PC -84 -33 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE MITIGATED NEGATIVE DECLARATION AND APPROVING TENTATIVE TRACT MAP NO. TR -3958 ON APPLICATION OF HARRY LIEB. WHEREAS, at a duly noticed public hearing on December 11, 1984, the Moorpark Planning Commission considered the subject applic- ation to subdivide 35.81 acres into 18 residential lots and one remainder pacel. The proposed project is located adjacent and north of Casey Road, approximately 200 feet west of Walnut Canyon Road (AP No. 511- 11 -03). NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: Section 1. That this body, after review and consideration of the information contained in the Mitigated Negative Declaration, finds that this project will not have a significant Negative Declaration. Section 2. The Planning Commission adopts the findings contained in the staff report dated December 11, 1984, which report is incorporated herein by reference as though fully set forth herein. Section 3. The Planning Commission hereby recommends to the City Council approval of TR -3958 subject to compliance with all the conditions attached hereto. 1984. PASSED, APPROVED AND ADOPTED this 11th day of December, SECRETARY CONDITIONS FOR: TR -3958 DATE: December 11, 1984 APPLICANT: Harry Lieb PAGE: 1 of 8 PLANNING DIVISION CONDITIONS: 1. The conditions of approval of this tentative map supersede all conflicting notations, specifications, dimensions, typical sections and the like which may be shown on said map and all of the provisions of the Subdivision Map Act and Moorpark City Subdivision ordinance. 2. All applicable requirements of any law or agency of the State, City of Moorpark, and.any other governmental entity shall be met, and all such requirements and enactments shall, by reference, become conditions of this entitlement. 3. The developer's recordation of this map and /or commencement of construction and /or operations as a result of this map shall be deemed to be acceptance by applicant of all conditions of this map. 4. The development shall be subject to all applicable regulations of the "RE" (Rural Exclusive) Zone. 5. All utilities shall be placed underground. 6. No zoning clearance shall be issued for residential construction until the final map has been recorded. Prior to construction, a zoning clearance shall be obtained from the Planning Division and a building permit shall be obtained from the Building and Safety Division. 7. Prior to recordation, the developer shall demonstrate by possession of a District Release from the Calleguas Municipal Water District that arrangement for payment of the Capital Construction Charge applicable to the proposed subdivision has been made. 8. The tentative map shall expire three years from the date of its approval. Failure to record a final map with the County Recorder prior to expiration of the tentative map shall terminate all pro- ceedings, and any subdivision of the land shall require the filing and processing of a new tentative map. 9. The final map may not be recorded in phases. 10. Prior to recordation or issuance of a grading permit, grading plans shall be submitted to the Planning Division for review to ensure that they meet with the intent expressed in the tentative map. 11. Prior to recordation, "will serve" letters for water and sanitation from Ventura County Waterworks District No. 1 shall be submitted to the Planning Division. That prior to the issuance of a zone clearance, the applicant, on behalf of himself and his successors and assigns, agrees not to protest or otherwise contest, and shall consent to, the formation of a Mello -Roos Community Facilities District which may be established by the City of:Moorpark for the purpose of providing police protection and /or civic government facilities. In the event the City Council, prior to submission of final subdivision map, eliminates the policy of requiring residential subdivisions to form or consent to the formation of a District, this condition shall be deemed null and void and not applicable to the subdivision. 13. That a landscaping and planting plan, together with specifications and a maintenance program, shall be prepared by a State - licensed Landscape Architect. The purpose of the landscaping will be to control erosion and mitigate the visual impacts of all man -made slopes three feet or more in height. Prior to recordation, three sets of plans shall be submitted to and approved by the Planning Commission following review by the City's Landscape Consultant. The applicant shall bear the total cost of such review and of final installation inspection. Prior to recordation, developer shall submit a bond or other form of financial guarantee, of an appropriate amount to be deter- mined by the Planning Director, to guarantee the completion of the landscaping. All landscaping installation shall be com- pleted no later than 30 days following the issuance of the last occupancy permit. 14. That prior to recordation, the applicant shall pay all fees pursuant to Section 8297 -4 et seq. of the Moorpark Subdivision Ordinance and Section 66477 of the Government Code as determined by the Director of Community Development. FIRE DEPARTMENT CONDITIONS: 15. The access road(s) shall be certified by a registered civil engineer as having an all- weather surface in conformance with Public works' standards. This certification shall be submitted to the Ventura County Bureau of Fire Prevention prior to occupancy. 16. when only one access point is provided and the zoning allows parcels of less than one acre in size, the maximum length of such access shall not exceed 800 feet. 17. The access roadway shall be extended to within 150 feet of all portions of the exterior walls of the first story of any building. where the access roadway cannot be provided, approved fire protection system or systems shall be installed as rqquired and acceptable to the Bureau of Fire Prevention. CONDITIONS FOR: TR -3958 APPLICANT: Harry Lieb DATE: December 11, 1984 PAGE: 3 of 8 18. Access roads shall not exceed 158 grade. 19. A secondary access road shall be provided to the development. 20. Any gates, to control vehicle access, are to be located to allow a vehicle waiting for entrance to be completely off the public roadway. If applicable, it is recommended that the gate(s) swing in both directions. The method of gate control shall be subject to review by the Bureau of Fire Prevention. 21. Prior to recordation of street names, names shall be sub- mitted to the Bureau of Fire Prevention for review. 22. Street signs shall be installed prior to occupancy. 23. Prior to construction, the applicant shall submit plans to the Ventura County Bureau of Fire Prevention for the approval of the location of fire hydrants. Show existing hydrants on plan within 500 feet of the development. 24• A minimum fire flow of 1000 gallons per minute shall be pro - vided at this location. 25. Fire Hydrants shall be installed and in service prior to com- bustible construction and shall conform to the minimum standards of the Ventura County Water Works Manual. a. Each hydrant shall be a 6 -inch wet barrel design, and shall have one 4 -inch and one 2h -inch outlet. b. The required fire flow shall be achieved at no less than 20 psi residual pressure. C. Fire hydrants shall be spaced 500 feet on center, and so located that no structure will be farther apart than 250 feet from any one hydrant. d. Fire hydrants shall be 24" on center, recessed in from the curb face. 26. All grass or brush exposing any structures shall be cleared for a distance of 100 feet prior to framing, according to the Ventura County Weed Abatement Ordinance. 27 of any rstructurek( CaliforniahAdministrativeeCode ,tTitlei24, Section 201217). f CONDITIONS FOR: TR -3958 APPLICANT: Harry Lieb DATE: December 11, 1984 PAGE: 4 of a 28. Address numbers, a minimum of 4 inches high, shall be installed prior to occupancy, shall be of contrasting color to the back- ground, and shall be readily visible at night. Where structures are set back more than 150 feet from the street, larger numbers will be required so that they are distinguishable from the street. In the event the structure(s) (is ) from the street, the address numbers shallbeapostedtadjacent to the driveway entrance. 29. Portions of this development may be in a hazardous fire area and those structures shall meet fire zone 4 building code requirements. 30. Any structure greater than 5,000 square feet in area and /or 5 miles from a fire station, shall be provided with an automatic fire sprinkler system in accordance with Ventura County Ordinance No. 14. Roofing material shall be any fire retardant roofing excluding wooden materials, defined by the Uniform Building Code. f- 31. Private driveways, serving up to two structures with exterior walls greater than 150 feet from the public roadway shall be constructed 12 feet wide and able to support a 20 ton fire- fighting vehicle. A width of 20 feet shall be provided on driveways serving 3 to 4 structures. 32• Access roads shall be installed with an all- weather surface, suitable for access by fire department apparatus. CITY ENGINEER CONDITIONS: 33. Prior to recordation of tract map, the developer shall submit to the City of Moorpark for review and approval, a grading plan prepared by a Registered Civil Engineer; shall obtain a Grading Permit; and shall post sufficient surety guaranteeing completion. 34. Prior to recordation of tract map, the developer shall submit to the City of Moorpark for review and approval, a detailed Geotechnical Report. The grading plan shall incorporate the recommendations of the approved Geotechnical Report. 35. Prior to recordation of tract map, the developer shall submit to the City of Moorpark for review and approval, street improvement plans prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improve- ments; and shall post sufficient surety guaranteeing the con- struction of the improvements. /^ CONDITIONS FOR: TR -3958 APPLICANT: Harry Lieb DATE: December 11, 1984 PAGE 5 of 8 The improvements shall include concrete curb and gutter, sidewalk, streetlights, striping and signing, and paving in accordance with the Ventura County Road Standards. The applicable Road Standard Plates are as follows: Casey Road shall be widened to Plate B5 -A Rev. D. Improvements for Casey Road shall commence at the project's western boundary and terminate at Walnut Canyon Road. The collector street shall be constructed to plate B5 -A Rev. D modified to accomodate one -half of the street improvements plus 12 -foot additional im- provements beyond the centerline. However, design plans shall include full width improvements. All cul -de -sacs shall be constructed according to plate B5 -C, Rev. D. �^ That the right -of -way shall be obtained from the property owner for the northwest corner of the intersection of Casey Road and the collector street to allow construction of the curb return and appurtenant street improvements. The developer will be credited for the cost of the Casey Road improvements and /or reimbursed from the Area of Con- tributions should the cost of his work exceed an amount equal to the number of his lots times the existing rate per lot. Improvement plans shall include the improvement of the intersection of Casey Road and Walnut Canyon Road, including: a. A left turn pocket on Walnut Canyon Road onto Casey Road. b. A handicap ramp at improved curb returns. 36. In conjunction with the recordation of the Final Map, the developer shall offer to dedicate on the Final Map to the City of Moorpark for public use, all the public streets right -of -way shown on the Final Map. 37. Prior to any work being conducted within the State or City right of way, the developer shall obtain an Encroachment Permit (� from the appropriate Agency. In conjunction with recordation, the developer shall dedicate on the Final Map to the City of Moorpark the access rights adjacent to Casey Road along the entire frontage of the parent parcel except for approved access road(s) as delineated on the approved Tentative Map. 39. Prior to recordation of tract map, the developer shall demonstrate feasible access with adequate protection from Q10 storm to the satisfaction of the City of Moorpark. 40. Prior to recordation of tract map, the developer shall deposit with the City of Moorpark contributions for the Gabbert Road /Casey Road and Los Angeles Avenue ImprovementAreas of Contribution. 41. Prior to recordation of tract map, the developer shall indicate in writing to the City of Moorpark, the disposition of any water well(s) and any other water that may exist within the site. if and wells are proposed to be abandoned, or if they are abandoned and have not been properly sealed, they must be destroyed per Ventura County Ordinance No. 2372. 42. Prior to the submittal of the Final Map, the developer shall transmit by certified mail a copy of the conditionally approved Tentative Map, together with a copy of Section 66436 of the State Subdivision Map Act, to each public entity or public entity that is an easement holder of record. Written compliance shall be submitted to the City of Moorpark. 43. If any of the improvements which the subdivider is required to construct or install is to be constructed or installed upon land in which the subdivider does not have title or interest sufficient for such purposes, the subdivider shall do all of the following at least 60 days prior to the filing of the final or parcel map for approval pursuant to Government Code Section 66457. a. Notify the City of Moorpark (hereafter "City ") in writing that the subdivider wishes the City to acquire an interest in the land which is sufficient for such purposes as provided in Government Code Section 66462.5; b. Supply the City with (i) a legal description of the interest to be acquired, (ii) a map or diagram of the interest to be acquired sufficient to satisfy the requirements of subdi- vision (e) of Section 1250.310 of the Code of Civil Pro- cedure, (iii) a current appraisal report prepared by an �— appraiser approved by the City which expresses an opinion as to the current fair market value of the interest to be acquired, and (iv) a current Litigation Guarantee Report; CONDITIONS FOR: TR -3958 APPLICANT: Harry Lieb DATE: December 11, 1984 PAGE: 7 of 8 C. Enter into an agreement with the City, guaranteed by such cash deposits or other security as the City may require, pursuant to which the subdivider will pay all of the City's cost (including, without limitation, attorney's fees and overhead expenses) of acquiring such an interest in the land. 44. Prior to recordation of tract map, the developer shall submit to the City of Moorpark for review and approval, drainage plans, hydrologic, and hydraulic calculations prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improvement and shall post sufficient surety guaranteeing the construction of the improvements. The drainage plans and calculations shall indicate the following conditions before and after development: Quantities of water, water flow rates, major water courses, drainage areas and patterns, diversions, collection systems, flood hazard areas, sumps and drainage courses. 45. In conjunction with recordation, the developer shall delineate on the Final Map areas subject to flooding as a "Flowage Easement" and then offer the easement for dedication to the City of Moorpark. Lot -to -lot drainage easements, flood hazard areas and secondary drainage easements shall also be delineated on the Map. 46. Prior to recordation of tract map, the developer shall submit to the City of Moorpark for review and approval, evidence that all the buildable sites in the subdivision will be protected from flooding. 47. In conjunction with grading operations, the abandoned water tank on the remainder parcel shall be removed. 48. Developer shall pay all energy costs associated with street lighting for a period of one year from the initial energizing of street lights. SCHOOL DISTRICT CONDITIONS: 49. In conjunction with condition No. 35, street improvement plans shall be prepared for the construction of a school bus turn -out on Walnut Canyon Road, approximately 50 feet south of Casey Road. The existing sidewalk on Walnut Canyon Road shall also be extended to and along the turn -out. CONDITIONS FOR: TR -3958 APPLICANT: Harry Lieb DATE: December 11, 1984 PAGE: 8 of 8 FLOOD CONTROL DISTRICT CONDITION: 50. In conjunction with the submittal of the improvement Plans for the storm water drainage system, the developer shall submit to the Flood Control District for review and approval, improvement plans for Walnut Canyon Channel east of Gabbert Road to near High Street equivalent to 258 of the project as determined by the Flood Control District; shall enter into an agrement with the District to complete the improvements; and shall post sufficient surety guaranteeing the construction of improvements. ADDITIONAL PLANNING COMMISSION.CONDITIONS: 51. That excess property west of the alignment of the collector street and adjacent to the property at the northwest corner of Casey Road and the collector street shall be offered to the adjacent property owner and all right -of -way needed from this property for the collector street shall be obtained. 52 That improvement plans shall provide for access, utility relocation, and sewer "V"s and laterials subject to approval of County Waterworks District No. 1 for existing residences adjacent to the collector street. i
