PC -84 -14 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, CERTIFYING THE NEGATIVE DECLARATION AND APPROVING LAND DIVISION (MOORPARK) NO. LDM -2 ON APPLICATION OF PETER WOLLONS. WHEREAS, on April 10, 1984, a noticed public hearing was held by the Planning Commission of the City of Moorpark, California on the matter of the Negative Declaration certification and Land Division (Moorpark) approval of Permit No. LDM -2, on application of Peter Wollons; and WHEREAS carried, the Comm adopted the findi approved the subj appropriate and c City Zoning Ordin , on motion duly made, seconded and Cssion certfied the Negative Declaration, zgs proposed by staff, and conditionally ect Land Division, in that it was deemed )mpatible with the requirements of the ince; NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission does hereby certify the Negative Declaration, and does further resolve that Land Division (Moorpark) No. LDM -2 for a 2 -lot subdivision to create a 0.868 and a 1.717 acre parcel, located on Flinn Avenue approximately 300 feet east of Minor Street in the City of Moorpark, be approved subject to the attached conditions. NIALL FRITZ Secretary, Planning CoLmission CONDITIONS FOR: Tentative Parcel APPLICANT: Peter Wollons Map No. LDM -2 DATE: April 10, 1984 PAGE: 1 APPROVED BY THE PLANNING COMMISSION ON APRIL 10, 1984 PLANNING DIVISION CONDITIONS: I. That the conditions of approval of this tentative parcel map supersede all conflicting notations, specifications, dimensions, typical sections and the like which may be shown on said map and that all of the provisions of the Subdivision Map Act, Moorpark Subdivision Ordinance, and adopted City policies apply. 2. That all requirements of any law or agency of the State, Ventura County, City of Moorpark, and any other governmental entity shall be met, and all such requirements and enactments shall, by reference, become conditions of this entitlement. 3. That applicant's recordation of this map and /or commencement of construction and /or operations as a result of this map shall be deemed to be acceptance by applicant of all conditions of this map. ENVIRONMENTAL HEALTH DIVISION CONDITIONS: 4. That in order to protect the public safety and prevent groundwater pollution, any abandoned wells on the property shall be destroyed in accordance with the Ventura County Well Ordinance prior to recordation. 5. That prior to recordation, the applicant shall demonstrate the availability of domestic water for all parcels created by submitting a "will- serve" letter from a domestic water purveyor licensed by the Ventura County Division of Environmental Health or the State of California Department of Public Health to the Ventura County Division of Environmental Health and the Ventura County Public Works Agency. 6. That at the time water service connection is made, cross - connection control devices shall be installed on the water system in accordance with the requirements of the Ventura County Division of Environmental Health. 7. That prior to recordation, a "will- serve" letter shall be obtained for sewage service for each lot created. Said letter shall be filed with the Ventura County Division of Environmental Health and the Ventura County Public Works Agency. FIRE DEPARTMENT CONDITIONS: 8. That street name signs shall be installed in conjunction with the road improvement. The type of sign shall be in accordance with Plate F -4 of Ventura County Road Standards. 9. That if the subject parcel is within a Water Purveyor District, water mains capable of providing 1,500 GPH @ 20 psi shall be installed from the right of way, or from the purveyor point of connection to all property lines of parcels A and B. The cost of engineering, installation and maintenance of these mains shall be that of the applicant of this division (Parcel Map). EXHIBIT 114" CONDITIONS FOR: Tentative Parcel APPLICANT: Peter Wollons Map No. LDM -2 DATE: April 10, 1984 PAGE: 2 APPROVED BY THE PLANNING COMMISSION ON APRIL 10, 1984 This improvement or provisions to guarantee its installation shall be completed prior to recordation. Prior to combustible construction on any parcel, the water mains shall be extended to within 250 feet of the building site. A fire hydrant shall be installed at this location on the access road to the site and it shall be capable of providing the required fire flow. The owner of the combustible construction is responsible for the cost of this protection installation. 10. That the applicant shall provide to the Fire Department verification from the water purveyor that the purveyor can provide the required fire flow for the project. PUBLIC WORKS AGENCY CONDITIONS: 11. That prior to recordation, the developer shall deposit with the Public Works Agency a contribution for the Los Angeles Avenue Improvement Area of Contribution. The actual deposit shall be the then current Los Angeles Avenue Improvement Area of Contribution applicable rate at the time of recordation. Since the developer has been conditioned on another entitlement (DP -291) to contribute, only one contribution shall be deposited to the Public Works Agency. 12. That prior to any work being conducted within the City's right -of -way, the developer shall obtain an Encroachment Permit from the appropriate agency. 13. That prior to recordation, the developer shall submit to the Public Works Agency for review and approval, street improvement plans prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improvements; and shall post sufficient surety guaranteeing the construciton of the improvements. The improvements shall include concrete curb and gutter, sidewalk, streetlights, stripping and signing, and paving in accordance with the Ventura County Road Standards. The applicable Ventura County Road Standards Plate(s) is as follows: B -31) (Modified to a 48 -foot pavement width) Flinn Avenue and Wollons Street 14. That in conjunction with the street improvement plans, the developer shall include the street intersection between Flinn Avenue and Wollons Street pursuant to Ventura County Road Standards Plate C -4. That in conjunction with the recordation of the Parcel Map, the developer shall offer for dedication to the City of Moorpark a street easement of sufficient width to permit an ultimate right -of -way of 60 -feet, according to the applicable Ventura County Road Standards Plate B -31), along the implied centerlines of the alignments of Flinn Avenue and Wollons Street established in 1976 with the recordation of the document, 21 PM 2, Parcel 3. LLA -236, ON APPLICATION OF GILBERT PHARRIS AND RUDOLPH WAGNER. WHEREAS, on February 28, 1984, a duly noticed public hearing was held by the Planning Commission of the City of Moorpark, California on the matter of approval of Lot Line Adjustment No. LLA -236 on applica- tion of Gilbert Pharris and Rudolph Wagner to adjust the lot line be- tween properties located at 4920 and 4958 Mira Sol Drive south by 40 feet; NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission does hereby find that the Lot Line Adjustment is categorically exempt according to Section 1SIOS of the State Environmental Impact Report Guide- lines (Class S: Alterations in Land Use Limitations); does hereby adopt the findings proposed by staff in Staff Report and Recommendation dated February 28, 1984; and does hereby approve Lot Line Adjustment No. LLA -236, subject to the following condition: 1. A certificate of compliance for each parcel affected by the Lot Line Adjustment shall be submitted to the County Public Works Agency for approval and filed for record in the office of the County Recorder.
