PC- 2007 -520 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, DENYING VARIANCE NO. 2007 -01, FOR EXCEPTIONS TO MINIMUM SIDE AND REAR SETBACKS AND GARAGE WIDTH REQUIREMENTS FOR CONSTRUCTION OF A SINGLE - FAMILY HOUSE ON A 3,300 SQUARE -FOOT LOT ON BONNIE VIEW STREET, ON THE APPLICATION OF AUTORN (DEAN) BHUSIRIRIT WHEREAS, at a duly noticed public hearing on July 24, 2007, the Planning Commission considered Variance No. 2007 -01, for exceptions to minimum side and rear setbacks and garage width requirements for construction of a single - family house on a 3,300 square -foot lot on Bonnie View Street, on the application of Autorn (Dean) Bhusiririt; and WHEREAS, at its meeting of July 24, 2007 the Planning Commission considered the agenda report and any supplements thereto and written public comments; opened the public hearing and took and considered public testimony both for and against the proposal and reached a decision on this matter. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. VARIANCE FINDINGS: Findings for a Variance per Section 17.44.030 (E)(2) could not be met by this application in that the allowance of the building at the size proposed on the 3,300 square -foot lot would confer a special privilege inconsistent with the limitations upon other properties in the same vicinity and zone. SECTION 2. DENIAL: The Planning Commission denies Variance No. 2007 -01. SECTION 3. FILING OF RESOLUTION: The Planning Director shall cause a certified resolution to be filed in the book of original resolutions. The action of the foregoing direction was approved by the following vote: AYES: Commissioners Di Cecco, Hamous, and Landis, Vice Chair Peskay, and Chair Taillon NOES: None ABSTAIN: None ABSENT: None Resolution No. PC- 2007 -520 Page 2 PASSED, AND ADOPTED this 24th day of July, 2007.
