PC -86 -75 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, REGARDING THE APPLICATIONS OF CARLSBERG DEVELOPMENT COMPANY AND DR. RAYMOND CAREN FOR GENERAL PLAN AMENDMENT NO. 85 -2 (CARLS- BERG AND CAREN COMPONENTS) AND ZONE CHANGE NOS. ZC- 2802 AND 2806. ASSESSOR PARCEL NOS. 500- 35 -15, & -27 AND 513 -05 -11 (CARLSBERGO AND 511 -09 -06 AND -07 ( CAREN). WHEREAS, at duly notice public hearings on December 11, 1985, January 8, 1986 and January 15, 1986, the Moorpark Planning Commission considered the application filed by Carlsberg Development Company and Dr. Raymond Caren for approval of the following: ° General Plan Amendment No. 85 -2 (Carlsberg Component) An amendment to the Moorpark. General Plan (Land Use Element) to redesignate approximately 77 acres from Low Density Residential (1.6 dwelling unity per acre average) to Light Industrial; ° Zone Change No. 2802 - A zone change of the 77 acre Carlsberg property from "R- E -lAc" (Rural Exclusive, one acre minimum) to "M -1" (Industrial Park District); ° General Plan Amendment No. 85 -2 (Caren Component) - An amendment to the Moorpark General Plan (Land Use Element) to redesignate approximately 1.4 acres from Light Industrial to General Commercial; and ° Zone Change No. 2806 - A zone change of the 1.4 acre Caren property from "M -1" (Industrial Park District) to "C -2" (General Commercial); said Carlsberg property being located adjacent to and south of New Los Angeles Avenue, east of Moorpark Road, adjacent to and west of the Moorpark Freeway (Route 23), in the City of Moorpark; and said Caren property being located adjacent to and northwest of the intersection of Moorpark and Poindexter Avenues, in the City of Moorpark; and WHEREAS, the Planning Commission has reviewed said applications, has reviewed and considered the information contained in the Environmental Impact Report prepared for the project, and has reached its decision in the matter; and WHEREAS, at it meeting of January 15, 1986, the Planning Commission took the following actions: �. 1. By the following roll call vote, request staff to prepare a resolution recommending certification of the Final Environmental Impact Report. to the City Council, with certain reservations regarding the traffic analysis for the air quality impacts of the Carlsberg Component, said resolution to be presented for Consent Calendar action at the next regularly scheduled meeting: AYES: Commissioners Hartley, Keenan, Claffey and LaPerch; NOES: None; ABSENT: Commissioner Holland. 2. By the following roll call vote, requested staff to prepare a resolution recommending approval of the Caren Component of General Plan Amendment No. 85 -2, said resolution to be presented for Consent Calendar action at the next regularly scheduled meeting: AYES: Commissioners Hartley, Keenan, Claffey and LaPerch; NOES: None; ABSENT: Commissioner Holland. 3. By the following roll call vote, requested staff to prepare a resolution recommending denial of the Carlsberg Component of the General Plan Amendment No. 85 -2, said resolution to be presented for Consent: Calendar action at the next regularly scheduled meeting; AYES: Commissioners Hartley, Keenan, Claffey and LaPerch; NOES: None; ABSENT: Commissioner Holland. By the following roll call vote, requested staff to prepare a resolution recommending approval of Zone Change No.2806, said resolution to be presented for Consent Calendar action at he next regularly scheduled meeting: AYES: Commissioners Keenan, Claffey, Hartley, and LaPerch; NOES: None; ABSENT: Commissioner Holland. 5. By the following roll call vote, requested staff to prepare a resolution recommending denial of Zone Change No. 2802, said resolution to be presented for Consent Calendar action at the next regularly scheduled meeting: AYES: Commissioners Keenan, Claffey, Hartley, and LaPerch; NOES: None; ABSENT: Commissioner Holland. WHEREAS, at its meeting of January 22, 1986, the Planning Commission took the following action: A. Requested that the motion reflected in No. 1 above read: "Request staff to prepar a resolution certifying that the Planning Commission reviewed and considered the Final Environmental Impact Report, with certain reservat- ions regarding the traffic analysis for the Caren Component and the mitigation measures presented for the air quality impacts of the Carlsberg Component, said resolution to be prepared for the next: regularly scheduled meeting ". B. That No. 1 of the recommendation of the Planning Commission hereinafter inthis resolution set forth, be stated as follows: "Reviewed and considered the adequacy of the Final Environmental Impact Report assessing the environmental effects of the Carlsberg and Caren Component projects, with the provision that an additional traffic analysis addressing the existing, project- specific, and cumulative traffic impacts on the Moorpark Avenue /Poindexter Avenue intersection is prepared at. the time the application for a new commercial planned development permit to allow the addition of parking, landscaping, and commercial uses on the Caren Component property is submitted to the City. The Commission also indicated certain concerns regarding the effectiveness and enforceability of the mitigation measures for the air quality impacts of the Carlsberg project presented in the Environmental Impact Report ". NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the findings contained in the staff report prepared for the Planning Commission meeting of December 11, 1985, which report is incorporated by reference though fully set forth herein, are hereby approved. SECTION 2. That the Planning Commission does hereby recommend to the City Council the following: 1. That the Planning Commission has reviewed and considered the adequacy of the Final Environmental Impact Report assessing the environmental effects of the Carlsberg and Caren Component projects, with the provision that an additional traffic analysis addressing the existing, project- specific, and cumulative traffic impacts on the Moorpark Avneue /Poindexter Avenue intersection is prepared at the time the application for a new commercial planned development permit to allow the addition of parking, landscaping, and commercial uses on the Caren property is submitted to the City. The commission also indicated certain concerns regarding the effective- ness and enforceability of the mitigation measures for the air quality impacts of the Carlsberg project presented in the Environmental Impact Report; 2. Approve the Caren Component: of General Plan Amendment No. 85 -2; 3. Deny the Carlsberg Component of General Plan Amendment No. 85 -2; 4. Approve Zone Change No. 2806; and 5.
