RESOLUTION NO. PC -96 -318 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING APPROVAL OF THE BOLLINGER DEVELOPMENT CORPORATION'S MOORPARK COUNTRY CLUB ESTATES PROJECT: GENERAL PLAN AMENDMENT NO. 94 -1, ZONE CHANGE NO. 94 -11 VESTING TENTATIVE MAP NO. 4928, RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. 94 -1, AND CONDITIONAL USE PERMIT NO. 94 -1 Senior Planner gave the staff report and provided the Commissioners with a memorandum identifying three additional modifications to the Vesting Tentative Map conditions. The Commission also accepted a letter from Paul Bollinger requesting additional modifications to conditions; however, Mr. Bollinger clarified that most of his concerns had been resolved. The Commission advised Mr. Bollinger that he would need to discuss remaining disagreement regarding surety requirements for grading and the time limit for the CUP with the City Council. Chairman Torres questioned whether CUP Condition No. 147 should have been deleted, and the Senior Planner verified that Condition No. 147 and any other conditions requiring trail construction should have been deleted. MOTION: Commissioner Martins moved and Commissioner May seconded a motion that the Planning Commission adopt Resolution No. 96 -318, deleting all conditions requiring trail construction, and that staff forward a recommendation to the City Council to have the City Attorney review CUP Condition No. 4. The motion passed with a unanimous voice vote.
