CALL TO ORDER Vice Chairman Lowenberg called the meeting to order at 7:10 p.m. 2. PLEDGE; OF ALLEGIANCE Commissioner Millhouse led the pledge of allegiance to the flag. 3. ROLL CALL Commissioners Lowenberg, Miller, Millhouse and Norcross were present at the meeting. Commissioner Acosta was absent. Staff attending the meeting included Nelson Miller, Director of Community Development, Paul Porter, Senior Planner, Dirk Lovett, Assistant City Engineer, and Celia LaFleur, Administrative Secretary. 4. PROCLAMATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS None 5. REORDEiRING OF THE AGENDA None 6. APPROVAL OF MINUTES a. January 27, 1997 Planning Commission MOTION: Commissioner Miller moved and Commissioner Norcross seconded a motion to approve the Planning Commission minutes of January 27, 1997. Motion passed with a 4:0 voice vote. 7. PUBLIC COMMENTS None 8. Entitlement: Tentative Parcel Map No. 5067 (Applicant: A -C Construction Company, Inc.) Proposal: Consider Tentative Parcel Map No. 5067 for a two -lot subdivision of 5.0 and 87.45 aces Location: Located south of Gabbert Road in the City of Moorpark, Assessor's Parcel Nos. 500 -25 -7, 500 -33 -22 and 45 Staff Recommendation: 1. Open the public hearing and accept public testimony and close the public hearing. 2. Determine that the Tentative Parcel Map is Categorically exempt from (CEQA) in accordance with Class 15 that consists of a division of property in urbanized areas zoned for residential when the division is in conformance with the General Plan and Zoning. 3. Make the appropriate findings as found in the attached Resolution. 4. Adopt the attached Resolution approving Tentative Parcel Map No 5067. Paul Porter, Senior Planner presented the staff report. The public hearing was opened, and the following speakers addressed the Commission. Jim McGrath - Mr. McGrath's identified his property being at the northeast portion of the adjacent proposed subdivision and stated his concerns on drainage. Steven Burns - Mr. Burns, the applicant, identified Mr. McGrath's parcel as the property that adjoining at the southwest portion of the proposed subdivision. The Commission's discussions included issues about legal and fire access, easement and maintenance, and revising Condition No. 33 to include "requirement for future participation. The public hearing closed at 7:45 p.m. MOTION: Commissioner Miller moved and Commissioner Norcross seconded a motion to approve staff recommendation. Motion passed with a 4:0 voice vote.
