PC -85 -66 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPRAK, CALIFORNIA, RECOMMENDING APPROVAL OF MODIFIED CONDITIONS TO CITY COUNCIL RESOLUTION NO. 83 -50, ON APPLICATION FILED BY (PACIFIC AND PARDEE). ASSESSOR PARCEL NO. 517- 16-09. WHEREAS, at duly noticed public hearing on October 24, 1985, the Moorpark Planning Commission considered the application filed by Pardee Construction Comapany, requesting approval of modification to Residential Planned Development Permit relating to model home sales complex, change of models (elevation and floor plans) and certain Conditions of this permit. Located near intersection of Moorpark Road and Christain Barrett Drive, east of Peach Hill Road, north and south of Tierra Rejada Road; and WHEREAS, the Planning Commission, after review and considerat- ion of the information contained in the staff report dated October 24, 1985 (revised October 30, 1985) has found that this project will not have a significant effect on the environment, and has reached its decision in the matter; NOW, THEREFORE, THE PLANNING COMMISSION ON THE CITY OF r MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the findings contained in the staff report dated October 24, 1985 (revised October 30, 1985), which report is incorporated by reference as though fully set forth herein are hereby approved; SECTION 2. That at its meeting of October 24, 1985, the Planning Commission took action to direct staff to prepare a Resolution with attached staff recommended condtions, as modified, recommending approval of Residential Planned Developement Permit No. RPD -851; said Resolution to be presented for Consent Calendar action at the next regularly scheduled meeting. The action with the foregoing direction was approved by the following roll call vote: AYES: CHairman Holland, Commissioners Hartley, Keenan, LaPerch; NOES: None; ABSTAIN: None; ABSENT: Commissioner Claffey. PASSED, ADOPTED AND APPROVED this 14 day of November, 1985. e& lz4CI4 Acting Secretary Ch man 1.11, MEMORANDUM TO PLANNING COMMISSION October 31, 1985 FROM: Planning Department SUBJECT: RPD -851 — RECWW - HOV?41985 CRY Of Moorpark Subsequent to the P.C. review of the requested modification to RPD -851 (Pardee), the following changes to both Staff Report and Conditions were made: Page 2: Add Monte Vista Park Page 3: Change Plan 1 to 49 units and Plan 4 to 104 units. Page 4: Add note and asterisk advising of new summary. Page 5: Add elevation numbers to Paragraph 1. Page 6: Add new plans. paragraph referencing % reduction of models or Page 7: Paragraph 3 - add City Engineer's Condition. Page 7: Paragraph 4 - permit driveway relocation. Page 7: Paragraph 5 - add City Engineer's Condition. Page 10: Paragraph 4 - add new sentence. MODIFIED CONDITIONS AND NEW CONDITIONS RESOLUTION 83 -50 The following sections are modified or deleted and new sections added as follows: Section 1 - Paragraph A ADD: All side and rear lot lines shall be fenced (slumpstone, wrought iron, pilasters and wrought iron, etc., but no wood). The fencing plan shall be approved by the Planning Commission. Section 1 - Paragraph B ADD: All side and rear lot lines shall be fenced (slumpstone, wrought iron, pilasters and wrought iron, etc., but no wood). The fencing plan shall be approved by the Planning Commission. Section 1 - Paragraph I and J ' DELETE: Data and map obtained from soils firm completing geologic inventory of site demonstrates that Pardee ownership not influenced by Simi -Santa Rosa fault line. No lots are within 200' of projected fault line. Section 1 - Paragraph K DELETE: Section 1 - Paragraph L MODIFY: That in order to insure an appropriate mix of all approved models and floor plans, no more than 16% of the smallest 81{ fiii model shall be constructed. An increase or decrease of 5% or less to Plans 2, 3, and 4A; an increase of 5% or less to Plan 5; and a decrease of 5% to Plan 1 may be approved by the Director of Community Development as a Minor Modification. Changes greater than 5% to items above or any decrease to Plan 4B and 4C or increase to Plan 1 shall be considered as a Major Modification by the Planning Commission for recommendation to the City Council. Section 1 - Paragraph M DELETE: is not applicable to project. Section 1 - Paragraph N ADD: A mix of color roof tile shall be demonstrated throughout the tract. -6- Revised 10/30/85 Section 1 - Paragraph P DELETE: Section 2 DELETE: Add the following development conditions: 1. Prior to the issuance of a zone clearance, an unconditional Will -Serve letter for water and sewer service shall e obtained from Ventura County Waterworks District #1. The existing masonry /slumpstone wall along Moorpark Road adjacent to Lot 376 shall be extended westerly along the northerly boundary of Lot 377 approximately 174' from back of sidewalk. The fence along the common boundary between Lots 378 and 379 and the park site shall be a combination of slumpstone and wrought iron. The type or kind of wall surfacing facing the park site - the north side of the wall - shall be to the satisfaction of the Parks and Recreation Commission. 3. The proposed underground drain located between Lot 378 and !� 377 shall be designed to accept surface water from the adja- cent park site. The design of the facility shall be to the satisfaction of the City Engineer. Temporary siltation basins shall be provided to eliminate the conveyance of siltation onto Oakcliff Drive. Said basins shall be maintained by owner and shall be removed and replaced with permanent drainage facilities upon the closing of the model home complex. The design of said basins and drainage facilities shall be subject tthe approval of the City Engineer. 4. Access to the model sales complex shall be restricted to one existing drive from Moorpark Road. The existing driveway may be repositioned no more than 10' north or south of exis- ting location. Prior to any repositioning efforts, the City Engineer's office shall be notified. Access to the devel- oped portion of Oak Cliff Drive shall be denied until the sales complex is no longer serving in that capacity. Prior to obtaining a zone clearance for any unit within the model complex, the developer shall post a bond with the City Engineer in the amount of $5,000.00. The bond is to assure the City that all temporary improvements /access to the model complex have been removed and replaced with permanent im- provements. The bond shall be released to the developer only upon replacement of improvements satisfactory to the City Engineer. -7- Revised 10/30/85 A left turn pocket from Moorpark Road into the model complex shall be constructed, complete with necessary paving sec- tions, signing, and striping, with appurtenances. The design of the foregoing shall be submitted for review and approval by the City Engineer. The model home complex entrance off of Moorpark Road shall not be utilized until the left turn pocket has been completed and approved by the City Engineer. Left turn signing and striping shall be removed within 5 working days of the closing of the model home complex. In addition, the driveway entrance shall be removed and replaced with standard curb, gutter and sidewalk subject to the approval of the City Engineer. In the event that the existing blockade is removed at the intersection of Oakcliff Drive and Christian Barrett Drive prior to the closing of the model home complex, a blockade per Moorpark Std. Plate F -1 shall be constructed across Oak - cliff Drive at the southerly property line of lot 381. Said blockade design shall be submitted to the City Engineer's office for review and approval. 6. The construction of an individual lot fencing plan shall not encroach upon the required or designated front, rear, or side yard setback area. 7. That gutters and downspouts shall be provided over all garage doors and front entryways, and all landscaped areas as well. 8. That the location of patio covers and accessory structures shall conform to "Patio Cover Policy" as adopted by the Moorpark City Countil on May 15, 1985. 9. Prior to obtaining a zone clearance for any unit within RPD- 851, the developer shall submit plans indicating location and landscaping of collective mail box stations. Plans shall be reviewed and approved by the Planning Department upon recommendation of the Moorpark Postmaster. 10. Prior to the issuance of a Zone Clearance, the developer i_ shall submit a fencing plan illustrating a combined slump - stone and wrought iron fence to be located along the south- erly right -of -way line of Tierra Rejada Road. The fence/ wall design is to be consistent with the wall design approved for the adjacent tract to the west. The fence /wall is to be completed no later than 30 days following occupancy of the adjacent dwelling units. -8- Revised 10/30/85 11. Prior to issuance of a zone clearance for any dwelling unit within RPD -851, arrangements shall be made with° the Moorpark Unified School District for payment of all necessary school facilities fees. a- Revised 10/30/85 SHERIFF'S DEPARTMENT 1. All appliances (microwave ovens, dishwashers, trash compac- tors, etc.) will be properly secured prior to installation during non - working hours. All serial numbers will be re- corded for identification purposes. 2. Address will be clearly visible to approaching emergency vehicles and mounted against a contrasting color. 3. All exterior doors will be constructed of solid wood core minimum of 1 -3/4" thick. 4. Doors utilizing a cylinder lock shall have a minimum five (5) pintumbler operation with the locking bar or bolt ex- tending into the receiving guide a minimum of one inch. All front doors must have single deadbolt lock on entry door when decorative glass panels are located adjacent to door jambs. S. All exterior sliding glass doors'or windows will be equipped with metal guide tracks at the top and bottom and be con- structed so that the window cannot be lifted from the track when in the closed or locked position. 6. Upon occupancy by the owner or proprietor, each single unit in a tract or commercial development, constructed under the same general plan, shall have locks using combinations which are interchange free from locks used in all other separate dwellings, proprietorships, or similar distinct occupancies. -10- Revised 10/30/85
