Chairman Torres presiding and called the meeting to order at 7:13 p.m. Commissioner Acosta led the pledge of allegiance to the flag. 9111FINTMEW-W Chairman John Torres, Commission members' Tina May, Barton Miller, Ernesto J. Acosta was present. Theodore H. Martens was absent(excused). Staff attending included Richard Hare, Director of Community Development, Senior Planner's Debbie Traffenstedt and Paul Porter, and Assistant City Engineer, Dirk Lovett. 4. Mr. Kelly requested that the City not permit maximum density (dwelling units) within the Specific Plan No. 2 (Morrison Fountainwood) development. He read from a Citizens Who Care proclamation that was later distributed to the Commission. Planning Commission, City of Moorpark, California Minutes of April 22, 1996 Page 2 None. Applicant: Hidden Creek Ranch Partners (Messenger) Proposal: The Hidden Creek Ranch Specific Plan is intended to provide for the systematic implementation of the City's General Plan, within the framework of a comprehensive regulatory plan. The City's General Plan allows for a dwelling unit range between 2,400 and 3,221, and other appropriate land uses, for the Specific Plan site. A General Plan Amendment has been requested to reflect the final approved Specific Plan land use designations, circulation system, and environmental setting information on the City General Plan exhibits; and a Zone Change has been requested to prezone the Specific Plan site. The proposed Specific Plan provides for up to 3,221 residential units located within 4 villages, which would be concentrated in the southern portion of the 4,323 -acre site and separated by open space. The 4 villages will be defined by village centers, schools, parks, and other public facilities. Other related and supporting uses would include a 18 -hole golf course with a 10.5 -acre clubhouse area, an equestrian center, and 29.2 acres of commercial uses. Approximately 10% of the residential units are proposed to be developed as affordable housing. The draft land use plan proposal is for 2,700 acres of the site to be designated as open space, of which 1,800 acres in the northerly portion of the site is proposed to be retained as natural open space. A Sphere of Influence amendment and annexation approval from the Ventura County Local Agency Formation Commission '" Planning Commission, City of Moorpark, California Minutes of April 22, 1996 Page 3 would be required before the City could formally approve zoning, subdivision maps, and permits for Specific Plan development. Location: Within the Moorpark Area of Interest in Ventura County, directly north of the City jurisdictional boundary near Moorpark College and the Campus Park and Varsity Park residential areas, and east and south of Happy Camp Canyon Regional Park. Senior Planner, Debbie Traffenstedt recommended that the public hearing be continued to the Commission meeting of June 17, 1996. Staff was directed to reschedule the regular meeting of June 10 to June 17. NOTION: Chairman Torres moved and Commissioner Acosta seconded a motion to continue the Specific Plan 8 Public Hearing to June 17, 1996. Motion passed with a 4:0 voice vote. b. Development Plan Permit No. 336 Major Modification No.l Applicant: American High Lift; Entitlement: Location: 875 West Los Angeles Avenue Proposal: Approval of a 3,280 square foot storage building; Existing General Plan Designation: I -2, Medium Industrial; Existing Zoning: M -2, Limited Industrial; Assessor's Parcel Number: 511 -0- 070 -555. Staff Recommendation: Continue the Public Hearing to the Planning Commission meeting of May 13, 1996. Planning Commission, City of Moorpark, California Minutes of April 22, 1996 Page 4 The Director, Richard Hare said they continued this item because of violations found (a metal building) on the property. MOTION: Commissioner Torres moved and Commissioner Miller seconded a motion to approve staff's request to continue the Public Hearing for DP -336 Major Modification No. 1 to the Planning Commission meeting of May 13, 1996. C. Entitlement: Conditional Use Permit No. 95 -2 Applicant: Ali Z. Boukhari Proposal: A 2800 square foot Mini Market /Deli selling grocery, snack items and beverages, including beer and wine for off - premises consumption with detached six gasoline islands with canopy for self -serve gasoline sales. The General Plan land use designation is I -1 (Light Industrial) The zoning is M -1 (Industrial Park). Location: Intersection of Condor Drive and Los Angeles Avenue in the City of Moorpark, Assessor's Parcel No. 513 -0- 060 -025. Staff Recommendation: 1) Open the public hearing and accept public testimony; 2) Review and consider the information in the Mitigated Negative Declaration; 3) Review and consider the proposed mitigation monitoring program; 4) Make the appropriate findings; and direct staff to prepare a resolution approving Condition Use Permit No. CUP -95 -2. Senior Planner, Paul Porter gave the staff presentation. Discussions involved the Los Angeles Avenue access that the developer proposed. City Engineer, Dirk Lovett said a conceptual plan and study identifying turning radius and accesses ability from the Los Angeles Avenue would be required. Planning Commission, City of Moorpark, California Minutes of April 22, 1996 Page 5 Anna Boukhari, 1115 Rambling Road, Simi Valley. Mrs. Boukhari introduced the Commission to her consultant, Lloyd Maitland. Lloyd Maitland, 5359 Indian Hills Drive, Simi Valley. Mr. Maitland gave his presentation on the proposed project and described the projects' amenities. He described where the project had equally or exceeded the commercial planned development requirements and claimed the project was consistent with the City's General Plan. First Mr. Maitland described traffic flow and the project disadvantages without the Los Angeles Avenue access. He read from the Traffic Study document of information on current level of services during peak hour exit intervals. He said a video recording traffic flows during peak and nonpeak hours had been prepared and was available for the Commission's review. The Commission's discussions involved the Los Angeles Avenue access, median, left turn movements onto Condor Drive, surrounding traffic patterns, signalization, the number of employees in the project area, and the issue of Day Laborers at Spring Road and High Street. The City Engineer spoke about the possibility of a realignment to the Kavlico median to the south to relieve traffic flow. The applicant requested a condition modification that required a masonry wall at the rear of the project site. He felt that the wall was not significant enough to require a masonry wall. He proposed a chainlink fence. Senior Planner, Paul Porter said the wall is visible from SR118 and it was his recommendation to the Commission that the condition that required a masonry wall remain. Testimony received from the following: r^ Planning Commission, City of Moorpark, California Minutes of April 22, 1996 Page 6 Bruce Tackman, 14501 Los Angeles Avenue. Opposed CUP - 95.1. Mr. Tackman's concerns were peak period traffic circulation, loitering, alcohol sales, gasoline spills into the Arroyo Simi, and future development proposed for remaining undeveloped parcels. Michael Feemster, 6000 Condor Drive. Opposed CUP -95.1 development. His concerns were security, the Arroyo Simi, and the project being incompatible with surrounding uses. Chris Evans, 4430 Cederglen Court. Opposed the project. He was concerned with traffic circulation and if the benefits outweighed the concerns of the project. Tim Saivar, 15594 Mallory Court. In support of CUP- 95.1. Mr. Saviar noted the need for a gas station in the northeast area of the City, although he was concerned with liquor sales at the site. Joe Bussing, Aquaria, Inc., 6100 Condor Drive. Opposed. Mr. Bussing concerned with the incompatible land use proposed, peak hour traffic circulations, the Los Angeles Avenue access, security, crime, and liquor sales. Bruce Greenfield, Mobile representative, 1201 S. Beach Blvd., #207, RHL. Mr. Greenfield addressed the Commission with information about the environmental aspects, regulations, and reviews required by the associated agencies. Steve Weinberger, Traffic Engineer, Whitlock & Weingerger Transportation, Inc., 2200 Range Avenue, #102, Santa Rosa. Mr. Weinberger spoke of his prior experience processing developments of this kind. He said that 50t of the additional traffic is not new traffic to the area and proposed a 5 -6 second delay at Condor Drive and Los Angeles Avenue. Planning Commission, City of Moorpark, California Minutes of April 22, 1996 Page 7 Mr. Weinberger talked about the combination of, vehicles turning, acceleration, vehicle gap, positioning, and the types of options to maintain traffic flow. Lloyd Maitland commented on the concerns received earlier. He said regarding "what the applicant can give back to Moorpark." He said that the applicant is a small business owner and should not be thought of as a corporate organization. Regarding loitering, the applicant is also opposed to loitering. That the masonry wall at the rear of the property will be built as conditioned. The public hearing closed at 9:22 p.m. The Commission asked if any development proposals for the remaining vacant parcels had been submitted to the City. The Director, Richard Hare said nothing had been submitted or proposed. The Commission along with Mr. Maitland discussed the zoning and types of uses at the site prior and after the zoning ordinance amendment. The Commission asked what industrial property remained in the City. Staff replied Carlsberg, West America, Science Drive, and Bugle Boy properties. Chairman Torres asked what would the ideal Level of Service be at Los Angeles Avenue and Condor Drive. City Engineer, Dirk Lovett responded "B" and nothing below a "C" level. The Director talked about access to the project and Caltrans requirements to construct or approve any type of curb cut on Los Angeles Avenue. Mr. Maitland and Steve Weinberger talked about their negotiations with Caltrans to permit the curb cut on Los Angeles Avenue, and that December 13, 1995, Caltrans, by phone, confirmed the approval of a curb cut. Planning Commission, City of Moorpark, California Minutes of April 22, 1996 Page 8 The Commission asked Mr. Maitland to view the video that recorded traffic flows at the proposed site. Mr. Maitland said the video was recorded on February 27, 1996, and preceded to prepare for viewing. At this point in the meeting the Commission called for a recess, the time was 9:46 p.m.. The Commission reconvened at 10:07 p.m. The Commission commented on the proposed median at the Los Angeles Avenue site. The Director said the median would provide for a left turn pocket and appropriate alignments to it. NOTION: Chairman Torres moved and Commissioner Acosta seconded a motion to approve Conditional Use Permit No. CUP -95 -2, with a modification to require the construction of a median on Los Angeles Avenue. Motion passed with a 3:1 vote. Commissioner May voted no. 10. DISCUSSION ITEMS None 11. ANNOUNCEMENTS or FUTURE AGENDA ITEMS 12. Chairman Torres announced that Mayor Paul Lawrason would not seek another term as Mayor, that he plans to retire and relocate to Grass Valley. Chairman Torres led in the acclaims to the Mayor. He thanked the Mayor for his commitment and hard work. He said staff and citizens of Moorpark give their support. He thanked the Mayor and wished him best regards.
