CALL TO ORDER Commissioner Acosta called the meeting to order at 7:09 p.m. 2. PLEDC17E OF ALLEGIANCE Commissioner Acosta led the pledge of allegiance. 3. OATH OF OFFICE Lillian E. Hare, City Clerk administered presented Commissioners Lowenberg and Millhouse with Oath of Office. B�:41030ato Aam All Commissioner's were present at the meeting. Staff attending included Nelson E. Miller, A.I.C.P., Director of Community Development, Dirk Lovett, Assistant City Engineer, Celia LaFleur, Administrative Secretary. 5. ELEC "ION OF CHAIRMAN AND VICE CHAIRMAN MOTTW : Commissioner Miller moved and Commissioner Millhouse seconded the motion to elect Commissioner Acosta as the Chairman to the Planning Commission. The motion passed with a unanimous 5:0 voice vote. MOTTO N: Commissioner Millhouse moved and Commissioner Norcross seconded a motion to elect Commissioner Lowenberg as the Vice Chairman to the Planning Commission. The motion passed with a unanimous 5:0 voice vote. Chairman Acosta congratulated the newly appointed Commissioners and said that he hoped to see more Moorpark Planning Commission, City of Moorpark, California Minutes of January 13, 1997 Page 2 residents attending the meetings and being involved in the future of Moorpark. 6. Staff Recommendation: Continue to the next regular meeting of the Planning Commission. MOTT)N: Chairman Acosta moved and Commissioner Miller seconded a motion to approve staff's recommendation to continue Zoning Ordinance Amendment No. 96.1 on the application of A.C. Construction to the Planning Commission meeting of January 27, 1997. The motion passed with a unanimous 5:0 voice vote. DISCUSSION ITEMS Staff Recommendation: Determine consistency of requested Home Occupation Permit for Experimental Pathology Support Services, 11340 Broadview Drive, with Section 5.88.020 of the Moorpark Municipal Code, and either approve or deny the requested Home Occupation Permit. Presented by Nelson Miller, the Director of Community Development. Testimony received from the following: Debra L. Sheppard, 18801 Ventura Blvd., Suite 301, Tarzana, CA 91436. Ms. Sheppard, Attorney for the applicant. Juan Sarmiento, 11340 Broad View Drive, Moorpark. Mr. Sarmiento provided the Commission with a brief overview and background information on the requested use and type of work conducted. He talked about the types of slides used and storage thereof. He estimated 200 -300 slides on the premises. At the end of his review he would return the slides. David Lawrence, 11343 Broadview, Moorpark. Mr. Lawrence spoke in support of Mr. Sarmiento request for a home occupation permit. He commented that Mr. Sarmiento had provided full disclosures. He believed there was no threat, additional traffic or noise impacts related to this use. Greg Rudebusch, 11353 Broadview Drive, Moorpark. Mr. Rudebusch spoke in support of the requested home occupation permit. Russ Shultz, 11332 Broadview Drive, Moorpark. Mr. Shultz was in opposition and spoke briefly about the home occupation permit. Mr. Shultz concerns were outlined in PC970113.PCM Planning Commission, City of Moorpark, California Minutes of January 13, 1997 Page 4 a letter addressed to Nelson Miller, Director of Community Development. Mr. Shultz's concerns were how this use would be monitored. Mr. Nelson Miller responded by saying there was no regular monitoring provided for the five -year permitted use. Citizens could bring forward any complaints to the Community Development Department, and later investigated. The Commission's discussions involved the type of use requested, exhibits use, storage, home deliveries, and concerns that the home occupation would expand its use. MOTION: Commissioner Miller moved and Commissioner Norcross seconded a motion to approve and recommend the Home Occupation Permit subject to staff developing conditions regarding delivery trips, the scope of materials used, number of slides stored, and that live samples be excluded or characterized. Motion passed with a unanimous 5:0 voice vote. B. Proposed Sign - 405 Science Drive Staff Recommendation: Staff recommends that the Planning Commission approve the proposed sign. MOTION: Commissioner Norcross moved and Commissioner Millhouse seconded a motion to approved staff's recommendation. Motion passed with a unanimous 5:0 voice vote. C. Planning Commissioners Orientation - January 24, 1997, Oxnard City Hall Received and filed. 13.
