Minutes of June 26, 1995
The Planning Commission meeting of June 26, 1995, held in the
City Council Chambers, 799 Moorpark Avenue, Moorpark, CA 93021.

Chairperson Torres called the meeting to order at 7:15 p.m.
Chairperson Torres led the pledge of allegiance.

All Commissioners were present (Commissioner Acosta arrived
at 7:28 p.m.). Staff attending included Jim Aguilera,
Director of Community Development, Dirk Lovett, Celia
LaFleur, Administrative Secretary.

MOTION: Commissioner Martens moved and Chairperson Torres
seconded a motion to approve the Planning Commission minutes
of May 22, 1995, and the Joint City Council /Planning
Commission meeting minutes of May 10, 1995.

Proposal: Consider revisions to Section 17.20.060
(Permitted Uses in Commercial and
Industrial Zones) of the Moorpark
Municipal Code (City of Moorpark Zoning
Ordinance) to Allow Automobile Service
Stations in Industrial Zones
Location: Incorporated area of the City of
Moorpark
Jim Aguilera gave the presentation. Reference: A staff
report dated June 9, 1995. The public hearing opened
at 7:29 p.m..
The Commission asked staff if there was enough
industrial zoned property to allow the requested
change. The Director went on to estimate the amount of
industrial zoned property.
Mr. Boukhar, the applicant briefly described the
requested proposal. A gas station facility of 2800
square feet (includes a mini mart facility). Mrs.
Boukahar explained to the Commission that a mini -deli
like facility is being considered.
The Commission was concerned about the time constraints
involved with the proposal and discussed the issues of
development and if the project should file for an
industrial development permit along with a Zone Change,
or a Zone Ordinance Amendment.
The Commission's other concerns were about the Zoning
Ordinance Amendment which would give all industrial
zoned properties the ability to have pubic or private
gas pump uses.
MOTION: The Commission's consensus to continue the
meeting to a future date and that the Zoning Ordinance
Amendment returns to the Commission with an application
for an Industrial Planned Development Permit request.
a. Conflict of Interest - Radius Map
At the Planning Commission meeting of May 22, 1995, the
Commission directed staff to provide information
regarding the conflict of interest. The Commission was
concerned with issues that may arise with the

Commission's review of the up coming entitlement
requests.
The memo identified how the proximity to a project
could create a conflict of interest.
Two of the Commission members said that they were
unsure of their position in determining whether they
had a conflict of interest. The Director said that he
will try to arrange a meeting with the City's attorney
for further discussion.
