PC -86 -81 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL ADOPTION OF A RESOLUTION RE- GARDING THE PERFORMANCE OF CERTAIN PERMIT APPROVAL PROCESSES BY CERTAIN CITY OFFICIALS AND BODIES. WHEREAS, at the public hearing of January 8, 1986, January 15, 1986, and January 22, 1986, the Moorpark Planning Commission considered the staff report dated January 8, 1986, requesting that the Planning Commission provide for final action by the City Council, recommendations to certain permit approval processes. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the Planning Commission has reviewed and considered the findings contained in the staff report dated January 8, 1986, and recommends to the City Council of said City adoption of the attached resolution modifying the approval process for permits; SECTION 2. That at its meeting of January 22, 1986, the Planning Commission took action to request that staff prepare a Resolution recommending approval; said Resolution to be presented for consent calendar action at the next regularly scheduled meeting. The action with the foregoing direction was approved by the following roll call vote; AYES: Commissioners Holland, Hartley, Claffey, Keenan, and LaPerch; NOES: None; ABSENT: None. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DIRECTING THAT CERTAIN PERMIT APPROVAL PROCESSES BE PERFORMED BY CERTAIN CITY OFFICIALS; AND THE REPEALING OF ALL RESOLUTIONS IN CONFLICT THEREWITH. WHEREAS, Resolution No. 83 -29 as amended by Resolution No. 83 -49, prescribes the City offices that approves various permits; and WHEREAS, the Planning Commission as well as the staff have recommended changes to said approval authority; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Moorpark that the following approval will be performed by the following City officials and does resolve as follows: SECTION 1. Resolution No. 83 -29, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK DIRECTING THAT CERTAIN FORMER VENTURA f COUNTY PERMIT APPROVAL PROCESSES BE PREFORMED BY CERTAIN CITY OFFICIALS. Adopted September 7, 1983, and Resolution No. 83 -49, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK AMENDING SECTIONS (e) and (f) OF RESOLUTION NO. 83 -29, ADOPTED SEPTEMBER 7, 1983, regarding permit approval process. Adopted October 19, 1983, are hereby recinded. F^' SECTION 2. Where the Planning Commission is authorized to approve or disapprove an entitlement herein, such decision is appealable to the City Council. Where the Director or Community Development is authorized to approve or disapprove an entitlement herein, such decision is appealable to the Planning Commission and subsequently to the City Council. SECTION 3. A request for a Modification to an entitlement herein shall be deemed a "Minor Modification ", as determined by the Director of Community Development, when such modification does not alter the intent of the determining body. All other modification, and including those where there is doubt as to it classification, are deemed "Major Modifications ". SECTION 4. Major Modifications shall be approved or dis- approved by the official or body granting the original approval or an appeal thereof. SECTION 5. Where the City Council is the body with approving or disapproving authority, the action shall first be processed through the Planning Commission for its recommendation. SECTION 6. Approval or disapproval shall be performed by the following City Offices of Officials: (a) General Plan adoption or major revision - City Council. (b) General Plan Amendment - City Council. (c) Ordinance Adoption /Amendment - City Council. (d) Zone Change - City Council. (e) Residential Planned Development Permit - Planning Commission. (f) Commercial Planned Development Permit - Planning Commission. (g) Industrial Development Plan Permit - Planning Commission. (h) Administrative Clearance - Planning Commission. (i) Director Conditional Use Permit - Planning Commission. (j) Planning Commission Conditional Use Permit - Planning Commission r (k) Tentative and final Tract Map - City Council. (1) Parcel Map and Parcel Map Waiver - Planning Comm- ission. (m) Lot Line Adjustment and Lot Consolidation - Director of Community Development. (n) Variance - Planning Commission. (o) Minor Modification Director of Community Develop- ment. PASSED, APPROVED AND ADOPTED this day of January, 1986. ATTEST:
