The Regular meeting of the Planning Commission was held on April
14, 1997 at the Moorpark Civic Center, 799 Moorpark Avenue,
Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:12 p.m.
2. PLEDGE OF ALLEGIANCE
Commissioner Lowenberg led the pledge of allegiance to the
flag.
3. ROLL CALL
Commissioners Ernesto Acosta, Gary Lowenberg, Bart Miller,
Paul Norcross and Keith Millhouse were present at the meeting.
Staff attending the meeting included, Nelson Miller, Director
of Community Development, Paul Porter, Senior Planner, Dirk
Lovett, Assistant City Engineer, and Celia LaFleur,
Administrative Secretary.

6. APPROVAL OF MINUTES
MOTION: Commissioner Miller moved and Commissioner Norcross
seconded a motion to approve the minutes of March
10, 1997.
Motion passed with a 4:0:1 voice vote, Commissioner
Acosta abstained.

B. CONSENT CALENDAR
None
9. PUBLIC HEARINGS
a Consider Vesting Tentative Tract Man No_ 5081 filed by
American Stores Properties, Inc. A proposal for an eight
lot subdivision of 11.8 acres into lots of 2.5, .7, 4.1,
1.5, .6, .7, .9 and .8 acres.
The proposed eight lot subdivision is located at the
northwest corner of Tierra Rejada Road and Mountain Trail
Street in the City of Moorpark, Assessor's Parcel Nos.
505 -0- 012 -41. Staff Recommendation: 1. Open the public
hearing and accept public testimony and close the public
hearing. 2. Determine that the effects of Vesting
Tentative Tract Map No. 5081 have been adequately
analyzed in the Mitigated Negative Declaration, Initial
Study, and Mitigation Monitoring Program prepared for
Commercial Planned Development No. 90 -2. 3. Make the
appropriate findings as found in the attached resolution.
4. Adopt the attached resolution recommending to the City
Council approval of Vesting Tentative Tract Map No. 5081.
Presented by Paul Porter, Senior Planner. Public hearing
opened and testimony received.
Kath McCunney, representing the applicant and in support
of the proposed staff recommendation.
Dorian Fortney, the applicant and in support of the
proposed staff recommendation.
The Commission's discussed issues related to re- stripping
at L. A. Avenue, dual left -turn requirement, median
construction, maintenance, landscaping and lighting
requirements. American Stores Properties conditioned
based upon the determination and areas of responsibility.
MOTION: Commissioner Millhouse moved and Commissioner
Norcross seconded a motion to approve staff

recommendation based on the 1)property owners maintenance
association; 2)final determination of City Engineer's
analysis of dual left turn lane requirement; 3)agreement
for the completion of the median improvements and
maintenance.
Motion passed with a unanimous 4:1 voice vote.
Commissioner Lowenberg voting NO.
b. Consider Conditional UqP Pprmit Nn. 6 -1 filed by Pacific
RP11 Mobile G rvi s. A proposal to construct a 60' high
cellular communication facility.
The proposed site is located on General Plan designated
OS -2, Open Space 40 acre minimum at Ventura County
Waterworks College Water Tank Reservoir Facility, North
of Highway 118 and East of Moorpark College. (Assessor's
Parcel Number: 500 -0- 280 -400). Staff Recommendation: 1.
Open the public hearing and accept public testimony and
close the public hearing. 2. Make the appropriate
findings as found in the attached resolution, including
environmental determination. 3. Adopt the attached
resolution approving Conditional Use Permit No. 95 -1 with
the conditions of approval.
Commissioner Norcross excused and stepped down from the
dias because of a potential conflict of interest.
Presented by Nelson Miller, Director of Community
Development. Public hearing opened and testimony
received.
The Commission discussed issues related to security,
service response, visual impact, graffiti, and
maintenance.
MOTION: Commissioner Miller moved and Commissioner
Lowenberg seconded a motion to approve staff
recommendation.
Motion passed with a 4:0:1, Commissioner Norcross
abstained.

At this point in the meeting the meeting recessed fifteen
minutes.
C. Consider General Plan Amendment No 6 -1 and Zone Change
No. 6 -- on the application c)f Panifir Community Builders.
Inc_._ A proposal to amend the Land Use Element of the
General Plan to High Density Residential.
Zone Change No. 96 -2 is a request to change the zoning
from Residential Planned Development 13 units per acre
and Residential Planned Development 5.3 units per acre to
Residential Planned Development 8.7 units per acre to
correspond with the General Plan, Residential Planned
Development No. 96 -1 and Tentative Tract Map No. 5053.
The proposed General Plan Amendment and Zone Change is
located on 35.23 acres on the south side of Los Angeles
Avenue in the vicinity of Shasta Avenue and Goldman
Avenue. Staff Recommendation: 1. Determine that the
impacts for General Plan Amendment No. 96 -1 and Zone
Change No. 96 -2 are substantially the same addressed in
the Environmental Impact Report prepared in 1991 for the
Land Use and Circulation Elements of the General Plan,
and in the Environmental Impact Report prepared for
Residential Planned Development 90 -2 and 90 -3 for the
Westland Residential Housing project during 1990. 2.
General Plan Amendment No. 96 -1 be approved to change the
Land Use Designation to High Density Residential (7.0
dwelling units per acre maximum, unless density bonus, in
which case 10 dwelling units per acre density limit) and
recommend Affordable Housing Agreement be considered
which would grant a density bonus pursuant to Section
17.64.030 of the Moorpark Municipal Code. 3. Zone Change
No. 96 -2 be approved rom Residential Planned Development
13 units per acre and Residential Planned Development 5.3
units per acre to Residential Planned Development 8.7
units per acre.

Plan Amendment process and land use designations,

affordable housing provisions and agreements, density
bonus, and whether to process all general plan amendments
together or inclusive with permit approval.
The Commission discussed the possibility of amending the
land use designation to high and very high and
comparability with the existing Maureen Lane residences.
MOTION: Commission Miller moved and Commissioner Acosta
seconded a motion to approve staff recommendation.
Motion passed with a unanimous 4:0:1 voice vote.
Commissioner Millhouse voting NO.
10. DISCUSSION ITEMS
a. "Toward A More Livable Community" - Oxnard, April 25,
1997
Received and filed.
11. ANNOUNCEMENTS or FUTURE AGENDA ITEMS
Request by Commissioner Millhouse to discuss concurrent
processing of projects and general plan amendments.
