PC -84 -7 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, CERTIFYING THE NEGATIVE DECLARATION AND APPROVING PARCEL MAP NO. 3930 ON APPLICATION OF MARLA BROSSARD. WHEREAS, on January 24, 1984, a noticed public hearing was held by the Planning Commission of the City of Moorpark, California and continued to February 14, 1984 on the matter of the Negative Declaration certification approval of Parcel Map No. 3930, on application of Marla Brossard; and WHEREAS, on motion duly made, seconded and carried, the Commission certified the,flegative Declaration, adopted the findings proposed by staff, and conditionally approved the subject Parcel Map in that it was deemed appropriate and compatible with the requirements of the City Zoning Ordinance; NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission does hereby certify the Negative Declaration, and does further resolve that Parcel Map No. 3930 to create four(4) one -acre parcels, located north of and adjacent to Wicks Road, be approved subject to the attached conditions. CONDITIONS FOB: Parcel Map No. 3930 APPLICANT: Marla Brossard PAGE: I of 3 pages PLANNING DIVISION CONDITIONS: 1. That the conditions of approval of this Tentative Map supersede all conflicting notations, specifications, dimensions, typical sections and the like which nay be shown an said map and that all of the provisions of the Subdivision Map Act, City of Moorpark Subdivision Ordinance and adopted City policies apply. 2. That all requirements of any law or agency of the State, City of Moorpark and any other governmental entity shall be met. 3. That no zone clearances shall be issued for residential construction until the parcel map or final map has been recorded. Prior to construction, a zone clearance shall be obtained from the Planning Division and a building permit shall be obtained from the Division of Building and Safety. 4. Recordation of this subdivision shall be deemed to be acceptance by the property owner(s) of all conditions of this map. 5. That fees for temporary school facilities may be required to be paid prior to issuance of a building permit. 6. That all utilities shall be placed underground. ENVIRONMENTAL HEALTH DIVISION CONDITIONS: 3. That in order to protect the public safety and prevent groundwater pollution, any abandoned wells on the property shall be destroyed in accordance with the Venturi County Well Ordinance prior to recordation/ occupancy. B. That prior to recordation, the applicant shall demonstrate the availability of domestic Water for all parcels created by submitting a "will - serve" letter from a domestic water purveyor licensed by the Ventura County Environmental Health Department or the State of California Department of Public Health to the Ventura County Environmental Health Department and the Ventura County Public Works Agency. 9. That prior to recordation, a "will - serve" letter shall be obtained for sewage service for each lot created. Said letter shall be filed with the Ventura County Environmental Health Department and the Ventura County Public Works Agency. FIRE DEPARTMENT CONDITIONS: 10. That prior to combustible construction, all- weather access road(s), suitable for use by a 20 ton fire department vehicle shall be installed. This Improvement, or provisions to guarantee its installation shall be completed prior to recordation. 11. That the access road(s) shall be a minimum surfaced width of 15 feet and located within an access easement a minimum of 20 feet wide, from Wicks Road to Parcels No. 1, 2, 3, and 4. 12. That the access road(,) shall be certified by a registered civil engineer as having an all- weather surface in conformation with Public Works Standards. This certification shall be submitted to the Ventura County Bureau of Fire Prevention prior to occupancy. 13. That if the subject parcel is not within or not annexing to a Water Purveyor District, an acceptable private water system for fire protection shall be provided prior to conbustible construction. 14. That if the subject parcel is within a Water Purveyor District, water mains capable of providing 1,000 GPM at 20 psi shall be installed from the public right -of -way, or from the purveyor point of connection to all property lines of Parcels No. 1, 2, 3, and 4. The cost of engineering, installation and maintenance of these mains shall be that of the applicant of this division (Parcel Map). This improvement or provisions to guarantee its installation shall be completed prior to recordation. Approved by Moorpark Planning Commission, February 14, 1984, by Resolution No. PC -84 -7. That the applicant shall provide to the Fire Department verification from the water purveyor that the purveyor can provide the required fire flow for the project. 17. That the private road shall be named. The street name(s) shall be submitted to the Bureau of Fire Prevention for review prior to recordation. 18. That street name signs shall be installed in conjunction with the road improvement. The type of sign shall be in accordance with Plate F -4 of Ventura County Road Standards. PROPERTY ADMINISTRATION AGENCY CONDITION: 19. That prior to recordation the applicant shall pay all fees as determined by the PAA pursuant to Ventura County Ordinance Code, Sections 8297 -4 et seq., as such sections read as of the date the parcel or final map is recorded, for the purpose of providing fees in lieu of land dedication for local park acquisition and /or development for the future residents of the subdivision. PUBLIC WORKS AGENCY CONDITIONS 20. That prior to recordation, the developer shall submit to the Public Works Agency for review and approval, road improvement plans, prepared by a Registered Civil Engineer; shall enter into an agreement with the County of Ventura to complete the improvements; and shall post sufficient surety in an amount agreed upon by the Public Works Agency guaranteeing the construction of the improvements. The improvements to Wickes Road shall include an A.C. here on the north side of the road, and paving for a 24 food wide roadway from Walnut Canyon Road to the property line an the vest side of the project site. 21. That prior to the submittal of the Final Map, the developer shall transmit by certified mail a copy of the conditionally approved tentative map together with a copy of Section 66436 of the State Subdivision Map Act to each public entity or public utility that is an easement holder of record. Written compliance shall be submitted to the Public Works Agency. 22. That prior to recordation, the developer shall submit to the Public Works Agency for review and approval, grading plans, drainage plans, hydrologic, and hdreulic calculations prepared by a Registered Civil Engineer. The drainage plans and calculations shall indicate the following conditions: Water flow rates, major water courses, drainage areas and patterns, diversions, collection systems, flood hazard areas, sumps and drainage course,. 23. That prior to any work being conducted within the State or County right -of- way, the developer shall obtain an Encroachment Permit from the appropriate Agency. 24. That prior to recordation, the developer shall submit to the Public Works Agency for review and approval, road improvement plans for the access roads from Wickes Road to Parcels 1 and 2 and Parcels 3 and 4, prepared by a Registered Civil Engineer; shall enter into an agreement with the County of Ventura to complete these improvements; and shall post sufficient surety in an amount agreed to by the Public Works Agency guaranteeing the completion of the improvements. 25. That prior to the issuance of a Building Permit, the developer shall deposit with the Public Works Agency, a contribution for the Los Angeles Avenue Improvement Area of Contribution. The actual deposit shall he the then current Los Angeles Avenue Improvement Area of Contribution applicable rate at the time the Building Permit is issued. That if archaeological or historical artifacts are uncovered, the pernittee shall ensure the preservation of the site; shall obtain the services of a qualified archaeologist to recommend proper disposition of the site; and shall obtain the Public Works Agency's written concurrence of the recommended disposition before resuming development, RR:J /L1OO N STATE OF CALIFORNIA ) COUNTY OF VENTURA ) SS.
