TR -4081 ON APPLICATION OF FRANK M. CHADWICK. ASSESSOR PARCEL NO. 500- 330 -180, 500- 250 -060. WHEREAS, at duly noticed public hearing on November 14, 1985, the Moorpark Planning Commission considered the application filed by Frank M. Chadwick requesting approval to subdivide a 111 acre parcel into 21 home sites, each containing 5 acres or more. Located approximately 5,000 feet north of Los Angeles Avenue, and adjacent and east of Grimes Canyon Road. WHEREAS, the Planning Commission, after review and consider- ation of the information contained in the Mitigated Negative Declaration, has found that this project will not have a significant affect on the environment; and has reached its decision in the matter; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the findings contained in the staff report dated November 14, 1985, which report is incorporated by reference as though fully set forth herein are hereby approved; SECTION 2. that at its meeting of November 14, 1985, the Planning Commission took action to direct staff to prepare a Resolution with attached staff recommended conditions, as modified, recommending approval of Tentative Tract Map Permit No. TR -4081; said Resolution to be presented for consent Calendar action at the next scheduled meeting. the action with the foregoing direction was approved by the following roll call vote; AYES: Commissioners Claffey, Hartley, and LaPerch; NOES: None; ABSTAIN: None; ABSENT: Chairman Holland, Commissioner Keenan. Chadwick DATE: November 14, 1985 PAGE: 1 PLANNING DIVISION CONDITIONS: 1. The conditions of approval of this Tentative Maps supersede all conflicting notations, specifications, dimensions, typical sections and the like which may be shown on said map and all of the provisions of the Subdivision Map Act, City of Moorpark Subdivision Ordinance and adopted County policies apply. 2. All applicable requirements of any law or agency of the State, City of Moorpark and any other governmental entity shall be met, and all such requirements and enactments shall, by reference, become conditions of this entitlement. The developer's recordation of this map and /or commencement of construction and /or operations as a result of this map shall be deemed to be acceptance by applicant of all conditions of this map. The development shall be subject to all applicant regula- tions of the RE 5 Acres zone. 5. All utilities shall be placed underground. 6. No zoning clearance shall be issued for residential con- struction until the Final Map has been recorded. Prior to construction, a zoning clearance shall be obtained from the Planning Division and a building permit shall be obtained from the Building and Safety Division. 7. Prior to recordation, the developer shall demonstrate by possession of a District Release from the Calleguas Munici- pal Water District that arrangement for payment of the Capital Construction Charge applicable to the proposed sub- division has been made. 8. The Tentative Map shall expire three years from the date of its approval. Failure to record a final map with the Ventura County Recorder prior to expiration of the tentative map shall terminate all proceedings, and any subdivision of the land shall require the filing and processing of a new Tentative Map. 9. At the time water service connection is made, cross- connec- tion control devices shall be installed on the water system. 10. Prior to recordation, an Unconditional Availability Letter shall be obtained from County Waterworks District #1 for r. sewage and water service for each lot created. Said agree- ment will permit deferral of the unconditional guarantee for sewer and water service until issuance of a building permit for each lot in the subdivision. 11. Chadwick DATE: November 14, 1985 PAGE: SCHOOL DISTRICT: 1. Prior to issuance of a building permit for any dwelling unit within Tract 4081, arrangements shall be made with the Moor- park Unified School District for payment of all necessary school facilities fees. The School Facility Agreement is the vehicle whereby these fees are obtained. The fee for single family units is $2,108.21 per unit. A bus turnout to service the school district needs should be constructed on the south side of Grimes Canyon Road between lots 1 and 2 (see City Engineer's Condition). COUNTY WATERWORKS DISTRICT N1: 1. The developer shall be required to install all offsite and intract water system facilities required by the District as necessary to provide water service and fire protection to the subject tract that will meet all the District standards. The developer will also be required to pay all applicable fees and complete all requirements prior to receiving said services. FLOOD CONTROL: 1. The site is subject to acreage assessment fees for flood control purposes. Prior to recordation, the Ventura County Flood Control acreage assessment fee requirement must be satisfied. SHERIFF'S DEPARTMENT: 1. Construction equipment, tools, etc., will be properly secured during non - working hours. CONDITIONS FOR : Tract 4081 DATE: November 14, 1985 CITY ENGINEER CONDITIONS: APPLICANT: Frank M. Chadwick PAGE: 1 1. That prior to recordation, the developer shall submit to the City of Moorpark for review and approval, a grading plan prepared by a Registered Civil Engineer; shall obtain a Grading Permit; and shall post sufficient surety guaran- teeing completion. 2. That prior to recordation, the developer shall submit to the City of Moorpark for review and approval, a detailed Geotec- hnical Report. The grading plan shall incorporate the re- commendations of the approved Geotechnical Report. 3. That prior to recordation, the developer shall submit to the City of Moorpark for review and approval, street improve- ment plans prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to com- plete the improvements; and shall post sufficient surety guaranteeing the construction of the improvements. The improvements shall include concrete curb and gutter, street lights, striping and signing, and paving in accor- dance with the Ventura County Road Standards. The applicable Road Standard Plates are as follows: Grimes Canyon Road shall be constructed per Plate B -7A. Developer shall construct full improvements to Grimes Canyon Road for the portion fronting the property. All interior streets and cul -de -sacs shall be constructed per Plate B -6B, revised to have 36 feet of paving on 44' of right -of -way. All alphalt and base sections are subject to the approval of the City Engineer. 4. That in conjunction with the recordation of the Final Map, the developer shall offer to dedicate on the Final Map to the City of Moorpark for public use, all the public streets right -of -way shown on the Final Map. 5. That prior to any work being conducted within the State or City right -of -way, the developer shall obtain an En- croachment Permit from the appropriate agency. 6. That in conjunction with recordation, the developer shall dedicate on the Final Map to the City of Moorpark the access rights adjacent to Grimes Canyon Road along the entire fronta a of the parent parcel except for approved access road(sl as delineated on the approved Tentative Maps. 7. That prior to recordation, the developer shall demonstrate feasible access with adequate protection from a 100 -year frequency storm to the satisfaction of the City of Moorpark. f- CONDITIONS FOR : Tract 4081 APPLICANT: Frank M. That prior to recordation, the developer shall deposit with the City of Moorpark a contribution for the Los Angeles Ave- nue Improvement Area of Contribution. 9. That prior to recordation, the developer shall deposit with the City of Moorpark a contribution for the Gabbert Road/ Casey Road Improvement Area of Contribution. 10 That prior to recordation, the developer shall indicate in writing to the City of Moorpark, the dispossition of any water well(s) and any other wells that may exist within the site. If any wells are proposed to be abandoned, or if they are abandoned and have not been properly sealed, they must be destroyed per Ventura County Ordinance No. 2372. 11. That prior to the submittal of the Final Map, or a Parcel Map (containing five or more parcels), or any Parcel Map whereon dedications are required to be offered, the de- veloper shall transmit by certified mail a copy of the con- ditionally approved Tentative Map together with a copy of Section 66436 of the State Subdivision Map Act to each pub- lic entity or public utility that is an easement holder of record. Written compliance shall be submitted to the City of Moorpark. 12. If any of the improvements which the subdivider is required to construct or install is to be constructed or installed upon land in which the subdivider does not have title or interest sufficient for such purposes, the subdivider shall do all of the following at least 60 days prior to the filing of the final or parcel map for approval pursuant to Govern- ment Code Section 66457. a. Notify the City of Moorpark (hereafter "City ") in writing that the subdivider wishes the City to acquire an interest in the land which is sufficient for each purposes as provided in Government Code Section 66462.5; b. Supply the City with (i) a legal description of the interest to be acquired, (ii) a map or diagram of the interest to be acquired sufficient to satisfy the re- quirements of subdivision (e) of Section 1250.310 of the Code of Civil Procedure, (iii) a current appraisal report prepared by an appraiser approved by the City which expresses an opinion as to the current fair market value of the interest to be acquired, and (iv) a current Litigation Guarantee Report; CONDITIONS FOR : Tract 4081 APPLICANT: Frank M. Chadwick DATE: November 14, 1985 PAGE: 3 C. Enter into an Agreement with the City, guaranteed by such cash deposits or other security as the City may require, pursuant to which the subdivider will play all of the City's cost (including, without limitation, attorney's fees and overhead expenses) of acquiring such an interest in the land. 13. That prior to recordation, the developer shall submit to the City of Moorpark for review and approval, drainage plans, hydrologic, and hydraulic calculations prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improvement and shall post sufficient surety guaranteeing the construction of the improvements. The drainage plans and calculations shall indicate the following conditions before and after development. Quantities of water, water flow rates, major water courses, drainage areas and patterns, diversions, collection systems, flood hazard areas, sumps and drainage courses. 14. That in conjunction with recordation, the developer shall delineate on the Final Map areas subject to flooding as a "Flowage Easement" and then offer the easement for dedica- tion to the City of Moorpark. Lot to lot drainage easements, flood hazard areas and secondary drainage ease- ments shall also be delineated on the Map. 15. That prior to any work begin conducted within the flowage easement, the developer shall obtain a Ventura County Flood Control District Watercourse Encroachment Permit. 16. That prior to recordation, the developer shall submit to the City of Moorpark for review and approval, evidence that all the buildable sites in the subdivision will be protected from flooding. 17. Developer shall construct a bus turnout on Grimes Canyon Road to the size and location as dictated by the City Engineer. 18. That lot to lot drainage shall be delineated on the final map with easements and assurance shall be provided to the City of Moorpark that these easements will be adequately maintained by property owners to safely convey storm water flows. 19. Developer shall pay all energy costs associated with any new street lighting for a period of one year from the initial energizing of the street lights. CONDITIONS FOR: Tract 4081 DATE: FIRE DEPARTMENT CONDITIONS: APPLICANT: Frank M. Chadwick PAGE: 1 1. Private driveways, serving Lots 14 and 16, shall be con- structed 12 feet wide and able to support a 20 ton fire- fighting vehicle. 2. That all drives shall have a minimum vertical clearance of 13 feet, 6 inches (13'6 "). 3. That access roads shall not exceed 15 percent grade. 4. That approved turnaround areas for fire apparatus shall be provided on Lots 14 and 16. S. That prior to recordation of street names, names shall be submitted to the Bureau of Fire Prevention for review. 6. That street signs shall be installed prior to occupancy. 7. That prior to construction, the applicant shall submit plans to the Ventura County Bureau of Fire Prevention for approval of the location of fire hydrants. Show existing hydrants on plan within 300 feet of the development. 8. That a minimum fire flow of 500 gallons per minute shall be provided at this location. 9. That fire hydrants shall be installed and in service prior to combustible construction and shall conform to the minimum standards of the Ventura County Water Works Manual. a. Each hydrant shall be a 6 inch wet barrel design and shall have 2 4 -inch and 1 2� -inch outlet(s). b. The required fire flow shall be achieved at no less than 20 psi residual pressure. C. Fire hydrants shall be spaced 500 feet on center, and so located that no structure will be farther than 250 feet from any one hydrant. d. Fire hydrants shall be 24 inch on center, recessed in from the curb. 10. That all grass or brush exposing any structures shall be cleared for a distance of 100 feet prior to framing, according to the Ventura County Wed Abatement Ordinance. CONDITIONS FOR : Tract 4081 APPLICANT: Frank M. Chadwick DATE: November 14, 1985 PAGE: 2 11. That an approved spark arrester shal be installed on the chimney of any structure. California Administrative Code. Title 24. Section 2 -1217 12. That address numbers, a minimum of four (4) inches high, shall be installed prior to occupancy, shall be of contrast- ing color to the background, and shall be readily visible at night. Where structures are set -back more than 150 feet from the street, larger numbers will be required so that they are distinguishable from the street. In the event the structure(s) is not visible from the street, the address number(s) shall be posted adjacent to the driveway entrance. 13. That portions of this development may be in a hazardous fire are that those structures shall meet Fire Zone 4 Building Code requirements.
