Moorpark was held on May 25, 1994 in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER Mayor Lawrason called the City Council meeting to order at 7:02 p.m. 2. ROLL CALL: Present: Absent: Staff Present: 3. 4. PUBLIC COMMENT: ACTION /DISCUSSION: COUNCIL ONLY: A. Councilmembers Hunter, Montgomery, Wozniak and Mayor Lawrason Councilmember Perez Steven Kueny, City Manager; Dorothy Vandaveer, Deputy City Clerk None Staff Recommendation: Approve agreement subject to final language approval of City Attorney and City Manager and authorize Mayor to sign agreement. (Continued Item 11.0. from 5/18/94) Mr. Kueny gave the staff report. MOTION: Mayor Lawrason moved and Councilmember Montgomery seconded a motion to approve agreement subject to final language approval of City Attorney and City Manager and authorize Mayor to sign the agreement. The motion carried by 4 -0 voice vote. B. Committee. He indicated that the City Attorney has suggested that the proposed Ad Hoc Committee be limited to the Settlement Agreement discussions only. If that is the action taken by the Council, Mr. Kueny said the Ad Hoc committee could consist of both members of a Standing Committee because this subject would not be a matter ordinarily considered by a standing committee. MOTION: Mayor Lawrason moved and Councilmember Montgomery seconded a motion to approve appointment of Mayor Lawrason and Councilmember Perez to the Ad Hoc Committee to negotiate the Settlement Agreement pertaining to the Conejo Freeway Properties, Ltd, et al litigation. The motion carried by 4 -0 voice vote, Councilmember Perez absent for the vote. AT THIS POINT in the meeting, Mayor Lawrason declared a recess of the City Council meeting. The time was 7:06 p.m. The City Council reconvened to a Joint Meeting with the Planning Commission. The time was 7:10 p.m. Chairman Wesner called the Planning Commission to order at 7:10 p.m. Commissioners Present: Commissioners May, Miller, and Chairman Wesner Absent: Commissioner Torres Councilmembers Present: Councilmembers Hunter, Montgomery, Wozniak and Mayor Lawrason Absent: Councilmember Perez Staff Present: Steven Kueny, City Manager; Charles Abbott, City Engineer; Jaime Aguilera, Director of Community Development; Dirk Lovett, Assistant City Engineer; Kathleen Mallory - Phipps, Associate Planner; Paul Porter, Senior Planner; Deborah Traffenstedt, Senior Planner; Dorothy Vandaveer, Deputy City Clerk Minutes of the Joint Meeting of the City Council and Planning Commission Moorpark, California Page 3 May 25, 1994 5. SWEARING IN OF TED MARTENS AS NEW PLANNING COMMISSIONER Dorothy Vandaveer, Deputy City Clerk, administered the Oath of Office to Ted Martens. Mr. Martens was seated as Planning Commissioner. 6. PUBLIC COMMENT: James Hartley, 5950 Gabbert Road, spoke regarding the freeway bypass. He requested that the City Council support allowing open opportunity for the citizens of Moorpark to evaluate the freeway bypass. He said the freeway alignment should be reviewed by the community before plans are made by Caltrans. Joe Latunski, 289 Casey Road, commented that the freeway alignment should be reviewed carefully by the City Council. 7. ACTION/ A. Ms. Traffenstedt spoke briefly about the General Plan consistency issues. She also indicated that a separate meeting will be scheduled after the Notice of Preparation is processed. Dennis Hargrave, spoke representing Development Planning Services, 651 Via Alondra, Suite 714, Camarillo. He briefly described proposed Specific Plan No. 1. He said one of the planning constraints is the building of the State Highway bypass. Mr. Hargrave said that the special study area may accommodate either public or institutional use. Steve McCormick, spoke representing the architectural firm of Richards & Martin Architects, 4611 Teller, Newport Beach. He identified the focal points, entryways and vehicular and pedestrian circulation for the proposed project. He indicated that this area lends itself to providing a network of sidewalks and paths to enhance the surrounding area. Mr. Aguilera said the issues to be resolved are related to land use and circulation as it relates to the placement and construction of the proposed freeway bypass. Additionally, he said staff is concerned about Casey Road at its present location with the school on the south side and homes on the north side. Casey Road as it is now constructed cannot accommodate the amount of traffic that would result from this development. Mr. Aguilera also indicated that the question as to who would maintain the 400 foot buffer zone needs to be resolved. Councilmember Wozniak said his concern is the Casey Road issue. He said he is not convinced that anything can be done with the older portion of the roadway. In response to Councilmember Wozniak, Mr. Aguilera said Casey Road would have to be widened to the north which would result in the removal of several homes. He stated that freeway access onto Walnut Canyon Road has been discussed; however, that would involve condemnation of property at the terminus of the freeway and where Walnut Canyon is located. Councilmember Wozniak said he does not think the City should have to buy property to get a roadway in on a specific plan. He indicated that preliminary studies of the alternatives should be done. In response to Councilmember Hunter, Dennis Hargrave said the buffer zone and the low density housing areas on the specific plan are there to maintain some degree of separation on the north side of the roadway. He described the buffer zone as natural open space. Minutes of the Joint Meeting of the City Council and Planning Commission / Moorpark, California Page 5 May 25, 1994 Mayor Lawrason said he is concerned about who will be responsible for maintaining the 93 acres of proposed open space. He said it is an issue that needs to be addressed. Commissioner May questioned if the access road in the proposed plan could be continued to connect to High Street. Mr. Kueny said that High Street extension was specifically removed from the Circulation Element. Mayor Lawrason commented that it would be helpful if the Council could be provided overlays to clarify the geological issues that may be involved. In response to Mayor Lawrason, Mr. Hargrave said the location of the bypass road is uncertain and that in approximately 60 days they will have information regarding future traffic needs in this area of the city. - Jim Hartley, 5950 Gabbert Road, said he is supportive of the project and especially the recreation trail element. He does believe the development should benefit the City as much as possible with amenities because there is a certain quality of life being sacrificed for this project. Mr. Hartley also said that he believes Liberty Bell Road should be extended north as it would reduce the traffic impacts on the community if this project is finalized. Rene Mayfield, 6085 Darlene Lane, indicated some changes to the project that she would like to see made. Mrs. Mayfield also said the density of 620 dwelling units is too much for the location of this project. Shirley Baher, 5979 Gabbert Road, commented that her concern is where the freeway right of way is going to ultimately be located. Councilmember Wozniak said that members of the public should get involved with the decisions being made by Caltrans with regard to the location of the freeway bypass. Councilmember Montgomery said that informational maps will be made available and that City staff will be available to answer questions. She said the developer is not returning enough benefit to the City to balance out the sacrifices that are being made by the residents. Barbara Wilhelm, 11905 Elwin Road, spoke in opposition to the development. She said gating her present community may be the only way to protect themselves from the crime element that would be increased if the population is increased. Manny Asadurian, 11905 Darlene Lane, spoke in opposition to the development. He said another entrance and exit for vehicular traffic is needed. Lowell Withington, 11925 Darlene Lane, said pollution is one of his concerns with the increased traffic that will result from this development. John Guaglianone, 145 Casey Road, said there are many issues to be resolved before this item can move forward. Steve Graven, 287 Casey Road, spoke in opposition to the project. Barbara Shultz, 116 Sierra Avenue, spoke in opposition to Liberty Bell Road being extended to Poindexter Avenue. Gerry Goldstein, 11932 Los Angeles Avenue, spoke regarding the needed drinking water supply. Mayor Lawrason clarified that this development is not a 620 unit project. He said the Specific Plan has an approved maximum allowable number of 415 units. He said the developer is merely portraying the 620 units on their drawings this evening and that they will have to provide specific community benefits in order to be considered for approval with 620 units. Councilmember Wozniak said he wants to see drawings that depict the two alternatives: 1) the one that shows the plan that was done by the school district where the road extends through their property; and 2) the extension of High Street as an entrance to Specific Plan No. 1 (the one mentioned by Commissioner May earlier). /- Minutes of the Joint Meeting of the City Council and Planning Commission Moorpark, California Page 7 May 25, 1994 MOTION: Councilmember Wozniak moved and Councilmember Montgomery seconded a motion to authorize staff to process the Notice of Preparation and distribute the Notice of Preparation of an environmental impact report. The motion carried by 4 -0 voice vote, Councilmember Perez absent for the vote. B. Mr. Kueny said that staff will come back with maps including the two circulation alternatives and the use of the corridor tentatively identified by Caltrans for the freeway bypass right of way. AT THIS POINT in the meeting, the Council took a recess. The time was 9:17 p.m. Councilmember Montgomery left the meeting at this point. The meeting reconvened at 9:50 p.m. Mr. Kueny recommended that this item be continued to June 27, 1994. MOTION: Mayor Lawrason moved and Councilmember Hunter seconded a motion to continue this item to June 27, 1994 at a regular meeting of the Planning Commission and a Special Joint Meeting of the City Council with the Planning Commission. The motion carried by 3 -0 voice vote, Councilmembers Perez and Montgomery absent for the vote. C. Mr. Kueny said that Items C. and D. could be considered together by the City Council and Planning Commission as part of the annual joint meeting forum. Meeting and Planning Commission Page 8 May 25, 1994 Chairman Wesner stated that the Hillside Ordinance is a number one priority for the Planning Commission in the upcoming weeks. He requested direction as to what weight of consideration the Hillside Ordinance and Growth Management Ordinances should be given when Specific Plans such as this one come before the Commission. Mr. Kueny said that Specific Plan Numbers 1 and 8 will be initially considered by the Council prior to Planning Commission consideration of the Hillside Ordinance. He continued by stating that the Council will be asked to give staff and the developer direction on the Hillside Ordinance. Chairman Wesner said that is exactly why the Commission wants the Hillside ordinance finalization expedited. Chairman Wesner said other concerns that the Planning Commission has placed as their priorities are the Zoning Ordinance, the Sign Ordinance and the Housing Element of the General Plan, which needs to be updated. Mayor Lawrason agreed that the Hillside Ordinance needs to be expedited. He stated that the Growth Management Ordinance is second priority of the items mentioned by Chairman Wesner. He indicated that the Zoning Ordinance, Sign Ordinance and the Housing Elements are costly items for staff to produce. In response to Mr. Kueny, Chairman Wesner stated that a downtown study is last priority in relation to the other items he mentioned. Mayor Lawrason said he believes there is some urgency attached to a downtown study because the City has property in that area. Commissioner May said she feels strongly that a Social Service Element should be prepared. She said the youth of the community would benefit from such an element and one needs to be developed. Mayor Lawrason complimented the Planning Commission on the quality of the support they have been providing to '� the City Council. Minutes of the Joint of the City Council Moorpark, California Meeting and Planning Commission Page 9 May 25, 1994 Chairman Wesner complimented the Council on their cooperation and on the independence they allow the Commission in making decisions. He indicated that it would be helpful if the Planning Commission could be provided with copies of the Community Development Committee agendas so they can be aware of impending projects or issues. Mr. Kueny said a copy of the Community Development Committee agendas can be provided to the Commissioners. 8.
